I am rejecting this response because: No matter what, I will be out financially.  I am already paying $350 more than what I was planning on paying (due to going to the wrong web address to place my final order--my fault) and to pay any restocking fee would only add to my losses.  It is unfortunate that you run your business in such a way that even when you truly could have helped me out, you choose not to.  We both know that appliance had not left any warehouse by 10 a.m. on Monday.  I am a professional contractor who purchases such items for clients regularly.  Your loss of my future business is far greater than your gain on this one purchase.  You may want to keep that in mind for future situations that are similar to mine.

I am rejecting this response because:The business sold a defective product to me, and not cheaply.  The product worked for not quite a week before it stopped working.  Even if I had used the product right when I received it, 4 months is not an adequate time for such a product to break if they assure that it was in good working condition when they sold it.  For them to insinuate that I spent $660 on an appliance and did something to it to cause it not to work is ludicrous and insulting.  I have a household full of other appliances, including another EdgeStar wine cooler purchased new from this company, that are working great.  What seems to have happened is that they got a defective product and sold it under the guise that the company had made sure that it was fully functional.  Obviously this was not the case!  The company took my money, gave me a defective product and now wants me to pay to have the product that they guaranteed was fully operational fixed.  Seems like a perfect situation for them.

I am rejecting this response because:I am not technically rejecting the response but the response requires further action on my part to a third party so I would ask that the complaint remain open until that correspondence has been acknowledged.At the request of the "Business", I have emailed the manufacturer with the problem and referenced this Revdex.com case.It is reasonable to close this case satisfactorily if the manufacture agrees that the unit is covered by warranty as the Business has stated.

I am rejecting this response because: The issue has nothing to do with scratch and dent/cosmetic.  The issue is that the refrigerator DOES NOT WORK and never did. So you sold as an appliance that doesn't work. Likely knowingly. If it was a scratch I would say ok that's fair. This has nothing to do with it being scratch and dent--it simply doesnt work.

We would be happy to offer the same product at the same price however we no longer have this same model available in stock. The customer was offered a brand new model which does have a higher price. The customer purchased a scratch and dent originally. If another one comes in stock they are able to purchase this at the same price point.

Again just because the customer feels they deserve a credit does not mean they will receive one. We have explained the circumstances and feel no need to issue a customer a credit on something they agreed to the terms and conditions of the sale.

The customer spoke with our service team on 12/19, they where advised the electrical 115v is the correct voltage and will work on any standard household outlet. I believe the customer is just confused on the electrical outlet. The customers order# with us is [redacted] if they need to reference this...

I am rejecting this response because: it is completely untrue. I could not take delivery if their delivery company refused to deliver it. What they proposed was that I pick it up instead. That is not delivery. And it was not what we contractually agreed upon. So they've held funds for well over a month, preventing me from buying a replacement product or getting my rental unit ready for sale. They haven't even refunded the several hundred dollars I spent on extending a warranty for a product I've never used. Their actions are completely unacceptable.

Hello, We apologize the incorrect unit was shipped.  We would like to resolve the issue by arranging for the retrieval of the incorrect items shipped.  What we will require is that the unit be placed in its original container or in a container that will allow for a safe trip back to...

our location.  Our objective is to receive the item in the same manor you received it ( no damage ).  If this option is not an option for you then we will have the ability to sell you the correct unit at the same price and when that unit is received we ask that you use that box for the return of the original unit shipped.  We will set up the return and upon its return to our location we will then provide a full credit on the original order.  I understand that you will be out of pocket during this period but this option will allow for a full credit when you receive the correct unit and I receive the incorrect unit shipped.  This option is available due to not having the original packaging.   If you would like to discuss this further you may reach me at my number listed below. Reviewing the records of this customer account it appears EdgeStar has sent out parts on 12/4/2015 and then fully exchanged the item on 4/7/2016. The warranty is a full parts and labor for one year from the original date of purchase. Unfortunatetly at this point the customer would be out of the...

manufacturers warranty. They are able to contact the manufacturer but will only be offered out of warranty options.

I am rejecting this response because:  their claim of "out of warranty", The product is less than one year old and is not working. I am perusing.  This isn't anything that they haven't already explained to me  other avenues as well, social media, consumer affairs, and small claims court.  How in good conscience this company can claim " out of warranty " is not satisfactory when the unit and its replacement unit failed working within months of their respective delivery dates.  I will seek more than just a refund to cover legal expenses etc etc

I was able to locate the other order. The order number is [redacted], purchased 7/10/2012. This order is out of the manufactures warranty however was purchased with an extended warranty. For this one you will want to reach out to the extended warranty company New Leaf. They can be reached at [redacted]. As far as contacting the manufacturer, they only have one number. I do not know why they would hand up on you so I would recommend communicating back with them.

The customer is currently under the manufacturers warranty. Any further communication would need to be through them as they are the decision maker at this point. EdgeStar can be reached at [redacted].

The customer was informed multiple times of the condition these would be in. That being said we will make a one time exception and issue the customer a refund. We would recommend that the customer not purchase any more scratch and dent models as his expectation does not align with our description.

I am rejecting this response because:Naturally, I am in receipt of your email and cannot accept this response because it must be "rejected" in order to proceed with the case. Kindly note that all four units, as of today, have been returned to the company, of which they will have to reimburse me for the cost to send back, and I hope this matter is resolved in my favor shortly.
