March 8, 2016At this time the deal for the vehicle purchase with MsB*** and MrLaboy has been cancelled as we were unable to obtain financing with a lender.Our advertised prices do not include tax, title, license fees, documentation fees, and dealer additions. These are all specified in a disclaimer with the advertisementAdditionally, a customer may not qualify for all of the rebates that are advertised and available.In reviewing the paperwork there was a $2,rebate applied to the cost of the vehicle.I have placed MsB*** on the dealership do not call list

pril 25, 2016We are in receipt of the second response submitted by MrArmstrong with your office.A review of the calls made between MrArmstrong and Jerimiah Duncan indicate that agreed cost of the vehicle was to be $6,544. The vehicle was listed at $6,MrArmstrong on the phone call wanted to negotiate the price of the vehicle down by $The desk manager indicated that he would split the difference to $450.00, which was accepted by MrArmstrongAdditionally, MrArmstrong was given a quote of $1, for tax, title, license, and documentation fees. For your reference, details of the offer I reviewed appear below.That information is not correct*** told me that the deal for the *** did not get approved(after I had the car for weeks and told me I had to bring it back to pick out a used car) and he said I had to pick a $or $13k car with $down and this was already approvedI DID NOT ask to look for a new car I was instructed I had to since they couldnt get the first loan doneI picked the Nissan *** when I got to the dealership and *** told me that I needed said to make the deal work I needed $down because the bank was charging them a $fee to buy the deal and this was the only way to make it work and I agreed to thatHe told ***(the sales person) and me that if I could do the $down then we had a deal and we shook on it and I thought that was itThen for whatever reason they sent me to the tent sale and I was then told that I needed $3k down but I told them I didnt understand how the 100% approval could change in minutesNobody had any answers and nobody could explain why thjngs changed so swiftlyEveryone conveniently didnt know anything about itI've filed a complaint with the secretary of state, Revdex.com, contacted van tuyl group directly, and filled out a complaint with the cfpbI would not go through all of that trouble if I felt the dealership did nothing wrong or there was merely a misunderstandingThey blatantly lied to me on several occasions and they need to be accountable for their actions and stop misleading customers.Regards*** ***

I have personally deleted his record out of our system.The changes I made to remove his phone number were overwritten and the warning not to call the customer were ignored. January 26, 2015Thank you for the opportunity to respond to the complaint submitted by *** ***.Pinnacle Nissan has been trying since the end of December to return *** ***'s vehicle back. *** *** can contact *** ***, Pinnacle Nissan Controller at ***, or at
*** and arrange with him to pick up his vehicle.As for the items that were in the vehicle at the time of repossession, *** *** will have to contact *** *** *** directly.*** *** did sign a "conditional delivery agreement" which states that until financing is obtained and approved the buyer is responsible for all payments that come due on the trade vehicle. Our position from out first correspondence to your office and that of the Arizona Attorney General has not changed. The documentation that was sent indicates that Mr*** was given a copy of the of the Carfax report, and acknowledged so by signing the "used vehicle Carfax disclosure statement"If you review the "delivery confirmation form against the used vehicle Carfax disclosure" you will see the signatures are the samePinnacle Nissan did not intentionally lie or mislead him in the vehicle purchaseThe dealership did not make any repairs to the vehicle or paint the vehicleThe Carfax report details that there was no structural damage to the vehicle, nor were any airbags deployed.We are unable to go back and review the tape of the financial transaction to determine the disclosures that were made or not madeThese videos are only kept for a day period, and Mr*** purchased his vehicle in May, 2016.Please review the complete Used Vehicle Carfax Disclosure that was signed by Mr***, specifically the paragraph which states: By signing this disclosure, I/We accept the vehicle in its present condition with regard to its current body, paint, and mechanical conditionI/we agree to release and hold harmless Dealer from any claims for mechanical problems, prior damage, and prior repairs, whether mechanical or paint and body or any other claim based on the history or condition of the Vehicle

This issue is not resolved, however here are the requested itemsThere are receipts enclosed, two of which are from Discount Tire (two tires per receipt) and one of
which is *** (having gone to them for another alignment for vibration and drifting, the same issue I complained about to Service on many occasions since I the first week of owning this vehicle).Total amount of these items $

The resolution provided only references the sales department, which was not the main problem As I said in my complaint, most of the calls are from customer service I need confirmation that they also will not be calling As I typed this, I just received a phone call from Pinnacle Nissan, I will not answer and collect information, this is not my issue to work on I also do not accept a resolution that just says "email me instead of BB" for complaints from here on out The whole point is that they aren't listening in the first place Here is a screen shot of the call I just received

Nissan company did not mention anything about the fraudulent advertisement on the prices of their vehicles, the rebates that were not given to me nor a reason as to why, they also did not mention I was approved through my own lending company, before I even took position of the car and had all our documentation with us. Your sales people and financial people lied to us over and over again. I still receive phone calls from your company, after asking serveral times not to be contacted.

 We are in receipt of the rebuttal submitted by [redacted]. Our position on reimbursing [redacted] for two months of payment due on the [redacted] has not changed.  [redacted] had and used our vehicle for 52days. During this time 5,595 miles were added to the vehicle. [redacted] made no payments for 52 days.  In essence, [redacted] drove our vehicle for free for those 52 days.  Please find attached a copy of the “Retail Buyers” order which clearly states Pinnacle Nissan has the option of charging$.30 a mile or $20.00 a day whichever is greater.  Pinnacle Nissan has the right to charge [redacted] $1,678.50 for the use of the 2014 [redacted] (52 days), as well asthe $325.00 for the recovery of the vehicle, we have not pursued these charges with [redacted]. Attached as well is a copy of the “conditional delivery agreement” which states that [redacted] is taking the vehicle prior to funding being obtained. Please note the paragraph which states [redacted] is responsible for all payments that are due or come due prior to financing being obtained.  Both of these documents are signed by [redacted] indicating he understood the terms of the agreements/contracts being signed. [redacted] did contact [redacted] regarding his latepayments, and at no time did he contact Pinnacle Nissan to find out why the [redacted] had not been paid off.As stated on the Retail Installment Contract [redacted]’s first payment on the 2014 [redacted] was due on January 13, 2015.  [redacted] made no inquiries tothe dealership in regards to where the payment should be made.Our Finance Office made numerous calls to [redacted], these calls would not be available for the Sales Staff to review.  Pinnacle Nissan made attempts toretrieve the vehicle prior to issuing an order to have the vehicle repossessed.
