the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint, Mr. [redacted] states that a Vivint technician failed to arrive for an appointment to install a security system in his new home. Mr. [redacted] desires a refund of $3,000.00Vivint’s records indicate that an appointment was scheduled to install a system in Mr. [redacted]’s new home on January 22, 2018. Due to unforeseen circumstances Vivint’s technician was unable to complete this appointment. A text message was sent to a phone number which Mr. [redacted] indicated was a mobile number at the time of installation on January 19, 2018 stating that the appointment needed to be rescheduled and presented an alternate appointment date. Vivint remains willing and able to reschedule to install security equipment in Mr. [redacted]’s new home following his move.Cancellation of Mr. [redacted]’s Agreement without penalty is not warranted at this time, and no refund is warranted.  Should Mr. [redacted] wish to cancel his agreement prematurely, his payoff amount would be $1671.78; however, in an effort to assist Mr. Prez, Vivint is willing to lower his payoff amount by 50%, bringing the total payoff amount to $835.89.  Alternately, if Mr. [redacted] wishes to have the system installed in his new home and continue service Vivint is willing to reduce his monthly rate by $10.00 for the remainder of his initial term.  If Mr. [redacted] wishes to take advantage of either of these offers, I would advise him to contact Vivint’s Customer Loyalty department at 1-800-216-5232 If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal. Concern:I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In her complaint, Ms. [redacted] alleges that she was misled by a Vivint representative regarding the automatic draft of payments, and that she has never used her system and is now being charged for a past due balance.  Ms. [redacted] desires cancellation of the Agreement without penalty, and forgiveness of the past due balance on her account.  Vivint’s records indicate that Mr. [redacted] signed a Purchase and Services Agreement with Vivint on April 28, 2014, indicating that he authorized Vivint to make electronic fund transfers in the amount of any fees according to the terms and conditions of the Agreement (Section 2.5).  As such, Vivint automatically charged monthly monitoring fees until Mr. [redacted]’s bank account revoked authorization for these withdrawals.  Mr. [redacted]’s account was cancelled due to non-payment on January 30, 2015, and was transferred to an outside collections agency.A representative from Vivint has recently attempted to contact Ms. [redacted], in an effort to resolve these concerns.  Pursuant to the signed Purchase and Services Agreement, cancellation of Mr. [redacted]’s agreement without penalty is not warranted at this time.  However, in an effort to assist Mr. [redacted], Vivint is willing to reduce the balance for settlement of the account.  Mr. [redacted]’s past due balance is $[redacted].  If Mr. [redacted] will pay Vivint $[redacted], which is 60% of the total amount due, Vivint will remove the account from collections, and Mr. [redacted] will have no further obligation to Vivint.  This payment or alternate arrangements such as reinstatement may be made by calling Vivint’s Billing department at [redacted].If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: [redacted], attention Department 160 – Legal. the information provided by Mr. [redacted] and appreciate the opportunity to respond. In his complaint Mr. [redacted] alleges that he called Vivint to cancel his service in August of 2015 but his account remained active and that he was not made aware of his contracted term. Mr. [redacted] desires cancellation of the Agreement and a refund for October’s payment. Vivint’s records indicate that prior to the installation of any equipment, Mr. [redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Our records show that Mr. [redacted] completed the required Pre-Installation Survey on May 12, 2012.  During the recorded Pre-Installation Survey, Mr. [redacted] represented that he understood and agreed to the initial term of forty two (42) months.  He also represented that he would pay a monthly monitoring fee of $[redacted] plus any applicable taxes each month during that term.  Further, Mr. [redacted] represented that these terms were clearly outlined on the Agreement and that Vivint’s representative did not make any promises or commitments which were not written on the Agreement.  Vivint relied on Mr. [redacted]’s representations to ensure that he understood his commitments to Vivint as outlined in the Agreement. Never the less Mr. [redacted] only has one more month left on his contracted term Vivint will cancel his Agreement without penalty and refund October’s payment to the same method that it came from. Concern: I have reviewed the information provided by Mr. [redacted] and appreciate the opportunity to respond. In Mr. [redacted]’s complaint he explains that he has had issues with the equipment and that he no longer uses the system. As such, Mr. [redacted] requests that his account be cancelled without penalty.At this time, Vivint agrees to send a technician to Mr. [redacted]’s home to fix the issues Mr. [redacted] has experienced. Or, to discount Mr. [redacted]’s contractual buyout fee by fifty (50) percent. A representative from Vivint has recently attempted to contact Mr. [redacted] via email in an effort to resolve his concerns. Vivint’s records indicate that Mr. [redacted] entered into an agreement with Vivint on July 16, 2014. Mr. [redacted] agreed to an original agreement term of sixty (60) months and to pay Vivint a monthly fee of $53.99 each month of that term. Vivint does not have any record of Mr. [redacted] calling into Vivint to fix or assist him with the equipment in his home. Because Mr. [redacted] is still within his original agreement term and because Vivint was never informed of any issues and therefore not given an opportunity to fix the equipment cancellation of Mr. [redacted]’s account without penalty is not warranted.In an effort to assist Mr. [redacted] Vivint agrees to the above resolution of Mr. [redacted]’s choosing. Mr. D[redacted] desires the cancellation of his agreement without penalty. Vivint’s records indicate that prior to the installation of any equipment; Mr. D[redacted] completed a telephonic Pre-Installation Survey with Vivint’s Account Creation department.  Every customer must complete this Pre-Installation Survey, and if a customer does not pass the survey, Vivint will not enter into an agreement with the customer and will not install any equipment in the customer’s home.  The purpose of the survey is to verify certain information, ensure that the customer understands Vivint’s offer, and confirm the terms and conditions of the Agreement. Vivint’s policy states that when an alarm is received, Vivint will first reach out to the customer; if the customer cannot be reached, or at the customer’s request, Vivint will contact the proper authorities so a patrol unit can be dispatched to the customer’s home. Due to the limitations in technology; Vivint cannot distinguish a false alarm from actual alarm without a person at the residence to confirm. When a customer is out of town and wants a follow up an alarm at their home, Vivint will refer them to the authorities dispatched for details. Vivint records further indicate Mr. D[redacted] contacted Vivint to cancel on April 23, 2015, because Vivint is unable to tell him when an alarm is activated whether it is a false alarm or an actual alarm. A Vivint representative offered Mr. D[redacted] cameras to assist him in monitoring his home if he agreed to extend his agreement with Vivint for forty-two (42) months. Mr. D[redacted] agreed and Vivint scheduled an appointment for May 7, 2015. Mr. D[redacted] informed Vivint he was unsatisfied with the quality of the cameras on July 3, 2015. A Vivint representative attempted to schedule an appointment to inspect the camera, but Mr. D[redacted] declined the offer. A Vivint representative has recently reach out to Mr. D[redacted] in an effort to resolve this concern. Cancellation without penalty is not warranted at this time; however, Vivint would like to assist Mr. D[redacted]. Currently, Mr. D[redacted] is under an agreement with Vivint until October of 2018. If Mr. D[redacted] wishes to continue with this agreement, Vivint offers an appointment with a Vivint field service professional to inspect the cameras. Alternatively, Mr. D[redacted] can also return the cameras to Vivint, and Vivint will reverse Mr. D[redacted] extension through October 2018 and revert back to Mr. D[redacted]’s original agreement through October 2016. Should Mr. D[redacted] wish to cancel his Vivint agreement prematurely, he may pay off the remaining balance on his account – currently $[redacted], however Vivint will take 55% off the payoff amount, bringing it to $[redacted]. This reduced payoff is based upon Mr. D[redacted]’s original agreement with Vivint. In order for Mr. D[redacted] to be eligible for this offer, the cameras will need to be returned to Vivint. 13, 2011        Date of Addendum: December 9, 2014 To Whom It May Concern: I have reviewed the information provided by Ms. [redacted]’s daughter and appreciate the opportunity to respond. In her complaint, Ms. [redacted]’s daughter states that her mother signed an Agreement years ago and that they have recently requested cancellation of that Agreement.  She states that Vivint called her mother to extend the Agreement and took advantage of her because she is not in the right state of mind to make a decision like this, and that due to the extended term Vivint will not cancel the Agreement at this time. Ms. [redacted]’s daughter desires cancellation of the Agreement without penalty.At this time, Vivint agrees to cancel the Agreement of Ms. [redacted] and Ms. [redacted] without penalty, effective immediately.Vivint’s records show that on August 13, 2011, Ms. [redacted] and Ms. [redacted] signed a System Purchase and Services Agreement with Vivint, with an initial term of forty-two (42) months.  As such, the initial term of the Agreement would have lapsed on February 13, 2015.  However, Vivint spoke with Ms. [redacted] (not Ms. [redacted]) regarding the alarm service on December 9, 2014.  Ms. [redacted] represented that she was interested in extending the term of her Agreement in exchange for a reduced monthly services fee.  Based upon this representation, Vivint offered a forty-two (42) month extension to which Ms. [redacted] agreed.  Indeed, Vivint read the following statement, after which Ms. [redacted] responded affirmatively:You understand that this call is being recorded, and you agree to extend the term of your agreement forty-two months from today.  No other provisions of your agreement have been changed and this amendment constitutes the new agreement between you and Vivint. Despite the validity of this extension, Vivint agrees to the above resolution.  Ms. [redacted] and Ms. [redacted] have no further obligation to Vivint.If you have further questions or concerns regarding this response, please respond to either our mailing address: 4931 North 300 West, Provo, Utah 84604, or fax number: (801) 765-5759, attention Department 160 – Legal.   To Whom It May Concern: I have reviewed the information provided by Ms. [redacted] and appreciate the opportunity to respond. In Ms. [redacted]’s complaint, she explains that she has experienced multiple difficulties regarding moving her system to her new home. As such, Ms. [redacted] requests that her account be canceled and a refund of all monthly payments after August 25, 2017.Vivint agrees to cancel Ms. [redacted]’s account without penalty.A representative from Vivint has recently attempted to contact Ms. [redacted] via email in an effort to resolve her concerns. Vivint’s records indicate that Ms. [redacted] entered into an agreement with Vivint on February 26, 2014. Ms. [redacted] agreed to an original agreement term of forty-eight (48) months and to pay Vivint a monthly fee of $49.99 plus any taxes each month of that term. Because the monthly payment on August 25, 2017, was to uphold the contract no refund is warranted.Despite this information, Vivint agrees to the above resolution. Ms. [redacted]’s account has been canceled as of September 1, 2017, without any further charges. Ms. [redacted] no longer has any obligation to Vivint.
