I had an account with Midland Credit Management/Midland Funding LLC, which has been settledPer their written policy, as well as verbal confirmation over the phone, Midland promised that they would "remove" the collection item from my credit report once it had been more than years since the date of first delinquencyThe agent with whom I settled the account told me that the collection item would be "removed" from my account after September The collection item is still present on all of my reports from the major credit bureausI am not sure if the policy has changed, however when I settled the account, which was closed on April 1st (verifiable via my credit reports) this is what I was told by both the agent and the manager to whom I spoke

In keeping with its Consumer-First policy, Midland Credit made the business decision to close the account. There will be no further collection activity or sale of this account

An investigation of this matter indicates that
Midland Credit is the servicer of an account belonging to another consumer. During a search for the correct consumer, *** *** phone number was provided to Midland Credit representatives by a third party. In reliance on that information, Midland Credit attempted to contact the consumer regarding the referenced account. Please note, Midland Credit had no information that it was contacting a wrong number for the consumer until a phone conversation with *** *** on April 12, 2016. The phone numbers provided at that time were marked “Do Not Call” in Midland Credit’s computer system for the referenced account
*** *** alleges that Midland Credit representatives have called him excessively, at times not allowed by law. Please be assured that Midland Credit has safeguards in place to ensure that its calls are being placed according to applicable law. Midland Credit’s determination of which local time should control the ability to call is based on information then available to it, including the address, and/or phone number’s area code. A review of Midland Credit’s business records indicates that all calls were placed after 8:00am and prior to 9:00pm Eastern Standard Time, and Midland Credit did not attempt to call *** *** more often than what is allowable.

As stated before I do not have an account with Midland Funding or the company they purchased it fromAgain, I was never notified by Midland Funding about any outstanding debtsMake no mistake, had I been notified by Midland Funding, I would have immediately disputed the accountFurthermore, I cannot send you information in reference to an account I never had
Please don't ignore my request for a copy of your company's business licenseIf you are a Legal entity, Midland Funding should be inclined to prove it
As requested, send a copy of the identification that was used to open the accountAlso send a copy of the signed contract in reference to the accountPrinted or Typed statements created by the consumer, does not constitute a valid debt

Mr*** writes that there is no signed contract with Midland Funding or its servicer, Midland Credit. Consumers are sometimes unclear as to what the term “charge off” means for a debt. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account. Brands, Inc., at the time of acquisition indicates this account was originated
on January 12, as a

name of *** L ***, under the last four of the social security number *** Subsequently, the account was charged-off as
an unpaid delinquent-debt on October 1, 2012. The balance at the time of purchase was
$251.95. A
copy of the verification information provided by the seller is enclosed
for Mr***’s records
Mr***
states that when he contacted Midland Credit to pay off the above-referenced
account, he was advised that Midland Credit is unable remove the negative
information upon payment of the account Mr*** further expresses a
desire to have the above-referenced account deleted from his consumer credit
files upon resolving the balance. A review of Midland Credit’s business records
indicates that telephone conversations with Mr*** occurred on April 18,
and April 23, during which he requested the account be deleted from
his consumer credit files upon payment of the account. The Midland Credit representatives
appropriately advised Mr*** that Midland Credit is unable to delete the
account from his consumer credit files upon payment of the account.
Please
note that it is Midland Credit’s policy to furnish accurate account
information. Should Mr*** pay the full balance, Midland Credit will
furnish information for the account as “Account paid in full, was a collection
account.” Should Mr*** pay less than the full balance, Midland
Credit will also notify the credit reporting agencies to add an additional memo
stating “Account paid in full for less than the full balance.” If
Midland Credit were to delete the account, its correct and accurate status
would not be reflected
Mr
*** further states that a Midland Credit representative asked if it had his
permission to call him and he advised “no.”
A review of Midland Credit’s business records indicate that during a
telephone conversation with Mr*** on April 18, 2016, the Midland Credit
representative asked if Midland Credit is able to contact his cell phone using
its dialer and he advised “no.” As such,
subsequent telephone calls placed to Mr*** were not placed using Midland
Credit’s dialerThe referenced inquiry is not for all telephone calls placed to
Mr*** regarding the accountFuture telephone calls that were made to Mr
*** by Midland Credit represatives were appriately placed
With
that said, Midland Credit apologizes for the misunderstanding. Per Mr***’s concern, the
above-referenced account has been marked “Direct Mail Only.” While it
remains due and owing, he will no longer receive phone calls from Midland
Credit representatives and all correspondence will be sent via the United
States Postal Service
Mr***
further expresses a concern that he was hung up on when being transferred to a
supervisor. A review of Midland Credit’s
business records indicates that the representative placed Mr***’s call on
hold, at which time it appears the line disconnected. Midland Credit apologizes for any
inconvenience this caused to Mr***

Mr*** expresses a concern that he has no contract with Midland Credit though it is attempting to collect the referenced debt from him. When a creditor "charges off" an account, it means that the creditor no longer believes the consumer will pay the bill and has written the debt off of its books. Often, they then sell the debt. Please note that the underlying promissory obligation remains valid, due and owing. Just as the original creditor had the right to legally seek repayment of the promissory obligation, the new third-party purchaser has the right to repayment of the credit account
Mr*** expresses an additional concern that his requests for validation have been ignored. On June 16, 2012, Midland Credit mailed Mr*** a validation letter. Please note that the letter was mailed to Mr*** via the United States Postal Service. The letter was not returned as “undeliverable,” satisfying the notification requirements of the Fair Debt Collection Practices Act (“FDCPA”). In that letter, Midland Credit provided the required disclosure of rights set forth in the FDCPA.
Midland Credit’s business records indicate that it did not receive any correspondence disputing the debt or requesting validation from Mr*** in response to the letter. A review of Midland Credit’s business records indicates that it received the first communication disputing the debt from Mr*** via telephone on February 3, 2017. In response to his dispute, verification information provided by the seller was mailed to Mr*** on February 27, 2017. As verification information had recently been provided, Midland Credit did not mail Mr*** additional copies of the documentation in response to his subsequent disputes
With that said, in keeping with its Consumer-First policy, Midland Credit previously made the business decision to close the account. There will continue to be no further collection activity or sale of this account. In addition, the three credit-reporting agencies were notified to delete Midland Funding’s reference to the collection account in question from Mr***’s consumer credit files on August 11, 2017. A copy of the Universal Data Form showing the request which was sent to the credit reporting agencies is enclosed for Mr***’s records
Please assure Mr*** that Midland Credit is a reputable firm, and that it is a member of the Revdex.com of San Diego in good standing. With numerous scams noted in the media, it can be confusing for a consumer to discern which companies are operating within the law

I have reviewed the response made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
There are so many discrepancies in this response of when I said I spoke with them and never recived any merchandise and that I obtained an attorneyI told the rep I spoke to my company I work for corporate attorney and becuase I did not recive this merchandise I do not owe this bill. Of course they are going to continue to try to bully me and send an insane long letter and all I can see that when I got sick of being harassed I would tell them every few months the same story that I didn't recive the merchandise and then it was sold to another creditor and then another. I DID NOT RECIEVE any merchandise and this is insane that years later than can throw this on my credit report . They are violating my rights and twisting wordsI did not receive any merchandise End of story.Please help me with resolution to this nightmareI am not paying a dime becuase they say they will work with meI DID NOT RECIEVEany merchandise EVER !*** ***

Midland Credit has no record of her attorney’s contact informationPlease have Ms*** provide her attorney’s information, if applicable, so that we may contact them directlyIf Midland Credit does not receive attorney information in the next days, it will assume that Ms*** is not or is no longer working with legal counsel and will mark her account accordingly
Ms*** continues to request validation of the account. As advised in Midland Credit’s previous response, verification information provided by the seller was mailed to Ms*** by Midland Credit on June 7, 2017. Additionally, the verification information was provided in Midland Credit’s previous response to your office. The verification information meets the requirements of the FDCPA. The original contract, complete payment history, and a full set of billing statements are not required under the FDCPA.
Ms*** further requests proof that Midland Credit rightfully owns the alleged debt. She also requests specific account information. Information provided by the seller at the time of acquisition indicates that the first delinquency occurred on January 17, 2014. Subsequently, this account was charged-off as an unpaid delinquent-debt on June 24, with a balance of $598.32. The current balance of the account is $598.32. A copy of the bill of sale verifying Midland Funding as the rightful owner of the account is enclosed. Additionally, a copy of the seller data sheet confirming the account was included in the purchase from *** *** Bank (USA), N.Ais enclosed.
Ms*** also requests the bonding information for Midland Funding. Please be assured that Midland Funding is licensed and bonded in every state which requires such licensing or bonding for collection companies. Please have Ms*** contact her local state agency for more information regarding licensing and bonding requirements and information
Please note that based on the information provided by the seller, Midland Credit has determined that its credit file, and the information being furnished for the above-referenced account, is accurateMidland Credit will be closing its investigation of Ms***’ dispute and will be resuming regular collection activities as allowed by the Texas Finance Code and/or the Fair Credit Reporting Act
Ms*** requested that all documentation be mailed directly to her, and so a copy of Midland Credit’s previous response to your office, including the validation information provided by the seller, and this response will be mailed directly to Ms***
Ms*** also requested days to review any documentation provided, during which time she requested that all collections cease. Accordingly, Ms***’ account has been updated to a “Cease and Desist” status for days. During this time, while the account remains due and owing, Ms*** will no longer receive correspondence or calls from Midland Credit representatives unless a response is required by law

While Midland Credit made the business decision to remove prior interest accrued on the account, *** *** states that the interest charged was not in accordance with the maximum 6% interest rate allowable under Pennsylvania law. Midland Credit respectfully maintains that it applied interest to the account in accordance with applicable state interest laws
*** *** continues to express concern about how the account is appearing on her credit report, namely that she indicates that Midland Funding is listing itself as a ‘retail creditor,’ and also provides a copy of her credit report. As stated in its previous responses, Midland Credit does not furnish information for accounts as a ‘retail creditor’ to the credit reporting agencies. After reviewing the documentation provided by *** ***, the account is appearing on *** ***’s credit report with a notation that indicates the Creditor Classification as a Retail account.
To clarify, Midland Funding has been advised and required by the credit reporting agencies to furnish such information, indicating the classification of the debt as it originated with the original creditor. However, this information is to provide classification of the original debt, and not that Midland Funding or Midland Credit are retail creditorsMidland Credit does not furnish information indicating that it is a retail creditor. Midland Credit’s business records indicates that the account information it has furnished to the three major credit reporting agencies is accurate
With that said, in keeping with its Consumer-First policy, Midland Credit has made the business decision to close the account. There will be no further collection activity, furnishing of account information to the credit bureaus, or sale of this account. In addition, the three credit-reporting agencies will be notified to delete Midland Funding’s reference to the collection account in question from *** *** consumer credit files
