Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below.Timeshare
Realty Specialists did not address the essence of the complaint They call themselves realty professionals, and based on that I trusted them in taking my money and guaranteeing a sale It was Timeshare Realty Specialists that told me my time share should be listed at the value range of $16,to $18, It was their expert opinion that established the value of the timeshare not me When I questioned them about the guarantee offer they kept saying not to worry about it my unit will sell fast and if it doesn't we will guarantee to buy it I never expected in my wildest dreams that the value would change in a year from $16k to under $ This is clearly not a change in market value but a sales tactic used by Timeshare Realty Specialists to mislead you into paying them to sell your unit This is clearly a marketing scheme to take my deposit This is simply a gimic and misleading to the consumer It would be interesting to know if they actually ever sold a timeshare!
I would like an explanation from Timeshare Realty Specialists how they could value my timeshare for sale at $16k to $19k and then turn around one year later and tell me it's worth less than $and by the way you have to pay us another $for us to buy it Once they can answer that question in good faith I will consider dropping this claim Based on the response I received so far, I plan to take this to court for a decision I've got to believe there are others that have been violated by this organization and I intend on finding them

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear belowPer your response,
you are advising me that, According to the definition of market price on his
contract; “Market price means what a similar Timeshare most recently sold
for on the current resale market.” The market price offer was made
by our in house licensed Real Estate broker, completing the contract with our
company
First
off, you are quoting something that is not in my contract with you and not in
your Real Estate Brokers contract. For
legal purposes, if you are going to quote something in a contract, it would be
in your best interest to quote verbatimFor the record, I don’t have a contract with him, I have a contract with
your company, so the verbiage in his contract is irrelevant
The contract I
signed says, and I quote, “We will have our company research
and pay to you, at your acceptance, the market price/value for your
timeshare. For the purpose of this
purchase provision, market price/value means what a similar Timeshare
comparable to yours most recently sold for on a competitive and open market.”
When a licensed
Real Estate Broker completes a market analysis,
they conduct research on similar units still available for sale and what
they are currently charging for these units. Using an online auction site is not
acceptable in conducting a reliable market value analysis. That site does not set a realistic value of a
property. If I want to value property I
expect comparables taken from data from completed listings in the timeshare
marketplace, that would show sales history for each resort as they were soldI
would expect the real estate agent to evaluate the location and quality of the
resort, not post on an online site with starting and ending bid of $
If
you set realistic expectations from the onset this would not have happenedHad
I known you would have been using Ebay as your source, I would have hired a
certified appraiser
I have completed
research on your in house licensed Real Estate brokerMr*** ***
Florida Lic # ***. Not only is he
not licensed to conduct Real Estate business in California, he does not hold a
Real Estate license in the State of California.
Mr *** who’s main address according to his lic#*** is *** *** *** *** *** *** and his licensing County is
SEMINOLE Per Florida State LawReal Estate
Brokers are professions and businesses that are regulated by the
Department of Business and Professional RegulationI have filed a complaint
with *** *** Investigations
Manager for the Florida DBPR advising of the unlicensed activity in a
State other than which he is Licensed
Furthermore, Per the California Department of Consumer Affairs Bureau of
Real Estate, *** *** is not Licensed to operate as a Real Estate
agent broker in the State of California.
He is not licensed to do Real Estate business in California which is
where my property is locatedI have too filed a complaint reporting his
Unlicensed activity in California
I will also be
filing a report with the state
Attorney General, local consumer protection officials, and State
Real Estate Commission
So to sum it up
yes I am very angry that my timeshare was valued at $1.00. I am not the only consumer that you have done
this exact thing to. I guess all of our
Timeshares just so happened to drop to $as the value Your company did not set a realistic expectation and your contract should be voided and my money should be refunded immediately.

Dear *** ***,
This is in reply to a message received by our office
on or about July 24,
Our records show that Mr*** contracted Timeshare
Realty Specialists mid November to help him sell his timeshare at his
requested sale priceAt no time was he ever told that we would take over
maintenance fees or up keep, he continues to be the owner of the timeshare and
therefore continues to be responsible for his timeshare until it’s sold
Mr*** mentions our months guarantee, we find
no complaint here as his months have not elapsedOnce his months are up
he is to follow instructions outlined in his signed contract
We do not appreciate the accusations; we have
advertised his timeshare pursuant to the signed contract and have done nothing
wrongAll the work has been done so we find that a refund is not appropriate
at this timeHe contracted our company in November of and had the
opportunity to cancel but instead has since signed our contract and taken
advantage of our advertising services

Dear Mr***,
This is in response to a message received by our
office on or about March 5, This message seems to be in regards to a
contract entered into by you with Timeshare Realty
Specialists for the marketing of your timeshare
Our
contract is very clear we have done everything the contract terms stateYou
are just not happy with the end result of what the current value of his
timeshare property is worthPursuant to the signed contract, if the timeshare

contract; “Market price means

The market price offer was made by our in house licensed Real
Estate broker, completing the contract with our company
There
was NO specific amount guaranteed as we have no way to see the future value of
any timeshareIf you believe the property is worth as much as your requested
sales price, you can try to sell it back to the timeshare company and see if
they buy it backYou should be more upset with the timeshare company, not us
We
don’t make the market prices; we report them as they are completed by third
parties other than usWe submitted about three comparatives for the timeshare
which are actual bona fide transactions done by buyers and sellers not affiliated
with usUnfortunately you seem to have a timeshare property that at this date
and time is not worth very much money on the re sale market as evidenced by the
proof we submittedPrices always fluctuate and we have no way to see the
future value of any timeshare
With
that said, all services contracted for have been provided by Timeshare Realty
Specialists, and we have completed the contract that you entered intoYour
timeshare has been advertised pursuant to the terms and conditions of the signed
contract and we have made you the market price/value offer as outlined in the

If I could rate them less than zero, I would in a heartbeatThese people are absolute SCAM ARTISTS!!!! They solicited my business and convinced us that we could sell our Diamond Resorts points well within the month agreement for "fair market value" which they quoted at the time to be worth around $10,They indicated the market was hot for these points and we needed to decide within days to ensure we had our points available for sale during the peak timeShould the points not sell within the month agreement period, they themselves would purchase it from us for "fair market value"So the $fee was clearly a good investmentThis was not a safe assessment
After jumping through the hoops to submit our request for them to purchase the points from us (we did not receive single offer during the months), they took weeks to come back and offer me $Also that doesn't include the $I would have to pay them to cover lawyer and transfer fees for them to buy itTheir documentation contained a great deal of paperwork provided purely for the sake of covering themselvesThis included a printed definition of "fair market value" as shown on www.dictionary.com
I'm in the process of pursuing legal action against them for this egregious misrepresentation of their servicesI feel it is critical that I report this experience to the Revdex.com to help others to not make the same mistake we did

The paragraph mentioned by the client, is not buried in the contract you can clearly read it as all terms are in the same font and size. We have completed the contract and have provided the services as contracted to do, we have done nothing wrong.
Client had over a year to...
