However, please note that the passing of the statute of limitations does not extinguish the validity of a debtRather, it eliminates litigation as a potential remedy
Similar to the statute of limitations, the expiration of the seven-year Federal Reporting period also does not extinguish a debt. It only prevents the account information from being furnished to the *** reporting agencies. A review of Midland ***’s business records indicates that the seven-year Federal Reporting period for the above-referenced account does not expire until March, 2020.
As advised in its previous response, the above-referenced account remains collectible, due and owing to Midland *** as servicer for Midland Funding. A review of Midland ***’s business records indicates that the account information it is furnishing to the three major *** reporting agencies is accurate

An investigation of this matter indicates that Midland Credit became the servicer of the above referenced account on behalf of purchaser, Midland Funding LLC (“Midland Funding”), on May 27, 2016. Information provided by the seller, *** Bank, at the time of acquisition indicates this account was originated on May 15, as a *** Bank/*** and *** credit card account number ending in ***, in the name of *** ***, under the last four of the social security number ***. The first delinquency occurred on January 11, 2015. Subsequently, the account was charged-off as an unpaid delinquent-debt on July 8, The balance at the time of purchase was $
Mr*** expresses a concern that he was not given the day period to respond before the collection was added. On June 15, 2016, Midland Credit mailed Mr*** a validation letter. Please note that the letter was mailed to the same address listed within the consumer’s complaint via the United States Postal Service. The letter was not returned as “undeliverable,” satisfying the notification requirements of the Fair Debt Collection Practices Act (“FDCPA”). In that letter, Midland Credit provided the required disclosure of rights set forth in the FDCPA.
Midland Credit’s business records indicate that it began receiving notices of dispute from the credit reporting agencies on December 30, 2016. In response, Midland Credit appropriately verified the information that it is furnishing to the credit bureaus, and mailed Mr*** a copy of the verification information provided by the seller January 11, 2017, and again on July 26, 2017, in response to the notices of dispute from the credit reporting agencies. A copy of that documentation is again enclosed for his records. Please note that the verification information meets the requirements of the FDCPA. The original contract, complete payment history, and a full set of billing statements are not required under the FDCPA

I had a credit card through G.Ecapital retail bank which had fraudulent activiy on I reported the fraud to the credit card company but since it had not been processed in days they were not able to assist me- I stopped paying on the card as the debt was not incurred by me- the debt was sent to midland management- and they have attempted to collect on this invalid debt for some time- this debt was not mine and needs to be removed from my credit report. Information provided by the seller, *** *** *** *** ***, at the time of acquisition indicates this account was originated on September 4, as a *** *** *** *** *** *** account number ending in ***, in the name of *** * ***, under the last four of the social security number ***. Subsequently, the account was charged-off as an unpaid delinquent-debt on May 29, 2012. The balance at the time of purchase was $2,
*** *** writes that he was working with Midland Credit on this account that was supposed to be paid in full. After a review of *** ***’s account, no payment plan was set up with Midland Credit. *** *** made one time payments online through Midland Credit’s website While no settlement agreement was ever established, in keeping with its Consumer-First policy, Midland Credit has made the business decision to settle *** ***’s account for amounts received
*** *** expresses a desire to have the above-referenced account deleted upon payment, but advises that the charges still show up on his credit report. Midland Credit’s records indicate that during a phone conversation with *** *** on January 6, 2015, he was advised that Midland Credit was unable to delete the account from the credit bureaus. Please note that it is Midland Credit’s policy to report all accounts accurately. Midland Credit will report the account as “Account paid in full, was a collection account,” with an additional memo stating “Account paid in full for less than the full balance.” If Midland Credit were to delete the account, its correct and accurate status would not be reflected. *** *** has no further financial obligation for this account
*** *** also states that he has asked Midland credit to stop phone calls, but continues to receive phone calls from Midland Credit. A review of Midland Credit’s business records indicates that in a phone conversation with *** *** on April 12, 2015, he requested that Midland Credit cease and desist communication with him. The representative appropriately marked the account as “Cease and Desist” and no further phone calls were made and no further letters have been sent to *** *** for the referenced account. This was the first request Midland Credit received to cease contacting *** ***.
Since *** ***’s complaint states that he is receiving calls well in excess of those made by Midland Credit representatives, it appears he may be receiving calls from different companies. Often a consumer will speak to someone from one collection agency and then erroneously believe that any subsequent collection calls, even those from another collection company, are from the same company.
