The Customer filed a complaint with the Attorney General and I will answer them both the same tine

RE: ID# [redacted] I am writing in response to the complaint filed on June 12, from [redacted] The problems that they are experiencing with the coating around their pool are not a result from improperly installed productAs stated from Mrs [redacted] , the product was “beautiful” the first yearThe first instance of a problem was after they uncovered the pool the following springOne year laterThe epoxy coating had discolored in the area under the winter coverThis is not a result of poor quality from Seven Seas but a problem with the epoxy product that was supplied by [redacted] ***, the manufacturerWhen the [redacted] s contacted me regarding this issue, I got in touch with [redacted] and was instructed from them to clean the surface that was “cloudy” and to re-seal the areaMr [redacted] chose to do this himself since we were too busy at that time to doAfter supplying him with the product, at no cost, and him completing the job, he contacted me regarding some areas that he “over epoxied” Could something be done? When we met at the home to discuss, they showed us an area that the stone coating was “crackling” when walking onWhen we finally got there to address that issue, and I’ll admit it was a while later, we ended up removing a large section of the stone coatingApproximately sqftof itWhat we discovered, in my opinion, and this opinion was discussed with the [redacted] s, was that the sub-surface concrete was breaking awayThe reason for the stone coating in the first place was that they had a bad concrete job done around the pool originally form another contractorSee attached photosWhen we prepped the surface the first time for the original coating, we removed everything that we couldWhen we removed the “bad” area of stone, we were literally removing the top surface of die concrete that the stone was epoxied toWe used a small jackhammer to remove the stone from the areas of the concrete that were still in good condition so that tells me that we properly installed the stoneIf we didn't, it would have come off all surfaces the sameThe crackling was occurring in a few other smaller areas around the pool at the time, but nothing that was major enough to addressAt that time, we discussed giving the deck a thorough cleaning with acetone in the spring as suggested by [redacted] ***, The acetone removes the cloudiness by breaking down the epoxyOnce the acetone dries, we would then reseal the entire surface with epoxyWe were busier than this spring and as stated, did not get to the job in a timeframe that the [redacted] s wantedThe work to be done was not needed due to poor quality of Seven Seas, but as a result of both an inferior sub-surface that obviously continues to break away and a product issue with the epoxy supplied by [redacted] ***I did not cause either of these so therefore will not be held responsible for themMrs [redacted] s request to have us remove the existing coating and replace is not something I will agree toHer minimum request of cleaning and re-sealing of the entire surface would be acceptable but not until [redacted] gets involved and is willing to assure us and the [redacted] s’ that the product issue with the cloudiness can be taken care ofI am not willing to do this multiple timesI have sent a copy of this letter, photos, and the original complaint file to [redacted] also and will be waiting for their responseRegardsDan [redacted] Seven Seas Home Leisure Center

Hi [redacted] Attached is a we-owe slip showing nothing Owed to the customer, at the time of delivery the customer was told that the vehicle was purchased from our store in PAand they would check to see if there was an extra key , there was not It was a used car and we do not always get the extra keys we would discount the key by % [redacted] Vice PresidentMAG Management Company

I disagree with Montrose Mazda dealership for the following reasons. If you read the previous response from Montrose it says that they will be happy to look at my non working air conditioning and repair it at discounted priceI am not paying for something that should be functioning from day oneAnd now they want to charge me $an hour plus materialsI live miles away from the facility and now that they are upset with me they will leave the vehicle in the shop for daysI would like to get reimbursed for the AC compressor for the amount of $so I can get it repaired with my certified shop near by my home

When [redacted] had returned possession of the leased premises, the walls in her apartment we painted in various colors Due to this, the apartment community maintenance had to finish priming the walls and then had to paint back to our standard color Ms [redacted] was charged for the labor in order to have the apartment put back in the condition in which she had received it The drip pans and blinds that she claims to have replaced would have been additional charges against her security deposit if they would have been left damaged This was explained to Ms [redacted] prior to vacating I apologize that the office was closed at the time Ms [redacted] had vacated and would have gladly performed her move out inspection with her if she would have returned when the office was open However, that would not have changed the charges that were assessed to her security deposit settlement We do appreciate that Ms [redacted] was satisfied with her apartment enough to have renewed her lease after her first year and were sorry to see her leave unhappy Nicole W [redacted] Zone Manager Management Resources Development c[redacted]

Hi [redacted] the people who make the appointments are not allowed to discuss the finance term other than in general termsHis credit score is exactly what we told himHe has filed a chapter bankruptcy and is his own lawyer and has not paid many of his creditors including the one that we would use for him They will not touch him nowbecause of that any other write offs and collection accounts we were not able to get him approved the score difference between what we say it is and what he says it is does not make a difference .If he thinks his credit is better than we do and the banks we set him to the credit sources he applied to did not agree with himIt serves us no good not to get him done if we could If he wants to question the credit bureaus position he can ask them for it as we are not allowed to provide the credit report to him

hi [redacted] , I was on vacation when this complaint came in I thought I looked back far enough I will check and get back to you thanks

In response to Mr [redacted] s proposal, we feel it is focusing more on the white film and the concrete rather than the stone crumbling back to its original state Since the last email there have been several more areas on the pool deck where the stone is crumbling When he first came to look at our pool deck Dan [redacted] said the concrete was sound and there would be no problem applying the [redacted] coating to the concrete pool surround Please keep in mind that the job was finished June 21, 2013, and all these problems occurred nine months later It did not even last one year.We would like to accept the proposal given by Mr [redacted] in the previous response if he gives us reasonable start and completion dates We understand that running a business is hard and very busy, but we feel a to 5-week time-frame is very reasonable He told us he would be here in May of this year and we haven't seen or heard from him yet Also we feel we shouldn't be responsible for any of the cost entailed in re-installing of the coating We need something in writing describing our responsibilities in this matter We would be more than happy to HELP Seven Seas if needed to remove the old coating We are very appreciative that [redacted] is generously providing the materials to reinstall the pool deck We feel our requests are reasonable and we would like some closure on this matter.Thank you for your time, [redacted]

I have this complaint and I am doing research on it

On Wed, Jul 15, at 9:PM, Dan *** wrote:***,In response to the referenced id #, the ***, I have been in touch with *** *** within the last week after receiving their assessment of the problems with the patio*** *** is their “in-house counsel” and we had a long discussion last Thursday regarding the their patio. I will not accept the assumption that I weakened the epoxy to save money on the jobIf that was the case, the problem would have occurred immediatelyThe dis-coloration (cloudiness) did not occur until the following spring in the area under their winter cover and then over the entire area after the homeowner re-sealed the patio on his own. After the discussion with Mr***, they, *** ***, has agreed to supply all new stone and epoxy as long as I, Seven Seas, will remove the old and install the new productI am waiting on a final verification from *** *** of *** *** on this arrangement and was told that I would hear from him by the end of this week. I accept this and will perform the work but under the stipulation that there is no warranty from Seven Seas that it will not happen againIf the sub-surface comes apart, then that is the homeowners responsibilityAs well as any cloudiness in the epoxyThe job will be as good as I can make it when I leave the site and the ***s will be present to approve itI also will not guarantee a completion date of “by the end of August” as requested by the homeownerI will remove the old stone surface at a convenient time closer to the install date as this can be done in almost any weather conditionBut, the actual stone installation will be done when the conditions are right for it to be doneIf we are going to go through all of this, then it only makes sense to do it in the best condition possible If this is acceptable to the ***’s, then I will contact them to make the arrangements for the job.Daniel ***Seven Seas Pools & Spas***

It is clear it is our fault and I apologize for itWho is the other manager who was involved ? How much is the late fee and any other charges ?

I would like to say we did not want this matter to come so far We just wanted Mr*** to stand behind his workmanship and act upon his word When he says he will come first thing in May, that's when he needs to show up It is June and still we have not seen or heard from him Since I sent the first letter to Revdex.com we have had two other experts come to look at the stone Both feel the initial placement of the *** *** around our pool was poor workmanship They thought the mix of stone and epoxy was mixed dry purposely to save money on Seven Seas part I have also been in touch with two gentlemen from *** *** who feel Mr*** should stand behind his work One has been in contact with him and Mr*** was supposed to be at our house last week (6/15-6/19) and we have not seen or heard from him When I stopped in at the store location in ***, no one there seemed to know what to tell me about cleaning the surface They tried to tell me many things to clean it with, but the acetone was never mentioned to me until this year by a *** *** representative My husband and I tried many cleaners last year and found undiluted *** *** cleaned it with much scrubbing We chose not to wait for any Seven Seas employees because they will tell you they will be there and then show up months later When I was at the store to ask about cleaning and what to do, there was one employee in a back room who was present when the stone was placed but he refused to come out and talk to me No one in the store but the man in the back room even knew what epoxy I needed to fix the surface THE EPOXY AND EPOXY KIT WERE NOT SUPPLIED TO US AT NO COST I HAVE THE RECEIPTS TOTALLING $TO PROVE IT My husband and I worked very hard by ourselves cleaning the surface and reapplying the epoxy We are not skilled in this as we do not do this for a living, but we tried our best As we rolled the epoxy out on the crackling stone, the roller pulled out the loose stones and made a huge mess They hadn't adhered to the sub-surface to begin with The epoxy set up while we were trying to deal with the loose stones and Mr*** did replace that small section in September of At that time he said he would be back the first of May to clean and and re-epoxy the entire surface I asked for this in writing or e-mail form and we never received it either way.If Mr*** thought the sub-surface would be a problem, why would he let us spend $on *** *** decking around our pool? Why didn't he say something at the time that would have prevented us from wasting all this time, money, and frustration? We would have definitely taken another path had we known this would cause so much aggravation My husband and I both work hard and we do like throwing money away on poor workmanship. Our sub-surface is not breaking away and is solid as told to us by other experts who have looked at it *** *** is involved and has been in contact with Mr*** and myself so a thorough cleaning and re-sealing of the ENTIRE surface would be acceptable wit NO COST to us by the end of JUNE 2015.I can add pictures too

[To assist us in bringing this matter to a close, we would like to know your view on the matter.]Good Afternoon,Before purchasing the car, I made the sales representative as well as the finance manager aware of the issues with the car I was not going to purchase the car with all the issues that needed to be addressed The finance manager assured me the repairs would be fixed at no cost Which was a sales pitch for me to proceed with the purchase My concern was not with the repairs, it was about the time and money I spent on getting this repairs done I had to drive to another city (Fairlawn), use my gas and take time off from work to handle the repairs Also, since then, my oil light now is on and its only been days since I purchased the vehicle I have called the dealership to inquire about the oil change with no return phone call My sales representative is no longer working at the dealership and the finance manager will not return any phone calls Never have I had to spend this much money on a car that I have had less than days of purchase
