Ms. [redacted] acknowledges that Vivint cancelled the last 6 months of her contract, but she has been advised by her attorney to have the system re-installed.  Ms. [redacted] states that she sent a copy of her police report to Vivint, and she asks why Vivint agreed to cancel her contract prematurely if they did not believe they were at fault.Vivint agreed to waive the remaining months of Ms. [redacted]’s Agreement and cancel her account in an effort to resolve her concerns after she reported a break-in.  This resolution was not an admission of fault but was a goodwill effort to assist Ms. [redacted].  As stated previously, Ms. [redacted]’s system was reporting to Vivint’s central station correctly, and Vivint made appropriate efforts after the alleged break-in to restore Ms. [redacted]’s system at no cost to her. Vivint has reviewed Ms. [redacted]’s police report and the alarm history from her account, and maintains its position that Vivint is not responsible for any loss or damages to Ms. [redacted]’s home resulting from the alleged break-in.Vivint cancelled Ms. [redacted]’s contract prematurely at her request, and she has no further obligation to Vivint.  She may contact Vivint’s sales department at 1-855-855-8765 if she wishes to have a system installed again.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759 attention Department 160 - Legal. Mr. [redacted] requests that Vivint cancel his account.   At this time, Vivint is willing to cancel Mr. [redacted]’ account without penalty.      Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] signed the Agreement on November 14, 2014.   Upon signing the Agreement, Mr. [redacted] represented that he understood and agreed to the initial term of forty-two (42) months.  He also represented that he would pay a monthly monitoring fee of $69.99 each month during that term. I am rejecting this response because: I signed the service agreement that was signed by me was based on my agreeing to pay Vivint 60 payments for security services.   The key word is SERVICE! I am paying for services that since I have signed up with Vivint I have not experienced ALL services.  Currently,  for at least 6 months or more I repeatedly have false alarms and must place several zones on bypass in order to set the alarm, which defeats the purpose of paying $70 a month for a secret alarm.  Once again the service agreement did not indicate they I will be responsible to pay and continue to be required to pay for services that I am not receiving, that is illegal  and frudulant on the part of Vivint.  Buyers Beware. Save yourselves the trouble and DO NOT do business with Vivint! !

Ms. [redacted] desires cancellation of her mother’s Agreement and a full refund of her payments to Vivint.Vivint’s records indicate that before the installation of the equipment, Ms. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, to verify certain information regarding the terms of the Agreement and other important details. Our records show that Ms. [redacted] completed the required Pre-Installation Survey on February 24, 2017. During the recorded Pre-Installation Survey, Ms. [redacted] represented that she understood and agreed to the initial term of sixty (60) months.  She also represented that she would pay a monthly monitoring fee of $49.99 each month during that term.  Further, Ms. [redacted] represented that she understood that Vivint was not associated with any other alarm company.  Vivint relied on Ms. [redacted]’s representations to ensure that she understood her commitments to Vivint as outlined in the Agreement.   Despite the above information Vivint has agreed to immediately cancel Ms. [redacted]’s agreement upon the return of the equipment. the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] states her sales representative promised that Vivint would install a new security system into her new home in the event that she moved. When she called Vivint to report her move she was told that she needed to bring her equipment with her from her previous residence, which was not possible since she had already moved. Further, Ms. [redacted] states that Vivint refused to cancel her System Purchase and Services Agreement (“Agreement”) even though she was not receiving service after her move. Ms. [redacted] desires her Agreement to be cancelled and she will pay Vivint $179.97 for the service she did receive at her previous residence.  Vivint’s records indicate that Ms. [redacted] entered into an Agreement with Vivint on June 4, 2015 with an initial term length of forty-two (42) months. By signing her Agreement Ms. [redacted] agreed to pay a monthly monitoring fee of $59.99 plus any applicable taxes each month during that term. Ms. [redacted] called Vivint on August 20, 2016 to inquire about moving her service. Ms. [redacted] was informed at that time that she would need to bring the master panel with her to her new residence and Vivint would install her system into her new home for a nominal fee of $99. Since Ms. [redacted] did not inform Vivint that she was moving residences before she moved and the equipment was no longer accessible Ms. [redacted] was informed that she would have to pay a fee to have a new master panel installed in her home. Ms. [redacted] did not agree with Vivint’s move policy and did not contact Vivint again until January 1, 2016 when she discovered that her account had been transferred to a third party collection agency. Vivint offered installation of a new security system in her home free of charge provided she pay a discounted reinstatement fee of $465.92, marked down from her past due balance of $585.90. Ms. [redacted]’s sales representative paid her first month’s service fee of $59.99 and her activation fee of $99 on June 4, 2016. Vivint did not receive any further payment towards her account. As such, Ms. [redacted]’s Agreement was transferred to a third party collection agency for nonpayment on November 27, 2015. At this time Ms. [redacted] must settle her past due amount with [redacted], they can be reached at ###-###-####. Alternatively, Vivint’s previous offer still stands. If Ms. [redacted] will agree to pay her discounted past due amount of $465.92 Vivint will agree to install a new system in her home free of charge. [redacted]Do to I have sent vivint back all there equipment and I didn't agree to anything stating 42 months special in a survey who does that then they say they agree to seen someone out but they didn't tell you it will be two(2) weeks before someone come out the tech person sent a email stating they can come out December 12, 2017 so you want me to keep jump up in the middle of the nights because there issues with your equipment with false alarms and if it was someone try to break in my home I wouldn't know if it was real or a false because it goes off when ever it want to it just wasn't at night it also goes off in the middle of the day twice I had to leave my job to check just because its going of as if someone broken in I LOST MY JOB BECAUSE I HAD TO LEAVE GO TO CHECK TO SEE IF SOMEONE BROKEN IN MY HOUSE AND IT WAS A FALSE ALARM so yes I cancel do to this issues and I don't have A JOB to PAY know buy out price WHICH you have your EQUIPMENT back so only agreement we will agree on is $500.00 dollar you cause me and my kids pain and suffering from this issues and now they are scare because of this issues with the alarm keep going of in the middle of the night so bit the bullet we shouldn't have to pay for something we longer has and it's not monorting anything anymore so I did not agree to 25% off the bill I only will pay $500.00 and you can write the rest off due to it's you equipment being know good I should read the review if you notice you has a lot of bad review concern your equipment and sale person false contract agreements THANK YOU KNOW THANKS

I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
It is very unfortunate that it had to come to this; but companies can not use contracts illegally to hold down a consumer...period!  Contracts should be filled out completely and list out all the fees applicable such as Labor and Service.  Companies should plan for fees being waved when its found to not be the customers fault.  I personally am very tech savy and could have fixed this; but the initial installation of the sensor was cemented to the door leaving it impossible to remove without damage.  When selling a home automation system; do not say it will work with all the devices in the market because it doesn't.  You have a list of what you work with and that is it.  The only reason the skycontrol panel was put in was because the linear garage opener did not work with what I had; but did with the competition.  Your phone agent put in the replacement request as a courtesy to being told wrongly; yet this one also had a set list of supported devices too and I was told it would actually work with more than the last.  Funny is how after this new panel went in the other garage sensor went on the frits; another device the new panel prob didn't work with; something else Vivnt didn't do its research on when changing equipment.   If I would have known this from day one I would have went to another company that was offering the same systems in 2013 instead of attacking your business today because I was backed up against a wall.  Listen to your customers and for a company that says they have the best service; you get a 0 rating from me considering it had to take a legal route within your company and the Revdex.com.I will begin the process of searching for a Canadian owned and operated business for my security needs based on the last response from your legal representative.  This concludes our business dealing. Thank you Revdex.com.

          To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she was unable to cancel her Agreement with Vivint when she moved, and that she has recently requested cancellation at the end of the initial term, but that Vivint continues to bill her for service. Ms. [redacted] desires cancellation of her Agreement immediately and all charges cleared from her account. At this time, Vivint will cancel Mr. [redacted]’s account and waive the past due balance of $93.21.  Vivint’s records show that Mr. [redacted] signed an Agreement with Vivint on May 22, 2013, in which he agreed that: “After the initial term, this Agreement will automatically continue month-to-month and either party may terminate this Agreement at any time upon at least thirty (30) days prior written notice to the other party.  If terminated, this Agreement ends on the last day of the thirty (30) day notice period.” (Vivint System Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was provided by Mr. [redacted] on December 23, 2016, and the account has remained active and has been invoiced monthly services fees until the termination date of January 23, 2017.  When December’s payment was rejected by Ms. [redacted]’s bank, a past due balance accrued on the account. Despite this information, Vivint agrees to the above resolution.  Mr. and Ms. [redacted] have no further obligation to Vivint. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] explains that he was told by the sales representative that he could cancel his agreement with Vivint at any time. Mr. [redacted] requests that his account with Vivint be canceledA representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve these concerns. Vivint does not have record of any promises made by the sales representative that is not on the contract. Therefore the normal cancelation options apply. However, in an effort to assist Mr. [redacted] Vivint can offer a 50% discount on Mr. [redacted]’ cancelation fees.
