December 20, 2016Revdex.com of Utah3703 W 6200 SSalt Lake City, Utah 84129 RE:   Consumer Complaint Case #: [redacted]        Complainant:  [redacted]        Vivint Account #: [redacted]        Date of Agreement:  June 18, 2016 To Whom It May Concern: In his rebuttal, Mr. [redacted] states that his concerns regarding cybersecurity and lost wages were not addressed in Vivint’s previous response.  He states that Vivint violated the Federal Trade Commission Act by not providing cybersecurity, and that he missed work to address problems with Vivint’s system.  In addition to the cancellation of his remaining Agreement term and the refund of $198.00, Mr. [redacted] desires compensation in the amount of $1,302.00.  In resolution to this matter, Vivint has waived the remaining months of Mr. [redacted]’s legally-binding Agreement (a value of $3,455.64).  Vivint has also reimbursed the installation fees and the monthly fees paid for the Space Monkey service.Vivint does not reimburse for lost wages, and Vivint disputes Mr. [redacted]’s claimed violations of the Federal Trade Commission Act.  Furthermore, any concerns regarding access to Mr. [redacted]’s network have been remedied as the account is now cancelled and all amounts paid for the Space Monkey device have been refunded.  No further compensation is warranted. If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759 attention Department 160 - Legal. Ms. [redacted] further states after several requests her initial payment has not been returned. Ms. [redacted] desires a refund of the payment which was taken in the amount of $64.65 Ms. [redacted]’s initial payment has been refunded. Ms. [redacted] never entered into a contractual agreement with Vivint and therefore has no further obligation to Vivint.  A representative from Vivint has contacted Ms. [redacted], in an effort to resolve these concerns. Vivint maintains its stance that termination of the Agreement is not warranted due to the facts Vivint provided previously. If Ms. [redacted] would like to listen to the recorded pre-install survey or would like to view the singed contract that Vivint has on file she may contact the Vivint representative who reached out to her.Vivint is still willing to remove her account from collections and reactivate it if she agrees to continue to pay her monthly payment as stated in the agreement. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he has had some issues with the equipment in the home and getting a technician out to his home to fix/replace the equipment. As such, Mr. [redacted] requests that a technician come out to his home and fix the issue or to be released from the contract without penalty.A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that this matter has been resolved to Mr. [redacted]’s satisfaction. A Vivint technician went to Mr. [redacted]’s home on January 28, 2017 and fix the issue Mr. [redacted] had been experiencing. And the fact it took them months to resolve the Revdex.com complaint is a perfect example of their customer service. They'll fix issues. Just not today. Or tomorrow. Or the next day. You know what, you may want to go read a good book. It's going to be awhile.

2010           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she requested cancellation of her account after her initial term had been fulfilled, and that Vivint continued to bill her for service. Ms. [redacted] alleges that she has now been contacted by a collections agency. She desires for her account to be cancelled without penalty and to receive a copy of her original Agreement. Vivint’s records show that Ms. [redacted] signed an agreement with Vivint on April 24, 2010, in which she agreed that service would continue year to year after the initial term of forty-two (42) months, unless cancelled in writing no less than 30 days before the next renewal term (Alarm System Purchase and Services Agreement, Section 2.4).  A written notice of cancellation was provided by Ms. [redacted] on October 6, 2015, and at that time her account was past due for five (5) months of monitoring service that had not been paid.  A representative from Vivint has attempted to contact Ms. [redacted], in an effort to resolve these concerns.  Ms. [redacted]’s account has been cancelled, and she has no further obligation to Vivint. Vivint has waived the past due balance on Ms. [redacted]’s account, and she will not be contacted further by an outside collections agency.
