Complaint: [redacted]
I am rejecting this response because:"I believe his complaint should be directed against the organization where his problem is manifesting itself, as they are the only ones who can correct it." - So the question still remains unanswered and ignored, why did the Customer Services Representative (or whatever title they use) from National Credit Systems asked me to fax my personal information so this issue can "actually" be fixed. After the phone agent said HERSELF the date of births did not match I was told by the phone rep to send a fax to [redacted] with the account # [redacted], A COPY OF MY DRIVER'S LICENSE AND SOCIAL SECURITY CARD, and a cover sheet with my name, address, telephone number, and email. All this SHOULD be in notes for the account #[redacted], or hopefully the conversation was recorded as it mentions when you first call (I doubt it!).- As I have already mentioned before. I have directed my complaint against the organization where "my" problem is manifesting itself. I have done this twice (read previous message in its entirety for full and all details). I called National Credit Systems this past month and the phone rep said that "my" issue happened AGAIN because I have not sent my personal information to NATIONAL CREDIT SYSTEMS for them TO REMOVE ME from this account; and I was told that disputing this with the "organization" (Equifax) was not going to fix it.
Sincerely,

This account was placed in our office for collection in February 2014.  The consumer previously disputed the debt.  National Credit Systems investigated the dispute and the debt was found to be a valid debt.  Letters were sent to the consumer at the address on this complaint, advising...

the consumer that the debt had been validated and with supporting documentation, on January 22, 2018 & February 12, 2018.  The account is marked as a disputed account and will remain on the consumer's credit reports at this time.  Additionally, the account is in a cease & desist status and is not being called by our collection staff at this time.

This account is no longer in this office and the consumer should contact the law offices of [redacted] at 888-231-6788.  However, the debtor previously disputed the debt and National Credit Systems investigated the consumer's dispute.  The debt was found to be...

valid.  A letter was mailed to the consumer validating the debt, with supporting documentation on November 27, 2017.  The account is marked as a disputed account for credit reporting purposes and will remain on the consumer's credit report at this time.

Complaint: [redacted]
I am rejecting this response because: "To correct it, a consumer must dispute the account being reported against them with the credit agency that is reporting it."- I have already disputed this account with Equifax TWICE. The first time it was almost a year to this date, it was in September 13, 2015; at that time it was for an amount of about $1,164, and it was fixed by Equifax. But then it happened AGAIN recently, in this case it was for $2,142, so I ended again submitting another dispute with Equifax this past Tuesday, September 20, 2016. “National Credit Systems is specifically reporting another party of the same name at a different address and a different date of birth.”- If this was accurate, then why both I and my dad (he is much older, so he was not born in 1991 like the person who truly owns this account) got hit with the same account from National Credit Systems last year in 2015? My dad also disputed with Equifax last year and they fixed it. I have not yet checked with dad if he has gotten hit with this account again. “We cannot correct an error made in another company.  That is why the consumer must dispute the error with the credit reporting agency, in order to correct it.”- So last year the Customer Service agent (or whatever they are told to use) from National Credit Systems stated that in order to fix this I (and my dad) needed to dispute the account with Equifax. We both did individually (of course) and our credit reports were fixed then. Now that I got hit again with this account, I called again (I think on August 20, 2016) National Credit Systems and I spoke with one of their Customer Service Rep and I was told “Sir, you did not fix this account with US. This is why you got hit again. We are not going to do the leg work for you. You must fix this. You need to fax us a screenshot or copy of your credit report showing this account, and copies of you driver’s license and social security card.” I had to ask the CSR how I would go about trusting my COMPLETE personal information to their company, and especially via a form of a fax. Needless to say, the response that I received was “Sir, I can go ahead and end this call now since you don’t want to the leg work, we are not going to do it for you, and this is company policy. Disputing it with Equifax is not going to solve this completely.” There should be notes under this account with this request and statements from this CSR agent, and perhaps there is a recording of the call.
Sincerely,

Complaint: [redacted]
I am rejecting this response because:First of all, debt collector did not respond to my request for validation within the timeframe specified under the Texas Finance Code 30 days.  And there is no evidence to support their claim of having done so.  In addition credit bureau reporting is considered collection activity, so they never ceased collection on this account.  I have suffered substantial actual damages as a result of this debt collector's willful negligence.  However, I am making every effort to resolve this matter without presenting this case to a courtroom before a jury in my community. I am respectfully asking that this invalidated account be deleted from my credit reports.
Sincerely,

Thank you for contacting our office on behalf of this consumer. We have reviewed the complaint and found the following:This consumer has informed our office that the account is being disputed. We have notated the dispute and will be happy to provide validation of the debt to this consumer. The...

account was from the origInal creditor, TERRA AT PARK ROW APARTMENTS. If the consumer contacted them, it is quite possible they would have told him that they no longer have the account or his records, because they are with National Credit Systems, Inc. We spoke to this very consumer on January 10, 2014. He was given a complete explanation for the debt and we offered to mail him a copy of the charges. The consumer refused to provide us with a valid address. The account was placed on his credit approximately 60 days later for non-payment. If the consumer would like to resolve the account, he may contact our office in writing or via telephone:National Credit Systems,Inc. [redacted]

I am rejecting this response because:  I have not received  supporting documentation.  I would like to receive a copy of the lease. This is especially important because I have been told different things since inquiring about the cause. Initially I was told that this charge was because I was still living in the unit up until March 31(this was untrue). After providing [redacted] with a copy of a letter from Greystone and a copy of my new residence, then I was told that the charge stemmed from liquidated charges for not giving adequate notice. At this point, I feel like this is an attempt to not admit a mistake.
Sincerely,

Initial Business Response /* (1000, 5, 2015/06/15) */
Thank you for contacting our office. This consumer has been sending in payments of 50.00 per month. We are accepting and posting the payments. Thank you. National Credit Systems, Inc.

Thank you for contacting National Credit Systems, Inc. on behalf of this consumer. We have researched our records and found the following: We are not saying or implying that these were the only times that the consumer spoke with our agents. We were simply providing a factual history to support that the consumer version of events is inaccurate. We stand by the following:  The consumer, unfortunately, has provided an inaccurate view of how and why the account was reported to his credit history. National Credit Systems, Inc. received the account in collections on 1-25-2016. We called and spoke to this consumer on 1-27-2016. He advised our representative that he would be calling back to address this account. We called numerous times and mailed letters, but did not hear back from this consumer until 5-4-2016. In a telephone  conversation, he advised our representative that he would be contacting us back to make a 100$ payment towards his account balance. Again, we did not hear from this consumer again until 9-16-2016, on which he called and finally paid the account. This consumer was not manipulated into making this payment, nor was he promised at the time that this account would be deleted from his credit history if he paid. The consumer was a legal party to the original debt that went into default, therefore, the account was reported on his credit history. The consumer could have prevented the account from reporting by making a payment or arrangements when initially contacted, but failed to do so. The account has now been paid and we have reported the account with the appropriate status. We are unable to delete the account history from the credit bureaus.

Account was placed in our office in March 2011.  Initial notice of placement was sent out advising consumer of right to dispute debt within 30 day period.  No dispute was received from the consumer and the debt is considered valid.  Signed paperwork is on file signed by the consumer....

A payment was actually received 1/31/2017.  National Credit Systems will investigate the balance again with our client.  The client has 30 days to respond.  A letter will be mailed to the consumer at the address given on this complaint, advising him of our findings.  The account has been marked as a disputed item, but will remain on the consumer's credit report as a disputed item at this time.

This account has been marked for deletion from the consumer's credit reports.  It will be submitted on or about 12/7/2017, and should be removed by [redacted], shortly there after.  A letter is being mailed to the consumer confirming that the account has been closed to...

the address on this complaint.  This should resolve the issue for the consumer.

I am rejecting this response because: I am awaiting photographic evidence of the "damages", and the 30 day notice given at time of move out.

National Credit Systems did receive a certified letter, disputing the account.  National Credit Systems investigated the dispute and the account was found to be valid.  National Credit Systems mailed the consumer a letter, validating the debt, with supporting documentation on 9/11/2017, to...

the address on this complaint.  The account is being reported to the credit reporting agencies as a disputed account, and will remain on the consumer's credit report at this time.

National Credit Systems is a third party collection agency representing [redacted].  This account ([redacted]) was placed in our office in June 2011.  National Credit Systems will investigate the dispute.  Once the investigation has been completed, National...

Credit Systems will send a letter to the consumer, at the address on this complaint, advising the consumer of the findings of our investigation, with substantiating documents.  The account has been marked as a disputed account, and will continue to be reported as a  disputed account on the consumer's credit reports, pending the outcome of our investigation.

Complaint: [redacted]
I am rejecting this response because: This account was disputed in accordance to FCRA laws and met the requirement for re-investigation.  National Credit System failed to respond to such request made to validate debt is owed by myself and Experian.  In accordance to FCRA laws, items that have not provided sufficient evidence of validation are to be deleted immediately from any and all consumer credit reports and further collection of debt must cease.  This case was never disputed as a fraud case as they claim.  This was disputed as an inaccuracy that was place on each of the credit bureau reports.  In doing so, National Credit System complied in deleting report account to Transunion and Equifax but failed to do so with Experian.  Question were raised as to why they complied with deleting account from two credit bureaus but failed to do so with Experian in accordance to the FCRA laws.  National Credit Systems did not and does not have valid proof that debt is owed.  In pursuant to Secton 609 of the Fair Credit Reporting Act, sufficient and adequate proof of debt is the original signed contract. National Credit System has failed to produce such documents or agreements.   They also failed to produce a contract/agreement that I have signed in which I validated such  alleged debt and agreed to pay alleged debt. FCRA does not consider itemized bill, information just because it matches the name, address, DOB or SSN to be sufficient proof or validation of debt.
Sincerely,

National Credit Systems had mail returned from the address we had on file, so we did not have a good address for this consumer or any phone number.  National Credit Systems will investigate his dispute and the account has been marked as a disputed account for credit reporting purposes. ...

Once the investigation is completed, a letter will be mailed to the consumer informing him of the findings of our investigation, along with supporting documentation.  The account will remain on the consumer's credit report as a disputed item, pending the outcome of our investigation.

National Credit Systems has extended offers authorized by the client to settle the account numerous times for $1190.82, on a balance of $2381.65.  These offers always had expiration dates and the consumer did not avail himself of the offer each time it was extended.  National Credit...

Systems does not own the account and all settlements have to be authorized by our client, [redacted], where the consumer previously lived.  Currently, the client has authorized a settlement in the amount of $1548.07.  This made be paid online, if the consumer wishes to do so, at [redacted], or he may call our office to pay this amount.  Additionally, we are mailing out a copy of the original charges to the consumer for his reference, at the address on the complaint.  All settlements offers are designed to urge the consumer to pay the account and generally have an expiration date.  The consumer's account number is 2785430, and the account was placed in our office in August 2013.
