I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me - Contingent upon the October '17 refund promised by Vivint in this latest response, and that the November '17 & December '17 disputes made to my bank regarding Vivint charges, that were only conditionally credited, REMAIN credited with no dispute from Vivint; which I have made clear from the outset of my complaint, that these THREE charges to my account were all in dispute. This resolution is also accepted under the previously replied conditions Vivint personnel agreed to abide by, and close my account with their company, and all further charges to me, from Vivint, will cease immediately.

2014          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he began having problems with his system within the first year it was installed and did not want to pay Vivint’s trip fee for a service visit.  Mr. [redacted] explains that Vivint was not willing to help him with these issues, and he desires cancellation of his Agreement without penalty.  In resolution to this matter, Vivint agrees to send a technician to Mr. [redacted]’s home at no cost, to address any issues with his system.  In addition, Vivint agrees to reduce Mr. [redacted]’s monthly services fee by 55% for the remaining 13 months of his Agreement term.  This also reduces the payoff balance by 55%, should he wish to pay off and cancel his Agreement prematurely.  Vivint’s records indicate that Mr. [redacted] signed an Agreement with an initial term of sixty (60) months and a monthly services fee of $60.99, plus any applicable taxes, during that term.  The Agreement states that Vivint will provide a replacement for any defective part without charge, but the customer will pay a visit charge for each service call. (Section 6: Repair Service)  Vivint’s records show that Mr. [redacted] called to report issues with his system, including the door lock, on October 18, 2014, and a service visit was scheduled and completed on October 20, 2014.  Vivint did not hear from Mr. [redacted] again until December 6, 2017 when he called with questions about his bill.Cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time; however, his monthly services fee has been reduced to $27.45 (plus any applicable taxes), and if he wishes to schedule his free service visit or pay off and cancel his account at the reduced rate, he may contact Vivint’s Customer Loyalty department at 1-800-216-5232.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she moved and requested a deferment of her payments, but that Vivint continued to charge her for service during that time.  Ms. [redacted] desires cancellation of her Agreement without penalty, and a refund of the months she paid for service she was not receiving, in the amount of $351.60.  Vivint’s records indicate that Ms. [redacted] notified Vivint of her move in July 2014, and was offered a deferment of her payments until she was able to install a system in her new home. Credits were applied to Ms. [redacted]’s Vivint account to cover four (4) months of service, but Ms. [redacted] did not arrange for installation of a system in her new home. Mr. [redacted]n [redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  The end of this initial term of the Agreement is November 24, 2015, and as such, Vivint will cancel the account immediately as requested by Ms. [redacted].  The four (4) months of deferred payments will not be charged.Furthermore, Ms. [redacted] has not paid for service since July 2015, leaving a past due balance of $[redacted] for the remainder of the initial term of the signed Agreement.  To assist Ms. [redacted], Vivint will waive that past due balance as well.  Mr. [redacted]’s Agreement is cancelled, and he has no further obligation to Vivint.  No refund is warranted, however.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-#### attention Department 160 - Legal.Sincerely, Nathan *. 2015 To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he does not recall extending the term of his Vivint agreement, and now he is unable to cancel his agreement. Mr. [redacted] desires cancellation of his agreement without penalty.Vivint’s records show that on September 7, 2012, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. Vivint spoke with Mr. [redacted] regarding his alarm service on March 25, 2015.  Mr. [redacted] informed Vivint that he was going to be moving. A Vivint representative informed Mr. [redacted] of the Vivint Moves Policy and explained to him that Vivint would waive the $99.00 move fee and lower the price of the Vivint Go Control Panel from $99.00 to $49.00 in exchange for his Vivint agreement being extended by forty-two (42) months to which Mr. [redacted] agreed.  Vivint’s Scheduling department found an appointment for March 25, 2015 to install a Vivint security system in his new home. 2016          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that some of his sensors are not functioning properly and he believes that Vivint used refurbished equipment instead of installing new sensors in his home.  Mr. [redacted] states that Vivint is trying to charge him for new sensors, and that he never received 2 new lamp modules as he was promised.  He desires either installation of new sensors and 2 lamp modules at no cost, or cancellation of his Agreement without penalty.  At this time, Vivint agrees to send a technician to Mr. [redacted]’s home, at no cost to him, to provide 2 new lamp modules.  Vivint remains willing to provide any new sensors to Mr. [redacted] at half price, should he decide to replace existing sensors with new ones during this service visit.   Vivint has also applied a credit to Mr. [redacted]’s account for one month of service, to assist with these costs.  Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on February 9, 2016. During the recorded Pre-Installation Survey, Mr. [redacted] was asked if he had a previous alarm system in his home.  Mr. [redacted] represented that he moved into a home with alarm equipment already installed, and that he would like to keep it and also add some new equipment.  Vivint’s installing technician activated the existing equipment and also added new equipment from Vivint, as shown on the Schedule of Equipment and Services signed by [redacted] or [redacted] at the time of installation.   The amount of free equipment offered by Vivint’s sales representative was installed new in Mr. [redacted]’s home in addition to activation of the existing equipment.Further, Mr. [redacted] signed a System Purchase and Services Agreement on February 10, 2016, in which he agreed to an initial term of forty-two (42) months and a monthly services fee of $60.99, plus any applicable taxes, during that term.  The Agreement states that Vivint does not warrant any work or products provided by the customer or a third party used in connection with the system (Section 3).  As such, Vivint will not replace at no cost any equipment that was not installed by Vivint’s technician.  Cancellation of the Agreement or free replacement of existing sensors are not warranted at this time.Despite this information, Vivint agrees to the above resolution.  Mr. [redacted] will not be charged for service in December, and he may schedule his service appointment by calling Vivint’s Customer Care department at 1-800-216-5232.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has experienced multiple issues with her Vivint system and that she was unaware of signing a sixty (60) month contract. She is requesting immediate cancellation without penalty.At this time, Vivint is willing offer Ms. [redacted] one month of free service to compensate for any inconveniences that she has encountered. Cancellation without penalty is not currently warranted. Vivint’s records show that on April 30, 2015, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of sixty (60) months.  By signing this Agreement, Ms. [redacted] represented that she understood and accepted all the terms of the contract, including the contract length and Vivint’s disclaimer that the operation of the equipment is not under warranty. In the Agreement, Vivint promises to repair or service any defective part of the system as soon as possible during normal business hours. A Vivint technician replaced the panel and doorbell camera and installed a router, free of charge, on June 28, 2017. Due to the above information, cancellation without penalty is not warranted at this time. Concern:I have reviewed the information provided by Mr. and Ms. [redacted] and appreciate the opportunity to respond. In their complaint Mr. and Ms. [redacted] explain that they were told by the sales representative that they would not be charged by the city for five faults alarms per year. Mr. and Ms. [redacted] explain that they had a faults alarm and their city charged them $650.00. Mr. and Ms. [redacted] request a refund of $650.00 and their account canceled.A representative from Vivint has recently attempted to contact Mr. and Ms. [redacted] via email in an effort to resolve their concerns. Vivint does not have any records of any promises made by the sale representative other than what is on the contract.In an effort to help Mr. and Ms. [redacted] and to resolve this issue. Vivint can cancel the account without any additional charges, if Mr. and Ms. [redacted] will allow a Vivint technician to come to their home to remove the equipment. After the technician has removed the equipment the account and contract will be canceled. However, regarding the refund of $650, Vivint never charged Mr. and Ms. [redacted] $650. Those charges came from the city Mr. and Ms. [redacted] live in. Vivint advices if Mr. and Ms. [redacted] wish to dispute those charges to contact a representative from their city. reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he was contacted by an attorney stating he was hired in regard to a lawsuit on behalf of Vivint. Mr. [redacted] further alleges his account was cancelled with Vivint two years ago because of a military move and all the documents were sent to Vivint. Vivint’s records show that Ms. [redacted] signed a Purchase and Services Agreement upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-two (42) months. He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term. Mr. [redacted] contacted Vivint on January 31, 2014, to request cancellation of his account due to a military move. During this conversation with a Vivint representative, Mr. [redacted] was instructed to send in documentation of his military orders and a written notice of cancellation. Vivint never received the requested documentation in order for the account to be reviewed for possible cancellation; as such the account remained active and continued to be invoiced. Vivint’s records further show that Mr. [redacted] stopped making his monthly payments after November 2013. Mr. B[redacted] has moved overseas due to military orders, and now desires the cancellation of his account with Vivint, and a refund of all monies paid since Vivint has received his military orders.Vivint’s records show that on May 13, 2010, Mr. B[redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months. However, Vivint spoke with Mr. B[redacted] regarding his alarm service on February 12, 2014.  Mr. B[redacted] represented that he was satisfied with Vivint’s services and that he was interested in extending the term of his agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Mr. B[redacted] agreed.  Indeed, Vivint read the following statement, after which Mr. B[redacted] responded affirmatively:  You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Mr. B[redacted] contacted Vivint on June 17, 2014, and requested cancellation due to military orders to move overseas. Vivint did not receive Mr. B[redacted]’s orders until May 17, 2015. Due to Mr. B[redacted]’s orders pre-dating the extension of the contact, Vivint denied Mr. B[redacted]’s request for cancellation. To assist Mr. B[redacted] further, Vivint requested documentation of proof of residency to confirm Mr. B[redacted] still resides overseas. Mr. B[redacted] was unable to provide further documentation, so his account remained active. Although cancellation of Mr. Bunge‘s agreement without penalty is not warranted at this time, Vivint has agreed to do so. Vivint has also agreed to refund Mr. B[redacted] one month of service. A total of $[redacted] has been refunded to the payment method Vivint currently has on file. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she switched alarm companies in July 2015 and sent in a Notice of Cancellation to Vivint, but Vivint did not cancel the account. Ms. [redacted] desires the cancellation of her Vivint account and a refund from July 2015 to September 2015.Vivint’s records indicate Vivint first received the request for cancellation of Ms. [redacted]’s account on August 12, 2015. Ms. [redacted] was informed to send in a Notice of Cancellation and that it will serve as her 30 day notice as stated in her Purchase and Services Agreement (Section 2.4). Vivint received Ms. [redacted] Notice of Cancellation on August 17, 2015. Ms. [redacted]’s Vivint account was cancelled on September 14, 2015. After further review, Vivint’s records show that Ms. [redacted]’s agreement with Vivint has been cancelled and she has no further contractual obligation to Vivint. All payments made to Vivint are valid; however Vivint has agreed to refund Ms. [redacted] payment made in September and August 2015.
