Whom It May Concern: I have reviewed the information provided by Mr. B[redacted] and appreciate the opportunity to respond. In his complaint, Mr. B[redacted] alleges that Vivint denied cancellation of his account for over a year. Mr. B[redacted] has moved overseas due to military orders, and now desires the cancellation of his account with Vivint, and a refund of all monies paid since Vivint has received his military orders.Vivint’s records show that on May 13, 2010, Mr. B[redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. However, Vivint spoke with Mr. B[redacted] regarding his alarm service on February 12, 2014.  Mr. B[redacted] represented that he was satisfied with Vivint’s services and that he was interested in extending the term of his agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. B[redacted] agreed.  Indeed, Vivint read the following statement, after which Mr. B[redacted] responded affirmatively:  You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Mr. B[redacted] contacted Vivint on June 17, 2014, and requested cancellation due to military orders to move overseas. Vivint did not receive Mr. B[redacted]’s orders until May 17, 2015. Due to Mr. B[redacted]’s orders pre-dating the extension of the contact, Vivint denied Mr. B[redacted]’s request for cancellation. To assist Mr. B[redacted] further, Vivint requested documentation of proof of residency to confirm Mr. B[redacted] still resides overseas. Mr. B[redacted] was unable to provide further documentation, so his account remained active. Although cancellation of Mr. Bunge‘s agreement without penalty is not warranted at this time, Vivint has agreed to do so. Vivint has also agreed to refund Mr. B[redacted] one month of service. A total of $[redacted] has been refunded to the payment method Vivint currently has on file. During this appointment, the Vivint technician upgraded  Mr. [redacted]’s Vivint door lock and pad, relocated Mr. [redacted]’s Vivint outdoor camera, and tested his system to insure the Vivint equipment was properly functioning. The Vivint technician also noted that Mr. [redacted] made racial jokes that made the Vivint technician uncomfortable. Mr. [redacted] again notified Vivint of his equipment concerns on September 6, 2017, and Vivint’s Scheduling department found an appointment for September 7, 2017. During this appointment, the Vivint technician installed a Vivint door lock, fixed Mr. [redacted]’s doorbell camera, and tested his system to insure the Vivint equipment was properly functioning.Vivint’s records show that Mr. [redacted] notified Vivint of his equipment concerns on September 7, 2017, and Vivint’s Scheduling department found an appointment for September 15, 2017. During this appointment, the Vivint technician fixed Mr. [redacted]’s Vivint door lock, adjusted the sensitivity level on his Vivint outdoor camera, and tested his system to insure the Vivint equipment was properly functioning. Vivint’s records further show that Mr. [redacted] notified Vivint of his equipment concerns on September 19, 2017, and Vivint’s Scheduling department found an appointment for September 20, 2017. During this appointment, the Vivint technician tested Mr. [redacted]’s Vivint system to insure the Vivint equipment was properly functioning. Vivint’s records show that Mr. [redacted] notified Vivint of his equipment concerns on September 25, 2017, and Vivint’s Scheduling department found an appointment for September 27, 2017. During this appointment, Mr. [redacted] asked the Vivint technician to lower his Vivint yard sign four (4) inches into the ground; additionally, Mr. [redacted] asked the Vivint technician to remove the leaves from his flower bed. The Vivint technician inspected the Vivint outdoor camera and noted that it was properly functioning and recording.It is my understanding that Mr. [redacted]’s Vivint security system is properly functioning and that Mr. [redacted] has taken advantage of having Vivint technicians sent to his home. Ms. [redacted] latter learned that the holes were not needed. Ms. [redacted] requests the holes be fixed or her account canceled.A representative from Vivint has recently contacted Ms. [redacted] over the phone in an effort to resolve her concerns.             Vivint Account #: [redacted]              Date of Agreement: August 13, 2016                                                                To Whom It May Concern:   I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond.   In her complaint, she explains that a Vivint sales representative informed her grandfather that Vivint was buying out his current alarm company, [redacted]. She goes on to explain that based off of this false representation, Vivint fraudulently sold Mr. [redacted] a new and upgraded security system. Ms. [redacted] requests that Vivint refund Mr. [redacted] all monies paid and reinstall his previous alarm system.   Vivint has previously been in contact with Ms. [redacted] and agreed to refund Mr. [redacted] $198 to cover the monies paid and reimburse him $100 to have the previous system reinstalled by [redacted]. Vivint has also agreed to cancel the account upon the receipt of the equipment. Vivint has attempted to contact Mr. [redacted] via phone; however, Vivint has not been able to reach him.   Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on August 13, 2016.   During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-eight (48) months.  He also represented that he would pay a monthly monitoring fee of $49.99 each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Ms. [redacted] responded affirmatively to the following questions:   Do you understand that Vivint and Parker are not affiliated with [redacted]? Do you understand that you are responsible for cancelling the agreement with [redacted] and for any agreement fees or termination fees with [redacted]?   Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.     Despite the above information, Vivint will honor the offer of cancelling the account upon receipt of the equipment. Ms. [redacted] desires cancellation of the Agreement without penalty if her window screen sensors will not work with the Vivint system. Vivint’s records indicate that Ms. [redacted] has an appointment scheduled for October 22, 2015 to see if Vivint can get her window screen sensors connected to her Vivint system. If it is discovered that Ms. [redacted]’s window screen sensors will not work with the Vivint system, Vivint will then review her account for a no penalty cancellation. In my original complaint I stated I cannot access my account online.   I still don't have access.  Apparently my request is too difficult to understand.
I need access to:

I had this access 3 weeks ago.  Now, I cannot log in, I cannot reset my password.  My account has been deleted (by Vivint).  The reason I want this access is so that I can see my billing information, being I do not get paper bills.  I cannot update a billing address, I cannot update my credit card, I cannot see what my next bill is, I cannot see if I have been credited anything.  I cannot do anything billing activity related.  I do not know any other way to state this.  This is Vivint's system and they should know how to put me back in the system, so that I can access it again.
As an FYI, yes I now have a Vivint Sky Account.  However with a Vivint Sky Account I cannot access billing through the VivintSky.com website, it redirects me back to https://account.vivint.com/ where I cannot log in.

Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she moved and requested a deferment of her payments, but that Vivint continued to charge her for service during that time.  Ms. [redacted] desires cancellation of her Agreement without penalty, and a refund of the months she paid for service she was not receiving, in the amount of $351.60.  Vivint’s records indicate that Ms. [redacted] notified Vivint of her move in July 2014, and was offered a deferment of her payments until she was able to install a system in her new home. Credits were applied to Ms. [redacted]’s Vivint account to cover four (4) months of service, but Ms. [redacted] did not arrange for installation of a system in her new home. Mr. [redacted]n [redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  The end of this initial term of the Agreement is November 24, 2015, and as such, Vivint will cancel the account immediately as requested by Ms. [redacted].  The four (4) months of deferred payments will not be charged.Furthermore, Ms. [redacted] has not paid for service since July 2015, leaving a past due balance of $[redacted] for the remainder of the initial term of the signed Agreement.  To assist Ms. [redacted], Vivint will waive that past due balance as well.  Mr. [redacted]’s Agreement is cancelled, and he has no further obligation to Vivint.  No refund is warranted, however.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-#### attention Department 160 - Legal.Sincerely, Nathan *. Mr. R[redacted] further alleges that he was not informed at the time of sale that the sales representatives are employed by a third party.  Mr. R[redacted] desires resolution of this matter through a Vivint representative he has been working with.  Vivint would like to apologize for any inconvenience experienced in Mr. R[redacted]’s interactions with customer service.  As a security company, Vivint does not generally provide, without a subpoena, recordings containing personal information or details of alarm events.  As such, Vivint’s Legal department was able to assist Mr. R[redacted] in this request where other departments could not.  Vivint’s records show that Ms. Elizabeth R[redacted] completed the sales and installation process of her Vivint system with Vivint Inside Sales and Field Service representatives.  Vivint does have third party door-to-door sales representatives, but Ms. R[redacted]’s account was set up by Vivint’s Inside Sales. I am rejecting this response because:
In May 2017, I filed Complaint #[redacted] against Vivint as they were disputing terms of my contract. I wanted to terminate my service as I was moving. I have emails from Vivint employee Jay M[redacted], dated May 10, 2017, which quoted me a final payoff to terminate my contract. I paid them - they check cleared Vivint's account on or about May 30. With my payoff, I requested Vivint place my on their permanent "Do Not Contact / Do Not Solicit" list. I moved on May 30 to my new residence in Cedar Hills. I received a bill from Vivint yesterday. The bill was in my name and had my previous address listed. The account number was different than my old Vivint account. I called Vivint for an explanation. I provided the Customer Rep with my email address and passcode; however, the Rep told me that my information was wrong and they would not give me details about the account in question. As the account is using my name, and presumably, my social security number, my credit rating is at stake. I paid Vivint to close my account but it is clear that they did not do this; OR, they sold my contract to the owner of my old residence without my expressed written permission to do so. I asked the rep to remove my name from the account OR refer me to their legal department; however, the Rep refused to do either of those.I want my name taken off of this account immediately. Vivint and the account holder do NOT have my permission to use my name and my personal information on any account. I do not have any contract with Vivint. I want verification from Vivint that this has been done and an apology for wasting my time with an issue that was resolved in May and for the anxiety that this has caused. After that, I want NO FURTHER CONTACT with Vivint in any manner.Sincerely,

As such, Ms. [redacted] requests cancellation of her account.A Vivint representative recently spoke with Ms. [redacted] over the phone to resolve her concerns. Vivint’s records indicate that this matter is being resolved to Ms. [redacted]’s satisfaction. Ms. [redacted]’s account will be canceled upon Vivint’s recovery of the equipment from her home. Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint she explains that there was a delay in canceling her account. As such, Ms. [redacted] requests that her account be cancelled and the billing to be adjusted accordingly.Vivint’s records indicate that Ms. [redacted] signed an agreement with Vivint on June 26, 2010. As part of that agreement Ms. [redacted] agreed to section 2.4 witch states, “After the Initial term, this agreement will automatically continue month-to-month and either party may terminate this agreement at any time upon at least thirty (30) days prior written notice to the other party. If terminated, this agreement ends on the last day of the thirty (30) day notice period.” Vivint’s records further show that Vivint received Ms. [redacted]’s written Notice of Cancelation on July 14, 2017. Ms. [redacted]’s account was cancelled thirty (30) days later as stated in the contract.
