To whom it may concern: We were just made aware of the complaint filed by *** *** regarding our firm. We deeply regret that *** *** believes that he had a negative experience with our firm. We nevertheless dispute *** ***’s account of the events described
*** *** did sign a retainer agreement with Volks Anwalt on November **, 2015. See attached. The retainer agreement provided that Volks Anwalt would render services to *** *** in terms of representation in potential bankruptcy and negotiation with his creditors, including pursuing loan modification of his mortgage. *** *** had his consultation for bankruptcy on December *, 2015. See attached Our office made repeated efforts to contact *** *** and obtain the documents necessary to complete his loan modification review and prevent foreclosure. *** *** never completed his bankruptcy questionnaire and didn’t submit his modification paperwork until March *, 2016. See attached. Even the application, however, was incomplete. *** *** did not enter his income information on the application and failed to provide his tax returns In order to file bankruptcy our attorneys require that all financial documents be provided. In order to compel a financial institution to postpone a foreclosure sale under Regulation X of the Real Estate Settlement Procedures Act, C.F.R1024.41(g) and/or Rule of the HAMP guidelines a borrower must submit a complete loan modification application. We contacted *** *** on November **, 2015, December *, 2015, January **, 2016, February *, 2016, February **, and March *, to remind *** *** of the documents that we needed. *** *** never complied with the requests for the full documentation and, as a result, his property sold at foreclosure sale on March **, We at Volks Anwalt never want to terminate any relationship with a client in a manner that leaves the client dissatisfied or disadvantaged. [November **, 2015- I received an email from Joe K[redacted], who was the lawyer assigned to my case.  I explained to him that I setup a payment arrange with Wells Fargo, but the payments were not affordable and what could I do about it.  Joe replied within the same day explaining that I could file Chapter 13 bankruptcy.  He said he would email me a form for me to initial and sign. I wrote back that day asking him to explain the bankruptcy process. (See Attached)December *, 2015- Joe K[redacted] emailed me back said that, “Chapter 13 takes all the payments you are behind on your mortgage and comes up with a monthly payment you can afford. That way it gives you time to catch up while preventing the bank from foreclosing.” I also asked him if the Chapter 13 would not only cover my house, but if it would also cover my vehicle. (See Attached)December **, 2015- I emailed Joe K[redacted] explaining that I setup my account and what was the next steps in the process. (See Attached)December **, 2015- I still haven’t heard anything from Joe K[redacted].  I sent another email to him asking for an update. Joe K[redacted] responded back saying, “You will hear from one of our paralegals soon. Sorry about that.” (See Attached)December **, 2015- I sent another email to Joe K[redacted] asking for an update because I haven’t heard from him or the paralegal he said that would call me. (See Attached)January **, 2016- In between the time I have made multiple attempts to call Volks Anwalt and I wasn’t’ able to get anyone to answer me to what was going on with my case.  I emailed Joe K[redacted] again. (See Attached)January **, 2016- Joe K[redacted] finally answered by email and his exact response was “I am no longer affiliated with VolksAnwalt. Good luck.” (See Attached)January **, 2016-I emailed Ms. C[redacted] who works for Volks Anwalt to explain that it has been over two months and nothing has been done with my case.  I was assigned a lawyer who quit and was never notified by Volks Anwalt about it.  (See Attached)February *, 2016- I received an email from [redacted], a paralegal from Volks Anwalt to fill out forms.  She asked me to complete the package and include the last 3 months of bank statements and the last 60 days in pay stubs. I sent in the documents that [redacted] sent to me (See Attached)February *, 2016- I emailed Ms. C[redacted] again to see what was going on with my case.  Her response was, “Let me investigate this issue and I will call you back with an answer.” (See Attached)February **, 2016- I still haven’t heard in anything and I emailed Ms. Cole again to see what was going on with my case.  (See Attached)March *, 2016- I received and email from Iwona F[redacted] legal assistant from Volks Anwalt that she has received the fax with the documents, which I sent a while ago and that she informed Marina, paralegal that supposedly was working on my case. (See Attached)March **, 2016- I called to follow-up to see if the paper work I sent in was filled out correctly. (See Attached)March **, 2016- I called Marina and didn’t hear anything from her.  I emailed her asking her if my paperwork was done correctly and to see if you needed anything else from me and I received no response.From the documentation that I have provided I have made multiple attempts to reach out to Volks Anwalt about my case since the end of November.  Volk Anwalt failed to provide the proper representation for my case.  They took my money and took advantage of me and my situation, which has cost me the loss of home.  I want a full refund due to their negligence.]

I did not receive any communication for over a month. I repeatedly asked for someone at this company to contact me. They did not.  I asked for a written invoice, but they refused to provide one. I did file a dispute with my credit card company and did receive a refund.

Obviously my wife and I are in communication with one another as we live under the same roof. And she has filed the complaint on my behalf. My last message still stands. I have agreed for you to proceed with the Skyline property, which by the way I still have not received an updated status on. And you are no longer working on the Ruidosa property and therefore we are looking for the $1,000 refund for the Ruidosa property. I think I've made myself pretty clear. There should not be no confusion on this issue. Please issue our refund.

I have been trying to get a refund from this company with no luck. I didn't realize that by accepting their offer of a refund, it would close my case. My number is ID #[redacted]. I have left several messages on their answering service with no return call. I think that I deserve a full refund from them, not the original $400 that they offered. I paid them around $1000 and they didn't do anything for me. I was told that, by law, if no services were rendered after payment I can get a full refund. It has been 3 months since they first offered a partial refund. I just want this resolved so I can move on.Full refund of all payments made to this company. Thank you.
