Mr[redacted] stated that he received the incorrect tickets; this should be noted as inaccurate. Our site is user-driven meaning that all order details are based on what the customer selects or inputs during the checkout process. When Ms[redacted] selected tickets for her event on 10/30 at 1:00 PM and navigated to our checkout page, she was directed to review her itemized order breakdown, which clearly displayed all order details including the time of the event, fees, price per ticket, and the total price in bold text. Ms[redacted] was required to agree to our terms and conditions—visible in a text box—and presented with the message in bold “All sales are final.” At this point, Ms[redacted] was also presented with the message “I agree to the sales terms and conditions listed above,” and a check box that needed to be selected in order to continue with checkout. Our sales policies, including our “all sales are final” policy, are disclosed throughout the purchase process and displayed at checkout with the message “All sales are final. All prices are listed in US Dollars (USD).” This page also states, “All sales are final. There are no refunds, exchanges or cancellations. If the event is postponed, tickets will be honored for the rescheduled date.”
 
Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.
 
Mr. and Ms[redacted] placed their order on 10/22 and immediately received an email summary reiterating the event date and time. Later that day they also received their valid tickets which also stated the event details prior to their event on 10/30. As Mr. and Ms[redacted] received the tickets they selected during the checkout process, we consider this matter closed.

Although Ms. [redacted] states she believed she was purchasing directly from the venue, directly on our website it states, “We are a resale marketplace, not a box office or venue. Ticket prices may exceed face value. This site is not owned by [redacted] Waterfront Pavilion.”Once Ms. [redacted] selected the event they were interested in, a production of Tool, she navigated to the ticket listing page. The top of this page clearly notifies customers, “We are a resale marketplace. Prices may exceed face value. This site is not owned by any venue.” This message is also stated on the top of every page throughout the checkout process. After customers select the ticket listing they desire, they are directed to the checkout page. Here, customers are provided with an order summary that displays the event details, ticket location, and price per ticket. Our customer was prompted to provide an email address and select a delivery method. After a delivery method is selected, since methods vary in price, a new order total is calculated. A complete itemized breakdown of our customer’s order including the price per ticket, all fees, and the total price of $228.79 was displayed in bold text on the left-hand side of the page. Below this order summary, our customers are notified in the Ticket Information portion of our site that, “We are a resale marketplace. We are not a box office or venue. This site is not owned by any venue. Price: Ticket prices may exceed face value.” Customers are then presented with our terms and conditions, including a bold message which clarifies, “All sales are final. All prices are listed in US Dollars (USD).” Ms. [redacted] was required to select a check box signifying her agreement to these terms. Customers are then prompted to select the "Review Order" button below these terms. Once selected, customers are taken to a review page which displayed their payment information, order summary and provided an additional itemized cost breakdown of their order. Our customer then proceeded to select "Confirm & Place Order" at which time their order was processed.In regards to the name printed on your tickets, we would like to provide clarification. Due to the nature of our business on the secondary marketplace, Online City Tickets is not affiliated with any artist or venue and does not own inventory; instead, we act as an intermediary between customers and sellers. The name printed on the ticket is information from the primary purchaser. This information is simply carried over from the primary market allowing the tickets to be completely transferable. Since our customers are purchasing tickets owned and listed by individual resellers, we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry.Ms. [redacted] also mentioned our 100% Money Back Guarantee. This guarantee is clarified throughout the checkout process and ensures that customer’s tickets will be authentic and arrive before the event. As Ms. [redacted] valid tickets were delivered on 3/18/2017 prior to her event, which took place on 5/27/2017, we have fully adhered to this guarantee.Prior to receiving this claim we thoroughly discussed this matter with our customer to address all of their concerns. Online experience is good but with such large surcharges, people would be less upset if they knew what those cost were covering!

Ms. [redacted] stated that she began looking for tickets through our webpage. Throughout our website it states, “We are a resale marketplace, not a box office or venue. Ticket prices may exceed face value. This site is not owned by any venue or box office.” Our contact information is also readily available throughout our site to assist customers with and concerns they may have.
 
On 10/1 Ms. [redacted] contacted the Online City Tickets sales department, regarding which seats were closer given her price range for the Disney on Ice: Follow Your Heart event later that day. Our sales agent provided clarification to Ms. [redacted] that the seats she was viewing in Section 113 Row Q would in fact be closer than seats in Section 113 Row AA. As a secondary marketplace, Online City Tickets is not affiliated with any artist or venue and does not generate tickets as a primary box office; rather, we act as an intermediary between ticket buyers and ticket sellers. Our sales agent clarified to Ms. [redacted] that the price difference in ticket listings was due to the face that sellers set the price based on those individual sellers’ assessments of changing factors such as customer demand. On this call Ms. [redacted] was also notified that tickets may be above face value prior to placing the order.
 
Ms. [redacted] expressed concerns about the name on her tickets. The name on the tickets represents the original purchaser that resold the tickets. This information is carried over when tickets are resold on the secondary market and the tickets are completely transferable. We discussed this with Ms. [redacted] on 10/1 and again after her event on 10/2.
 
Ms. [redacted] stated that all of her tickets would be 100% refundable; this should be noted as inaccurate. Ms. [redacted] is likely referring to our 100% Money Back Guarantee which the sales agent explicitly stated assures customers will receive their valid and authentic tickets prior to their event. This guarantee does not provide customers the opportunity to cancel orders as tickets on our site owned and listed by individual resellers, and we must ensure that our policies are fair to both parties. This means that we are unable to offer refunds and must adhere to an “all sales are final” policy—a standard throughout the industry. This policy was also discussed, and agreed upon, by Ms. [redacted] prior to placing the order.
 
Prior to receiving this complaint we have been in contact with Ms. [redacted] and have addressed her concerns thoroughly. If Ms. [redacted] has any further questions or concerns regarding this or any other order, we welcome them to contact a member of our customer service team. I will never purchase any type of ticket online adter this situation. I thought this site was affiliated with the [redacted], it is not. Its a third party ticket site. I paid triple the price of what ticketmaster was, this site would not refund anything to me when I explained what had happened. I told them they were outragous and really should be ashamed for the price that was charged to me for 3 tickets to the circus.

I received my tickets via email right away. As long as they get me into the theatre on the 18th, I'll say my experience is great!

I think online ticket purchases should mention if the cost of the tickets will be in US funds. This makes quite a difference in the final ticket cost when a Canadian is purchasing tickets. The cost in US funds isn't revealed until the purchase shows on the credit card statement.

It was very east to order! Got tickets next day. Was not told they were barstool sears though.

Process was easy and tickets were delivered in a timely manner.

I chose tickets that are immediately downloadable. I was able to download without issue. Assuming the tickets get me into the event I would rate this as positive and easy. I also used [redacted] in case there were any issues.

I will remain neutral about this service until which time we have attended the event. Overall the transactions were easy. The waiting for the order to confirm was a little unnerving. But so far so good.

Great experience, no hassles. Ticket arrived within 12 hours of placing the order.

On 1/25/2017, they received an email clarifying that their tickets were being shipped and were provided the [redacted] tracking number [redacted] to monitor the delivery process. This tracking number verifies that the package was delivered on 1/27/2017 and signed for. It was not until 3/19/2017 that our customer contacted us stating they had not received tickets. Per the sales terms agreed to at checkout, “We are not responsible for lost, stolen, damaged or destroyed tickets and are under no obligation, and, in many instances, are not able, to replace the tickets.” Nevertheless, as a courtesy, we contacted the seller on this purchase to request a reissue of tickets. This request is done as a courtesy as it is dependent upon the primary issuer of the tickets, with which we have no affiliation. The seller on this purchase later notified us that they would be unable to fulfill this request.As our customer’s valid tickets were delivered, and signed for, prior to their event which has since passed, we have fully adhered to our sales terms and consider this matter closed. This site is not owned by any venue.”In regards to Ms. [redacted]'s statement that her tickets were priced above their primary-market, or "face," value, it should be noted that this is a common occurrence on the secondary market. This is because all tickets sold on the secondary market are owned and listed for sale by individual ticket sellers, who price their tickets based on a range of factors, including customer demand. All prices on our website are set by individual sellers, not by Online City Tickets. Prior to choosing tickets, Ms. [redacted] was made aware of the fact that her tickets may be above face value several times throughout the checkout process, with the message, "Prices may exceed face value." Ms. [redacted] was presented with an interactive map of the venue, displaying all available seating. At that point, Ms. [redacted] selected the tickets she wanted to buy. After choosing those tickets, she was taken to our checkout page. From there, she was directed to review the itemized order breakdown, which clearly displayed the ticket location, price per ticket, all fees, and the total price in bold text. There was also an information box under the order summary box which repeated the following message: "We are a resale marketplace. We are not a box office or venue. This site is not owned by any venue." Ms. [redacted] was required to agree to our terms and conditions—visible in a text box below this order total—and presented with the bold-text message “All sales are final.” At this point, Ms. [redacted] was also presented with the message “I agree to the sales terms and conditions above,” and checked the box to signify her agreement with this statement. During this process, Ms. [redacted] saw an even more in-depth order summary that displayed the quantity, location, and prices of her tickets, delivery and service fees, and the total charge. Additionally, at the time of checkout, Ms. [redacted] was again shown the specific seating location she had selected: Section 16, Row KK. Should Ms. [redacted] have needed any clarification at the time, she could have reached out to one of our sales agents to provide clarity as to the exact location of these particular seats.Online City Tickets has fully adhered to the sales terms and conditions that Ms. [redacted] agreed to prior to completing her purchase. Ms. [redacted] received the valid, authentic tickets that she selected and was able to attend the event using the tickets she chose. Verified by this tracking information, our customer’s tickets were attempted to be delivered on 5/31/2017 though the package was refused by the receiver. We later received a dispute from our customer’s financial institution. We addressed this, and the dispute was ultimately ruled in our favor. We then attempted to re-deliver our customer’s valid tickets on 6/8/2017. Verified by tracking number [redacted], the package was again refused by the receiver.In terms of tickets being available before the tickets on the primary market were released to the general public, we would like to clarify. Tickets on the secondary market often become available to purchase prior to the primary market due to a number of possibilities; for instance, sellers may be season ticket holders or subscribers. Arrangements parties may have with box offices, venues, promoters, artists, or teams allow them to know in advance where they will acquire tickets.Prior to receiving this claim we thoroughly discussed this matter with our customer to address all of their concerns via telephone and email.
