Seneca Mortgage Servicing has further reviewed this matter and stands by its initial findings and response.  [redacted] Mortgage Company, LLC, originated this mortgage in August 2015, which in turn resulted in the first mortgage payment being due October 1, 2015.  Bank  South Mortgage, as the originator - paid 2014 taxes as part of the new loan closing process, resulting in the next installment being due and payable as of October 2015. SMS acquired the servicing of this mortgage loan from [redacted] Mortgage Company, LLC in January 2016.  The servicing was later transferred to [redacted] Mortgage as of 09/2016, prior to the City, State and county tax due-dates.  [redacted] in turn remitted the required 2015 tax payments, which resulted in an escrow shortage.  [redacted]’s review and findings mirror those of Seneca Mortgage as the issue is the direct result of [redacted] Mortgage Company’s origination data/processing - which the mortgagor herself references in her comments (“This was an investment property so homestead did not apply…”).   As it stands today, [redacted] has worked diligently with the mortgagor to address the escrow shortage and has offered a positive solution whereby the escrow shortage would be spread over 99 months.  We encourage the mortgagor to continue working with [redacted] in regard to this matter and if deemed warranted, further contact [redacted] Mortgage Company in regard to any origination related questions or concerns.

I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.Seneca's responses added that they could not continue to investigate without "more information," presumably with respect to the missing payment.  I received a called this afternoon from Seneca and the check (dated 31Mar) had officially been located.  I would like to know if the payment had been on Seneca's premises on or around the 31Mar date, or if there was an issue with the courier.  If this had been received in a reasonable time, I call into question Seneca's accounts receivable functions especially since they are managing huge sums of money.  I would also like to know why BoA needs to send mailed checks instead of electing for an electronic transfer, which, in theory, would have avoided this problem.

My experience with Seneca gave me an impression of a small time agency that does not know how to run their business and involved in unethical behavior. The mortgage payment checks were send directly from US Tier1 Bank using US Mail Postal services, so this constitute a shipping contract.  I am not surprise that Seneca is using the tactics of "lost checks in mail" on other customer to defraud others of bogus late fees, but in my case all checks are accounted for as they are send directly from the bank.  I am concerned about Seneca claims of the balance on the account because it might be the case of "lost checks in mail" all over again. While I would not expect  Seneca to admit wrong doing of their actions, the next  time Seneca attempts to defraud me of any fund, such matters will be handled in court. I am prepared to handle the case viciously in court and seek full compensation including punitive damages.

2014. During thisanalysis the monthly collection of $262.94 for the Private Mortgage Insurance (PMI) was inadvertentlyremoved from the payment, lowering the monthly payment effective March 1, 2014 from $1,912.12 to$1,623.08. Even though the funds were no longer being collected for in the monthly payment, thepremiums were still being paid to the PMI carrier on his behalf.When the loan was transferred to Seneca Mortgage Servicing LLC on 12/1/14, the error was discovered.As the account did not meet the qualifications to have PMI removed, we resumed the monthlycollection. With the PMI added back in, an escrow analysis was completed on February 6, 2015. Thisanalysis showed a shortage of $4,053.64 due to the PMI collection error with the prior servicer. I feel my response rejecting Seneca's escrow audit findings and review on their customer service model were explicit. Here's a summary:Seneca's escrow analysis was wrong as the amount I owe is near $1,300.  My complaints around their customer servicing is their IVR and inability for a customer to speak with a representative.  Email with them is worse as no response.  Should you get to a live body, the information conflicts.  Simple stuff like:  why is my escrow increasing, what is my new payment, when is it do, does Seneca draft automatically from my account.  With such poor customer support, I feel the security of my home asset is in jeopardy.  This company feels very miss managed.  I encourage you to pool your customer complaints about Seneca.  You'll see a strong pattern of miss management.  It would be horrific if this company goes under and home owners lose their homes.
