22, 2014 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges to having equipment complications with her security system that have not been resolved, and that Vivint will not allow cancellation of her Agreement. Ms. [redacted] desires a refund of the most recent payment made to Vivint, and cancellation of her Agreement without penalty. Vivint’s records confirm that Ms. [redacted] has notified Vivint of her equipment concerns, and Vivint Field Service Professionals have been dispatched to Ms. [redacted]’s home on multiple occasions. Vivint recently paid a third party contractor to inspect Ms. [redacted]’s HVAC system, and it was determined that the thermostat issue was caused by a problem with the HVAC system and not Vivint’s thermostat.A representative from Vivint has recently contacted Ms. [redacted] via email, in an effort to resolve these concerns. Due to multiple equipment complications and per Ms. [redacted]’s request, Vivint has cancelled her Agreement without penalty. Ms. [redacted] has no further obligation to Vivint. Vivint is willing to refund the most recent payment in the amount of $[redacted], if Ms. [redacted] will allow Vivint to retrieve its equipment from her home. In Mr. [redacted]’ complaint, he explains that he canceled his account in November 2016 but continued to be charged by Vivint. As such, Mr. [redacted] requests that his account be canceled and a refund of all monies paid to Vivint after November 2016. A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that her husband requested cancellation of his account on April 6, 2015, and that he paid the remaining balance of his agreement at that time. Ms. [redacted] alleges that the account is still active, and she desires for the account to be cancelled. Vivint’s records show that Mr. [redacted] signed an agreement with Vivint on January 28, 2012, in which he agreed that service would continue year to year after the initial term of forty-two (42) months, unless cancelled in writing no less than 30 days before the next renewal term (Vivint Purchase and Services Agreement, Section 2.4). A written notice of cancellation was provided by Mr. [redacted] on April 6, 2015, and the remaining balance on his account was paid. Mr. [redacted]’s account was cancelled prior to the end of the thirty (30) days after notice was given, on April 24, 2015, at Mr. [redacted]’s request.Mr. [redacted]’s account has been cancelled, and he has no further obligation to Vivint. In his complaint Mr. [redacted] alleges that he called Vivint to cancel his service in August of 2015 but his account remained active and that he was not made aware of his contracted term. Mr. [redacted] desires cancellation of the Agreement and a refund for October’s payment. Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department. Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on May 12, 2012. During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty two (42) months. He also represented that he would pay a monthly monitoring fee of $[redacted] plus any applicable taxes each month during that term. Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement. Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Never the less Mr. [redacted] only has one more month left on his contracted term Vivint will cancel his Agreement without penalty and refund October’s payment to the same method that it came from. Mr. [redacted] has no further obligation to Vivint. To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was unaware of the permit fee required by his local police department. Mr. [redacted] further states that damage was left to his home during the initial install of Vivint equipment and that not all of the Vivint equipment was properly installed. Mr. [redacted] desires for the Vivint equipment to be removed from his home, repair of the damage to his home, and cancellation of his agreement without penalty.After further review, Vivint’s records show that Mr. [redacted]’s agreement with Vivint has been cancelled and he has no further contractual obligation to Vivint.Vivint’s records indicate that Mr. [redacted] signed a System Purchase and Services Agreement on August 30, 2016 with an initial term of sixty (60) months, a monthly services fee of $99.99, plus any applicable taxes, during that term. Section (six) 6 of this agreement states: The city or county in which your home or business is located may require that you obtain a permit for the use and monitoring of the System. Local authorities may not respond to alarm notifications until all permits or licenses for use of the System have been obtained, and therefore we may not begin monitoring until you have obtained, at your expense, all necessary permits or licenses, and provided us with the license or permit information.Vivint’s records show that Mr. [redacted] had his Vivint security system installed on August 30, 2017 and August 31, 2017. However, Vivint was not notified of any damage caused to his home until December 14, 2017. In her complaint, she explains that Vivint did not receive five of the payments that were sent through bill pay from her bank. As such, Ms. [redacted] paid the overdue amount that resulted from the missing payments; however, she provided payment history from her bank that shows that the payments were sent in February of 2017. Ms. [redacted] requests a refund of the amount of $326.30. Vivint has agreed to apply a credit to Ms. [redacted]’s account in the amount of $326.30.
