 The general manager for Equinox Gramercy, contacted both via email and phone to give me another opportunity to...

lock in their "promotional pricing" before it increases on November [redacted], 2016. However, this was another misrepresentation by Equinox as the original pricing ($165/mo) is still being advertised on their website.  In order for the Revdex.com to appropriately process your response, you MUST answer the question above.

The following constitutes the response of Equinox Holdings, Inc., in response to the consumer complaint filed by Melissa Schilling. [redacted] signed a membership agreement with Equinox on December **, 2014 (the “Agreement”). All indications are that [redacted] voluntarily signed the...

membership agreement and fully understood its terms. The Agreement provides for a 12-month obligation period, and thereafter, the membership becomes a month-to-month membership. This obligation is clearly and conspicuously stated on pages 1 and 2 of the Agreement. Paragraph 2 of the Agreement on page 3 provides for additional cancellation rights during the obligation period should a member (1) provide a doctor's note stating that she cannot physically receive the services of the club for a period in excess of six (6) months; (2) pass away; (3) move her residence more than 25 miles from any health club operated by Equinox; and (4) be involuntarily terminated from her employment without cause (and provide documentation from her employer confirming the termination and the reason for such termination). [redacted] is currently still within her obligation period, as it has not yet been 12 months since she activated her membership. She has not provided any of the documentation necessary to cancel her membership within the obligation period, nor has she indicated that any of these rights are applicable to her. While it is unfortunate that [redacted] is unsatisfied with the terms of the contract that she agreed to, there can be no doubt that the terms are clear.

[redacted] signed up for a membership on 10/**/16. His account was cancelled and refunded 10/**/16. We apologize if he believed the facility
would be open sooner and offered additional options to purchase a short term or to transfer his membership to a different facility. Each facility has its own price point and the pricing for the Flatiron location was provided to [redacted]. We would not be able to honor the Gramercy pricing for a different facility. Our site communicated that the Gramercy facility was not yet open with the “Club Opening Soon” verbiage and understand that [redacted] wanted a more specific date. We appreciate his feedback and will use it as an opportunity for growth and development.

On September [redacted] 2016, member Gerald C[redacted], signed a membership agreement that indicated that the agreement was for a minimum of twelve months, at which time membership may be terminated at any time with forty five days notice to Equinox. be cancelled with forty five days' notice for relocation(member must provide proof that they have relocated more than 25 miles from an Equinox facility), job loss (member must provide proof of job loss), and medical (medical note is required and account will be cancelled immediately).
