Regarding Case # [redacted]. Original Complaint "We were given a quote for financing a piece of equipment. We were given preliminary approval. We sent a deposit check of $3,021.08 on October 30th, 2014. We were then told a week later that the terms would be changed and would require a large down payment to secure the loan for the equipment. We declined the financing due to the changed terms and got our financing at another institution. We requested our deposit back with two separate letters with no response. I have not been able to get anyone to answer the phone. As I have been writing this complaint the phone number shown on the webpage for the legal department has been ringing with no answer." USBusiness Funding claimed in their response to complaint that the reason for keeping my deposit and not returning my deposit after changing the terms of financing was that I had not filed tax returns and in fact had not filed in five previous years. I have filed tax returns every year I have been in business since 1995. This is a common tactic that USBusiness Funding has used on most of the complaints found with Revdex.com. The case was termed resolved with their response. The case is not resolved and if USBusiness Funding insists on slandering my company, that will not be tolerated. Again, I request that my deposit be returned. I have tried countless times to contact their "legal" department which rings and rings and rings........never to be answered. I will not go away especially after your response is a flat out lie.Please address this situation and issue the refund of deposit check as this has been out there way too long. I was promised by the 'salesman' that if I decided not to take the financing deal that was changed after the deposit check written that I could get my money back. Please honor your policies and quit hiding behind lies and fabrications.

While I ended up not moving forward with my line of credit, I appreciated the quick response from US Business Funding in refunding me my activation fee of $395 back in October. Because of that I just funded my equipment lease with them. Appreciate Cody's help.

They financed $490,000 worth of construction equipment and provided me with $300,000 line of credit as a bridge loan for the project. you for bringing this to our attention. We always strive for a 100% client

satisfaction rate in all we do, however certain circumstances occasionally

impede our ability to complete a transaction for a prospective client. Mr.

[redacted] was approved for this loan and made a deposit to our company to secure

financing. The advance allowed us to dedicate our resources to completing final

diligence on the information Mr. [redacted] provided on his signed finance

application and other financial documentation provided to us. As part of the

final underwriting process, applicants are required to provide copies of filed

corporate tax returns to complete the file. Us or our assignees will not fund

transactions without this very important information. Obtaining this

information prevents fraud, establishes identity, and is necessary for audit

purposes.

Mr.

[redacted] misrepresented the facts in that he had filed corporate tax return for

his business. When our company asked Mr. [redacted] he provide proof of filing by

emailing or faxing us his recent tax returns prior to funding his transaction,

he was unable to provide. When pressed, he admitted he had not filed tax

returns on his business for the previous 5 years. USBF cannot and will not fund

a transaction without proof an entity is paying taxes on their business income

and/or properly reporting losses to the government. If a company is skirting

their tax liability, it puts our investment and our capital in jeopardy, which

is precisely the reason for this requirement.

Borrowers

that misrepresent facts on transactions are not entitled to refunds, as our

resources cost money. Chasing fraudulent and misrepresented transactions

without compensation for our time and resources result in losses for our

company and raise costs on future legitimate borrowers.

If

Mr. [redacted] would like to provide us the required information and cooperate

with our funding process, we would be glad to work with him again. We hope this

will close the matter with the Revdex.com.

Review: US Business Fund approved our company for 53k of lease financing in Sept 2012. Still to this day March 21st 2013 we are not fully financed, and want our remaining deposit returned of $3207.68. We sent them over $5000+ in a deposit, they charged us a $395 processing fee inside that amount, we are willing to let them keep the $395 as long as they send back the remaining $3207.68.They were NOT able to complete the other 40k of EFA Lease Financing that they said we were originally approved for. They did have one other potential lease for 11k, but this lease was not the original EFA lease terms that we agreed in the agreement. I did not simply decide to jump on here and file a complaint. It has been over 2 weeks of phone calls, emails, voicemails. I will quote the other consumer complaint EXACTLY because this is EXACTLY how I am feeling at this time: Their failure to communicate leaves me to believe they manipulate people into placing a deposit and signing an agreement with no intention of funding the agreement and every intention of keeping money they have not earned, they practice in deceptive marketing, they fail to respond in a timely matter. I suspect that if the Attorney Generals office were to look into US Business fundings deceptive practices they will find that US Business Findings main income is on deposits made by inspecting people whos loans were never funded. Response to complaint: Based of the information we received from the client’s application US

Business Funding was able to approve applicant for 53,000 for equipment financing. Upon

underwriting it was discovered the client sent over false information about their business

regarding ownership specifics which included Mr. [redacted] stating he was the sole owner when in

fact there were three owners. In addition, Mr. [redacted] stated he had been in business for four

years and nine months when in fact he was in business for only thirteen months. Once we

received the correct documentation, the client requested to finance a lesser amount first and

the balance thereafter. We funded the first draw of 13,906 on September 11, 2012 and

attempted to fund the balance of funds since and have been unsuccessful. Although the client

falsified their application we continued to assist them in achieving their financial needs and we

were successful in funding the lease for the full amount requested, however the client decided

not move forward and has since defaulted on the balance of the lease. If the client request to

change equipment the original terms change as a result, however if we have already have an

existing contact in place we will work with the client accordingly but upon execution of the lease

agreement it becomes non-cancellable when monies are secured for funding.

Review: I started working with [redacted] with US Business Funding in August 2013 to obtain a loan for a new Tow Truck for my company. I completed their application and other documents they requested and finally received loan approval on Sept. 23, 2013. In order to proceed with the loan, he said I needed to mail them a check of $995.00 for processing fee which was mailed on 10-9-2013 and cashed. On Oct. 14th [redacted] emailed me a new approval and had changed the terms and payment amount that had already been agreed upon. I started asking questions to [redacted] and he kept things short and said he would get back to me. I inquired about the change in monthly payments of almost a $1K more along with the interest rate being charged on the loan as that was not put on the approval like I had earlier requested. Once I started raising questions via phone and email, he stopped calling or emailing me back. I felt something was not right and requested a refund of the processing fee since he did not complete the loan per the approval. I have called, emailed and mailed letters to him and his company asking for a refund of my processing fee since they never completed the loan. I have not heard back and every time I try calling, I select different departments and the phone just rings forever.Desired Settlement: 995.00 plus interest since Oct. 9, 2013

Client was approved for $92,073 for a new truck. Clients credit was poor and did not qualify under US Business Funding credit guidelines since we are an "A" credit lender so we had to outsource it. The bank we placed it at takes challenged credit deals and collateralizes them with existing equipment the client owns outright in order to obtain the funds. The client had initially filled out an application stating that the equipment she owned and was going to use as collateral had a value of "X" amount of dollars so we sent her an agreement based on the information she had provided. Client signed a disclosure stating the value held true. We then collected the info and sent the doc fee of $995 to the lender we outsourced the deal to and they take it from there. US Business Funding does not have the $995 doc fee and has no recourse or affiliation with this deal. Please make sure the client understands what she signs before she goes to the Revdex.com and files the complaint with the incorrect financial institution a year after the fact.

As you will see by the documents attached, I was in fact approved with US Business Funding. I mailed a check in the amount of $995 made payable to US Business Funding with the Lease Approval form signed per [redacted]'s request. It was after the check was cashed and the Lease Approval was signed that [redacted] called me to say the bank will no longer honor the terns and that they have to broker out the file. [redacted] then told me the terns of the new lease agreement, which I did not agree with...the numbers being told to me were not making sense. I asked about the interest rate as I have leased trucks in the past and an interest rate has always been disclosed. Since [redacted] was avoiding my interest rate questions, I told him that I did not approve of the new proposal being offered. I never heard from him after that. I sent several emails to him and also left messages with regards to the Processing Fee and never once received a phone call or email back so I sent a letter to him and the company requesting a refund of the processing fee and have never heard back from ANYONE at US BUSINESS FUNDING.

I am writing to you in regards to the dealing I had with US Business Funding for the equipment leasing

and financing. I was dealing with the person name [redacted]. He sent me documents giving the

details of the finance amount and asked for a check for the first month, last month, and $500 processing

fee for the total amount of $5092.86. I was going to send the voided check but he stated he needed an

actual check to process by underwriter. Per his request I faxed him a copy of the check and asked him

not to deposit or cash until the contract was finalized and signed by me. The check was dated 4/10/14,

check #[redacted] for the amount $5092.86 from Shree Yoga Bapa LLC and it was cashed on the 4/10/14 from

Chase Bank by your company.

I attempted to contact [redacted] several times and left several messages but did not receive a

response from him. I was able to speak to another person name [redacted] and was advised that

[redacted] was no longer with the company. He had assured me that everything will be taken care

of and I need not to worry. After waiting for a while to someone to set back to me I called again and

spoke to [redacted] and she transferred the phone and It went to voice mall. Finally I was able to get in

touch with [redacted] who Introduced himself as the finance manager and he advised me that

[redacted] was no longer with the company. Mr. [redacted] had asked me to write an email providing all of

the details so the legal department can research and assist me with getting my funds back as soon as

possible. After two months I was contacted by [redacted] and introduced himself as someone from

the US Business Fundinalepl department and offered settlement for $3500. He stated I either take the

$3500 or I will not set anything. I refused the offer because I would like all of funds to be returned to me

as It was not my fault.

1.) Client signed a affidavit that he had owned the company for 20 years and he only has 1 year Time in Business, so the process took a while longer than expected. (attached)

2.)We had Shree Yogi Bapa, llc approved and the client decided to cancel the deal. He first started to state that he had never signed the check (and had written not for deposit). He also proceeded to state that he had never signed the contract(as per attached). I had our IT department find the original fax showing he had signed the agreement and that the check he sent was dated and signed for our use. Also attached is an email from Mr. [redacted] to the sales representative stating that he had just signed the documents and was going to fax them . Once Mr. [redacted] was caught up in his lies he then started to threaten that he would call the Revdex.com etc as legally he is in violation of multiple bank fraud regulations. Mr [redacted] was trying to back out of a fully executed binding lease agreement with US Business Funding using deceptive and fraudulent business practices. We will proceed with the filling in the Orange County Superior Court.

It is evident the client has breeched the contract and tampered with federal bank documents. We have copies of all documents and supplied them to the Revdex.com and CHASE Bank NA would not cash a check with VOID written across it, nor would the client turn to the Revdex.com for support if they had a leg to stand on. This issue will be resolved in the Orange County Superior court. US Business Funding can no longer make any of the issues public until further hearings.

This company is a scam and [redacted] ought to be ashamed of himself for perpetuating the scam. They don't come through with the financing yet find a way to hold back/keep your deposit. They claim they will be refunding immediately but the refund never happens. I finally had to dispute the charge with my bank and was able to recoup my funds in that manner. So if you have have suffered through a bait & switch by this company go through your bank for resolution as you will not receive one from U S Business .Funding.

I applied for a loan with US Business Funding. I did so after carefully weighing my options and even looked on the Revdex.com site to see what kind of score they had been given in the past. I found an A rating.

After the payment I sent (a check), I received notice that for some reason I could no longer qualify.

Simply asked for the return of my payment and was told he could no longer speak with me, I would need to go through their legal department. I get a number that works but just rings and rings [redacted]). No one answered at all.

[redacted] from [redacted]’s [redacted] Movers has been approved for a used Mack 2005 roll off truck on 9/15/2014. Client has signed an agreement that clearly states all Federal and State Tax liens need to be paid, or client needs to show proof of payment plan. Upon funding our credit department had filled a UCC search lien and multiple unpaid Federal and State Tax liens came up. He owes approximately $175,796 in back taxes that either need to be paid or set up a payment plan for. US Business protects its secured lending covenants and wants to ensure the IRS gets paid before anyone else. We believe this is always the honorable thing to do. [redacted] indicated to me that he has not filled taxes in over 4 years and will not pay the IRS. The tax invasion liability is very high and US Business needs to ensure its in good standing with all lender license requirements with all our internal lenders. I let [redacted] know that we could still provide financing for him however he would need to set up a payment plan with the IRS for us to move forward with the deal. [redacted] told me he had no desire to pay the federal government and wanted to unwind a deal that we have approved for him. This client has backed out of a transaction that we performed our due diligence on and processed everything for. The damages incurred have exceeded the initial deposit if client decides not to pay said taxes. The Revdex.com should not be in a position to file this complain as client is cleanly approved and in violation of tax fraud and invasion. We have no further comment on this file.

Review: 06/25/13 approval fax from US Business Funding for $150k loan.Date on check #[redacted] is 08/07/2013 Amount $5,915.00 The check states 1st & Last payment (Original check is still in my position, they cashed a faxed copy)US Business Funding, employee [redacted], quoted a 5.1% apr rate for five years on a $159,029.00 loan. [redacted] left the company, and owner, [redacted] took over. [redacted] asked me to fax a copy of my company check for 1st & last payment $5,915.00. (They cashed the faxed copy, (I still have the original check.) I was sent a contract that didn't make sense, so I called within the hour to say hold everything. I had no luck talking to anyone so I left a voice message. I had to leave six voice messages before getting through to [redacted]. TO THIS DATE, They have not funded a penny or issued a refund. I have left 15 voice calls to [redacted] in the last 10 days, and they will not return a call. I have paid my local attorney over $1,000.00 with no results.Several weeks ago you had four other complaints about US Business Funding on your web-site. They have put our company in an extreme hardship because we ordered equipment, which was delivered and we had to pay for. Response to complaint: I was able to speak to my colleague and he informed me that this gentleman

rendered unlawful and dishonest actions when we attempted to achieve his financial needs. He

single handedly changed his invoice in attempt to offset his loan repayment. I have attached the

email correspondence between him and my finance manager, [redacted]. He was originally quoted

financing of 138,680 based off the invoice he provided for equipment to be purchased. Mr. [redacted]

was approved from underwriting that his loan payback amount would be 162,600 with interest. Loan

documents were produced, attached with the original equipment invoice on August 5, 2013 and sent

to the client (see attached email from [redacted]). Mr. [redacted] returned his executed loan documents

by fax on August 7, 2013 with a different invoice in the amount of 159,029. Unannounced Mr. [redacted]

tampered with his loan documents and attempted to commit fraud by switching out his documents. We

discovered his motive and addressed it directly with Mr. [redacted]. Upon realizing he was essentially caught,

he wanted to cancel his contract with us. The loan approval process is not an easy task and when a

fraudulent person tries to beat the system, it makes it very challenging to trust their word- subsequently

their true colors have already been exposed. It is baffling that Mr. [redacted] had the audacity to contact the

Revdex.com and file a complaint against us when in fact we should have turned him into authorities for the scam

he attempted to achieve.

Review: I contacted US Business Funding on April 4, 2013 about leasing a vehicle for my business. They sent me an application which I filled out and sent them bank statements and financials for my business. After 7 days US Business Funding told me I was approved for a lease. They said my payments would be $409.00 per month for 48 months. They said I had to send first and last payment plus registration for the vehicle. I sent them a check for $1314.10.

They told me that I had to get insurance on the vehicle so I did. I overnighted everything to them and the check was cashed by them in early April.

A week later, I was informed that I was not approved for a lease. They stopped contacting me. I emailed them and called them every day. They then contacted me and said I may be able to get approved with another company and the payments for this lease would be $1075.00 per month for 24 months. I told them I did not want this payment and I wanted to cancel. They told me that they would not give me my money back. The money that I sent them was not for their service in finding a lease company. The money was supposedly for the first and last payment of the lease plus registration for the vehicle.Desired Settlement: See Complaint Text

Response to complaint: US Business Funding doesn’t request copies of financials for financing

less than 100,000. This transaction was to purchase a small vehicle for 15,000 and the client was

approved for a monthly payment of 409.00 for a 48month term. Upon lending approval and the

client agrees to financing terms by signing our agreement do we collect a one-time processing

fee. If the client request to change equipment the original terms change as a result, however if

we have already have an existing contact in place we will work with the client accordingly but

upon execution of the lease agreement it becomes non-cancellable when monies are secured

for funding.

Review: We were provided with a contract for financing equipment with specific terms and paid a deposit in excess of $1200, to secure the terms. When it came time to fund the equipment (which was installed at my practice), US Business Funding provided a new contract with new terms. The resulting difference was in excess of more than $7000 for 48 months of financing. When questioned, they indicated a person made a mistake with the first contract and they would not honor it. They offered to "unwind the deal" and cancel the contract to which we requested a return of our deposit. We then had to secure funding elsewhere within 15 days. To this date, nearly 90 days later, US Business Funding has not returned our deposit, returned our calls, or responded to written correspondence with any indication of their intent to refund the deposit. We consider their dealings with us fraudulent for purposes of securing deposit proceeds, issuing a contract, which was clearly discussed and negotiated (they provided the documents!), then once equipment was installed provided new documents with an over 300% increase.Desired Settlement: Return deposit proceeds of $1247.72

Response to complaint: The client requested financing for new office equipment and was

approved. Finance documents were executed, funds were secured, and UCC’s completed

however after all final documents and terms were processed and executed by the client, they

decided to obtain financing through another institution. The client was fully aware upon

executing final lease documents, the contract became non-cancelable. US Business Funding is

boutique finance broker that works directly with each client and vendor to customize their

individual needs to be sure they don’t exceed their financial capabilities.

As evidenced by the documents filed with the original complaint, US Business Funding provided initial documents/financing agreement which were signed and agreed to. When it came time to pay the invoices for the equipment, US Business Funding provided a new set of documents for execution before releasing the funding. These new documents significantly extended the term of the financing, seeking to increase the financing charges over $7,000.

US Business Funding was able to provide me with a short term capital loan for $50,000. It was completed within 3 days and I certainly would recommend working with them!

Review: I inquired about a loan for my business. [redacted] told me that we approved pending under writers approval. He said I needed to send him a check for $495.00 for the processing fee. The agreement also stated that if for some reason it was not approved he would refund my $495.00. Once the check was cashed I never heard from him again. I have left him several messages on his voice mail and many E mails as well and not one response. I have even called the main number and it tells you to press #3 for customer service and the line keeps ringing. I let it ring for 23 minutes one time. It has been a month now with no response!Desired Settlement: Refund my $495.00
