The basket that was sent by the seller is open on the side where it attaches to the back of the seat and needs to be attached to a metal plate with boltsThe damaged basket is not open and attaches directly to the back of the seatIf the dealer was a qualified dealer, he would know that the manufacture used two different types of rear basketsThe basket that was shipped can not be used without the section that is attached to the seat so that the basket can be bolted to this pieceIf the dealer would check the web sites of the other dealers, he could see the pictures of the two types of rear baskets used by the manufacture

that cannot be considered false advertising by any standard because we are selling a specific charger for a specific scooter. A customer can contact us to verify if it works for a different scooter if they do not have the X-500 scooter but this customer never did that, so to accuse us of false advertising is not only wrong but deceptive. We authorized a return for the customer but as already explained to the customer we do not refund the original shipping and processing fees incurred and the customer is responsible for the return cost. If the customer would have liked to exchange for a charger that works for him then we would have considered other alternatives like shipping the other charger without paying additional shipping.

The company has failed to document that the scooter purchased from them is new or has a three year factory warranty. The broken weld on the basket lid was documented by your repairman when he assembled that part on the scooter. Your response to my compliant is unacceptable. You have refused to replace or  offer an adjustment for the broken weld on the basket lid. Your failure to produce documentation that this scooter is new and not re-manufactured reflects poorly on your company.  I have been very reasonable in giving you the time to resolve all of my concerns. I did not buy an as in scooter with no warranty.

When a customer requests for a return we do grand that as requested and if a customer requests for an exchange, we do the same but we do not believe you even made the attempt to exchange the charger.  As you stated, "I ordered it hoping it was the right one". It is not okay to turn around and place the blame on the seller simply because you happened to have ordered the wrong charger. The picture however small it is shows the features of the charger and a customer who knows what they are looking for can easily see it is a round plug as opposed to a triangular plug.If you are still looking for the triangular plug, here is a link to a 48 volt charger that we sell [redacted]

This would not resolve my compliant because the company used deceptive advertising in selling me this scooter, and tried to cover it up by changing their ad after  I complained to them.                                     �...   1. I am disabled and can not assemble this scooter.  2. I requested written instructions from the factory in installing the parts that were not assembled.  3. Did not receive a registration card for this scooter so that it can be registered with the manufacture to validate the warranty.  4. I need to pay someone to assemble and inspect this scooter to insure that it is safe to ride and that the required assembly will not void the manufacture's warranty.  5. The company has not made any effort to resolve this compliant. The company has used deceptive practices and  can not be trusted in dealing with seniors.  
6. This company is an authorized factory dealer for this EW36 Mobility Scooter

The response does not address the following issues: 1. No instructions have been provided by the company for assembling this scooter as it was delivered. 2. There was no registration instructions/card to insure that this Scooter will be warranted by the factory. 3. Will the person the company uses to complete the assembly of parts, certify that this scooter is safe to ride? 4. After the scheduled assembly is made by your person, I want the company to assume any liability for his work.

A replacement basket has been shipped out to you

I did ask him if he had a charger with the right connecting end. He said no. Furthermore there was not a full description of the charger he sells so I ordered it hoping it was the right one, because another one that also was 48v was out of stock. He is lying about I never tried to exchange for another charger.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  I would like to state the following facts with regards to my complaint with this dealer.1. He ran a deceptive ad when advertizing this Scooter has being shipped fully assembled, inspected and ride ready. This was not the case and I informed him that his ad borders on fraud.2. When I asked for help initially to get the Scooter assembled, he stated that no one else that purchased this Scooter didn't have any problems putting it together. The only instructions that were provided stated that the mirrors had to be attached.3. When I asked for a $400.00 credit to have a qualified person to assemble and check out the scooter, he refused.4. After I filed a formal complain, he contacted someone in this area to assemble the Scooter.5. The defect on the lid of the Scooter's basket is a broken weld that prevents the catch to fully engage when closed on the basket. The dealer was well aware of the problem, but refused to do anything about it. 6. I was never asked by the dealer to send this basket back. In fact when he sent me the wrong basket that can not be used without additional hardware, I offered to ship it back, if he would provide a prepaid shipping label. 7. I have never received proof that this Scooter is new or covered with the Manufactures warranty. The date stamp on the Scooter only goes up to 2010, which would make this Scooter 5 years old and void any manufactures warranty. 8. I can back up my facts with the copies of the e-mails that were exchanged between the dealer and myself. The facts stated in your response charging me with fraud are not only untrue but  an attack on my character.  9. In your response, you confirm that the basket has a minor defect. This minor defect prevents the lid from catching and can not be fixed since it has a broken weld.10.A rear wire basket replacement for for scooter is listed $44.95 plus shipping and $20.00 to have it installed[redacted]

Attached again is the basket that is installed on the scooter, it is a very clear picture and there is no evidence to show any defect on the basket. if the customer could provide the evidence to support his allegations it would be easy for him to prove his allegation. What we cannot understand is why this customer has disputed the payment for the scooter based on an allegation that he has not provided evidence for.

As previously promised to Mr. [redacted], we contracted Mr. [redacted] a technician from Amp'd electric who after making an appointment with Mr. [redacted] went  to his house today to install the items that had not been installed on the scooter during shipping. Mr. [redacted] has send us the pictures of the scooter as attached which is know completely assembled as per Mr. [redacted] request.

You have not addressed my concerns with regard to warranties and continue to make up excuses. I asked you for documentation from the manufacture. I guess 4 year old batteries are not part of the scooter, or the wheelie bars or the basket. I have documented the items that I have previously complained about. I also have documentation from qualified scooter dealers that will back up my claims. I feel that the manner you advertised your scooter was deceptive and judging by your actions to date you can not be trusted. You know the lid of basket was broken near the latch. Your man sent you a picture. The picture you that you posted did not show the lid where it latches on to the basket. Now you state this is an accessory not covered by the scooter warranty which is not true. I do not trust this company as it takes advantage of seniors, selling mobility scooters that have to be assembled or backs up the manufactures warranty. If you want to close out this complaint, I will accept a reasonable credit card credit to cover the warranty issues and the damage to the basket lid. If you decide you not accept my offer, I will be filing complaints with the appropriate governmental departments responsible for internet sales and protecting seniors.

in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me.  It is so sad that it takes this kind of action in order to get a company to respond to it's consumers.

This customer has completely refused to provide any evidence of  the defect that he alleges is on the basket by taking a picture and attaching it here.  When he made that allegation we asked the technician who installed the basket and he said there was no defect on the basket. We then asked him to send the basket back to us for repair or replacement and he refused to do that. since we did not want the basket issue to drag on, we decided to ship to him a replacement basket that he has refused to use.  If it where true that there is a functional defect on the basket, it would not have been possible to attach the basket on the scooter as seen on the attached picture. If there is a defect that is merely cosmetic, we do not understand why he would dispute $1899.00 he paid which is the value of the entire scooter while it would probably cost less than $20.00 to replace or repair the basket. The actions of this customer border on fraud and we will do whatever is necessary to prove that.

That  this scooter is new and not a factory second. 2. Date of manufacture and warranty verification. 3. Written instructions on assembling the basket to the back of the seat.My original request of $400.00 was not for the replacement of the basket, but was to have the scooter assembled and made ride ready as stated in your original ad. That was the amount that I was quoted to have a qualified technician from an authorized dealer to come to my house to assemble and make this scooter ride ready.  You hired a electrician's helper to assemble the scooter and he spent almost an hour attaching the basket to the scooter.You have finally acknowledged that the basket had a minor defect that would only cost $20.00 to fix. If this is a new scooter the basket should be replaced. Please tell me what is a reasonable amount to pay someone to removed the existing basket, pack it up and pay the postage to send it back to you. And then there cost to ship another basket to me and pay someone to assemble it on the back of the seat. The cost of a replacement basket with shipping would be approximately $60.00 and the cost to remove the old one and install the new one would be approximately $50.00. I  think this would be a fair amount to resolve the issue concerning my complaint with the basket. As I previously mention that I purchased this scooter to be fully assembled because of my disability, and I would have to pay someone to remove and install any replacement basket. A labor charge of $50.00 is not an excessive amount for removing and installing a basket.  Since I purchased the scooter from you, I am not dealing with a third party. You are the dealer that I purchased this scooter from,  and I expect you live up to your responsibilities.[redacted] G. [redacted]
