you for your letter dated May 29, 2015 regarding a complaint that was filed by [redacted]. After receiving your letter I reviewed [redacted]’ account and found
that she spoke with a representative from our customer service department on May
14, 2015. During the conversation [redacted] explained her disappointment with
regard to the reservation process that is utilized for her vacation program and
the properties that are available for use within it. We advised [redacted] that
although there has been no breach of contract on the seller’s part, in the
interest of customer service we would cancel her account upon the receipt of an
executed Confidential Termination, Release and Refund Agreement. That same day
we sent [redacted] her Confidential Termination, Release and Refund Agreement. The
executed document was received in our office on May 19, 2015 and we immediately
finalized the cancellation of [redacted]’ account. We also submitted a refund
request, which [redacted] can expect to receive within 10 to 14 business days.

Attached please find our response to this complaint.  FeThank you for your letter dated May 12, 2016 regarding [redacted]. I was sorry to hear that Ms. [redacted] felt that the details of her Vacation Program Agreement were not adequately...

disclosed. It is never our intention to mislead clients, but rather one of our main priorities to ensure that all information is fully disclosed prior to any purchase taking place. We strive to communicate, both verbally and in writing, all information in a manner that is easy to understand. Upon reviewing her complaint to your office, the primary concern that Ms. [redacted] seems to have with her Vacation Program is that she feels that she was misinformed regarding her ability to cancel. We feel that this is a complete misrepresentation of both the facts of the Pennsylvania Consumer Protection Laws and the efforts our sales staff makes to ensure that all details are disclosed. The fact of the matter is not that Ms. [redacted]’s right to rescission was revoked, but that it never existed in the first place, in part because she entered into this Agreement in our permanent place of business, and not in her residence or over the telephone. This is also information that is well covered in the Vacation Program Agreement entered into by Ms. [redacted], and I have included copies of the pertinent pages for your reference. Please note section 11 of the Agreement, as well as question 18 of the Consumer Disclosure Acknowledgment which shows Ms. [redacted]’s intials in the “Yes” column when asked if she understood that the Agreement was not subject to any right of rescission. Upon receiving the letter from your office, a manager from our Customer Service department contacted Ms. [redacted] to see what could be done to rectify the situation. Our records indicate that on May 14, 2016 we agreed that in the spirit of providing exemplary customer service we would honor Ms. [redacted]’s request and cancel her Vacation Program, in spite of the fact that there was no right of rescission associated with it. Ms. [redacted] signed and returned our standard Termination Agreement to us, and we are in the process of providing her with a full refund of all monies paid. We trust this resolves Ms. [redacted]’s complaint, and we ask that you notify us if it is not resolved. dated February 5, 2016 regarding a complaint that was filed by [redacted]. A manager from our customer service department contacted [redacted] to discuss her complaint. [redacted] explained that the current cost of her vacation program was causing her a financial hardship. In an effort to resolve [redacted]’s complaint we offered to revise her vacation program to a paid-in-full status, which would give her 4 weeks of vacation at a cost of $779.24. [redacted] accepted our offer and her account was adjusted accordingly. As a result of this change [redacted] has been released of the remaining balance on her account.

service department was able to speak with Mr. [redacted] regarding this complaint.
Mr. [redacted] reiterated the concerns that are noted within this complaint,
focusing on the location and quality of the properties that are accessible for
use through his vacation program. We advised Mr. [redacted] that although there
has been no breach of contract on the seller’s part, in the interest of
customer service we would cancel his account upon the receipt of an executed
Confidential Termination, Release and Refund Agreement. That same day we sent Mr.
[redacted] his Confidential Termination, Release and Refund Agreement.
On
March 3, 2015 we received the executed document in our office and immediately finalized
the cancellation of Mr. [redacted]’s account. We will finalize Mr. [redacted]’s
refund on March 5, 2015, which he can then expect to receive within 10-14
business days.

I am trying to cancel the entire contract. I have offered them $1500.00 to cancel the entire contract.
The salesman and I talked about Hawaii, once you log on to there website they have TWO (2) vacations spots in all the islands of Hawaii.
In Florida they have 2o places, no so bad. In the Southwest part of the USA it (which includes 11 States) they have 12 total properties. In the Midwest which includes 12 States, they have 8 properties.
I feel the properties were not introduced properly at the presentation, and I feel my offer is fare...because that what I have saved for a real Vacation to Hawaii.Regards,[redacted]

Pending acceptance: I'm waiting on the refund. A verbal agreement works the same as a written one. They told me I could cancel. So they need to change their policy. This place really is a scam.

Thank you for your letter dated September 8, 2014 regarding a complaint that was filed by [redacted]. I was sorry to hear of the confusion regarding our call attempts to [redacted]. We obtained this specific phone number from an entry form for our giveaway that was completed by **. [redacted] (I’ve enclosed a copy for your records). **. [redacted] provided his signature thereby giving his consent to our contacting him in regard to the services that we offer. As a result, our marketing division made several call attempts to contact **. [redacted].
 
After receiving your letter I researched our database and found that effective September 8, 2014 we placed [redacted] on our internal Do-Not-Call list. As a result of our taking this action, no additional calls were made to **. [redacted] and none will be made.

We apologized for her experience and offered to act as a personal liaison between [redacted] and [redacted] ([redacted]) for her reservation request. We were able to book [redacted] a unit located in [redacted] Florida for the week of March 27, 2015. We also offered to revise the terms of [redacted]’s obligation to a paid-in-full status (for 33 weeks of vacation at a cost of $7,500.00). [redacted] accepted our offer and we adjusted her account accordingly.

I am rejecting this response because the company spoke with [redacted] several times prior to the 14th and were less than helpful in explaining their position and address concerns.  When [redacted]'s husband attempted to resolve the issue he was met with resistance and beuracracy.  Since English is [redacted]'s second language, she now feels threatened and that the company is trying to extort more money after not receiving communication for almost 8 years. This company has been less than forthcoming  in the original contract and has been aggressive in recent interactions.

My husband was called and told he won a "free vacation" we were all excited and picked out our spot, then we were told we had to pay $200 for taxes, once we paid that $200 we waited and waited to hear a response about when we would be going on our vacation only to find out that we needed to pay ANOTHER $200 for me, the woman on the phone actually said "yes I hear a lot of people say they weren't informed of the fees" so we are now $400 deep into the vacation plus money for our passports, then we get to the airport which we didn't pick only to find out we had to pay to check our bags at the airline that, again, we didn't even pick. Then they didn't have transportation from the airport to our hotel, and the hotel was absolutely awful. I am highly dissatisfied in this "vacation" and would never, ever recommend this place to anyone.
