We are in receipt of the 2nd response from Ms. [redacted] regarding the money she believes is due her.Ms. [redacted] claims that when the vehicle was purchased she was unaware of the charges for the “dealer adds”, of paint protection, door guards, window tint, and nitrogen kit. The vehicle was purchased in March 2016 and Ms. [redacted] filed her first complaint with the Attorney General’s office June 28, 2016.  Our response was sent back indicating that we were willing to refund the entire amount for the “dealer adds”, upon signing the Release Agreement.This Release Agreement is a standard form that is used for any customer when a formal complaint is filed with the Attorney General’s office or the Revdex.com. Ms. [redacted] has had nearly a year to voice her feelings about Pinnacle Nissan to her family, friends, as well as the use of social media.Our position since the first complaint was filed has not changed. We are more than willing to refund the amount of $1,614.00 when the Release Agreement is signed and returned to Pinnacle Nissan. We do not feel that asking for a signature on this document to be unfair or unjust.

Ms. [redacted] was asked to sign a settlement/release agreement.  This is company policy when a formal complaint has been filed and there is a monetary exchange in order to resolve the complaint. Ms. [redacted] has refused to sign the document, therefore no money has been paid out.  We believe we have made a reasonable attempt to resolve her issue.  I have attached a copy of the Release agreement, should the customer decide to sign.  Upon receiving the signed document, a check will be sent to the customer.  Please allow 7-10 business days for the check to be processed. purchase states the following:Selling price of the vehicle:          $22,995.00Dealer added accessories:           $  2,189.00  ( Window tint, door guards, Zaktek application, nitrogen fill)Cash price with accessories:        $25,184.00On the Retail Installment Contract, under Itemization of amount
financed line 1A shows the cash price of $25,184.00.  With the $7,500 trade allowance, $10,000 cash
down, the amount financed was $9,982.38.Of that amount Ms. [redacted] will pay $1,299.12 in finance
charges.  Both of these documents were
signed by Ms. [redacted] indicating that she was aware and approved the cash
price of the vehicle.  We are unable to
determine where an extra amount of $2,800.00 was added to her price.Also enclosed is the “we-owe” form indicating that additional work was
to be added to the vehicle. Please note that the document states the customer
is responsible for contacting the service department and making an appointment
to have the work completed. We regret that Ms. [redacted] is unhappy with the
installation of aftermarket products in her vehicle. These features were added
to the vehicle at no cost to the customer and was not included in the price of
the vehicle.In Arizona there is no “cooling off” period, a customer can’t decide to
return a vehicle just because they changed their mind or can no longer make the
payments.We regret that Ms. [redacted] is unhappy with her experience at Pinnacle

I have reviewed the response made by the business in reference to complaint ID[redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
On Saturday, January 24, 2015, I did appear at Pinnacle Nissan, in which it took their management staff 3 hours before they decided to return the [redacted] to me.  However, their Assistant Sales Manager that spoke to me stated that their computer does not show any records of the dealership attempting any type of contact with me regarding returning the vehicle to Pinnacle.  This lack of proper communication has escalated this into a larger matter than it needed to be.  As far as the items, I am not waiving Pinnacle Nissan's responsibility for these items as they were the initiating and contracting party to request [redacted] to repossess the [redacted].  These items have been reported stolen.  Pinnacle refuses to accept the responsibility for their contractor, and their negligence in communicating with me.  I further will not waive their responsibility for payment of the past due amounts owed to [redacted].
