Since we were unaware of a notification for a request for cancellation and/or a returned product during the allotted trial period, the consumer was automatically billed for the 30 day supply on 12/16/14 as explained in the terms and conditions for which they agreed to. The consumer contacted our company on 12/18/14 with a request for cancellation and stated that he had previously emailedour company to cancel. We located the notice for cancellation via email at that time. The account was canceled immediately as instructed and they were sent a confirmation email confirming the cancellation. At that time,  the customer service agent also refunded the charge of $87.63 on that same day. The consumer would have received an e-mail confirmation of the cancellation and refund.

Once a refund is processed, it takes 3-7 business days for it to be credited back to the customer’s account. We have refunded the remainder of the amount, $44.71, due to this complaint, however we stand by our policies and we would like to reiterate that our customers accept the terms and conditions two separate times to process their order. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent refunded the amount of $87.63 that day for the most recent charge (the customer would not have received this order at the time he called because it only shipped on 2/13/16). We also mailed a check to the customer for the previous amount of $89.43. This is in reference to the order of Ultimate Muscle Black Edition original 30-day product supply on a 14-day trial basis placed by [redacted] on 10/20/14. We provide this trial for consumers to receive the item and try the product to determine if they wish to continue with the item. The...

stipulation of the trial period, is to make this decision within 14-days if they chose to cancel. If the item is kept outside of the trial period, they are charged for the original product at the retail price of $89.43.
The original trial order was processed on October 20, 2014 at $4.95 for shipping and handling. His original e-mail confirmation will verify this date, we can provide a copy of his account if necessary to verify when the order originally processed. We shipped the item the next business day, and the trial period was started. There was no attempt to cancel within the trial period and he was charged on November 4, 2014 for the 30-day product supply.
The first attempt to cancel was made on November 5, 2014. He left a voice mail with customer service and we attempted three separate times to get in contact with him to verify the cancellation. We received no call back, and the account was cancelled from any further membership.
Due to the receipt of this letter, and as we are fully invested in customer service we have issued the full refund of $89.43 from November 4, 2014. This refund will take three to seven business days. The customer, Mr. [redacted], will receive an e-mail confirmation for the refund credited to his account.

Based on the nature of the call, the customer service agent refunded the discounted amount of $47.33 that day. Contacted customer service about this and noted misleading advertising. The business certainly has covered itself legally however consumers are being misled. When I noted that I misunderstood due to the website and difference in buried terms the supervisor noted I should have called the company to clarify. I was offered a $44 refund as a courtesy. Please see attached document copying the terms and conditions from the website. While I feel the resolution of full refund is acceptable I firmly believe that deceptive marketing is occurring with this company. Although the supervisor I spoke with when discussing my complaint noted that they are not offering a free bottle of the product the website clearly has banner graphics throughout the landing page and subsequent detail pages stating "Get your free bottle now.." Further, if the terms and conditions were started with the paragraph the business submitted to you in the response instead of the version of copy I attached it woudl be clear that this is a time-limited offer that handicaps the consumer and many would not proceed with the trial any further.In their information they note that maximum effect takes 60-90 days. Most supplements will begin to demonstrate an effect in 2 weeks. If the business truly desires to allow a trial then 10 days from purchase date (taking into consideration shipping time) will not even allow a 10 day trial. One can only conclude that the intent of this busines is to "hook" consumers into a purchase that they will then cancel once the charge shows up on their credit card bill. The result is $89 in revenue to the company and a hoodwinked consumer. Review: I ordered this supplement on Jan 8, that had a 14 day free trial, I received the product 10 days after the order, They had UPS delivering the package on the 15th to the apartment complex office. I thought I had 14 days to try the product how can you test a product when by their own words it took at least 7 days to arrive at my apartment complex. Review: Ultimate Black had a 14 day promotional trial, they sent 2 bottles of dietary supplements for "cost of shipping" in Dec 2015. I never received anything after the initial shipment. They charged my checking account for $89.43 for 2 consecutive months in Jan & Feb. My credit union notified my of fraud last night when they attempted to do the 2nd WD. They closed my card down. I called the company this AM and the representative was VERY argumentative that I had received a 30 day supply in the 1st shipment and the charges were justified because of that. 1st: the Ad said a 14 day supply, their "over shipment" is highly shady when I did not authorize any adt'l shipments or charges 2nd: I have not received more product & we are 60 days into their charging my card. She argued w/ me for almost 30 minutes & I repeatedly requested a manager. When she did get one, he said he would refund the charge from last night & a paper check would be sent in 7-10 days & I "didn't have to return any product" WHICH I NEVER RECEIVED!Desired Settlement: Full refund of the 2 charges @ $89.43 each and deceptive marketing adjusted to be full disclosure. Also, removed from ALL of their customer lists.

Since there was no notification of a request for cancellation and/or a returned product during the allotted time, the customer was automatically billed for the 30 day supply on 1/10/16 as explained in the terms and conditions which they agreed to. We attempted to bill the customer for the next 30 day supply on 2/9/16 but the charge was declined. We successfully billed the customer on 2/12/16. The consumer contacted Ultimate Muscle: Black Edition on 2/13/16 with a request for cancellation. The account was cancelled immediately as instructed and the customer was sent a cancellation confirmation via email. Based on the nature of the call, the customer service agent refunded the amount of $87.63 that day for the most recent charge (the customer would not have received this order at the time he called because it only shipped on 2/13/16). Review: Saw an ad for this product started to fill out the order formed and figured it seemed like too good of a deal and there had to be a catch, so I read the terms and conditions and sure enough I figured out they would automatically charge you and send you the product unless you cancel within their trial period, So I decided I wasn't interested. The next day I was contacted by a salesman offering it at half the original price and they would throw in an additional product as another "Risk free trial" (I was not provided with terms & conditions of this product as this sale was made over the phone, come to find out it was through a completely different company which I had no knowledge of {elite test 360}), I finally caved after rejecting the first couple salesmen (they called repeatedly) and ordered the product. After using the product for approximately 15 days at double the bottle suggested dosage (per salesmen's verbal instruction) with only a few pills left, I decided to cancel the product as it did not do anything for me. I was told in order to not be charged full price for the product I would have to return the remainder, I did not feel like dealing with the hassle of this and gave the approval to charge for the full amount but to cancel the product, I did this with both companies. 1 month later I received another bottle of the product which I was not expecting and checked bank statement and saw I had been billed again without my consent. After leaving messages (un-returned) and waiting on hold for around and hour, I finally got ahold of customer service and was able to re-cancel the order and obtain a copy of the first cancellation phone call, where the operator tells me that he will be sending a cancellation email and that I "need to return the un-used portion", to which I respond "how much will I be charged if I just keep it" (as I did not want to deal with the hassle of the return), we discuss the price and when I am to be billed for it and end the conversation.Desired Settlement: I find this companies business practices shady, and would like to be refunded for the product which I was not made aware of the terms & conditions of (Elite Test 360 $47.33), and I would also like to be refunded for the extra shipment of ultimate muscle black I did not want or authorize $47.33 (and would be willing to return this full bottle as long as shipping is covered). Honestly I would like to see this company shut down due to underhanded sales tactics and trickery, but I doubt that is possible through a bad online review as they are technically doing some of this legally and taking advantage of people who put their undeserved trust into this company blindly.
