Ms. [redacted]’s desired resolution is cancelation of the contract.   A representative from Vivint has recently attempted to contact Ms. [redacted] in an effort to resolve her concerns. In an effort to help Ms. [redacted] Vivint can cancel the account without any additional charges, if Ms. [redacted] will allow a Vivint technician to come to her home to remove the equipment. Concern:  I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states that her alarm system has not operated correctly since it was originally installed. Ms. [redacted] desires her System Purchase and Services Agreement (“Agreement”) cancelled without penalty. Vivint agrees to cancel Ms. [redacted]’s Agreement without penalty and waive any past due balance provided Vivint can remove the alarm system from her home. I would advise Ms. [redacted] to contact Vivint and schedule an appointment to facilitate this resolution. Vivint’s records indicate that a technician recently went out to Ms. [redacted] home and tested her internet connection to the master alarm panel. It was discovered that Ms. [redacted]’s internet speed was not fast enough to handle all of Vivint’s equipment. By signing her Agreement Ms. [redacted] agreed to provide adequate internet service to ensure that the alarm system would operate efficiently as stated in section twelve (12). To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. Vivint’s records show that on December 4, 2014, Mr. [redacted] signed a Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  As such, the initial term of the agreement would have lapsed on May 19, 2018.  However, Vivint spoke with Mr. [redacted] regarding his alarm service on April 19, 2017.  Mr. [redacted] represented that he would extend his Vivint contract by sixty (60) months in exchange for two (2) Vivint outdoor cameras priced at $330.00. Vivint agreed to the terms of the sixty (60) month extension, took payment in the amount of $330.00, and scheduled an appointment for a Vivint technician to install two (2) outdoor cameras on May 8, 2017 on his home. Vivint’s records indicate that Mr. [redacted] called into Vivint on April 26, 2017 to cancel his appointment.Cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time. Vivint agrees to the above resolution in regards to the sixty (60) month extension. Vivint will send a field service professional to Mr. [redacted]’s home at no charge to install the Vivint outdoor cameras. Alternatively, should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $3.775.41; however, I would be willing to lower Mr. [redacted]’s payoff amount by 55%, bringing the total payoff amount to $1,698.96. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] alleges that his cameras have not been installed yet and has been having issues with his doorbell camera and thermostat. Mr. [redacted] desires cancellation of the agreement or the replacement of his system equipment. Vivint’s records indicate that Mr. [redacted] has an appointment to have his camera installed on October 5, 2015. During this appointment the technician will be able to resolve the issues with his doorbell camera and his thermostat. A $** credit has been applied to Mr. [redacted]’s account for the time he has been without cameras.  Vivint would like to ensure that Mr. [redacted]’s alarm system will operate efficiently, Mr. [redacted]’s account has been upgraded to premium service. 2016                          To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he has had multiple complications with his thermostat that have not been resolved, and that he had a problem at the time of installation and has not requested any credits.  A representative from Vivint has recently attempted to contact Mr. [redacted] in an effort to resolve his concerns.  At this time, Vivint will reduce Mr. [redacted]’s monthly services fee by $10.00 for the remainder of his Agreement term.Vivint’s records show that Mr. [redacted] notified Vivint of his recent thermostat concerns on June 1, 2017, and a technician was dispatched to his home on June 6, 2017.  During this visit, it was determined that the best course of action would be to downgrade the service by removing the thermostat. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she has been experiencing multiple equipment issues and that Vivint charges a $49.00 fee for a technician visit. She is requesting that the equipment be serviced at no charge, or immediate cancellation.   At this time, Vivint is willing to provide a month of free service to compensate for any inconveniences that Ms. [redacted] has encountered, as well as one free technician appointment to ensure the equipment’s functionality. Vivint’s records indicate that on June 5, 2016, Ms. [redacted] signed a Purchase and Services Agreement (“Agreement”) with an initial term of forty-two (42) months. By signing this Agreement, Ms. [redacted] represented that she understood and accepted all the terms contained within the contract. As stated in the contract, Vivint does not warrant that the System cannot be compromised or that it will always operate. However, Vivint does guarantee technical assistance over the phone or via a service appointment. The Agreement further states that after the initial one hundred and twenty (120) days following installation, the customer will pay a visit charge for each service call at the then-prevailing visit fee. That fee is currently $49.00. Due to the above information, Vivint is willing to provide one month of free service and one free technician appointment. Vivint reviewed the call between Vivint’s representative and Mr. [redacted] requesting additional equipment on August 31, 2016. Mr. [redacted] was informed of the cost associated with added the requested equipment. As such Mr. and Ms. [redacted]’s monthly rate was increased. The Agreement states that Mr. [redacted] authorizes Vivint to make electronic fund transfers from the card or account on file in the amount of any fees owed to Vivint (Section 2.5). When the appointment was cancelled, the change in the monthly rate had already occurred but was previously authorized. Given Mr. and Ms. [redacted] did not receive the additional equipment. Vivint authorized a refund of $173.05 to be sent back to the checking account on file and their monthly rate was lowered back to their original rate.  Cancellation of the account without penalty is not warranted. Should Mr. and Mrs. [redacted] wish to cancel their Vivint agreement prematurely, they may pay off the remaining balance on their account – currently $4,987.42; however Vivint will take 25% off the payoff amount, bringing it to $3,740.57. 2007       Date of Addendum: June 29, 2010           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she cancelled her account in 2014, and that Vivint recently started to bill her for service again. Ms. [redacted] explains that she contacted Vivint to dispute the charges and had negative experiences with customer service but paid the past due balance. She desires a refund of the $96.50 she recently paid to Vivint. Ms. [redacted]’s account was cancelled as of December 27, 2017 after her written cancellation request, and she has no further obligation to Vivint.  In an effort to assist Ms. [redacted], a check in the amount of $96.50 is being sent to the mailing address provided on this complaint, to refund the last payment made. Vivint’s records show that Ms. [redacted] signed an Agreement with Vivint on July 9, 2007, in which she agreed that service would continue year to year after the initial term of thirty-six (36) months, unless cancelled in writing no later than 30 days before the end of the original term or any renewal term (Alarm System Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was never provided by Ms. [redacted] until November 27, 2017, and Vivint has no record of a cancellation request in 2014.  Automatic payments on the account stopped after June 2017, and as such Vivint began contacting Ms. [redacted] to collect past due balance.  Vivint agrees to the above resolution.  Ms. [redacted]’s account with Vivint was cancelled 30 days after the written notice of cancellation was received, and she may expect her refund check in the mail in 7-10 business days.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she called Vivint to change her billing cycle date, but that she was not satisfied with the customer service and that the requested change was not made on her account, which cost her additional money.  Ms. [redacted] desires for Vivint to reprimand the customer service agent she spoke with as the mistake caused her increased stress and loss of funds.  Vivint’s records confirm that Ms. [redacted] called Vivint on October 5, 2015 to change her billing cycle date.  Ms. [redacted]’s billing account is set to automatically draft on the 5th of each month, and the payment was already set to come out on the date she called in.  As such, October’s payment drafted that day and the billing cycle date was not changed.  I apologize for any misinformation that Ms. [redacted] may have been given regarding her billing cycle.  Vivint will pursue any necessary discipline and direction for the representative who spoke with Ms. [redacted].To assist Ms. [redacted] at this time, I have applied a credit to her billing account in the amount of $[redacted], to cover one month of service. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: ###-###-####, attention Department 160 – Legal. December 6, 2016Revdex.com of Utah3703 W 6200 SSalt Lake City, Utah 84129 RE:   Consumer Complaint Case #: [redacted]        Complainant: [redacted]        Vivint Account #: [redacted]        Date of Agreement: February 10, 2016          To Whom It May Concern:In his rebuttal, Mr. [redacted] states that when he spoke with Vivint’s sales representative, the existing door sensors specifically were not discussed.  Mr. [redacted] further states that he does not believe he would have been charged more at installation had he requested all new sensors for his doors.  He explains that everything has stopped working and his home is not secure at this time.  Vivint maintains its position that Mr. [redacted] was provided with an appropriate amount of new equipment at the time of installation, and that repair of his system is the proper course of action at this time.  Vivint remains willing to send a technician to Mr. [redacted]’s home, at no cost to him, to provide 2 new lamp modules, and to provide any new sensors to Mr. [redacted] at half price, should he decide to replace existing sensors with new ones during this service visit.   Vivint has also applied a credit to Mr. [redacted]’s account for one month of service, to assist with these costs.  The telephonic Pre-Installation Survey mentioned in Vivint’s previous response took place after the sales calls. The purpose of this survey is to verify certain information, ensure that each customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. During this conversation with Vivint’s Account Creation department, Mr. [redacted] represented that he moved into a home with alarm equipment already installed, and that he would like to keep it and also add some new equipment.  Mr. [redacted]’s signed Schedule of Equipment and Services (attached to this response) shows how the points of new equipment offered by Vivint’s sales representative were used during the installation.  Vivint offers a certain amount of free equipment, and after using that allotment, a customer is required to purchase any additional new equipment if desired.  Due to the existing equipment in Mr. [redacted]’s home that Vivint was able to activate, he was able to use his allotment of points on sensors beyond window and door sensors. Mr. [redacted]’s Schedule of Equipment and Services shows that he was able to have a new CO detector, smoke/heat detector, and motion detector installed at no cost because his windows and doors were already covered by his existing sensors. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he was pressured into buying the system. Mr. [redacted] requests help in resolving this issue.Vivint’s records indicate that Mr. [redacted] signed an agreement with Vivint on June 13, 2015. Mr. [redacted] agreed to an original agreement term of sixty (60) months and to pay Vivint a monthly fee of $49.99 plus any taxes each month of that term. Vivint records further show that Mr. [redacted] ceased making his contractual monthly payments in January 2016. Mr. [redacted]’s account was then cancelled and sold to an outside collections agency on April 28, 2016.
