We disagree with all statements made by this client with the exception of the fact that yes our crew damaged their shed
Their invoice was adjusted to compensate for

We have submitted a complaint with the Ministry of Consumer Services where Davey Tree Co.will be investigated for possible violation of the Consumer Protection Actin regards to "Misrepresentation"
As previously stated in an e-mail addressed on December 13, to the Vice President and General Manager,we offered to pay half of the total bill which will be forwarded today, January 22,
Their website misrepresents details in regards to stating the company is fully insured and yet they continually refused to accommodate our request to have an adjuster assess and estimate damage to our shed sustained by a tree that was hastily taken down
Their website also offers integrity, commitment and respect in a professional and ethical manner which was not our experience from beginning to current day
We have withheld posting reviews on the internet but will escalate complaint not only to make the company accountable but to save potential customers from the unpleasant occurence we are enduring

We disagree with the statement noted by Ms B*** that there was "Misrepresentation " on the part of Davey TreeThere were delays in the work being completed but there is no indication on the contract stating that the work must be completed in day or that they have a day care business operating out of their home
We disagree with comments made about our employee acting unprofessionally "jumping from the hood of the truck onto the shredder" The shredder is hooked up to the back of the truck, not the frontYes, we had an employee that was illThis is a safety sensitive job in which employees must be in healthy shape to work safelyUnfortunately, by leaving the jobsite, we had to shut the job done for safety reasons as we do not permit employees to work alone
Unfortunately, during the removal of one of the trees, a piece of wood rolled and damaged the shedThis incident was not out of hast but simply an error of judgement
We have made several attempts to schedule at day to meet and resolve all issues (at their convenience) in which they declined via emailAttempts were made to send a contractor to access and repair the damage to the shed and that the cost would be covered by Davey TreeB*** noted they would contact someone to repair the shedDavey Tree reminded them that we would cover the cost of the repair and that we are not against the fact they would like it fixed on their termsThere was no further response from B***
Davey Tree is fully insured and will cover their clients of damages that may occur during the operation of the task hired to perform(Property damage)
The written contract which B*** has agreed to hire Davey Tree has stated warranty and disclaimers on the back copy (they have a copy)

We originally set this contract with Mrs P[redacted]. DM previously tried to speak to clients husband. We try to follow up with her and leave messages on her machine. We have explained that the pricing on the proposal was calculated one way for one...

service because she specifically asked for it to be broken down that way and the other item just had a total because she did not ask for any breakdown. All prices were included in the text of both items and the client specifically
checked off the boxes for both items and signed the contract. I tried to call the client but there was no answer and I left a message again explaining all of the above and that payment in full is expected.

Please look at the proposal like a regular consumer would. it is VERY misleading!!! The columns are not even. If the $480 was for the tree only, you should have never put it in the TOTAL column, because there was other work on the contract, also. I NEVER asked for anything to be broken down in any certain way! I also never asked for the tree removal to be listed separately! I don't know where you are getting your information from. Someone is not telling the truth. The gentleman arrived at my house and went around the house pointing out trees that needed work, and then told me he would send me a proposal. That was it. I NEVER asked for anything to be broken down a certain way. I never had tree work done before! If you put $480 in the total column, then the total of work is $480. This contract was VERY misleading, I am so disappointed with this company, I am 52 years old, I have never had a problem like this before, I have never filed a complaint like this before. I am very upset, I showed this contract to a relative who told me it was very confusing and misleading. Your own company corporate office has seen the proposal and concurred with me that the proposal did not look right to them and was in error. Also, you say the tree was listed separate because I did not ask for a breakdown on the tree???? How can you break down a tree removal? Yes, the tree should have been listed separately, just like everything else was. The error was in putting the tree removal in the total column, making it appear as if the total work was $480. PLEASE LOOK AT THE PROPOSAL LIKE A REGULAR LAY-PERSON. IT IS VERY CONFUSING. THERE IS A MISTAKE. THE TREE REMOVAL SHOULD HAVE BEEN LISTED AS A SEPARATE ITEM, LIKE EVERYTHING ELSE WAS. THE ERROR WAS IN LISTING THE $480 IN THE TOTAL COLUMN. THE TOTAL COLUMN SHOULD HAVE BEEN LEFT EMPTY.

We have left several messages trying to resolve issue, client specifically asked for one of the two items to be broken down individually and the second item just a total.
Mrs checked both boxes for work and signed the contract.

I am rejecting this response because:
The statements made are not true.  The police asked me to allow them to continue using my driveway for access to finish my neighbor's work and I kindly allowed it.  I was not directing them on how to do their work as being a professional engineer, I know better than do that. I  simply noted that what they already did did not work. I will accept the settlement of half fee,  but the other half has to be considered compensation for the damaged plants and they should clean up the mess they left behind. Including cutting the damaged  limb.  Thanks

This incident was reported to Safety on 2/2/16 and the adjuster has been speaking and working with the claimant. The car was to have been dropped off for repairs to be completed on 2/22/16.

The replacements were dying plants and no one followed up after they were planted to see if they were acceptable and they are not healthy plants.
