of this year. The client has placed the amount of $3,561.00 and assures us that this amount is correct and owed by the borrower.
The RMS representative has requested an itemized accounting of the debt and will mail that to the borrower upon receipt. The address we have on file is [redacted] Drive Apt [redacted] XXXXX.
The RMS representative did ask for verifiable information to forward to our client. The borrower stated that she filed a grievance with the school 2 years ago but has heard nothing about it since. Without any other information and the client assuring us that the debt is valid we must fulfill our contractual obligations with [redacted] and attempt to collect the amount owed. We will not contact Ms. [redacted] again until we provide the itemized statement to her.

university.Our Debt Counselor [redacted] contacted the consumer on 10/19/15 in reference to this debt and asked that the balance be paid in full as the whole balance was due and outstanding. After speaking with the consumer it became clear that the consumer had the resources to pay the account balance. [redacted] took payments totaling $[redacted] that have been applied to the consumer's balance. [redacted]lso set up payments to be debited at a later date to continue the payments until the balance was paid in full.The consumer called back on 10/23/15 and asked that the remaining payments be deleted as the consumer would be unable to abide by the previous agreement. RMS-Recovery Management Services, Inc. has honored the consumer's request and deleted the remaining payments. At this time no payments are scheduled to be debited from the consumer. The outstanding balance of the consumer's account is currently $[redacted].[redacted] can contact me directly at [redacted] to discuss his account. University to secure recovery of Mr. [redacted]'s defaulted [redacted] loan. Please note that RMS does not own the debt the client [redacted] University does. Mr. [redacted]'s account was placed for collections with RMS on [redacted] XX XXXX and RMS had no involvement with Mr. [redacted]'s loan before that date. Also important to note is that RMS is not allowed to report [redacted] loans to the credit bureau's that is handled by the client. RMS does not have the ability to offer a settlement to Mr. [redacted] as this is a Federal defaulted [redacted] loan and all of the fees associated with this loan are stipulated in the promissory note which we have already provided to Mr. [redacted]. RMS would be happy to work with Mr. [redacted] to resolve this outstanding loan.

Their response is in direct contrast to the answers giving by [redacted] Account Manager for RMS. She informed me RMS had had the loan for "Quite some time" and that they were not allowed to report the defaulted loan at the request of [redacted]

We are no longer willing to respond to Mr. [redacted]'s false accusations. His concerns have been addressed in a letter sent to Mr. [redacted] by [redacted] University. The letter refutes each and every one of Mr. [redacted]'s allegations and refers to Federal Regulations that uphold the amount being pursued. I have requested authorization from [redacted] University to send the account to an attorney with instructions to pursue this matter through the courts. If received I intend to send the account to an attorney to take such action. If Mr. [redacted] is unable to pay the balance in full in accordance with the contract he signed we are more than willing to negotiate an equitable payment plan for the balance owed. He may call me personally should he wish to do so.

Hello, As I stated in my earlier response we did send a letter showing the balance of the consumer's account every month. The consumer just recently asked for an Itemized breakdown of the account. An Internal account breakdown was sent to the consumer on September 12, 2017. I asked [redacted] to send a breakdown but they no longer hold the consumer's loan as they have sold their loan portfolio to [redacted]. I will attempt to contact [redacted] and ask them to send an Itemized statement but they are not our client. The consumer can certainly contact [redacted] and request both the promissory note that she signed and an itemized statment of her account.

Hello, We have sent letters stating the consumer's balance each and every month since November of 2014. As the consumer has asked for a complete breakdown we have asked [redacted] to provide that. Every payment that has been received has been credited to Ms. [redacted] account and forwarded to [redacted]. We have been informed that Ms. [redacted] account will soon be recalled from our company and placed with a new servicer.

I am rejecting this response because:  this communication has become ridiculous and has solved nothing.   If you go back to my previous communication it was about the lack of providing appropriate accounting information to me including a running balance statement each and every month including any additional fees that were added in.    I find it very difficult to understand that collection agencies do not have to provide TRANSPARENT information to consumers on an ongoing basis.   All that I seem to get is look at the promissory note....that was issued 11 years ago in 2006 and yes, I have looked at it. This has nothing to do with me requesting an accounting for the additional fees in a current, understandable format.    The statement you sent I would have no way of telling me what was going on. NOW, all of a sudden, you’re transferring me to a new servicer.  How convenient.....when you can’t provide requested info my bill goes to someone else?  Is this new company going to add on their additional fees? I have received no written communication about this from either company (Natiomal Education Servicing or Recovery Management Services.     I thought that your company was going to ask for a statement from [redacted] to give to me?    Are there no laws that require busi[redacted]ses to provide what, when, and why were are receiving charges???   There must be consumer protection laws to prohibit these behaviors.

On 12/29/2015 we sent an itemized accounting of the consumer's debt to her. The debt is being as disputed to the credit bureaus. consumer was advised that this debt would be reported to the credit bureaus unless the account was paid in full prior to the scheduled reporting date.RMS-Recovery Management Services, Inc. is contractually obligated to report collection accounts for Long Island University if the debt has not been paid in full after the debt has been placed with us for 60 days. A payment plan would not have altered this contractual obligation. Since our initial contact with the consumer no payments have been made on this debt. RMS-Recovery Management Services, Inc. has requested proof of the consumer's debt with our client and will be mailing an itemized accounting of the consumer's debt to her this week.

I am rejecting this response because:
 
When I spoke with the representative "Adam" I was informed that I had to pay the amount in full and that I perhaps consider taking a loan in which to do so.  A payment plan option was not given to me.  I then asked if the debt had been reported to the bureaus and was given a date of September 11, 2015, that the debt would be reported.  RMS submitted the debt in August 2015.
The email from Mr. [redacted] supports partially what was communicated between myself and the representative I called on July 28th.  Adam was the second rep I spoke with, because the initial man I was talking with, was as what seems to be consistently trained to be curt and intimidating.  My goal then and still remains to be a fair plan of action.  I contacted RMS in good faith with food intention...the debt is righteous, I was a student at LIU, however RMS did not have good intentions
Once I implored the service of Park View Legal (this was AFTER learing that the RMS reported the debt in August and not September as I was informed) and disputes were made, it was only then that a payment plan was given.
I also received a harrassing call from RMS after this complaint was filed. 
 
This IS my debt (though I'm disputing $50 of the total amount for "Dining Dollars" NEVER used!) and I'm steadfast in paying it.  RMS lacked integrity in my initiating conversation with them and per the email from Mr, [redacted].
