The company's "response" of no responsibility is typical of them. However, nowhere in the "term & conditions" is it declared that I am responsible for accepting a product that doesn't work. There is a specific list of items that I was required to assemble - an ignition switch is not in the "terms & conditions".

We stand by previous response.  Customer is welcome to call us at [redacted] for tech support.  He can take the unit to a  mechanic in his area and we gladly assist a real mechanic in helping resolve the issue and provide parts support, if there actually is one.  If the customer needs parts he can order thru our online web site.  The terms and conditions of sale customer agreed to at purchase is clearly posted on the web site as well as the warranty policy.  We stand by to assist customer within those parameters. Thanks[redacted] / Motobuys

This customer has a good reason to be upset.  He bought a scooter thru us that was shipped by the factory direct to him ([redacted])  and in November 2013 the factory began a move of their warehouse and parts dept.  They have have just completed this move and reopened as of Jan 2,...

2014.   Because of this we have been unable to get him the parts he requested promptly.  We are now working on getting his parts out to him ASAP as the factory has now re-opened since this move.  In most cases we get parts requests out promptly, we are sorry that circumstances were out of our control in this case.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Hello Mrs. [redacted] and thank you for the e mail reply. I want to tell you that I read the message that was summited by Motorbuys and it is another LIE ! I bought this bike from them on Sept, 20th and received it 2 weeks later and called about the problems and the parts needed to actually ride it in the beginning of October. There warehouse that they clamed was closed was open then and all they did was stall me and lie to me stating the parts were on the way. This went on for months. They first told me about the warehouse being closed in late November and said it would be closed for only 2 weeks. More lies ! Mrs. [redacted] these folks do not belong in business and have a long record of very bad reviews as well. With that being said I would like $1000.00 of the $2345.00 I spent for all the wait and lies and hassles they put me through. I will reverse all the negative reviews that I wrote about them on seven different web sites if they agree to refund $1000.00 into my [redacted] account. Please be advised that they are lying and don't have a ligament excuse for my case and I want retribution ASAP along with the parts that were ordered way back in October. It is very wrong for a person to spend that amount of money for a motorcycle and not be able to ride it for 5 months...Very wrong indeed. You very clearly informed that the factory parts dept would re-open on January 2, 2014.  The moment the new location opened these parts were sent out you, as we promised.   We have never EVER lied to you.  We have given the addresses of the factory proving that they moved during this period.  We have provided you the factories phone number as proof so you could also verify. We are sorry that factory moved but that was out of our control.   Your complaint contains many falsehoods about us.    We wish you the best with all your future endeavors and hope that this new year brings you joy, happiness and a truthful outlook on life. This complaint is 100% false.  This customer has been sent the title 2 times in May and June of 2016.  And 2 times he has lost them.  The factory will no longer send this customer any more legal titles free of charge.  The customer was informed of this and never made payment for...

the cost of a third duplicate title.  I spoke with this customer over a month ago and informed him of this with no response.

I am not getting a full refund from the company. They are...

charging me $10 for gloves and goggles..which I did not ask for. Also told them to go ahead and ship it because they said it would be here by the end of next week. The guy Bob who responded to my email asked if I wanted it sent and I told him yes and then I got a response telling me it wasn't being sent after he asked me if I wanted it sent. I have never in my life seen a company act like this. I have the emails to prove all this also I was NEVER sent an email about the go kart being on back order...that's a lie! That's why I contacted the Revdex.com...no one would communicate with me and now they are acting childish because I contacted the Revdex.com. I want a FULL refund! I don't want gloves or goggles that I have to send back...I did not order goggles and gloves. I am being charged for something I didn't not order. If I wanted gloves and goggles I think I would want them to come with the go kart. This is being done to inconvenience me.

1.  The report is 100% false. Customer is simply making up false issues on the unit and there is nothing wrong with it.  Yesterday we asked him to do a conference call with us to resolve whatever issues he claims he has with Motobuys and the factory general manager from [redacted].  He...

refused to do this and makes excuses and false statements to create an issue that does not exist. 2.  The customer refuses to allow us to assist him.  The General Manager of the factory ([redacted]) wants to do a conference call with this customer to find a resolution to issues that customer claims. Customer refuses to talk with us to resolve issues, mainly we believe because there really is nothing wrong with the unit. 3. Customer did not setup the unit correctly and did not remove the factory installed speed limiter per his prior email. His complaint was the unit was to slow. He then after removing the speed limiter complained this unit (which is designed for kids) only did 30mph. That is correct for childrens safety. 4. The customers complaint is simply an issue of buys remorse.  We have sold many many of this exact same machine with ZERO issues.  The customer is making up false issues to return a perfectly good UTV after using it now for many months.  5. The unit is designed for kids and is geared to go around 30mph.  This is exactly what the customer claimed in his 2nd e-mails to us.  That is the only thing wrong with the unit according to the customer in his last e-mail to us. (please keep in mind that this all can easily be resolved with 1 phone call that customer refuses to have with us. ) 6. If the customer would simply talk with us we would explain that we can send him a sprocket that will allow the unit to go faster.  PROBLEM SOLVED!  However this customer does not want the problem to be solved. 7. Customer will not talk with us simply because he knows that nothing is wrong with the unit and these false claims he is making will be exposed.  8. So instead of talking with us to resolve the issues, customer simply filed this false report.

This customers claim is 100% false.   please read the customers parts request form where he clearly states that he broke the bike parts himself. (underlined).  We have offered to sell him the parts he broke at a discount.  Motobuys has attempted to assist this customer and many times have told him to take the unit to a repair shop as this customer does not seem to have he skills to work on the bike. Customer has refused to do that.  THE EVIDENCE below clearly shows that this customers claim is 100% false by his own admission in the exhibit below.

Issue Description: I first purchased the moped with the impression that thebig bore kit will be installed, turns out not to be the case. To make a longstory short, after I installed the kit, it seems that I did not bolt downthe install properly and it broke apart damaging the cylinder side cover andthe cylinder head itself. So now I am seeking the 72cc big bore kit cylinderhead and the side cylinder cover. The moped is currently running with theolder 49cc cylinder and body. Please considered that I was left side trackedwithout a telephone call for an inspection during delivery and that I am nota rich man and the money that I have since acquired to pay for the moped ison my head to repay. There are times when you have exhausted all attempts to satisfy acustomer and there are times when you have to stand tall and defend youryourself against false accusations.  Thisis one of those times.  We responded to this complaint clearly in the first response.  Anyone can write anything they want, howeverthat does not make it true.  That is the fact in this complete fiction novel that this customer has be saying here.  This customer makes hearsay statements in this complaint that are completely false as some kind actual facts.  They are not even close to the truth.  I am the person that spoke to this customer.I never raised my voice with her!  Her problem is that she will NOT listen to anything we or the factory has tosay.  This bike was purchased in November 2014.  The factory changed the model to a 2015 model in March of 2015. THAT IS A FACT! The factory made changes to the model and to the specs at that time.  THAT IS A FACT!  This customer has repeatedly been told this,but refuses to accept or wants to ignore the facts so she can continue with her tabloid style of writing in this false complaint. Again the factory national service manager at SSR will confirm these facts, and I gave his name and contact info to this customer.  However she refuses to contact him because it will show the true facts.ACTUAL FACTS IN THIS CASE ARE1. Such as her final statement("We are not the only ones they have been wronged and I'm sure will not be the last.").  Who is she to make a statement like this.  She bought a $399 pocket dirt bike once. Broke it several times during use (most likely fromabuse), was given free parts, free tech support and free factory support. She  Knows nothing about motorcycles and makes this kind of statement that has ZERO basis in fact!  So we hope the reader of this complaint will see that this customer is simply trying to bully us into doing her will by writing this fictitious complaint.  I am an old school American.  When wrongly accused with falsehoods, half-truths and blatant disregard for the facts,it is time stand up and defend our reputation.  Thank you to anyone who has taken the time toread this and see that there is always two sides to every story.  We deeply  value our relationships with all our customers and are committed to providing the highest level of service simply becauseour customers deserve the very best. customer does not have the skills to install this unit.  Our tech support and parts manager have spent hours with on the phone with this customer.  He tryed to install the kit himself and broke the head and parts.  He was told many times to take the kit to a professional but he refused to do that.    IN REGARDs to the color please see attachment # 2, this is the customer online order that he placed.  On it you can clearly see he ordered 2 color choices, black or silver and he got one of those.  Motobuys has sold hundreds of this exact same model and never had any complaints about these issues with any customers before.  The attached evidence speaks for itself.  The customer will need to take his moped to a professional scooter to repair shop to assist him with problems he did to the unit himself.  If we can be of any further assistance the customer can contact us.

They had no right to make me wait weeks before I could get the necessary parts to use a new scooter before there warehouse closed and moved. I want a partial discount of $1000.00 given back to me for all the lies, excuses, and having to unnecessarily wait to use a new scooter. This is not the right way of running any business and if needed I will proceed with an attorney at law to get this solved unless I get the partial refund I am requesting ! I requested an invoice through paypal 2 times for the duplicate, along with 2 follow up emails asking when they can send the MSO. That is FOUR responses. Why will you not send it with a tracking number? send me the invoice. Why will you not provide me with a bill of sale?

tech support is not reachable is 100% FALSE! We have a toll free number [redacted] and 24 hour voice mail as well. Customer called us and mis-dianosed the issue on the vehicle if it still blows smoke. We dont know what the this customer did at set-up or if he used the correct oil. At purchase customer agreed to terms and conditions of sale agreement.  It clearly states:  (Terms & Conditions I have read and understand the Motobuys Inc. terms and conditions of sale policy, manufacturers' warranty policies and product return policy. By clicking "Submit Order", I agree to all the terms and conditions set forth in these policies. )Under the terms and conditions agreement its reads: (You are responsible for performing the set-up/"PDI" that a dealer would normally perform. i.e.- installing rear view mirrors, setting up and connecting the battery, checking tightness of all screws, checking and securing all electrical connections, nuts, bolts, changing oil, etc. Items such as lose hardware and parts damaged from loose hardware and components are not covered under warranty. On 11/24 - My husband purchased an electronic Go Kart for our children (from Santa) from MotoBuys. He received a confirmation email, and no other notification (none, not even a "this product is on back order".

The week of 12/13 - My husband called to find out where the Go Kart was. He were told the Go Kart was at the warehouse and they would contact us with a shipping number when it shipped (within 48 hrs).

On 12/24 - I called, as we still had not received any communication from MotoBuys or anyone else on the Go Kart. The gentleman I spoke to sounded astonished the Go Kart had not been received yet. I was told the Go Kart was sent to the warehouse on 11/30 and off the listing for MotoBuys.

On 12/29 - We finally received the Go Kart in a severely damaged state. On the R&L Carriers bill of lading, it was shipped from California on 12/18 (it doesn't take 10 days to make it from California to Tennessee).

I cannot believe that we received NO communications from MotoBuys or anyone else as to the progress of the shipment, not even that it was out of stock or delayed in any manner. None, period. Worst experience I've ever had with an online retailer.

12/30 - I called again and spoke with Joe. He seemed unconcerned that it took over 30 days to receive the Electric Go Kart. His "story" changed multiple times while I was on the phone with him. From stating he wasn't sure if the Go Kart had been on back order or not, to then stating it had been on back order and they weren't received until 12/18 which is why it shipped on that day from the manufacturer (not a warehouse). He only changed what he said after I noted the Go Kart shipped on 12/18.
