Sundance talks about striving both verbally and in writing to communicate all information in a manner that is easy to understand, however, in actuality their delivery of information is a rapid fire presentation that dupes senior citizens into signing documents and forms that are push before them in at breakneck speed. For instances the Consumer Disclosure Form is given to you and reviewed at warp speed. At no time during or after the form was signed did they make it clear in layman's term that I could not get my money back if I cancelled at a later date. Upon questioning by me the representative stated then that I could cancelled if I was not happy with the packageIn reference to the call initiated to Sundance on October 6th, I did not agree to have them keep any funds associated with services I did not use (please review the phone call). A review of the letter that was also sent will show that I requested and demanded that Sundance return the full total of my $1,300.00. I also stated that as a fiduciary responsibility the company contract should have consideration for both parities and not just a written document that suits only the sellerSundance has a legal responsible to myself to return funds not used or for services not rendered.
In addition, the respondent referenced a promotional gift (cruise) that was free, however, at no time during the presentation did they say cruise it was a airline flight to Montego Bay, JamaicaIn closing I would like to say that no company should be able to bind a person to a one-sided illegal agreement. If a person chooses to cancel the agreement prior to using any of the services where is the justification or argument in keeping the fundsThe mere fact that you wrote a contract that favors you does not make it legal or binding when no consideration is given to the buyer*** ***

February 17, 2016Thank you for your letter dated February 8, regarding a complaint that was filed by *** ***After receiving your letter a manager from our Customer Service department contacted *** ***During the course of a conversation on February 5, we attempted to
discuss his complaint with *** ***Unfortunately *** *** informed us that he was not willing to discuss anything with us, including the complaint that he filed through your officeHe demanded that the only communications he would have with us would be via email, and hung up on us.In reference to the details of his complaint to your office, we see that it is chiefly about our denying him what he thinks is his right to rescissionWe feel that this is a complete misrepresentation of both the facts of the Pennsylvania Consumer Protection Laws and the efforts our sales staff makes to ensure that all details are disclosedThe fact of the matter is not that *** ***’s right to rescission was revoked, but that it never existed in the first place, in part because he entered into this Agreement in our permanent place of business and not in his residence or over the telephoneThis is also information that is well covered in the Vacation Program Agreement entered into by *** ***Please note the section of the Agreement referenced below, as well as the pertinent section of the Consumer Disclosure Acknowledgment which shows *** ***’s initials in the “Yes” column(I have also attached these documents for your reference)As discussed earlier, *** *** refused to discuss this matter with us, and as a result we were not able to offer a resolution to this complaintI remain confident that if given the opportunity we could resolve *** ***’s concernsIf *** *** would like to discuss his complaint and become an active participant in its resolution I would encourage him to contact our Customer Service department at his earliest convenience.We trust this resolves the complaint and ask to be notified if it is not considered resolvedShould you have any questions regarding this or any other matter, please do not hesitate to contact this office at ###-###-####Sincerely,

There are two refund checks for this account totaling $1,457.01,
one in the amount of $representing the down payment and one in the
amount of $1,representing the total monthly paymentsIf for any reason
we are asked to reissue new refund checks they will be in the same format (two
checks), but the amounts will be less the stop payment fees ($each) for
the original refund checks (reissued amounts would be $and $1,127.01)The
checks reissued at the lesser amounts would be sent to the customer and your
office would be provided with copies.

($1,673.68) was incorrectly noted on the original Confidential Termination,
Release and Refund AgreementThe error was found on our end when the signed
document was returned to our officeAt that time we explained the error to the

full amount that was paid on the account, which is $1,The difference
($216.67) represents the errorOn 5/12/the customer’s account was revised
to a smaller package, and during that transaction we incorrectly credited the
customer’s account twice for a portion of the interest paid (totaling $216.67)

dated 5/12/in the amount of $that represents the amount in question
This is the interest amount that we incorrectly credited twiceIt is not an
amount that was paid by the customerThe total amount paid by the customer is

system generated letter that holds the original letter generation dateAs a
result all Confidential Termination, Release and Refund Agreement’s for this
account will always reflect the original generation date regardless of when you
generate the letterIn this particular scenario the original Confidential
Termination, Release and Refund Agreement was generated on 12/14/After the
error regarding the refund amount was identified a Confidential Termination,
Release and Refund Agreement with the correct refund amount of $1,was
generated correctly reflecting a date of 12/14/in the date fields
