Dear Dispute Resolution Services:
9.5pt">Thank you for the opportunity to respond to the complaint of *** *** ***. *** *** retained the services of Volks Anwalt in November 2015. At that time *** *** was facing foreclosure on her property. Through the efforts of Volks Anwalt we were able to get her into loan modification review. *** *** failed to provide the documents required by Wells Fargo prior to her foreclosure sale date on March *, 2016. The foreclosure sale therefore took place. Volks Anwalt sent Wells Fargo a Notice of Error requesting rescission of the foreclosure sale. Wells Fargo agreed to complete *** ***'s loan modification review even after the foreclosure sale. *** ***, however, was not timely with her responses and she was unable to get the quitclaim deed that Wells Fargo required recorded On May **, *** *** signed an agreement with Wells Fargo's attorneys to voluntarily surrender the property in exchange for an extended move-out date that gave her the time she needed to relocate. Volks Anwalt provided legal representation for *** *** through each stage of the process. *** ***'s complaint, i.ethat she was represented by a Georgia attorney, is untenable. *** *** is a Georgia resident and is required to be represented by a Georgia licensed attorney *** ***'s claim that she was left out of the loop is equally specious. The attached email demonstrates that *** *** was included in the correspondence with Wells Fargo. Our firm notes indicate that *** *** was contacted by the firm on November ** *** *** **, December ** *** **, January ** *** **, February *** *** **, March ** ** *** *** **, April *** *** *** *** *** May ** *** *** ** and **. *** *** was not always available to receive such communication but she actively participated in her loan modification review and the negotiations for the surrender of the property We regret that *** *** was dissatisfied with the communication on her file. Volks Anwalt does offer an apology to *** *** if she felt in any way neglected during the process. In the interest of amicably resolving the dispute Volks Anwalt is willing to refund $to *** *** Volks Anwalt

[November **, 2015- I received an email from Joe K***, who was the lawyer assigned to my case. I explained to him that I setup a payment arrange with Wells Fargo, but the payments were not affordable and what could I do about it. Joe replied within the same day explaining that I could file Chapter bankruptcy. He said he would email me a form for me to initial and signI wrote back that day asking him to explain the bankruptcy process(See Attached)
December *, 2015- Joe K*** emailed me back said that, “Chapter takes all the payments you are behind on your mortgage and comes up with a monthly payment you can affordThat way it gives you time to catch up while preventing the bank from foreclosing.” I also asked him if the Chapter would not only cover my house, but if it would also cover my vehicle(See Attached)
December **, 2015- I emailed Joe K*** explaining that I setup my account and what was the next steps in the process(See Attached)
December **, 2015- I still haven’t heard anything from Joe K***. I sent another email to him asking for an updateJoe K*** responded back saying, “You will hear from one of our paralegals soonSorry about that.” (See Attached)
December **, 2015- I sent another email to Joe K*** asking for an update because I haven’t heard from him or the paralegal he said that would call me(See Attached)
January **, 2016- In between the time I have made multiple attempts to call Volks Anwalt and I wasn’t’ able to get anyone to answer me to what was going on with my case. I emailed Joe K*** again(See Attached)
January **, 2016- Joe K*** finally answered by email and his exact response was “I am no longer affiliated with VolksAnwaltGood luck.” (See Attached)
January **, 2016-I emailed MsC*** who works for Volks Anwalt to explain that it has been over two months and nothing has been done with my case. I was assigned a lawyer who quit and was never notified by Volks Anwalt about it. (See Attached)
February *, 2016- I received an email from *** ***, a paralegal from Volks Anwalt to fill out forms. She asked me to complete the package and include the last months of bank statements and the last days in pay stubsI sent in the documents that *** sent to me (See Attached)
February *, 2016- I emailed MsC*** again to see what was going on with my case Her response was, “Let me investigate this issue and I will call you back with an answer.” (See Attached)
February **, 2016- I still haven’t heard in anything and I emailed MsCole again to see what was going on with my case (See Attached)
March *, 2016- I received and email from Iwona F* legal assistant from Volks Anwalt that she has received the fax with the documents, which I sent a while ago and that she informed Marina, paralegal that supposedly was working on my case(See Attached)
March **, 2016- I called to follto see if the paper work I sent in was filled out correctly(See Attached)
March **, 2016- I called Marina and didn’t hear anything from her. I emailed her asking her if my paperwork was done correctly and to see if you needed anything else from me and I received no responseFrom the documentation that I have provided I have made multiple attempts to reach out to Volks Anwalt about my case since the end of November. Volk Anwalt failed to provide the proper representation for my case. They took my money and took advantage of me and my situation, which has cost me the loss of home. I want a full refund due to their negligence.]

RE: Revdex.com Case Number *** To whom it may concern, This correspondence is in response to the complaint filed with the Revdex.com by our former client *** ***. Although the date on the complaint states it was filed with the Revdex.com on March **, 2016, Volks Anwalt was not aware
of the complaint until May *, 2016. Volks Anwalt strives to provide excellent service to all our clients whether they are a past or current client. The firm does not wish for any former client to feel unsatisifed with the legal services and representation provided to them. The firm wishes to take this forum to address the issues raised in the complaint by *** ***, as well as come to an ammicable resolution with her*** *** retained Volks Anwalt in October of for the purpose of filing bankruptcy with the goal of retaining her home. *** *** signed a retainer agreement for a total fee of $3,500.00. *** ***’s retainer agreement states the her bankruptcy would not be filed without a minimum payment of $1,toward that retainer plus filing fees, as well as completing all the necessary documents and providing expressed written consent for the bankruptcy to be filed when all the documents were completed*** *** made an initial fee deposit of $200.00, but continued to struggle with providing the funds necessary to get her bankruptcy filed. *** *** repeatedly broke payment arrangements that were made in good faith to her in an effort to help her with her financial difficulties. *** *** paid the firm a total of $which was not enough to file her bankruptcy per the terms specified in her retainer agreement. Despite *** ***’s claims that no one ever returned her calls or emails, *** *** repeatedly failed to respond to letters and emails from the firm requesting her completion of the bankruptcy questionnaire and the return of all pertinent documents. Due to continued defaults on the part of *** *** to complete her payment and document obligations to the firm, Volks Anwalt severed its relationship with *** ***, in turn terminating her legal representationTo date, Volks Anwalt has not received any correspondence from *** *** requesting an invoice of time billed on her case versus her fee deposits. Volks Anwalt’s policy is to return any unearned fees to clients in a timely fashion. *** ***’s retainer agreement provides for a billing structure of $per hour for attorney time and $for non attorney support staff. The invoice of *** ***’s time indicates hours of attorney time and hours of non attorney support staff time was done on her case. The total fees billed to her case file is $1,318.75. This amount is greater than the $in fees placed on deposit by *** ***Although Volks Anwalt has earned all fees paid by *** ***, in the interest of resolving *** ***’s complaint, Volks Anwalt shall remit a refund of fees paid in the amount of $as soon as we received confirmation of an address in which *** *** would like the funds to be sent.
