I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The response from the business is not acceptable because their ethic practice is still deceiving and misleading. First of all I did not receive a call for delivery so that I may inspect the product before actually completing transaction. And they did state that this process was important to their delivery process. To be honest I properly would not have accepted the vehicle in the condition that it was in, the 49cc label opposed to the 72cc that I upgraded to, the wrong color I firstly chosen, the alignment of the speedometer were off slightly, the gas tank's alignment was hanging over to the left side too much, it looked awful. After all I have since been incurred with numerous occasions of headaches and heartaches, in pain and suffering because of this unfortunate mishap. Not to mention all the time that this business has spent avoiding me, and many excuses for not honoring their business code of ethic, the tickets and fees from this terrible business purchase. So currently the moped is functional on the 49cc motor, and it is true that the 72cc kit is no longer operable from interchanging the cylinder heads without new bolts that they did not include in their kit, because from replacing the camshaft gear, the bolts tend to lessen is strength and its ability to hold in place so therefore they should of provided the three new bolts needed for the installation. And it is true that the cylinder head and its cam came loose and now is not functional.

In conclusion, I will be happy if the business can offset the incurred ticket and fees with the DMV, replace the broken 72cc kit with a new kit, with new cam bolts so that I can install properly and I can just forget about the pain and suffering I have under gone and we will just make a note of experience in good practice, thank you.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I will keep this response as short as possible and have attached two documents for the review of the Revdex.com.  The first outlines the misrepresentation of the weight capacity of the product as ackowledged by the Manufacturer, SSR.  I did highlight a couple of key spots of our correspondence with them, but I feel it is vest if the Revdex.com reads it start to finish.  The second document is a small sampling of other customers' reviews of Motobuys.  I have attached this just to show how they truly handle their so called important customers.  In their response they claim that we were told "several" times that the weight limit had nothing to do with the performance of the bike.  First of all, it does, as per SSR and any person with even the tiniest bit of mechanical knowledge.  Secondly, I had ONE conversation regarding their misrepresentation of the bike's weight capacity wherein the gentleman I spoke to was rude, condescending and actually raised his voice to me when I attempted to explain what I had been told by SSR.For them to claim that the bike was misused is absolutely absurd...it did not run long enough to be misused!  Each time the clutch burned out it was within one to two brief riding sessions and as you can see in our correspondence with SSR we contacted them each time it happened.  The only exception to that is the first time it happened.  That time we contacted Motobuys.  Or attempted to.  We had to resort to a harassing number of phone calls and emails to their [redacted] department as well as service department to get any help from them.  During one of our early conversations with their service department we were told that they were swamped because they were getting an enormous unmber of calls from customers with similar issues so we were not the only ones they took advantage of.As far as their claim that the bike specs were changed since our purchase in "2014".  I can clearly see that they are trying to make it sound like an older purchase than it is.  I purchased the bike on Black Friday in November of 2014.  The bike was not received for approximately three weeks.  Upon arrival we found it had a broken gas tank and missing/wrong hardware.  After several trips to get hardware and repairing the gas tank ourselves we gave it to our son for Christmas which was the first day the bike was ridden.  The bike broke the following day.  When I purchased this bike it was a pre-order as it was a new model that SSR came out with (atleast that's how Motobuys advertised it) so they are obviosly fabricating the story that the specs were changed after the fact.  The only changes they could possibly be referring to is when SSR contacted them after realizing the mistake they made and told them to fix their website.  You will see this in our correspondence with SSR.I simply want this company to accept the wrong they did and refund us the purchase amount as we deserve.  We are not the only ones they have wronged and I'm sure will not be the last.Please feel free to contact me with any questions.Sincerely,[redacted]###-###-####[redacted]

Our service and parts dept has been in constant contact with this customer and is taking care of his issues.

I am 60 and rarely place comments good or bad. I spent two months researching Chinese motorcycle retailers reviewing comments, experiences, Revdex.com, any info I could gather. So many considerations like how it would run, how long it would last but my biggest concern was would I get the bike I ordered color, all there, damaged in shipment. Finally decided to go with Motobuys.com because they had very little bad reviews. Called and spoke with Sam he took the time to answer my questions without any issues. I called back about a week later (Wednesday) asked for Sam and made the order via credit card, a Green Hawk Enduro 250cc. Asked if I would get a receipt and Sam told me shortly, as soon as the finance department could process the sale, asked how long before I received the bike Sam said 5-7 days (I thought that would be nice but expected 2-3 weeks from reading so many reviews and complaints from a lot of retailers). He said the freight would be by trucking company with liftgate and would be to my home at no charge.

I received my receipt and confirmation via email in about 2 hours, the carrier called me on Friday to see if Monday at 1:00 would be ok to make the delivery and I agreed. The driver called me at about 9 am and wanted to know if he could come about 11:00, I agreed. Once near my house the driver called and asked if I had a truck and could I meet him in a parking lot down the road from me because he may not easily get down my road, I agreed and we met. The driver was very helpful and we opened the box so I could check it for damage and missing items. The metal crate was wrapped very well with shrink wrap and then wrapped with cardboard and had no damage to packaging or the bike or parts. It was however missing the green tank covers, front fender, headlamp assembly, exhaust cover, front axle nut and 6 small nuts. I took photos of the bike on the truck, of the truck and of my truck with the crated bike on it. I called Motobuys at that point and explained about the missing parts and Sam was not in at that time but the person I spoke with said the photos would be great and to put together a list and email it to them. When I got home I put together the list and called again and Sam was there and said send the list to him. I took him at his word and emailed the parts list and the serial number for the MSO on Tuesday and hoped for the best. I received the parts at my door the following Tuesday right down to the 6 small nuts, wrapped very well, correct color no damage.

The assembly was not that much and was relatively easy, the hardest is lifting the front enough to set the center frame on a short stool, 12" best to make the wheel assembly easier (actually enjoyed the assembly). The bike started easily and runs fine.

Bottom line, Sam said I would get my confirmation shortly and I received it in 2 hours. He said I would receive the bike in 5-7 days and I received it in 5 days. He said the freight would be included and I received no surprise from the carrier. He couldn't give me a time on the parts since they would have to come from the warehouse, but I received them in 7 days.

This has been an exceptional experience, the Motobuys sales team was very professional and courteous. I would purchase from them again in an instant.

This response is again false.  Please see attached 2 documents that proves they did indeed receive the title.  These 2 documents  are # 1 a fax cover letter asking us to sign an odometer statement and document # 2 is the actual statement,  in order to verify with the statement they first have to have the title in hand.   We faxed this document back to the Florida DMV .   This issue has been resolved now and we have 2 times mailed titles to this customer.

I did check the oil level, that is all. I also, in no way misdiagnosed the mechanical problems with the unit. I told tech support (their mechanic) over the phone what the unit was doing (blowing smoke and oil) and the person "[redacted] from tech support told me what repairs needed to be made and which parts I should order. So if anyone misdiagnosed the problem it was him. I am not a mechanic. I also performed all the setup procedures properly and in accordance with the terms and conditions that they mentioned (copy and pasted) in their response. I was perfectly comfortable assembling the ATV when it arrived. But that has absolutely nothing to do with the mechanical problem that I found with the motor. As I stated in my initial complaint, the ATV ARRIVED INOPERABLE! If the customer is solely responsible for ordering parts/repairing any mechanical problems that might be wrong with the unit when it arrives, what would happen if it arrived missing half of the engine? Would I be responsible for ordering and installing a new motor? This makes no sense, and the fact that whomever responded to my complaint from Motobuys lied about my comments and about me "misdiagnosing" the problem speaks volumes to the integrity and professionalism at MOTOBUYS. They were stand offish and rude on the phone and now they are lying to cover their agenda. Unbelievable. As a business owner myself I would NEVER handle any situation with a customer this way, I would see that there are extenuating circumstances (arrived inoperable) and make the situation right ASAP to insure the longevity of my company and my company's good name.

Customer refuses to allow us or the factory to assist him.  We have repeatedly requested a conference call with us and the factory GM and customer simply refuses to do this.  We suspect because this is simply a buyers remorse issue rather than anything actually wrong with the UTV.  It appears customer does not wish to resolve issue by refusing to allow us and the factory to assist them . We still await a chance to speak with the customer. If customer wants to return the unit he can do so.  After he speaks with us in a conference call.

As was clearly told to customer, these units are not legal in Calif on the new 2015 models.  The listing the customer sent is for the 2013-14 model. They are sold out.  This customer was never charged for the units.  I am sorry but it is against Calif law to send units to that state that do not meet there emission rules.  This customer has been clearly informed of this.  It also clearly states on the web site terms and conditions which customer clicked yes they agree to the following:"The pictures provided on this website are only a representation of the actual product being sold. On occasion the factory may without notice make changes to any product that are not represented in the pictures provided. We will make every attempt to keep all of our pictures, specifications, and color changes as up to date as possible. At no point will Motobuys be held liable for factory authorized changes in design, specification, or color variations. The pictures provided on this website are only a representation of the actual unit being sold. On occasion the factory may without notice make changes to the units that are not represented in the pictures provided. Motobuys will make every attempt to keep all of it's pictures, specifications, and color changes as up to date as possible. I purchased a BMS Ranch Pony 500 in July 16 from motobuys. After reading several reviews, I was skeptical about the product and the service provided by motobuys. After pricing the Polaris Ranger, I decided I would take a chance and see if the reviews I read were true.

I spoke with a gentleman named Bill, who came across as "Gruff" and not too friendly; however after speaking with him via email and telephone several times, I got the feeling that he is just not a joking kind of guy. He always responded promptly to my inquiries and was very knowledgeable about the Ranch Pony. I ordered the machine on a Thursday and was told the following day that it was already scheduled to be placed on car carrier and transported. I RECEIVED THE MACHINE WITHIN 4 BUSINESS DAYS! It was in great shape as promised and was entirely turn-key. Two days later, I received a package with my free battery charger and the next week I received my MCO. I don't understand how these other reviewers say they waited for months for their MCO. All in all, the ordering process and delivery of the goods were exceptional. A+

The Ranch Pony thus far seems to be a great value for the money. It came fully equipped with every option available. I did have to install the roof and windshield myself, but that literally took 10 minutes. The machine has good power, looks great, and seems to be put together well. I guess time will tell if it holds up in the long run, but thus far I am more that pleased.

I would recommend both motobuys and the BMS Ranch Pony to friends and family and will do business with them again in the future.

simple parts request form.   All the customer has to do is submit this simple form and his parts will be sent out.  Customer has never done this .  We are an Online company and all these details are clearly posted on our web site.

This complaint is 100% false!  The customer purchased a unit that comes with a 30 day warranty in 2014.  It is an entry priced $399 pocket Dirt Bike.  The customers claim that we mis advertised the item 100% false.  You can confirm this with the national Service Manager at SSR...

([redacted]) at ###-###-#### directly that this claim is false.  The customer has burned out 2 clutches.  These parts were supplied to the customer free of charge.  As the factory will confirm ([redacted]) the rider weight has zero to do with burning out a clutch. It is opinion of our techs that some other type of mis-use has occurred on this mini bike for it to have 2 burned out clutches.  We have sold hundreds of this exact same model and there has not been one customer other than this customer that filed any complaints on this unit. The bike model was changed by the factory in Feburary 2015 by the factory.  At that point, with the new 2015 model, the factory specs changed.  This customer is using the new 2015 specs as a basis for this false claim.This customer purchased this vehicle in 2014!  The model and specs were different on the 2014 model. This has been completely explained to this customer many many times.  However the customer does not want accept this fact.  We have provided all the support we can for this customer. stubborn, abusive and foul mouthed.  The bike he purchased is an xlint model.  Since customer is not a mechanic he should take it to a mechanic that knows what to do. he does not know what to do.   The bike does leak oil.  Most likely the customer or dellivery truck may have leaned the bike on its side which can allow small amount of oil to drip out.  Our web site clearly states the customer must do the PDI on the bike when it arrives.  The issues he is claiming are part of the PDI set-up. Again his parts have been shipped.

Customer ordered a 2 stroke SSR mini bike that was sold out.  Customer was informed of this at time of purchase and has been refunded in full as he requested

Purchased a Hummer 200 Go-Kart, Motobuys notified the next day that it has shipped. Trucking company called me 5 days later and delivered to my door. No Damage and all parts were received. This Kart has only 5 hours on it so far with no problems. Starts right up, runs great, all lights and accessories worked right out of the Box. Taking your time prepping and assembling this Kart is real critical on how dependable your Kart will run and stay together. Also most people do not take the time for proper motor break-in period. Product is what I have expected and the Dealer was fast with shipping and delivery. Very Pleased!
