the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that Vivint is still charging him for services after he cancelled his account. Mr. [redacted] is requesting his account be cancelled and to be refunded for services not rendered. Vivint’s records indicate that by signing his System Purchase and Service Agreement (“Agreement”) Mr. [redacted] agreed to the following clause. Section 2.1 This Agreement starts on the day this Agreement is signed and continues for the initial term. After the initial term, this Agreement will automatically continue month-to-month and either party may terminate this Agreement at any time upon at least thirty (30) days prior written notice to the other party. If terminated, this agreement ends on the last day of the thirty (30) day notice period. Vivint’s records indicate that we did not receive a written notice of cancellation until September 12, 2016. As such, Mr. [redacted]’s Agreement was terminated after the third (30) day notice period on October 13, 2016.Despite the above information, Vivint has agreed to refund Mr. [redacted] the payment made on October 3, 2016 for $60.99. Mr. [redacted] can see this credited back to his AMEX card within the next 5-7 business days. the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was misled by a Vivint representative regarding the deferment of his account. He explains that in November of 2017 he was told that his account would be deferred until he moved into a permanent residence, however despite this he continued to be billed. Mr. [redacted] requests a refund of these payments and cancellation of his Agreement with no penalty.  Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on August 1, 2014. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of sixty (60) months.  He also represented that he would pay a monthly monitoring fee of $63.99 each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement.   Cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time. Vivint records indicate that on November 7, 2017 Mr. [redacted] spoke with a Vivint representative to inform them of his impending move and that he would not be able to utilize the system for a period of time until he moved into a permanent residence. While Vivint does offer a deferment of payments for a period of up to six (6) months, Mr. [redacted] was informed that his account did not qualify for a deferment at that time as his account was not current on payments. He was informed that his account could be deferred once the past due balance was paid. Records show that this past due balance was paid on December 9, 2017 and the account was subsequently deferred six (6) months on January 8, 2018. As such, no refund is warranted at this time.Should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $1599.75; however, in an effort to assist Mr. [redacted], Vivint is willing to lower his payoff amount by 50%, bringing the total payoff amount to $799.87.  If Mr. [redacted] wishes to take advantage of this offer, I would advise him to contact Vivint’s Customer Loyalty department at 1-800-216-5232.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. I am rejecting this response because: Rebekah B[redacted], a representative of Vivint Legal department, and myself agreed that the equipment would be returned to Vivint and a full refund would be issued. On 02/02/18, a technician of Vivint came out to the property and secure the equipment. Rebekah and myself determined that the amount of the return should have been $5522.23. This amount include 7 months of services and the total paid for equipment. On 02/06/2018, I received an email notification stating that the amount of my refund would be $2894.33 for Case number [redacted] despite efforts made to contact Rebekah to seek clarification on the issue she has not returned my call or answered my email. As a result, I do not agree with this resolution. Attached you will find the receipts for the total cost of the equipment purchased from Vivint and the refunded amount does not cover that cost.

It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’ complaint he explains that he moved to his new home in September 2013 but the move of his security system was not complete. Mr. [redacted] further explains that he continued payment on the service until he was made aware in November 2016 that the move was not complete. As such. Mr. [redacted] requests cancelation of his account and a refund of all monthly payments from September 2013 to November 2016. Vivint’s records indicate that Mr. [redacted] singed a System Purchase and Services Agreement on February 22, 2013. In that agreement in section 12: Customer Duties it states, “You will test the System’s protective devices and send test signals to the Center in accordance with our instructions at least monthly… If a problem with the System occurs, you will notify us.” Vivint has no records of any tests done on the system. It is also the customer’s duty to make sure the move is scheduled at their convince. Vivint have any record of an appointment being made to install the system in Mr. [redacted]’ new home. Due to these facts a refund of all the monthly payments is not warranted.Despite these facts, in an effort to assist Mr. [redacted], Vivint is willing to cancel Mr. [redacted]’ account as of today November 23, 2016 and refund him $500.00 in the form of a check. He requests a refund of $87.98.   Vivint has agreed to refund Mr. [redacted] $87.98. He will receive this in his account within 7-10 business days.   Vivint’s records indicate that the charge of $68.99 that Mr. [redacted] is disputing was withdrawn on July 20, 2016. Vivint did not receive his notice of cancellation until July 27, 2016. Therefore, it is simply out of goodwill that Vivint is refunding this amount.   In addition, the payment of $18.99 that Mr. [redacted] is disputing was the remaining amount due within the 30-day cancellation period. Vivint Wireless’ records further indicate that when Mr. or Ms. [redacted] call in when the internet was not working it was due to outages that were resolved within a few hours. Also Vivint Wireless’s records show that for the first six months of service Mr. and Ms. [redacted] received a $20 discount on their service per month. As well as a $20 credit that was placed on the account on April 12, 2016 for time that her system was not working due to outages.Vivint security’s records indicate that a technician was sent to Mr. and Ms. [redacted]’s home on February 2, 2016 to replace the door lock that they were experiencing issues with. After that date Vivint has no record of any issues with the system.In an effort to assist Mr. and Ms. [redacted] Vivint will be able to have another technician go to their home to fix the door lock and make sure the whole system is working as intended. Due to the records that Vivint has stating that the internet service is working as intended and Mr. and Ms. [redacted] have received credits for downtime no more credits on the account are necessary. Also, for the same reasons cancelation of the internet service is not warranted at this time. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has been experiencing multiple equipment issues and that Vivint charges a $49.00 fee for a technician visit. She is requesting that the equipment be serviced at no charge, or immediate cancellation.   At this time, Vivint is willing to provide a month of free service to compensate for any inconveniences that Ms. [redacted] has encountered, as well as one free technician appointment to ensure the equipment’s functionality. Vivint’s records indicate that on June 5, 2016, Ms. [redacted] signed a Purchase and Services Agreement (“Agreement”) with an initial term of forty-two (42) months. By signing this Agreement, Ms. [redacted] represented that she understood and accepted all the terms contained within the contract. As stated in the contract, Vivint does not warrant that the System cannot be compromised or that it will always operate. However, Vivint does guarantee technical assistance over the phone or via a service appointment. The Agreement further states that after the initial one hundred and twenty (120) days following installation, the customer will pay a visit charge for each service call at the then-prevailing visit fee. That fee is currently $49.00. Due to the above information, Vivint is willing to provide one month of free service and one free technician appointment. Vivint maintains its stance that repair rather than cancellation is the proper course of action for Ms. D[redacted]’ account. Vivint is willing to work with their scheduling department in order to find an appointment within a reasonable amount of time. Vivint also provides their customers a 24/7 Customer Care department in order to assist their customers with troubleshooting over the phone. Ms. D[redacted] can call in at her earliest convenience and troubleshoot her technical concerns with a Vivint representative. Ms. D[redacted] may also cancel her agreement prematurely if she agrees to pay Vivint a reduced payoff of $[redacted]. Ms. [redacted] desires cancellation of her Agreement without penalty.At this time, Vivint agrees to waive the past due balance of $96.70 and cancel Ms. [redacted]’s Agreement without penalty, effective immediately.Vivint’s records show that on July 18, 2011, Ms. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  Vivint spoke with Ms. [redacted] regarding her alarm service on June 17, 2015.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her Agreement in exchange for a reduced monthly rate.  Based upon this representation, Vivint offered a thirty-six (36) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement thirty-six months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Despite the validity of this extension, Vivint agrees to the above resolution.  Ms. [redacted] has no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.
