I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.  Similar to how ACS DID NOT respond to the Revdex.com complaint within a timely manner, they've completely dismissed both of my concerns and needs.  Brian called me on 10/30 and since then he's NEVER contacted me again, even though he said he would.  He never explained the billing/interest issues with my account nor why my total payments within my billing cycle continue to be more than the interest he stated I should be charged within that timeframe.  I explained and expressed my issues/concerns with him on 10/30.  He said he would look into it and call me back, which he NEVER did.  I don't even have his contact information.

Xerox Education Services, LLC. doing business as ACS Education Services (“ACS”) services one Federal Consolidation Loan account for Mr. [redacted] on behalf of the lender, JP...

Morgan Chase.  JP Morgan Chase partnered with ACS to maintain servicing, repayment and collection activities on the student loan.  While ACS remains the primary contact for the servicing activities, the loan is owned by JP Morgan Chase and serviced per their terms and federal regulations. 
 
Our records indicate that Mr. [redacted] had submitted a discretionary forbearance request on October 31, 2016.  The discretionary forbearance was rejected on November 2, 2016 as Mr. [redacted] has exhausted his discretionary forbearance time available. 
 
I was able to reach Mr. [redacted] via telephone on November 4, 2016 and explained the reason why his forbearance request was not processed.  We were able to discuss available options available.  Mr. [redacted] was sent Student Loan Debt Burden (SLDB) forbearance along with a new Income Based Repayment (IBR) application.  To date, no further documentation has been received from Mr. [redacted].
 
Mr. [redacted]’s account is reflecting as delinquent with a total amount due $4,370.94 at this time.

This is in response to the above-referenced complaint filed with your agency by [redacted]. We are providing you with a detailed response that addresses her concerns
 
Our records do not indicate that a Loan Verification Certificate (LVC) was received from Ms. [redacted]’s consolidating lender, [redacted].  A manual LVC was generated and submitted to [redacted] on June 16, 2016 which included all loans currently serviced by ACS.
 
Ms. [redacted]’s loans are currently being serviced by our cures department.  Our records indicate that several representatives in this department have been in contact with Ms. [redacted].
 
Our records indicate that the derogatory credit reporting which originally occurred in October, 2014 was cleared in November, 2014 when Ms. [redacted]’s School Deferment was processed.  Federal Stafford Loans are granted one six month grace period.  If a customer returns to school after the initial grace period has expired, they may be eligible for a School Deferment, but will not be granted another grace period.  The loans will enter repayment immediately after the School Deferment expires.  Our records indicate that Ms. [redacted]’s original separation date from school was in 2006 at which point her six month grace period was utilized.
 
Ms. [redacted]’s accounts currently remain delinquent and will continue to be reported delinquent to the nationwide credit bureaus until the accounts have been brought under 60 days past due, or paid in full.
 
Ms. [redacted]’s loans are not eligible for Economic Hardship Deferment.
 
While ACS’ correspondence address is in New York State, we also have offices in California.  As such, Ms. [redacted] may receive telephone calls from a California area code.
 
We apologize if any member of our staff failed to communicate with Ms. [redacted] in a positive and professional manner, and we appreciate her honest criticism.  We are committed to improving our service and implementing changes that will prevent situations such as hers from occurring in the future.

In my original letter I clearly stated that I am disputing the claim from ACS that my account was delinquent between April 2013-August 2013. They continue to fail to send me validation that I was delinquent. I was only sent a copy of the master promissory note dated 14 years ago. Furthermore, they have now violated federal and state laws by failing to put a notice of dispute on my credit reports within the required 30 days of receiving the original dispute. I have time stamped proof of this failure via certified mail and dated credit reports. Please see the attached documents.In order to avoid a small claims suit for their violation of state credit reporting laws my credit report needs to be updated with these derogatory marks removed.

Being that the dispute with ACS has already been in motion 30+ days I would like resolution sooner than 14 days. I have provided ACS with my actual credit report as documentation of the duplication. This matter is drastically impacting my ability to secure a home loan. A three-five day response is more reasonable at this point. ACS should escalate the research.

LLC., doing business as ACS Education Services (“ACS”) services one Federal Family Education Loan Program (“FFELP”) Consolidation account for Ms. [redacted] on behalf of College Loan Corporation.  College Loan Corporation contracted with ACS to maintain servicing, repayment and collection activities on their student loans.  While ACS is the primary contact for the servicing activities, the loan is owned by College Loan Corporation and serviced per their terms and Federal Regulations.   Our records indicate Ms. [redacted] was contacted by ACS after we received notification of the completion of her bankruptcy on May 10, 2017.  Attempts were made to contact Ms. [redacted] by telephone to advise her of the status of the account and to ensure her repayment plan was reinstated successfully.  Federal Regulations allow servicers to attempt to contact the customer using the contact information on file.  In addition, we may attempt to obtain current contact information for Ms. [redacted] from relatives and other sources.   I have reviewed the e-mail notice sent to Ms. [redacted] on May 13, 2017, and have confirmed that this was sent to her inadvertently.  We apologize for any inconvenience Ms. [redacted] may have been caused.   Prior to the bankruptcy status, Ms. [redacted] had utilized the Income Based Repayment (IBR) plan which calculated her monthly payment to $0.00.  Federal regulations require the loan to be split based on the interest subsidy of the loan, while enrolled in the IBR plan.  The loans split into account number [redacted] and [redacted]    When the bankruptcy notification was received, the IBR was removed and the account was combined.  Ms. [redacted] was advised that a signed Repayment Obligation form was required, which ACS received on May 23, 2017.  The monthly payment amount of $1,316.88 was disclosed in the document, and is attached to this response.      If Ms. [redacted] has difficulty making the new monthly installments, she may submit appropriate documentation to renew her Income Based Repayment (IBR) plan.    Should you have any further questions or concerns, please contact our offices Monday through Friday from 8:00 AM to 11:00 PM EST by calling ###-###-####.   Sincerely, Shannon W[redacted]

We are providing you with a detailed response that addresses the customer’s concerns. Conduent Education Services, LLC. (Conduent) serviced one Federal Consolidation Loan account on behalf of Ms. [redacted]’s lender, Nelnet.  Nelnet contracts with Conduent to maintain servicing, repayment and collection activities on their student loans.  While Conduent was the primary contact point for servicing activities, the loan was owned by Nelnet and serviced per Federal regulations. Conduent received a copy of Ms. [redacted]’s loan rehabilitation completion letter on September 25, 2017.  On October 20, 2017, Conduent submitted a request to the National Credit Bureaus to update the status of the account from Claim Paid, to Transferred, and removed the “assigned to government” status. Industry standards allow 30-45 days for the National Credit Bureaus to update their records. All derogatory information reported prior to August 12, 2013, is valid. This information will remain a part of Ms. [redacted]’s credit history regardless of her completion of a loan rehabilitation. Each Credit Reporting Agency must abide by the Fair Credit Reporting Act, which limits how long information stays on Ms. [redacted]’s report with them.  It is their responsibility to remove information as it ages beyond federal requirements. Per Ms. [redacted]’s request, we have mailed a copy of her promissory note, which bears the name [redacted], and her signature, to the address on file.  The information in Ms. [redacted]’s complaint is not legally valid to discharge, settle, close or in any way affect her student loan obligation.  By signing her loan application and promissory note, Ms. [redacted] agreed to the terms set forth in that note by her lender. Regarding the name change process; the name in our records is [redacted].  The name used in Ms. [redacted]’s prior Revdex.com complaint was [redacted].  Because of this difference, we informed Ms. [redacted] of steps she could take in order to have her name updated in our records.  Ms. [redacted] is not required to update her name, the process is optional. Should Ms. [redacted] have any further questions or concerns, we encourage her to contact our Customer Care department at [redacted]. ACS reviewed Ms. [redacted]’s accounts and determined that adjustments were required resulting from her Income Based Repayment (IBR) plan in December 2010, which caused a change to her principal balance as detailed below: 
 
Account [redacted] required a decrease to the principal balance of $2,670.12. Therefore, we have decreased her principal balance by $2,670.12.
Account [redacted] required an increase to the principal balance of $188.52. As this adjustment was not due to anything she did or could have done, ACS has credited her account for the amount of the increase and there is no impact to her principal balance.
 
These adjustments were required to be completed prior to the release of account information to her consolidating lender.  The Loan Verification Certificate (LVC) was completed and returned to the consolidating lender on August 15, 2016.

Hello, I have asked about forbearance or deferment lower payment options in the past.  Every time I ask I am told that this loan does not allow for this.  I have requested the name and the address of the original loan provider and the complete history of the account.  I have asked for the way in which payments are applied and also have not received that information.  I would like to know the complete terms of this loan and why all payment are applied to interest.  Although the loans is being paid most all of the payments are going to interest.  I would like to know why and how can payments be applied to the principal of the loan.  I would like to know the terms of the interest rate and something in writing about how payments are applied.  I would like the complete history of the loan from ACS as to how ACS came into the owner of this loan.   Is ACS the owner or [redacted]?  Is ACS the servicer for [redacted]?  Has ACS always been the servicer?   I would like a copy of the loan terms and/or promissory note.  I am not being fully disclosed the information I am asking I want to know what company originated this loan and when and to whom this loan was then sold.  I would like a complete history of the selling of this loan.  I would like something which tells me the terms of the loan and how the loan payment can be applied. Thank you,
