Complaint: [redacted]
I am rejecting this response because:  In the letter of validation that was sent to the company on November 17, 2014 via certified letter it stated at the bottom that ALL correspondence was to be done via mail to the address listed.  Even on the phone we stated that we asked to be contacted only by mail.  The company listed multiple times that they called after this time that they contacted me in regards to this collection.  I did receive a bill and letter from the collection agency but it did not have all the information requested.  Below is a list of the items requested under the Texas Finance Code Section 392.202 and in parenthesis states which items were received and which were not. The name and address of the original creditor ([redacted]Physicians – Received)       The original date of default or non-payment of the debt withoriginal creditor (Received)         The date the debt was transferred from the original creditor tothe third party debt collector (Not received)The original balance (Received). The current balance (received)Any fees added by your agency. Sec. 392.303 (a)(2) (Not Received)Texas Surety bond information as required by Sec. 392.101(NOT received)As a debt collector you failed to respond completely to my debt validation request with ALL of the requested information, then Financial Control Services has essentially admitted, per Texas Finance Code 392.202(b)(2), that the debt in question is inaccurate. Also during this debt validation process the debt collector was supposed to cease any collection efforts and I requested that all correspondence be via mail and the collection agency continued to call in an attempt to collect the debt.  Attached is a copy of the original letter I sent to you certified stating that information. We wanted complete validation under the Texas Finance Code 392 before we could make an informed decision.  The company did not comply with this request that are under my rights as a consumer in the State of Texas.  I request that the report be removed from the credit bureaus until a full debt validation can be completed and we can confirm with the original creditor and the insurance company the validity of the debt.

We spoke with consumer on 12/30/13, made him aware accounts were placed for collection.  He requested a statement, it was emailed to him.  We tried to contact him three times after the email.  He never let us know he did not receive the statement.  He called from his credit...

report, wanted accounts deleted from the report, told him no, they would be updated as a paid account, he said fine and paid the bill in full.  The credit bureaus will be made aware of the change when we drop our file to them the end of the month.  Our calls are recorded so everything said can be verified.[redacted]

CONSUMER IS CORRECT WE DID REFUSE TO PROVIDE AN ITEMIZE STATEMENT. REASON IS WE ARE NOT LICENSE IN HIS STATE, WE SHOULD HAVE NOTIFIED OUR CLIENT THAT THE CONSUMER WAS REQUESTING THIS INFORMATION BUT IN THE MEANTIME THE ACCOUNT WAS CANCELLED FROM OUR OFFICE PER CLIENTS' REQUEST.  THE...

ACCOUNT IS NOW NO LONGER IN OUR OFFICE AND IT HAS NOT GONE ON HIS CREDIT REPORT.

I HAVE CHECKED WITH ALL 3 CREDIT BUREAUS AND THE ACCOUNTS FOR $558.00 ARE SHOWING ON CBR.  I WILL DO DELETION FOR BOTH ACCOUNTS ON E-OSCAR AND SEND LETTER TO CONSUMER AND PROVIED AUD NUMBERS.

I have checked with all 3 credit bureaus and per Transunion and Experian the accounts have been deleted.   Equifax is the only one that was not showing the accounts on the CBR as deleted. I have done another E-0scar deletion to Equifax to have them deleted. I will be sending letter and...

providing AUD#.

Please be advised that we have contacted our client in an effort to provide you with verification you requested.  However our client has been unable to provide us validation in a timely manner. Therefore we have ceased collection of this account.  I will be do a deletion for you on E-Oscar...

and will be sending you a letter today.

We did at one point have issues with our web-site. Did make over the phone payments on December and January. Made a web payment on March 7, 2017. We have had the account since 1/12/16. Patient was aware of the account since then.  We offered her to do post dated monthly...

payments several times and refused and did not start making payments until August 2016.  We cannot dismiss the charges or delete.

The itemize statement shows payments and the balance after payments that was provided to the consumer. The insurance can provide him EOB if it is requested for him to review.

Our office has verified the balance we are collecting is accurate. I have sent itemize statements from our office.  As a patient and as the insured it is your responsibility to follow up with your insurance and verify the EOB and proper billing.  Our healthcare provider bills insurance as a courtesy but it does not absolve the consumer from his responsibility as a patient to review his EOB's and billing statements. We are more than willing to reinvestigate this matter however the consumer has not provided us with a specific reason for disputing the debt.  Currently we have responded to his requests for validation and we are not required to provide him with the additional information he is request.

I am rejecting this response because:I have called the Original Creditor Bryan
Emergency Physicians and performed my due diligence in investigating this
issue, and they have no records of me whatsoever. I believe this debt to either
be a mistake that is not mine or to be fraudulent. I have no knowledge of any
of these companies and never have.Again I don't need proof of simple itemized account summary or a signature
for validation from
the collection agency as validation. I need the a certified copy of the
original contract, full accounting from origination to present, copies of
cancelled checks proving late dates, etc. I am questioning the validity of something I was never informed of
before appearing on my credit report that is now negatively affecting my credit.
According to the FCRA, Financial Control Services must provide complete and accurate
information to the credit reporting agencies or delete it.

CONSUMER DID CALL OUR OFFICE WANTING PROOF OF THE BILLS SAID HE WAS TRAVELING WANTED TO COMMUNICATE BY E-MAIL.  HE FAILED TO PROVIDE AN E-MAIL ADDRESS THIS IS WHY THE ITEMIZE STATEMENTS WERE NOT SENT TO HIM WHEN HE REQUESTED THEM ON 10-12-15. THEN HE SENT A FAX INCLUDING HIS E-MAIL ADDRESS ON...

12-16-15.  I RESPONDED TO HIS REQUEST AND PROVIDED HIM AN ITEMIZE STATEMENT FOR BOTH ACCOUNTS ON 12-23-15 AND THIS WAS E-MAILED TO HIM. THE ITEMIZE STATEMENTS PROVIDED DOS, PROCEDURES, DIAGNOSIS, DR NAME, TOTAL AMOUNT OF THE BILL AND ALSO INCLUDED INSURANCE PAYMENT AND THE AMOUNT OWED AFTER INSURANCE.

I have sent Mr. Offineer a letter today regarding the 4 accounts.

I have confirmed with our client consumers DOB and she was a minor at that time of services.  I will do deletion on e-Oscar and send letter to consumer.

Validation has been sent to consumer along with a letter on 12-10-15.

I have a copy of the original letter from the patient, it does not say anywhere cease and desist.  It says please address all correspondence regarding this opportunity to: and gives his name.He is not disputing the debt, he requested validation,  we provided that for him.

The only reason we ask the consumer for her information to make sure we are talking to the correct person.  We cannot disclose any information unless we know we are speaking to the correct person and she refused to provide us any information. I will do a deletion on E-Oscar send...

a letter providing an AUD# this will confirm the deletion has been done.

Complaint: [redacted]
I am rejecting this response because:First of all, I never received debt collector's response to my request for validation.  There is no evidence supporting their claim.  Furthermore, any documentation or information presented at this time comes too little to late as collection agency has already violated Texas Finance Code Section 392.202.  I have made every effort to resolve this matter outside of presenting my case before a courtroom jury.  I am respectfully requesting removal of the invalidated item.

This is an ER visit that did not have any insurance information for the consumer.  We do not bill or contact insurance companies for payment as we are only a collection agency.  It is up to the consumer that received the bills from providers to follow up with the facility that...

provided the services to make sure they have insurance information to bill.
