This is in response to a message received by our
office on or about February 11,2015. This message seems to be in regards to a
contract entered into by you with Timeshare Realty
Specialists for the marketing of your timeshare.
Our
contract is very clear we have done everything the contract terms state. You
are just not happy with the end result of what the current value of his
timeshare property is worth. Pursuant to the signed contract, if the timeshare
did not sell after 10 months a market price offer would be made for the
purchase of the timeshare. According to the definition of market price on his
contract; “Market price means
what a similar Timeshare most recently sold for on the current resale market.”
The market price offer was made by our in house licensed Real
Estate broker, completing the contract with our company.
 
There
was NO specific amount guaranteed as we have no way to see the future value of
any timeshare. If you believe the property is worth as much as your requested
sales price, you can try to sell it back to the timeshare company and see if
they buy it back. You should be more upset with the timeshare company, not us.
We
don’t make the market prices; we report them as they are completed by third
parties other than us. We submitted about three comparatives for the timeshare
which are actual bona fide transactions done by buyers and sellers not affiliated
with us. Unfortunately you seem to have a timeshare property that at this date
and time is not worth very much money on the re sale market as evidenced by the

As mentioned in our previous response dated January
30, 2015, our contract is complete. The market price offer was made based on comparables
from the biggest competitive and open market. We don’t make
the market prices; we report them as they are completed by third parties other
than us. We submitted about three comparatives for the timeshare which are
actual bona fide transactions done by buyers and sellers not affiliated with
us.
We have no control over the value of your timeshare.
Unfortunately you seem to have a timeshare property that at this date and time
is not worth very much money on the re sale market as evidenced by the proof we
submitted. Prices always fluctuate and we have no way to see the future value
of any timeshare.
With
that said, all services contracted for have been provided by Timeshare Realty

This is in reply to a message received by our office on or about March 18, 2014.
We have carefully reviewed the file and find that Mr. & Mrs. [redacted] entered into an advertising contract with Timeshare Realty Specialists on or about 11/15/2013. According to their signed contract they agreed to all terms and conditions stated and were the ones to provide their requested sales price, if it was something they needed adjusted they were advised to call customer service to change.
Furthermore, we have a guaranteed program which according to their signed contract; they decided to be listed on the home page and did not opt to be a guaranteed member. However, they were offered to upgrade if they were interested and at no time they were forced to pay us any more fees as this was simply an option.
We can’t tell the future value of any timeshare, we advertise their timeshare for the amount they request as their sale price. If they believe their timeshare is worth less than what is being advertised they can adjust the price at any time with customer service.
We find that our contract is very clear and we have been providing the services as outlined in the contract accordingly since November 2013. We have a signed contract on file, they acknowledged the terms and conditions and at no time were “mislead” everything is in writing. There is no refund due as we have done nothing wrong and we admit no liability what so ever.

At no time was any specific amount guaranteed as we didn't know what the future value of your timeshare would be in the future months. We were paid to advertise your timeshare and we did. We also promised to have a real estate broker submit to you a market price offer, based on comparables from timeshares that have sold on the open market. This offer was done and comparable were submitted to you, we do not make the market we report it as you see in the comparables that were submitted to you with the offer.
We understand your frustration but seems that you should be more upset with your timeshare company, not us since we have no control over the timeshare value. If you opt to continue listing your timeshare, we will be happy to continue to help you find a buyer close to your requested sales price. Otherwise, we do find that we have completed the contract and have provided the service that you contracted us to perform.

[You continue to tell customers a value (estimated appraisal) up front setting expectations of a sale in that range to you at the end of the contract. If you have no ability to provide that value then DON'T provide the quote of expected value. If you told me the expected value would be a dollar then I would not have entered a contract to sell with you and pay close to $1000. You already knew the value and falsely told me a higher value in a scam to get me to enter a contract with your company. This is flat out a FRAUD. From previous complaints posted to the Revdex.com you have continued to perpetrated this fraud on consumers.]

Review: In June of 2013 I entered into a contract with Timeshare Realty Specialists (TRS) to market my timeshare for sale. Included in the contract was a guarantee that they would buy my timeshare from me for market price if it was not sold in one year. The initial representative that I spoke to was [redacted]. He said that comps for my timeshare ranged from $9925.00 to $10640.00. He directed me to their website where I saw those comps. I did not receive one correspondence from TRS over that one year time period. I followed their process to initiate the guarantee. The response from TRS is that my timeshare is worth $10.00. I spoke with another representative from TRS, [redacted] on 12/10/14. She told me that [redacted] no longer works for TRS and that they are not responsible for the things that he told me. When I persisted that he was a representative of TRS, she stated that I over valued my time share. She pointed out the language in the contract, "Owner's requested sale price: 9925 to 10640." I again insisted that that value came from a representative of TRS. I asked to speak to a supervisor but MS. [redacted] said there was not a supervisor available.Desired Settlement: I would like the $800.00 marketing fee that I paid to Timeshare Realty Specialists refunded to me.

Review: As with the majority of the complaints against this company they misrepresented the value, per their appraiser of $13,700 for my timeshare. Expecting that I might get that value I agreed to have them advertise my timeshare with a guarantee to sell to them at the end if the timeshare was not purchased in 10 months from 1/22/14. Per agreement I contacted them at the end of the period and asked to sell. The now obtained comparables from e-bay of timeshares in CA and HI of $1.00 to $1.25 and now offered to purchase my timeshare for $1.08. Their appraiser misrepresented the value to me so that I would sign a contract for advertisement with expectation that I would get my purchase price back. They also wanted an additional $479 to complete the transfer to them. Once again this is outright fraud and misrepresentation of an expected outcome by quoting an apprisal price that has no meaning. DO NOT enter into an agreement with this company. They will only take your money.Desired Settlement: Refund of $975.00 fee.

Review: Gave them our credit card for $800.00 on June 10.2013 to list our timeshare with them. On June 11,2013 I hand delivered a cancellation notice to the address 3755 avacoda blvd #157 la mesa ca 91941 (which ended up being a post office box)I was told by my bank that it takes 10 days for a refund but [redacted] supervisor at 1-888-892-3794 said that and its going to take an additional 15-22 business days for the refund and if I turn it over to [redacted] Credit Union it will only take longer.Desired Settlement: refund to our credit card in a timely matter

Review: We were contacted by Timeshare realty specialist. We did not call them to initiate this. We were inforemd of the purchase guarantee agreement when listing our timeshare with them. We paid the said listing fee of approximately 1200$ with the understanding that if the timeshare did not sell within the 10 months it was listed, it would be purchased by timeshare realty specialist at "fair" market value. we purchased this timeshare which consists of a 30 000 points annual allocation for approximately 12 000$. The 10 months expired with no offer when listed at a low range of 14 000$ and hi range of 17 000$ there was absolutelly no effort whatsoever from timeshare realty specialist to actually sell our timeshare. They let the 10 months expire and had the nerve to send us an offer of 41.00$ plus transfer fees of approxiamtelly 500$ to change the deed. They came to that price range by providing quotes of timeshares sold on EBAY. which in my opinion does NOT represent the "fair market value" mentioned in our contract This is completelly unacceptable and an insult to myself and my ex-wife who trusted this "company" to assist us in this matter. Unless I am selling a condo in a shanty town in south africa. 41.00$ does not even cover the fees I have paid to this sham of an organization.Desired Settlement: I would appreciate, at a minimum a refund of the listing fees. Since apparently absolutelly no effort was made to actually sell our timeshare besides listing it online thus not fulfilling THEIR part of the contract. Idealy I would agree to the completion of said agreement from timeshare realty specialist at FAIR MARKET VALUE. which I assess to be in the 10 000$ to 12 000$ range after contacting the home resort where our timeshare is located.

In United States tax law, the definition of fair market value is found in the United States Supreme Court decision in the Cartwright case:

The fair market value is the price at which the property would change hands between a willing buyer and a willing seller, neither being under any compulsion to buy or to sell and both having reasonable knowledge of relevant facts. United States v. Cartwright.

In this situation ALL relevant facts were not disclosed with regards to final "fair market value" offer being made by Timeshare Realty Specialist.

Review: In January 2014 I was contacted by the company indicating a lot of interest in my timeshare property in Florida. After discussing the offer for awhile in which they said that they aggressive market properties and would expect to have a sale in 1-2 weeks, I consented, signed a contract and sent them $1750. The contract read that if the timeshares weren't sold by 10 months after the contract signing, they would buy the properties at market value. they estimated at the time the properties would easily sell for about $13,000 each. After the transaction was complete, I could not contact the company despite numerous attempts. Only when I contacted my credit card company to dispute the charge did I hear from them. I decided to wait out the 10 months. I then submitted my request for them to purchase the properties at market value as stated in the contract. Several weeks later I received an offer of about $10 per property based on eBay sales in that amount. I contacted an attorney who sent them a letter stating that there was misrepresentation of their claims to sell the property or to buy it at accepted market rates. We have demanded that they refund the the $1750.Desired Settlement: I would really prefer they buy the properties at what they indicated the going rate was at the time of the contract, i.e., ~$13,000 per property (2). As I doubt they are going to do that, I would accept the $1750 I paid them for their "services".

Review: This company is clearly aware of what they are doing. They are misleading hopeful, trusting and hardworking folks that their service is to in fact SELL timeshares. Their website states "You will be timeshare-free quickly and GUARANTEED", not they are just marketers, as the customer service manager stated when I spoke with her. It comes down to semantics. They are committing fraud and I'm not sure how this company is still able to operate? Our situation consists of an individual calling for 2 weeks straight and coming off as a kind and concerned individual who wanted to help us make the most money out of selling our timeshare. We own a Monarch Grand Vacation. He promised to keep in contact with us and never called back! When we tried to call back we were told he was on leave and that they were not sure when he would return. Upon speaking to several VERY RUDE individuals, we reached the rudest of them all, the sales manager. We had a lawyer listen in and found that he was clearly breaking the law by using semantics in attempt to confuse us. He did promise to call us back with more info and never did. We called for weeks and never received a straight answer. When we spoke the customer service manager whom was very dismissive and again, rude, she tried to convince us to pay $500+ to get the 10 month guarantee. Really? She is delusional. I'm not sure how these people sleep at night. We called in one night pretending to be interested in selling a different more valuable timeshare and of course reached someone right away. I mentioned the Revdex.com reviews and the sales man we reached said "they were a joke". He became defensive and began to raise his voice. He did seem very interested and adamant about selling our timeshare though... for $900 marketing fee and did mention he was a "real estate agent". WHEN I MENTIONED THAT I HAD READ THE 10 MONTH GUARANTEE WOULD ONLY GET US $1... HE SAID "OH YEAH THOSE ARE ONLY FOR MONARCH GRAND TIME SHARES"... THIS IS A SCAM!!! THAT MEANS THAT THEY HAD FULL KNOWLEDGE WHEN ENTERING THE CONTRACT WITH US THAT MONARCH GRAND WAS NOT VALUABLE AND CHARGED US $350 ANYWAY!!! When I said "really, well we just went through someone there and he said to list at $14,000!!! THEY VERY WELL KNOW WHAT THEY ARE DOING!!! He stayed quiet and hung up right away!!!! I want my $350 back. They knew they had no intent to sell our timeshare from the very beginning! This is breaking several laws that protect consumers from these low lives. We want to start a class action suit and have 2 interested parties that would like to represent us. So if you are reading this please do yourself a favor and tell those guys off... they will get it back in this life.. you know what they say about KARMA!!!!Desired Settlement: I would like my $350 back as this a breach of their verbal contract and what there website claims.

Review: They present themselves as agents to sell a timeshare. They state numerous times that no further action by me is needed, and they will handle all timeshare maintenance and upkeep issues. They state that they will buy the timeshare after 10 months if it fails to sell.

When contacted, they retreat into legalese and are extremely dismissive and rude. If I persist in questioning them I am abruptly disconnected.

They are fraudulent, COMPLETELY.

They also represent themselves as having a stellar Revdex.com reputation.Desired Settlement: I want my $800 back ASAP (though I realize this is a fairly remote chance.)

Review: I entered into a one year contract with the company to advertise my timeshare condo for sale. The sales associate that worked with me at sign up explained that if the property did not sell within one year, the company would buy the property from me. He failed to disclose that the property purchase guarantee only applies if you make a written request for the service within 2 months before the expiration of the contract. While that information is indeed in the contract, it is buried on page 4 of the contract and written in rather cryptic legal language, in addition to hiding the clause in the depths of the contract, the existence of that particularly important clause was never mentioned during the sales process.Desired Settlement: Since the company did not fulfill the promises made by their sales associate, I would like a refund of the $1200 that I paid them.

The paragraph mentioned by the client, is not buried in the contract you can clearly read it as all terms are in the same font and size. We have completed the contract and have provided the services as contracted to do, we have done nothing wrong.

Review: The individual who contacted us regarding the sale of our timeshare used deceptive language to convince us to believe that he would be in direct contact us and that he would sell our timeshare quickly. This in fact is not a sales business but rather a marketing company that does minimal work to get your timeshare sold. He promised to be in contact with us... it's been 5 months and we haven't even recieved a courtesy call. Above that, upon calling to speak with someone regarding the deal, I have been hung up on and given the run around by the sales manager as well as the customer service manager. The orginal rep did mention that if the services we paid for ($350) where not completed that we can file fraud on out credit card. Also I believe the reason why we got such a great rate was because it was towards the end of the year and sales people have quotas to reach. We have been treated unfairly and are extremely frustrated and this is a clear violation of the UDAPP. I will be seeking legal counsel at this time.Desired Settlement: I would like my money back and would like to see some type of action to prevent this scam from continuing. This company is being run by individuals who need to take pride in what they do for a living and not praying on those trustworhty individuals who are trying to get rid of their timeshare.
