       To Whom It May Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he was unaware of the permit fee required by his local police department. Mr. [redacted] further states that damage was left to his home during the initial install of Vivint equipment and that not all of the Vivint equipment was properly installed. Mr. [redacted] desires for the Vivint equipment to be removed from his home, repair of the damage to his home, and cancellation of his agreement without penalty.After further review, Vivint’s records show that Mr. [redacted]’s agreement with Vivint has been cancelled and he has no further contractual obligation to Vivint.Vivint’s records indicate that Mr. [redacted] signed a System Purchase and Services Agreement on August 30, 2016 with an initial term of sixty (60) months, a monthly services fee of $99.99, plus any applicable taxes, during that term. Section (six) 6 of this agreement states:  The city or county in which your home or business is located may require that you obtain a permit for the use and monitoring of the System. Local authorities may not respond to alarm notifications until all permits or licenses for use of the System have been obtained, and therefore we may not begin monitoring until you have obtained, at your expense, all necessary permits or licenses, and provided us with the license or permit information.Vivint’s records show that Mr. [redacted] had his Vivint security system installed on August 30, 2017 and August 31, 2017. However, Vivint was not notified of any damage caused to his home until December 14, 2017. Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] states that he agreed to pay $60 a month for Vivint’s services but Vivint has been charging him $91 a month. Further, Mr. [redacted] states that he has experienced equipment issues that caused him to request cancellation but Vivint would not complete his request. Vivint agrees to send a technician to Mr. [redacted]’s home free of charge to resolve any equipment issues he may be experiencing and has credited his account for a month of service for any equipment downtime. Vivint’s records indicate that Mr. [redacted] entered into his System Purchase and Services Agreement (“Agreement”) on May 25, 2016. Before any customer enters into an Agreement with Vivint and prior to the installation of any equipment, the customer must complete a telephonic Pre-Installation survey with Vivint’s Account Creation department. If a customer does not pass the Pre-Installation survey, Vivint will not enter into an Agreement with the customer and will not install any equipment in the customer’s home. The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. During the Pre-Installation survey, Mr. [redacted] represented that he understood and agreed that his Agreement has an initial term of forty-two (42) months and that he would pay a monthly service fee of $85.99 plus any applicable taxes each month during that term. He further represented that these terms and conditions were clearly provided on the front of the Agreement and that Vivint’s representative did not make any promises or commitments to him that were not provided on the Agreement. Vivint relied on Mr. [redacted]’s representations during this survey and, based upon his representations, entered into an Agreement with him and installed an alarm system in his home. Vivint does not have record of Mr. [redacted] calling in during his three day right of rescission period to cancel his Agreement. Vivint has also not received any communication regarding any equipment issues. Vivint must be granted the opportunity to resolve any equipment issues, Vivint has not had the opportunity to do so. Ms. [redacted] requests that Vivint cancel her account without penalty.   Ms. [redacted]’s account was closed and sent to collections on April 27, 2017 due to non-payment. However, Vivint is willing to remove Ms. [redacted]’s account from collections.   Vivint spoke with Ms. [redacted] regarding her alarm service on September 18, 2015.  Ms. [redacted] represented that she was satisfied with Vivint’s services and that she was interested in extending the term of her agreement.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:   You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint.                           Mr. [redacted] requested that Vivint cancel her account due to her moving into an assisted living                             facility. Vivint requested that she send in paperwork from her assisted living facility that stated she was living there. Ms. [redacted] did not send in this documentation; therefore, her account was not cancelled at that time. 2012       Date of Addendum: March 1, 2017           To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he has recently reported to Vivint that he is moving but has been unable to cancel his Agreement without penalty. I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me. Vivint must change their customer service practices, train their staff in appropriate resolutions to customer issues and provide timely, professional assistance for mistakes and irregularities in their customer accounts. This has been a stressful, totally unnecessary use of time and resources to reach this resolution. Something is very wrong with the internal workings of this company. I will not recommend Vivint to anyone who will listen. Before this fiasco, I was satisfied, even excited about the system installed in my home. Word to the wise, research businesses before signing on the dotted line.

18, 2015          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] alleges that he was promised a reduced term of his Agreement with Vivint at the time of sale, but has recently learned that his term was not reduced to two years as promised. Mr. [redacted] further alleges that he has had complications with his equipment that have not been resolved. Mr. [redacted] desires cancellation of the Agreement without penalty.  Vivint’s records indicate that Mr. [redacted] signed a Purchase and Services Agreement and also participated in a telephonic Pre-Installation Survey upon installation of his Vivint system, in which he represented that he understood and agreed to the initial term of forty-eight (48) months, which was the reduced term approved by Vivint’s sales representative.  He also represented that he would pay a monthly monitoring fee of $[redacted] each month, plus applicable taxes, during that term.  Cancellation of Mr. [redacted]’s Agreement without penalty is not warranted at this time; however, Vivint will honor the forty-eight (48) month initial term as shown on Mr. [redacted]’s Agreement. Vivint would like to ensure that Mr. [redacted] is able to utilize his system as intended, and is willing to send a field service professional to his home at no charge. Mr. [redacted] desires the repair of his sensor, his information to be updated, and Vivint to change its policy regarding the verbal password. Vivint’s records indicate that Mr. [redacted] notified Vivint of a concern with his sensors on October 19, 2015. A representative of Vivint was unable to verify Mr. [redacted] with his verbal password. Because Vivint deals with sensitive information, Vivint policy states that information regarding the account cannot be updated without verifying the customer. Vivint has sent out a letter with included the password on Mr. [redacted]’ account on October 19, 2015. Mr. [redacted] chatted in with a representative on November 13, 2015 and reported he had not received his password. The representative mailed out the password a second time.Vivint apologizes for any inconveniences this may have cause Mr. [redacted]. Agreement: July 25, 2012           To Whom It May Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] states that she requested cancellation and transfer of her account at the end of her initial term, but that Vivint continued to bill her and the new account holder for service in July, August, and September 2016. Ms. [redacted] explains that she asked for a refund of these payments but was advised that Vivint would not refund since a notice of cancellation was not received until September.  She desires a refund of the monies she paid to Vivint in July, August, and September. At this time, Vivint agrees to send Ms. [redacted] a check in the amount of $192.12, to refund payments made for service in July, August, and September 2016.Vivint’s records show that Ms. [redacted] signed an Agreement with Vivint on July 25, 2012, in which she agreed that service would continue month to month after the initial term of forty-two (42) months, unless cancelled in writing at least 30 days prior to the next renewal term (System Monitoring and Services Agreement, Section 2.4).  A written notice of cancellation was not provided by Ms. [redacted] until September 21, 2016, and her account was automatically invoiced for service, pursuant to the Agreement, until thirty days following the notice.  Despite this information, Vivint agrees to the above resolution. 2015          To Whom It May Concern:I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that he had a negative experience when his system was installed, has had complications with the doorbell camera half the time he has had it, and does not desire to have a system installed in his new home.  Mr. [redacted] desires cancellation of his Agreement without penalty.  At this time, Vivint is willing to reduce Mr. [redacted]’s payoff balance by 40% if he wishes to cancel the Agreement prematurely, or to waive move and equipment fees to transfer a system to his new home.Vivint’s records show that Ms. [redacted] signed an Agreement on July 10, 2015, with an initial term of forty-two (42) months and a monthly services fee of $59.99, plus any applicable taxes, during that term.  Mr. [redacted] first notified Vivint of problems with his system on September 9, 2016.  Vivint sent a technician to his home and then at a later date did troubleshooting over the phone to resolve this issue.  Vivint’s Claim Resolution department was never notified of any damage to Mr. [redacted]’s home from the installation of the system.  Cancellation of Ms. [redacted]’s Agreement without penalty is not warranted at this time. information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint Ms. [redacted] alleges that her system has not worked correctly. Ms. [redacted] desires her system to be operational or cancellation of the Agreement without penalty. Vivint’s records indicate that a technician has visited Ms. [redacted] on October 30, 2015. Vivint believes the system issues to be resolved. Never the less if Ms. [redacted] desires, Vivint will cancel her Agreement without penalty as long as Vivint can remove the Vivint equipment from her home.
