At the time we only had the voicemail to go off of, since no other website listed the business hours as wellWe attempted to contact you multiple times before the deadline date and we heard nothingWhy was the part of the contract we listed still crossed out? I would still like an answer to this as wellWe were not given a description on how to cancel when we received the vacuum, and the section of the contract I uploaded was still crossed outThe salesperson also crossed it out after we signed it, leaving us with no choice but to take itI am under the belief that if someone is going to edit parts of a contract to meet a sales quota, then why not revise said contract altogether? Mr [redacted] , signed and verified with the finance company, United Consumer Financial Services, a contract for the purchase of a Kirby Avalir SystemThis contract does not state anywhere on it that a new machine was to be deliveredThey had a copy of a separate receipt stating that we would switch them out for a new machine within 7-business daysWe are not in possession of a copy of this document, however, I offered to replace the machine and honor the copy of the agreement that was made between them and the independent contractor that sold them the machineAs stated on the contract, I informed them of the three day cancellation policy and that they couldn't cancel the machineMs [redacted] stated she had called the office a few times the same day, yet did not leave a voicemailWe will not be cancelling out the contract, however, if they would like their machine replaced with a new one, they can still contact our office to do so

The contract has instructions on the bottom portion of how to cancel as well as the date the cancellation notice must be in writing and delivered to the office by 2/13/It is clearly not crossed outA certified letter was sent out on 2/17/16, however it was returned on march 24th because it was "unclaimed"We will not be honoring a late cancellation

Additionally, 7-business days is a far cy from -days, which is what the sales person told meHe did not use the word "business." Moreover, Watson Productions, Incdidn't contact me or even attempt to deliver the machine they were selling me until AFTER I advised the finance company that I was canceling the order.? As for the 3-day cancellation period, how am I supposed to cancel an order within days if I have not received my machine?? Finally, it was a representative of Watson Productions, Incthat told me that they (Watson Productions, Inc) would be sending me to collectionsShe did not say that the finance company wouldI took this as an intimidation tactic and refused to engage in the conversation further.? Complaint: [redacted] I am rejecting this response because: Upon initially responding to my complaint on January 22nd, Watson Productions, Incstated that it was their intent to return the funds exchanged as part of our contract within 3-days Regardless of the fact that this exceeds state mandated days (which had already expired), and I did not agree to this, I have patiently waited to verify whether or not they would keep their word It has now been more than 3-BUSINESS days and I have still not received our cancelled check, a refund check, nor proof that either have even been sent Again, Monday the 8th will mark a month since the receipt of our Right of Rescission letter was received at the Watson Productions, Incoffices and the refund should have been sent out days after receipt With regard to their representative’s statement that our merchandise (vacuum) was the exact unit tendered, that is correct, but it was not returned in the same condition in which it was given to Watson Productions, Inc The fact that Watson Productions continues to withhold repayment while attempting to refuse to remedy the condition in which they returned our property can only lead me to the conclusion that Watson Productions, Incis attempting to withhold our funds in an effort to either commit theft or extort an acceptable response on this website I will not be bullied or robbed If I do not receive both an accommodation to remedy the issues that Watson Productions, Inccaused with my vacuum as well as a refund, I will continue to reject these responses as disingenuous and I will seek alternate methods to retrieve the funds that they have been otherwise unwilling to return.Sincerely, [redacted]

The Kirby product is multifaceted and comes with an extensive warranty from the manufacturer, a rebuilding plan that is in ? effect for the life of the product sold to the original consumer and a fire replacement plan whereby the product is replaced free of charge in the event the product is destroyed as a result of a house fire.Additionally, a consumer that is aged or older can cancel the sale within one year from the date of purchase and recover all monies paid and if the sale is financed and to have the finance company likewise cancel the contract with monies having been paid refunded to the consumer.? Upon any cancellation, the distributor must return any traof a vacuum by the consumer with the same traor one equal to or of better value.All prospective dealers with a distributor are background checked to be certain that they do not pose a danger to the consumer and are to wear identifying badges as to their names and contact information as to the distributor.During orientation and thereafter, dealers are told about consumer protection laws, what constitutes deceptive trade practices and as to the Fair Debt Collection Act and The Consumer Practices Act - both as to Federal and State Laws.I also travel to meet with distributors to proactively advise as to compliance issues as to consumerismAny resulting compliant involving a sale is promptly addresses or the distributor is subjected to disciplinary action by the manufacturer.? Once a sale is made a dealer is not paid his/her commission until the buyer's remorse period has expired since otherwise a cancellation will result in the distributor having paid the dealer commission and suffering a loss.? It is my understanding that Watson Production is "picking up" the product sold to Ms [redacted] and attached is a copy of my letter to her which I believe is self-explanatory.***Please See Attached***

These products are and always have been sold to consumer end-users by in-home demonstrations done by an independent contractors associated with the distributors of same (e.g., Watson Productions) known as "dealer" Distributors seek to associate with persons for those purposes and often advertise for that position in the news media, Craigslist, etc I have reviewed the ads for his position placed by my client and and can find nothing deceptive or misleading with themTherefore, I am at a loss to offer any type of resolution to this amorphous complaint ***Please See Attached***

Mr [redacted] called yesterday morning about some product he hadn't yet receivedI inquired as to what he was missing and informed him I would place him on hold while I looked up his fileWhen I came back, he had hung up the phoneI have pulled his file and will send any promised product we have to the address we have on file
