Revdex.com Case No: [redacted] – [redacted]

Account # [redacted]

Complaint Summary:

Mr. [redacted] states Sperian

Energy enrolled his account without authorization and charged him $152.41. He

states that his utility [redacted] Power advised him he must pay this amount or

his service would be disconnected. He states Sperian Energy received $610.84

from him without his approval and he would like the money back.

Sperian Energy Response:

On October 21, 2015, Mrs.

[redacted] completed a valid Third Party Verification (TPV).

Mrs. [redacted]’s

enrollment was processed on November 4, 2015 after the [redacted]’s had been

sent the Sperian Energy welcome letter explaining the rate and terms and

conditions of the agreed upon contract. Service commenced with Sperian Energy

on November 4, 2015.

Sperian Energy has no

record of Mr. or Mrs. [redacted] contacting Sperian Energy regarding their bill

until January 20, 2016. Mr. [redacted] requested his account be cancelled and

his service return to [redacted] Power. The cancellation was completed and the

utility also processed the cancellation on January 20, 2016. Mr. [redacted]’s

service was with Sperian Energy from November 4, 2015 to January 20, 2016 and

the total amount of electricity consumed by Mr. [redacted] was 4700 kWh which

totaled $334.14 in Energy Supply Charges.

Sperian Energy did not

charge Mr. [redacted] and his account was validly billed at the agreed upon

rate. No refunds are warranted and Sperian Energy suggests Mr. [redacted] speak

to [redacted] Power regarding the amount of his bill.

It is Sperian Energy’s

goal to maintain an exceptional level of customer service and we regret anything that may have been considered unsatisfactory.

Should Mr. [redacted] have any additional questions,

Sperian Energy will gladly address any further concerns.

Response:

Good afternoon,

Review: The last two months the charge that Sperian Energy has charged me on my electric bill were $0.09200 per KWH and $0.10300 per KWH. I am on on month to month variable so I understand that it changes from month to month. However, every few weeks for the last couple of months I have checked their variable price for my area with my utility and at no time have they listed their prices this high on their website. Currently, 1-28-15 they are listing their price at $0.07350 per KWH. which is much less than what they actually charged me. I called Sperian's customer service today and told the lady that I thought my bill might be a mistake and she tried to explain to me that it is because of the monthly variable rate. When I told her that the Sperian website is listing the variable for my area with my utility at $0.07350 currently, she said that this was not the price last month. When I explained to her that I have been checking their advertised prices online for the last couple of months and at no time was it listed even close to what I was chargedshe said that she didn't know why it was advertised like that. She then proceeded to explain to me that if I wanted the advertised price that I would have to sign a fixed, committed rate plan which this plan is also advertised less online than what she wanted to offer me. I turned down the offer and told her that I would be switching company's because almost every other company offers a better rate. This company is falsely advertising their online prices or falsely charging my account.Desired Settlement: The only way I will accept the outcome as satisfactory is if they refund me the difference of the advertised price vs what I was actually charged and they correctly advertise the price online.

Business

Response:

This is in response to a complaint filed by Mr. [redacted] J

[redacted], Revdex.com Complaint ID # [redacted]. Mr.

[redacted]’s complaint is that the variable prices posted for Sperian Energy online

do not match the variable prices we were charging him on his monthly

invoice. The rates that Sperian Energy

post online are the current sales prices for consumers interested in enrolling

with Sperian Energy. When Mr. [redacted]

joined Sperian in April 2014, the variable price we were offering new customers

at that time was $0.0545/kWh. He

received that price for 2 months and then continued to be served on a

month-to-month rollover variable rate.

Our month-to-month variable rate for existing customers is based on

market conditions and our actual cost of energy.

When Mr. [redacted]

contacted our customer service department on 01/28/2015 to question the variable

rates, we offered him a 3-month fixed rate and 12-month fixed rate to allow him

budget certainty and knowing what his rates would be for future months. He was not interested in locking in a fixed

rate and asked to be returned back to ComEd’s default rate. We submitted the switch request and Mr. [redacted]

will drop with Sperian Energy on 2/23/2015.

Sperian Energy left a message for Mr. [redacted] today and

explained that there is no refund due on his account as he was invoiced the

same market based rates as all other customers in our existing portfolio that

have similar account attributes to his. [redacted]

Review: A representative of Sperian Energy called without identifying herself, and said that I should have received a letter from Con Edison that required a response. She said that Con Edison was lowering my electricity rate and needed my current information such as account number and address. It was only after I provided this information that I realized that this person represented an alternative energy supplier (Sperian). The representative gave the false impression that Con Edison was lowering my rate, but in fact she was guiding me to switch my electricity supplier. The problem is three-fold: (1) my number is on the Federal no-call list, and yet I received this sales call, (2) the representative did not identify herself until midway through the conversation, and initially led me to believe she was affiliated with Con Edison and that Con Edison was lowering the electricity rate, and (3) she breached my privacy by acquiring my Con Edison account number and current address.Desired Settlement: Stop contacting me (I am on the Federal no-call list), stop the aggressive and deceptive marketing, and erase my information (Con Edison account number and current address) from your database. I would also like a formal apology.

Response:

Ms. [redacted],

This is in response to Ms. [redacted]’s complaint, ID-[redacted]. We apologize that Ms. [redacted] was telephoned by a sales representative, who is employed by one of our outsourced telemarketing firms.

I telephoned Ms. [redacted] and apologized for the negative experience she had with Sperian Energy.

The sales representative who telephoned Ms. [redacted] is a new employee and unfortunately veered off of Sperian’s approved sales script. Our outsourced telemarketing firm has given this sales representative a warning and she is going through retraining. I will also be monitoring her performance for the next two weeks to ensure that she is adhering to the approved sales script.

We have very strict policies in place to ensure that customers who are on the Federal Do Not Call registries are not solicited. I can assure you that Ms. [redacted]’s telephone number was not on any approved soliciting calling list and has been placed on our internal DNC list. Ms. [redacted] will not be contacted by Sperian Energy again.

Again, we are very sorry for the inconvenience caused to Ms. [redacted].

Thank you,

Compliance & QC Manager

I received a phone call two days in a row from a sales representative whom indicated that their records showed I have an active account with the local utility provider. My electric utility is included in my rent, which my landlord pays for. When I told the representative this, she asked for my landlord's contact information. I asked the representative whom her company was three times over the course of the phone call, and she eventually told me it was Sperian. They did not get my number from the local utility because I do not have an account with them. When I told them this and asked again where they got my number, she would not answer. My phone number is on the do not call list, which I feel that this company is ignoring.

This company contacted me through outbound telemarketing in violation of the federal Do Not Call act. Additionally, the message intentionally misleading, indicating that I had some business relationship with them and I need to call about my account.

Review: I signed up with Sperian Energy Corp in order to save money on my electric bill. I asked them about the 7 cents kilowatt hour if it was fixed they said, no its not fixed but I do not need to worry about it going up because they stay competitive. Well a few months later my bill increased from $150 to $270. I examined my bill and sure enough the kilowatt hour increased to 13 cents kilowatt hour from 7cents. I called them to cancel and went back with [redacted] which was 8 cents kilowatt hour. A month later they are still on my bill. I cant seem to get them off. I called [redacted] and they said they cant do anything sometimes they stay on for 3 months before they cancel. I feel that this is unfair business practice and I also feel that they lied to me about staying competitive . My electric bill is now doubled for this winter.Desired Settlement: I feel that they owe me money. I would be happy with anything you can return to me.

Review: On 1/28/15 at about 1:45 ET, I received a phone call from 713-574-8408. The phoner identified as a representative of Sperian Energy, and requested that I change electric suppliers. My phone number has been registered with the National Do-Not-Call Registry for many years, and this company disregarded the tenants of the DNCR by calling me with a sales call. This is an illegal, and so by extension, unethical business practice.Desired Settlement: An apology and a statement from Sperian promising not to call any phone numbers outside the strictures of the National Do-Not-Call Registry.

This is in response to Mr. Mark [redacted]'s complaint received on 01/28/2015. Mr. [redacted] was contacted on 01/28/2015 by one of our outsourced telemarketing firms. Mr. [redacted]'s telephone number is confirmed to be on the National Do Not Call registry. It is unfortunate, and our mistake, that he was included in the campaign and contacted by our vendor. We have recently updated our Do Not Call lists and improved our internal processes to ensure that Sperian Energy vendors are not contacting customers that have requested to not be contacted. I have also contacted Mr. [redacted] personally to apologize for any inconvenience. I provided my direct contact information also so he may contact me in the future (as well as the Revdex.com) in the event that he receives any calls from Sperian Energy. Please let me know if any further information is needed or if this complaint can be closed.[redacted]Sperian EnergyO: 702.757.2690F: 702.974.1528

Review: Sperian Energy has contacted our house at least eight times trying to get us to change our electric provider to their company. We have told them each time that we do not want to switch and to please remove us from their call list. They continue to call us, including two times just this past week. The representatives become rude when asked to remove us and to not call again. Additionally, one representative told me that I was required to change to them, a fact that I know is not true.Desired Settlement: We would like for them to stop contacting us. Additionally, I would like their representatives to not falsely tell customers that they are required to change to a new provider.

Business

Response:

This is a response to a complaint filed by Ms. [redacted], Revdex.com Complaint ID [redacted]. I contacted Ms. [redacted] this afternoon and left a message with a female in the household with my personal contact information for any follow up questions or concerns. I have placed Ms. [redacted]'s telephone number on all DNC lists, and have requested that her telephone number be removed from any outbound campaigns. Ms. [redacted] should not receive any additional solicitations over the phone from Sperian Energy in the future.

Review: Sperian Energy contacted me via my home phone. The woman on the line insisted that I had received information about Sperian and that I was running out of time. I needed to consent to Sperian Energy via this phone call in order for my electric bills to be significantly lower. When I asked if she was asking me to change providers , she stated that this was not a change. (lie) She was rather insistent and argumentative saying that nothing would change except my bill. (lie) When pressed, she stated that They work with my provider to cut my energy costs by eliminating excessive billing charges, but I needed to assent today. (lie) I asked why my provider wasn't telling me about this deal if they were working together and she stated that I should have received countless information in the mail for months, and that this was a last chance courtesy call. I asked for a web address regarding this company and deal and she gave it to me and then proceeded to try to call me back in an hour. I asked her for a number to call when I was ready and she didn't even have one. She did provide me with a number eventually which turned out to be a sales number that did not work without a sales account code. This company told three lies in an effort to scam me out of changing my energy provider. They used a false sense of urgency and lies to try to commit me to something I knew nothing about. They did not offer much in the way of information, and what they did offer was not only vague, but in most cases, flat out lies.

Even if this company could lower my monthly electric costs, I would not change simply from this horrible experience and these deceitful tactics.Desired Settlement: I fear for the older population that are unable to use the internet to search for these companies and learn for themselves what they are really doing. I know that there are truth in advertising/ marketing laws - and these folks should be sued or put out of business.

Response:

We apologize that Mr. [redacted] was mistakenly telephoned by one of our outsourced telemarketing firms, Alliance Marketing. We have very strict policies in place to ensure that customers who are on the National and Pennsylvania Do Not Call registry are not solicited. Unfortunately, we were informed after the fact that there was a system error that occurred with our outsourced telemarketing firm resulting in his number being dialed. I can assure you that Mr. [redacted]’s telephone number was not on any approved soliciting calling list and is on our internal DNC list. He will not be contacted by Sperian Energy again.

Review: I was contacted by someone who never identified themselves as a representative of Sperian Energy Co. They implied that they represented the Duke Energy Co. and wanted to lower my rate. I currently have FirstEnergy as a supplier and was told that would not change, only my rate will change, when in fact I would be switched from FirstEnergy to Sperian. The rep knew of this and never advised me that I might be charged fees for switching. All I understood was Duke Energy was rewarding me for being a GOOD customer. Sperian is soliciting Duke Energy customers under false pretensions. They are not being clear about what they really are trying to do and that is to SWITCH the unsuspecting customer to Sperian Energy without fully understanding what is taking place.Desired Settlement: No settlement required. I want them to clearly state up front that they are an Energy supplier and want to switch them to their company. Also let the customer know that it might cost them fees .

Response:

Ms. [redacted], It was a pleasure to speak with you today. I apologize again for the bad experience you had when one of our outsourced telemarketing firms telephoned your residence. We understand your frustration when you are interrupted daily by so many phone calls from various electric suppliers. As we discussed, please accept this written confirmation that I have placed your telephone number on our internal DNC list and had instructed our outsourced telemarketing firms to do the same. I also want to reassure you that I have spoken with my Sales Manager who has assured me that he has instructed our outsourced telemarketing firms to do a better job in educating consumers on energy deregulation so that the consumer fully understands the benefits of switching to an Alternative Electric Provider. Again, I am sorry for what happened. Kindest regards,

Review: *My Con Ed bill of 7/15 showed an exorbitant charge of $ 157.76 for 'Customer Service,' in addition to a supply cost of $ 28.77.

*7/18 ~ I phoned Sperian and spoke with [redacted] who said this was a mistake [service charge of 4.93 was er[redacted]iouely charged for each day of the month, instead of only once. [redacted] said they sent me a letter re. this on 7/14/14 [No letter as of 7/29/14] [redacted] further said there would be credit given of $ 152.83 on my bill and that Con Ed was informed of this overcharge

*7/18 ~ spoke with Con Ed who knew nothing of this and said I would have to pay the entire bill, which is now due on 8/8/14; a late charge would be $ 3.88.

*7/21 ~ [redacted] of Sperian said they would cut me a check and send within 24 to 48 hrs. for $ 152.83, so I could simply pay the total bill with this overage. {no check received yet, as of 7/29/14

*7/ 29/14 ~ spoke with [redacted] again who reiterated that a letter had been sent, but that supposedly they were no longer sending out checks. The customers affected by this error numbered in the thousands.

[redacted]. said he woule have [redacted], his supervisor in the CS office: Las Vegas ~ phone me re. sending a copy of the letter by eMail. [redacted] was also requesting that Amy in the San Diego Compliance office phone me re. cutting the check and sending to me..Desired Settlement: Receipt of check for $ 152.83 ASAP, so payment to Con Ed ~ who doesn't want to 'know' about this error (only wants full payment) ~ may be made by the due date of August 8, 2014.

Response:

Ms. [redacted],

This is in response to a complaint filed by Ms. [redacted] ID of [redacted]. Ms. [redacted] was originally enrolled by one of our outsourced telemarketing firms via Third Party Verification(TPV) on 5/14/2014.

I telephoned Ms. [redacted] and apologized for the negative experience she had with Sperian Energy. I assured her that her ConEd electric account was dropped from our service. Her end date is on 9/03/2014 and she will not incur any penalty fees. I informed Ms. [redacted] that we are reimbursing her $152.83. I explained to her that unfortunately ConEdison was only supposed to bill her our monthly Energy Service Fee once at $4.93, however they had billed her every day at $4.93 x 32(her billing cycle) for a total of $157.76.

Ms. [redacted] was very satisfied that we are sending her a refund check for $152.83 and that she was dropped from our service.

Please let me know if any additional information is needed or if this complaint can be closed.

Response:

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution would be satisfactory to me. I will wait for the business to perform this action and, if it does, will consider this complaint resolved.

PS: I was told I should receive the check for $ 152.83 by yesterday [8/7 or today, 8/8] and so far it is not here. Also, I have yet to receive the letter explaining this error that was supposedly sent on July 14. Things are promised, but not fulfilled.

I request that this matter remain open until fully rectified, and in this regard, I will stay in touch with the Revdex.com of San Diego until all is completed.

Thank you for your attention and assistance.

Review: We have been getting calls from Sperian for MONTHS. We have told them we are not interested multiple times no matter what discounts they offer. The final straw was when we had representatives ACTUALLY SHOWING UP AT OUR DOOR. We keep saying no over and over. I have even emailed the company demanding that they stop contacting us and filed the number under the National Do Not Call Registry. They did not contact us for a few months, but today, we were called by [redacted] at 4:26 PM EST. I hung up the phone on him and he called back TWICE.

I have filed a complaint through the Revdex.com and will pursue legal action if we keep being harassed by the company.Desired Settlement: Simply stop contacting us by phone, email, mail, and door-to-door. We want literally nothing to do with your company. Not even a courtesy phone call.

Good morning,

This is in response to a complaint filed by [redacted], ID [redacted]. We apologize that Mr. [redacted] had a negative experience with Sperian Energy. I have placed his telephone number on our DNC list and our Do Not Knock List. I can assure you that Mr. [redacted] will not receive any more solicitations from Sperian Energy.

Again, we are sorry for any inconvenience caused to Mr. [redacted] and his family.

Thank you,

Sperian called my home and talked to my wife and lied to her about the superior rate they would provide. My wife said she would talk to me about it. I said no and my wife called Sperian back to let them know. They however without permission, and nothing in writing switched our account and immediately switched to a higher cost per month costing me over $100/month in extra charges.

Review: First, I was contacted by phone by Sperian Energy and I am on the national "Do Not Call" list since December 2014 so I would like to know why I was called? The person calling identified himself as "[redacted]" and told me that my current energy supplier FirstEnergy Solutions Corp was going out of business and that I needed to change per the many letters that I received in the mail. I do get an occasional letter from my electric company and figured I had missed some fine print. Unfortunately, upon checking later, I never got these letters since they were never sent and this was an outright lie. He further told me that I needed to change to Sperian who was an energy supplier in PA and they were acting to replace my current supplier and emphasizing my current supplier was not going to supply electricity any more which again was a lie. Also, if I did change I could even save money on my electric bill. Well that was also a lie since the numbers per KW he was using were not the correct values. Finally if I didn't like the agreement I had 3 days to cancel, which I would like to do since I don't like the lies and marketing tactics that were used. The business practices and marketing that were used are not acceptable and the reason for my complaint and to alert other consumers about Sperian's unethical practices.

Business

Response:

This is a response to a complaint filed by Mr. [redacted], Revdex.com ID # [redacted]. Sperian Energy provided a direct response back to Mr. [redacted] on 02/25/2015 in an attempt to address his concerns/claims of lies and misrepresentation. Additionally, I provided Mr. [redacted] my direct contact information and offered to play back the sales call for him if he'd like to hear the interaction. Upon our internal review and investigation, there were no lies or incorrect savings quoted to Mr. [redacted]. The response also provided some public documentation on MetEd's rate filings of rate changes that will go into effect 3/1/2015 as the sales rep indicated. He has not yet contacted Sperian back, but can do so at a time that's convenient for him. I wanted to provide a response back to the Revdex.com to update the complaint that a response has been initiated.

This company called me and represented themselves as West Penn Power. Only when I pressed him asking if he was from West Penn Power did he admit he was from Sperian Energy. He immediately asked me to find a copy of my West Penn Power Bill, and then I knew it was a "Bait and Switch" tactic and told him to never call my house again. I am also on the National Do not call List, so this company is breaking the law. They are pushey and misrepresent themselves.

Review: While speaking to a representative from Sperian Energy, I was informed that I would get the contract information in the mail within 3 days, and that at that time I could accept or decline the companies offer for electricity rates. Needless to say we never got that information in the mail, nor did we have the chance to decline the offer. I believe his name may have been [redacted] or [redacted].Desired Settlement: We wish to be returned to our Electric supplier without any charges to us for this action to take place.

Business

Response:

This is in response to a complaint filed by [redacted] Revdex.com Case ID [redacted]. I have personally contacted the customer and we have resolved the issue. Per the request in the complaint, Sperian Energy has returned

the electric account back to the default utility. There are not any fees or penalties as a result of this request.
