Ms [redacted] is no longer a resident hereShe moved out on January We found out that her child’s father ws living with her as an unauthorized guestNone of her complaints are valid, especially claiming no heatThere is no way would management allow anyone with no heat in these cold conditionsI tried to send my maintenance tech over when she claimed this, but no one would allow my maintenance tech inLike stated, she moved out January and even up to that point we were unable to get inWhen we did the move out inspection, we found a huge hole in the wall under the breaker box, drywall was caved in, carpet was very dirty, but no issue was found with the heatShe made complaint based on her late rent payments consistently happeningI met with her and tried to make payment arrangementsI tried working with herHer and her significant other hit the roof when they saw the legal fee, I told her the legal fee comes off if she could become current with her paymentsShe was an irate tenantThe majority of her complaints are unfoundedShe hindered management from doing our jobShe called me last week about what she was charged for the findings of the move out inspectionI explained to her the condition she left the place in, she then told me never mind her lawyer will reach out to me

Management is willing to amicably resolve the allegations in this complaint by allowing [redacted] to terminate her lease early with no re-let fees or penalties Such offer does not constitute nor should it be treated as an admission of liability, which is expressly denied It is being made merely to amicably resolve disputed claims

Complaint: [redacted] I am rejecting this response because: Placing changes on my door while I am not HOME and taking my car without a warning sticker is not listed in my lease agreement I was NEVER notified by mail and taking my car without notice is not listed in my lease agreement My car was following ALL of the parking rules listed in the Lease agreement Not whatever this new un notified unsigned not initialed they think they gave me I signed and initialed my lease agreementIf official changes to the lease agreement is to be made I should have been informed officially not unofficially leaving flyers on my door while I am gone all day at work & schoolI will be following up this complaint in civil court as soon as I am able Regards, [redacted]

We did not put a sign up when a car was parked on the handicap spotWe had a resident that had requested a handicap sign put up in that particular spotThe resident that requested the handicap sign brought in the proper paper work so that we can put up the signWhich was done on Wednesday, December 3rd before our owner visitThe resident which made the complaint has been having a dispute with my assistant manager and has been putting review after review on apartment ratings as well as now reporting us to the Revdex.comWe are here to take care of our residentsI have been managing years and have been thru seminars to get educated and update us with the dos and don’ts especially about the handicapI spoke to her husband and was able to get their car back with no problemsHe apologized for her behavior and said thank you

Complaint: [redacted] I am rejecting this response because: I spoke to the managers of The Villages at Riverside and was told that Lynd was the management company that was responsible for paying out all outstanding balancesBeyond that you absolutely should have my records and lease information on file because I leased from your company from August to July In accordance with Texas Property Code I should have received notice within days of the end of lease of deductions and a remaining security deposit balanceWere you not the managers of the property as of July 27th 2014? As the manager at the time of lease end you are responsible for payments and documentation Regards, [redacted]

For the reasons previously stated, management rejects the desired resolution

Management advised Ms [redacted] of the new parking policies on several occasions between January and July Several notices were placed on her door and one notice was placed in her mailbox (attached are examples of the notices provided) Therefore, management is not willing to agree to her desired resolution

Lynd Company no longer has access to *** ***'s lease file, but current management should be able to assist her with review of the fees paid when she applied

I am rejecting this response because: It's funny how as soon as I complained to the Revdex.com they went right to work to fix all our issuesThat just clearly demonstrates my point that they do not uphold their own standardsIt is not my problem that they owe people money and couldn't get the plumbing addressed immediatelyNOT MY PROBLEMIt's their legal responsibility to make sure any leak reported is presented with a solution immediately not left overnight for the resident to clean and deal withNot only did they not fix it immediately they left a giant mess overnightbut as soon as I complain to an authority they hop right on every single issue? so what was the holdup in the first place if they were able to fix literally the day they found out?! it's because Lynd and the management here do not careI still have not had one phone call from them because they're afraid to speak to me because I do not ignore the issuesthey have NOT told me when the bugs will be taken care of they did NOT fix our toilet they did NOT fix the dripping faucet I've reported several times, and they still have NOT fixed the carpet that was coming up the day we moved intheir management either doesn't put the work order in or they do and just don't care to see that it's taken care ofthe fact that they said "Lynd doesn't own Cedar Creek" just proves my pointthey don't care about taking care of their residents if they did they wouldn't be clinging to that point as their defenseagain, the moment they got this complaint they suddenly are able to fix all of our issues? funny how it took me going to the Revdex.com for that to happen.

Management of Vistana Apartments offers this, its response to Ms*** *** allegations. Management has in a diligent manner addressed Ms*** concerns as follows:
On August 16, 2014, a supply line break was reported to the after-hours service number at approximately 2:
a.m. The on-site maintenance technician responded and began to assess the situation within minutes of the call and the water was immediately shut off Restoration Services was called to assist in water extraction, remediation and removal of baseboards and wet sheetrockIn Ms***’ apartment unit, Restoration placed four dehumidifier units and eight air mover
On August 18, Restoration removed and treated Ms***’ rugs. Ms*** was advised to place a claim with her renter’s insurance policy for the damages to her personal property as stipulated in the Texas Apartment Association Lease Contract signed by Ms***
On August 18, 2014, management also offered to transfer Ms*** to another apartment unit
On August 20, 2014, Ms*** was scheduled to move to the new apartment unit, but refused to sign the new lease
On August 20, 2014, the air and dehumidifier units were removed from Ms***' apartment unit around August 20th. However, MsBrook informed management that an area was still wet In response, management contracted with ServePro for humidity testing and removal of additional sheetrock
All repairs were completed by August 30,
On September 3, management had the contractor return to complete additional repairs at Ms*** request.
On September 4, housekeeping cleaned Ms*** apartment.
On September 24, additional moisture testing was performed at Ms***' request.
From August 16, through August 25, Ms*** represented that she was staying with friends or family. From August 26, to September 1, 2014, management procured a hotel room for Ms***. Ms*** will not be charged rent from August 16, through September 3,

As counsel for The Lynd Company, which is the managing agent for Cedar Creek Apartments, I have investigated this complaint and provide the following:• The Lynd Company doesn't own Cedar Creek Apartments. • The sewer issue, water extraction, and cleaning were all addressed within one day
Management is working with a plumber to address any latent issues • Pest control provided service within a week of MrBrennan's requestManagement has not received any other requests for service from MrBrennan However, in response to this complaint, management will will contact Mr*** and schedule treatment. • The lights on the building are now in working orderManagement has been working with an electrician to investigate a lighting issue Unfortunately the process took longer than expected Mr*** should please bring to management's attention any other areas of concern

Please find attached the lease and Statement of Security Deposit Account illustrating that a security deposit was not paid

*** *** and *** *** leased an apartment at Bluffs at Castle Rock on June 7, 2014, and in doing so, signed a *** Apartment Association Apartment Lease Contract, a Lease Contract Buy-Out Agreement, and an Animal Addendum The *** Apartment Association Apartment Lease
Contract required a $security depositThe Lease Contract Buy-Out Agreement required a $1,fee to terminate early. The Animal Addendum required a non-refundable $animal deposit and an additional one - time fee of $for each animal in the dwelling unit (management could have charged $for both pets) The Garage Addendum required a non-refundable $deposit. The refundable fees came to $as indicated below:Security Deposit $300Animal Deposit $ Garage Deposit $150Paragraph Noof the *** Apartment Association Apartment Lease Contract states that "if you don't clean adequately, you'll be liable for reasonable cleaning charges." Paragraph outlines the charges that can be accessed against a security depositParagraph of the Animal Addendum makes clear that the Animal Deposit is subject to the terms and conditions of the *** Apartment Association Apartment Lease Contract. On September 20, 2014, *** *** and *** *** gave a notice to vacate on November 30, 2014. This was one month prior to the end of the lease term; therefore, they were required to pay a break lease fee of $and were advised of this. As indicated in the attached Statement of Security Deposit Account, upon move-out *** *** and *** *** were charged $1,for the following: Lease break fee of $1000.00, Heavy carpet shampoo $225.00, Light house cleaning fee of $85.00, Pet treatment $200.00, andDrip pans $20.00 Once the $in refundable fees was applied to the above charges, it left an outstanding balance of $Management has agreed to waive the cleaning fee; thereby reducing the outstanding balance to $545.00. The Statement of Security Deposit Account was sent to *** *** and *** *** at the forwarding address provided Taking the above into consideration, Management is not willing to agree to the resolution proposed by *** *** and *** ***

After reviewing Mr. [redacted]'s tenant file, Resident Portal, and Pest Control log, Management has found no record of a pest control request.  Management has scheduled Bug Me Not to treat Mr. [redacted]'s apartment on Monday, February 22, 2016.  Management will continue to have Mr. [redacted]'s...

apartment treated until the pest problem is resolved.
