We are sorry that Ms [redacted] feels that she is being harassedOkinus keeps trying to contact Ms [redacted] due to her account being due for 7/18/A partial payment was made on Ms [redacted] 's account on 9/and before that another partial payment was made on 8/Okinus has not contacted Ms [redacted] since the payment on 9/and her account has been turned over to our legal department being Ms [redacted] has requested we do not contact her any longerBefore we received the Cease and Desist Okinus was trying to get in contact with Ms [redacted] so that we can set up arrangements with her to help bring her account back current with our company Okinus will not be calling Ms [redacted] any longer but we do request that she contact our office to set up arrangements to bring her account back current with our office

Ms [redacted] applied with Okinus in November after visiting Exclusive FurnitureMs [redacted] submitted all the required information Okinus requested including IDMs [redacted] 's account has had successful payments (the down payment, 2/payment, 3/payment)Okinus is the original creditor for account ***Ms [redacted] current due date is 4/15/Ms [redacted] should contact Okinus at 1-800-472-to make payment arrangements to bring account current and reporting positive on EquifaxThe previous reporting is accurate (last payment received on account 3/2011), currently due for 4/15/Okinus received an ROG (Receipt of Goods) that Ms [redacted] was in receipt of merchandiseOkinus sends a Welcome Letter to all customers (the welcome letter has same address Ms [redacted] gave with Revdex.com dispute) Attached: Application Texas ID Signed Contract ROG Welcome Letter [redacted] Senior Manager

Ms [redacted] made arrangements to pay the Same As Cash payout on 4/3/as previously offered size="3">Okinus was not able to extend the Same As Cash payoff until 4/22/ Ms [redacted] took advantage of the Same As Cash extension Okinus offered until 4/3/ [redacted] Senior Manager

Ms [redacted] signed a lease agreement with Okinus on 6/6/ stating that the contract was read, understoodBy signing the lease agreement Ms [redacted] was agreeing to make the monthly payments in the amount of $ for months after the initial paymentOn page of the lease agreement below the signature Okinus also provides a payment schedule that gives the estimated payoff (minus sales tax) provided the payments are made on time Ms [redacted] has payments remainingMs [redacted] has not been taken advantage of as stated in the initial complaintMs [redacted] ’s initial cash price was $(reflected on signed lease agreement)Okinus provides customers the option to pay out days SAC (Same as Cash), Ms [redacted] ’s SAC expired on 9/5/ Ms [redacted] contacted Okinus’ automated system on 1/6/and received the following information Payoff - $453.56; Total Balance - $1047.27; Due Date - 2/6/15; Last Payment - 1/6/and on 1/12/to speak with a representative and the payoff information was being explained when the call was disconnected If Ms [redacted] does not have intentions of completing the agreement that was signed on 6/6/14, Ms [redacted] should contact Okinus to discuss the options available to her, or Ms [redacted] can take advantage of the payoff of $that was quoted from the automated system, the payoff of $ expires on 2/5/ [redacted] Senior Manager

Mr [redacted] is correct that Okinus has been charging him per the invoice received from the storeOkinus received a call from Mr [redacted] on 5/26/(who was at the store) that was not in receipt of the bar stools and no longer wanted to waitThis was verified with the store and a revised invoice was sent without the price of the stoolsOkinus sent a contract for the customer to sign so the account could be correctedOkinus received the revised contract signed on 5/27/The account is in the process of being corrected and Mr [redacted] should be able to contact Okinus by close of business 5/28/for an up to date account status.Mr [redacted] stated that Okinus has charged him for all merchandise and is FRAUD due to not receiving all merchandise, this is not the caseOkinus was charging Mr [redacted] incorrectly due to Mr [redacted] signing an ROG (Receipt of Goods) on 3/31/stating that had received all items on his Okinus contract and instructed Okinus to fund the storeOkinus attempted several Welcome Calls to welcome to Okinus and go over any questions that may have, we were unsuccessful in reaching Mr [redacted] and left several messagesMr [redacted] did contact Okinus on 5/11/in reference to correspondence sent via mail about payment, information was verified however nothing was mentioned about not being in receipt of merchandise (this was not until 5/26/as stated above) [redacted] Senior Manager

Okinus would like to thank Ms [redacted] for her service to our country Attachments: Contract page 1&2, Payment History, Welcome Letter Per the contract Ms [redacted] signed on 2/1/the terms were initial payment of $and remaining payments of $Ms [redacted] has made payments out of the total scheduledThe remaining payments are Ms [redacted] should have received a copy of her contract when signed on 2/1/Okinus sends Welcome Letters to all customers that go over the contract (due date, payment amount, remaining terms, SAC expiration)The Welcome Letter has a payment schedule on page that lists the day of each payment and the payoff after each payment (this is provided that no extra payments are made over course of contract)Ms [redacted] has not made any extra payments and currently is past due for 9/1/ The desired settlement you reference is the SMCRAIn reference to the Service Member's Civil Relief Act you were already serving in the Navy your current rank when applied was (E3), and then you entered into the Lease Agreement with OkinusThere is not interest to adjust Okinus does not charge interest because this is a leaseMuch like, if you were renting an apartment, there is no interest Ms [redacted] can rest assured Okinus is not a scam, Okinus reports to Equifax monthly and have many payment options available to those who qualifyIf you are experiencing financial difficulty contact our office to see if you qualify for other amounts Thank you again Ms [redacted] for your continued service to our great country [redacted] Senior Manager

Okinus would like to thank Mr [redacted] for his service to our countryMr [redacted] contacted Okinus on 1/2/and asked about the Day SAC (Same as Cash) and the SAC was explained to customerIn reference to the contract and account paying off December The store sent over the ROG (Receipt of Goods) showing that Mr [redacted] picked up his merchandise on 2/16/ Mr [redacted] did not begin making payments until 3/25/14, this will affect the estimated payoff date per the contractMr [redacted] has not made any additional payments on account to pay out sooner than the contract reflects; this was explained to Mr [redacted] when contacted the office on 11/29/ In reference to the 103% interest: Okinus does not charge interest, Okinus contracts are LEASE AGREEMENTS and state as such on the contractUnless Mr [redacted] pays the account off sooner he will pay the total terms that are on the contract [redacted] Senior Manager

The reason the payoff is not lower is due to Ms [redacted] getting behind when lost her job 5/23/2014, Ms [redacted] did inform Okinus of this Okinus agreed to work with Ms [redacted] and allowed Ms [redacted] to make a partial payment of $on 6/17/Okinus spoke to Ms [redacted] 7/16/and made arrangements to get account currentOkinus set Ms [redacted] up with arrangements that when completed Okinus would forward due date to currentMs [redacted] made a payment 7/16/2014, 8/16/& 9/17/The payment that Okinus has set up for 10/16/was returned to Okinus as Payment StoppedWhen Okinus was notified of the returned payment, this subsequently caused the due date to revert from 11/16/back to 10/16/Ms [redacted] made an online payment to Okinus 11/19/and the due date was then advanced to 11/16/Okinus sent Ms [redacted] a Welcome Letter that included a payment history (provides estimated payoff provided no issues with payments)Ms [redacted] has completed payments of the payments, the number of payments remaining is Attached you will find the Welcome Letter and the payment historyMs [redacted] is not due a refund however due to the confusion of payments returning Okinus will waive the past due lease fee and accept a payoff of $The reduced payoff will be extended until 12/19/If the $is not received by 12/19/the offer will be rescinded Okinus asks that Ms [redacted] contacts Okinus to take advantage of the reduced payoff of $to avoid any further confusion on account Attachments: Signed Contract, Welcome Letter, Payment History [redacted] Senior Manager

Mr [redacted] ’s Day SAC (Same As Cash) expired on 1/24/The welcome letter was mailed to Mr [redacted] on 10/28/(have enclosed for review)Okinus did not receive returned mail from this address [redacted] ***The reason that Mr [redacted] ’s payoff has “increased” as he states is due to the SAC expiring and lease fees adding inAs with the Welcome Letter the contract is accompanied by a payment scheduleThe payment schedule will give every customer an estimate of their current payoff provided they have made on time monthly paymentsThe contract payment schedule states that the payoff reduces by $out of every $payment Mr [redacted] did not contact Okinus until 2/20/he stated that an Okinus rep informed him that his Day SAC would not start until 12/1/14, Mr [redacted] was explained this was the day he chose for his due date (because he needed the 1st of month)He said that we were lying; the representative informed Mr [redacted] that the call could be pulled from that dayThe call was pulled and the only thing that was stated was the due date, nothing was mentioned about the SAC (the SAC cannot be changed; it is from date receive furniture)When Mr [redacted] was contacted back to inform of the call review he stated “I was not expecting you to say anything else” then Mr [redacted] ended call Okinus would like to extend to Mr [redacted] a reduced payoff of $by removing lease fee ($65.84), the reduced payoff will expire on 3/2/ Okinus cannot extend the SAC due to SAC expiring on January 24, [redacted] Senior Manager

On 2/10/Ms [redacted] did go on the Okinus website and set up the payoff on her lease furniture accountOkinus uses a third party company so we are not aware that a payment has been made on an account until we receive the payment unless the customer contacts our officeIt takes 3-business days for Okinus to receive any payment that is made onlineOkinus submits all payments 5-days in advance and Ms [redacted] 's monthly payment was submitted to our bank to be processed for a payment on 2/11/being her due date was for 2/16/I see where Ms [redacted] did chat with one of the representatives here at Okinus on 2/11/around 7:14pm in regards to letting us know she paid out her account onlineWhen Ms [redacted] chatted online with one of our Okinus representative it was not caught that her payment was submitted earlier that day and I want to apologize for the inconvenience this has caused her Also, I want to apologize that the NSF fee wasn't returned back to Ms [redacted] when the account was originally reviewedOkinus is in the process of rectifying the situation and Ms [redacted] should see the credit for the fee back in her checking account within 1-business days

Ms [redacted] is correct her account is past due, though the refusal to work out payment arrangements cannot be attributed to OkinusMs [redacted] informed Okinus in hours were cut; Okinus requested proof so arrangements could be reached (Okinus received no proof) Ms [redacted] informed Okinus in that no longer had employment; Okinus requested proof so arrangements could be reached (Okinus received no proof) Ms [redacted] contacted Okinus 4/to inform that wanted to speak to a particular representative at Okinus (due to receiving a collection letter that was emailed), the message was relayed to the representative to contact Ms [redacted] due to Ms [redacted] not wanting to discuss account with anyone but particular representative The contact number was not good, the return email was never answeredOkinus has been trying to contact customer the rest of 2012, and Due to Ms ***’s intentional refusal to work out arrangement with Okinus, Okinus has no recourse but to collect payments per the contract that Ms [redacted] signedI have attached a copy of the signed agreement (contract) that Ms [redacted] entered into with Okinus on 6/22/11, on page of contract number 17; Ms [redacted] gives authorization for Okinus to ACH debit account In reference to account being in collections, the account has been in collections and past due since the payment was returned to Okinus in (10/22/ payment)Okinus has not sold account to a collection agency Ms [redacted] is urged to contact Okinus to work out suitable arrangements on account to bring current and satisfy the agreement from Attachments: Contract, Payment History [redacted] Senior Manager

Mr [redacted] has not completed the terms of the contract that was signed on 2/20/(a copy of contract is attached)The due date and the SAC will not always be on the same day (due to some months having days and February which has 28{affects Mr [redacted] since contract signed on 2/20/14})As stated previously Okinus has already given Mr [redacted] an extra weeks to pay the account out SACIf Mr [redacted] was going by the monthly payments the Mr [redacted] should have completed the SAC with the 3rd payment (which was made on 5/19/14)The payments that have been made on the account are as follows 2/26/$Initial Payment (Down Payment) 3/20/$1st monthly payment (Regular monthly payment + extra to depreciation) 4/21/$2nd monthly payment (Regular monthly payment) 5/19/$3rd monthly payment (Regular monthly payment) 6/12/$(Per Mr [redacted] apply to balance on account, therefore leaving account due for 6/19/14) Mr [redacted] is urged to take advantage of the reduced payoff of $due to expiring on 6/24/Otherwise Mr [redacted] will need contact our office to make arrangements for 6/19/payment that is dueIf Mr [redacted] would like for the payment of $to be redistributed to include making 6/19/payment and the extra going to depreciation (balance) of account, he needs to contact the office at 1-800-472- [redacted] Senior Manager

Ms [redacted] contacted Okinus on 5/14/14, and state that wanted to stop the payment for 5/21/(the reason the ACH was suspended), asked for the payoff (payoff was quoted) changed due date to 27th of month Ms [redacted] called Okinus on 5/22/ and spoke to [redacted] , decided to pay the payment with checking instead of debit card (due to fees), asked for payoff after Mays payment (payoff quoted good until 6/27/14), the call ended A payment was not processed for June 27, payment until July 25,Starting on 7/2/messages were left for Ms [redacted] to contact Okinus, a letter was sent on 7/2/to contact about past due paymentThe authorization to ACH draft/debit account is located on page of contract # (authorizes Okinus to process payment) [redacted] Senior Manager

Ms [redacted] has been a long time customer of OkinusThe most recent purchase was from [redacted] e in Houston Texas (purchase made 5/26/11)The last successful payment that was made to Okinus was made on 10/26/Okinus has made several attempts in leaving messages, sending letter to Ms [redacted] so that a resolution could be made to bring the account back to good standingThe account information that Okinus has is the same information that Ms [redacted] made the 1st payment on 5/1/(payment was returned NSF)Okinus would like to work with Ms [redacted] to bring account back to current and reporting positive on Equifax credit report In reference to settlement Okinus cannot refund the payment (payment was returned NSF) nor the NSF fee incurredOkinus urges Ms [redacted] to contact our office at ###-###-#### to resolve account [redacted] Senior Manager

Mr [redacted] is correct Okinus filed suit on accountOkinus received a judgment on 7/1/( [redacted] Municipal Court Case no [redacted] )Okinus was notified that Mr [redacted] wanted to now return merchandise due to current garnishmentThe account will now be handled through [redacted] Municipal Court Okinus was contacted on 10/22/stating that wanted to give the furniture back and was informed that Okinus would not pick up the merchandise with account being in legal status, however if wanted to turn it in that would be fine but would not stop the current garnishment in effect Okinus made attempts to communicate since 5/the messages were not returnedThe only recourse remaining for Okinus was to file suit to collect the monies owed [redacted] Senior Manager
