Ms. [redacted] requests cancellation of her account.   At this time, cancellation without penalty is not warranted.   Vivint’s records indicate that prior to the installation of any equipment, Ms. [redacted] signed her System Purchase and Service Agreement (“Agreement”). Every customer must sign this document, and if a customer does not, Vivint will not install any equipment in the customer’s home. Our records show that Ms. [redacted] signed the Agreement on August 12, 2014.   Upon signing the Agreement, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $69.99 each month during that term. Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.     Should Ms. [redacted] wish to cancel her agreement prematurely, her payoff amount would be $2,099.70; however, in an effort to assist Ms. [redacted], Vivint is willing to reduce her payoff amount by 60%, bringing the total payoff amount to $839.88.  Alternately, Vivint is willing to lower her monthly payment by $15.00. have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In his complaint, Ms. [redacted] alleges that she was misled by a Vivint representative regarding the term of her agreement and the cancellation options Vivint provides its customers. Ms. [redacted] desires the cancellation of the agreement without penalty. Vivint’s records indicate that prior to the installation of any equipment; Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on July 23, 2015. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement including the three day trial period where cancellation can be requested without penalty.    Vivint records indicate Mr. [redacted] first contacted Vivint requesting cancellation on September 10, 2015. Mr. [redacted] was informed of the cancellation options he had at the time, and he would be unable to cancel without penalty. Later on September 10, 2015, Ms. [redacted] called in requesting cancellation and was informed of the same options quoted to Mr. [redacted] earlier. Ms. [redacted] was offer a credit to cover two months of her service fee in order to assist her. Ms. [redacted] declined this offer. Cancellation of Ms. [redacted] without penalty is not warranted at this time.  Should Ms. [redacted] wish to cancel her Vivint agreement prematurely, she may pay off the remaining balance on her account – currently $[redacted], however Vivint will take 25% off the payoff amount, bringing it to $[redacted]. Concern:I have reviewed the information provided by Mr. and Ms. [redacted] and appreciate the opportunity to respond. In their complaint Mr. and Ms. [redacted] explain that they were told by the sales representative that they would not be charged by the city for five faults alarms per year. Mr. and Ms. [redacted] explain that they had a faults alarm and their city charged them $650.00. Mr. and Ms. [redacted] request a refund of $650.00 and their account canceled.A representative from Vivint has recently attempted to contact Mr. and Ms. [redacted] via email in an effort to resolve their concerns. Vivint does not have any records of any promises made by the sale representative other than what is on the contract.In an effort to help Mr. and Ms. [redacted] and to resolve this issue. Vivint can cancel the account without any additional charges, if Mr. and Ms. [redacted] will allow a Vivint technician to come to their home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled. However, regarding the refund of $650, Vivint never charged Mr. and Ms. [redacted] $650. Those charges came from the city Mr. and Ms. [redacted] live in. Vivint advices if Mr. and Ms. [redacted] wish to dispute those charges to contact a representative from their city.           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she requested cancellation within the first month after installation of her system due to an accident and subsequent financial difficulty and move.  She states that Vivint refuses to cancel her Agreement and that she had a negative experience with Vivint’s customer service.  Ms. [redacted] desires a full refund of payments made to Vivint. A representative from Vivint has recently attempted to contact Ms. [redacted] in an effort to resolve her concerns. In Vivint's response they referred to a telephone survey in which I verbally agreed to the contract of 42 months.  I would like to hear the voice recording of such survey.  Since they provided a rebuttal, I would also like to make claim to the $150 in referral bonuses that were promised.  I await Vivint to provide audio evidence.  Thank you Revdex.com for your role in this matter.John *. July 23, 2013 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In her complaint, Mr. [redacted] alleges that he does not recall extending the term of his Agreement over the phone with Vivint, and that now he is unable to cancel his agreement. Mr. [redacted] desires cancellation of his agreement without penalty.Vivint’s records show that on November 10, 2010, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of thirty-six (36) months.  As such, the initial term of the Agreement would have lapsed on November 10, 2013. However, Vivint spoke with Mr. [redacted] regarding his alarm service on July 23, 2013. Mr. [redacted] represented that he was satisfied with Vivint’s services and that he was interested in extending the term of his agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. [redacted] agreed. Indeed, Vivint read the following statement, after which Mr. [redacted] responded affirmatively: You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Although the extension of the Agreement is valid, in an effort to resolve this matter, Vivint has agreed to the cancellation of Mr. [redacted]’s account without penalty. She is requesting immediate cancellation without penalty.At this time, Vivint is willing offer Ms. [redacted] one month of free service to compensate for any inconveniences that she has encountered. Cancellation without penalty is not currently warranted. Vivint’s records show that on April 30, 2015, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months.  By signing this Agreement, Ms. [redacted] represented that she understood and accepted all the terms of the contract, including the contract length and Vivint’s disclaimer that the operation of the equipment is not under warranty. In the Agreement, Vivint promises to repair or service any defective part of the system as soon as possible during normal business hours. A Vivint technician replaced the panel and doorbell camera and installed a router, free of charge, on June 28, 2017. Due to the above information, cancellation without penalty is not warranted at this time. 2016          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that some of his sensors are not functioning properly and he believes that Vivint used refurbished equipment instead of installing new sensors in his home.  Mr. [redacted] states that Vivint is trying to charge him for new sensors, and that he never received 2 new lamp modules as he was promised.  He desires either installation of new sensors and 2 lamp modules at no cost, or cancellation of his Agreement without penalty.  At this time, Vivint agrees to send a technician to Mr. [redacted]’s home, at no cost to him, to provide 2 new lamp modules.  Vivint remains willing to provide any new sensors to Mr. [redacted] at half price, should he decide to replace existing sensors with new ones during this service visit.   Vivint has also applied a credit to Mr. [redacted]’s account for one month of service, to assist with these costs.  Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on February 9, 2016. During the recorded Pre-Installation Survey, Mr. [redacted] was asked if he had a previous alarm system in his home.  Mr. [redacted] represented that he moved into a home with alarm equipment already installed, and that he would like to keep it and also add some new equipment.  Vivint’s installing technician activated the existing equipment and also added new equipment from Vivint, as shown on the Schedule of Equipment and Services signed by [redacted] or [redacted] at the time of installation.   The amount of free equipment offered by Vivint’s sales representative was installed new in Mr. [redacted]’s home in addition to activation of the existing equipment.Further, Mr. [redacted] signed a System Purchase and Services Agreement on February 10, 2016, in which he agreed to an initial term of forty-two (42) months and a monthly services fee of $60.99, plus any applicable taxes, during that term.  The Agreement states that Vivint does not warrant any work or products provided by the customer or a third party used in connection with the system (Section 3).  As such, Vivint will not replace at no cost any equipment that was not installed by Vivint’s technician.  Cancellation of the Agreement or free replacement of existing sensors are not warranted at this time.Despite this information, Vivint agrees to the above resolution.  Mr. [redacted] will not be charged for service in December, and he may schedule his service appointment by calling Vivint’s Customer Care department at 1-800-216-5232.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that her sales representative promised that she could cancel her System Purchase and Services Agreement (“Agreement”) without penalty if she decided to move but Vivint has not allowed her to do so. Ms. [redacted] desires her Agreement cancelled without penalty and a refund for August and September’s monthly payments. Vivint agrees to cancel Ms. [redacted] Agreement without penalty as a gesture of goodwill. As of the date of this letter Ms. [redacted] has no further obligation to Vivint. Vivint’s records indicate that Ms. [redacted] entered into her Agreement on July 12, 2013. By signing her Agreement Ms. [redacted] agreed to pay a monthly monitoring service fee of $68.99 plus any applicable taxes each month during a term length of sixty (60) months. Vivint has also been providing monitoring service to Ms. [redacted] home since the alarm system was originally installed. As such, a refund for two months of service is not warranted. Since the alleged referrals took place three years ago, Vivint will be unable to provide Mr. M[redacted] with the alleged referral credits. However, Vivint’s offer of a reduced payoff of $[redacted] still stands. I am rejecting this response because: These are two different accounts. I closed my account. But this complaint is about Mrs. [redacted] account.  I had to discuss with someone, because the individual I spoke with gave me the phone number to fax in the death certificate, and told me to give them a couple of days before falling to ensure they had received it.  I've talked to several representatives about this issue, and they are lying.  I pray to God no one has to ever experience this undue hardship. In the end they'll lose more than they gain.
