Claim WIDI- [redacted] -WEB was submitted electronically 5/8/On 5/10/2017, the adjuster reviewed the claim and approved the insured to get a repair estimate from a local vendoron 06/20/2017, upon notification from the insured that he was unable to locate a local repair vendor that would provide a written estimate, the adjuster arranged for the device to be sent to a repair facility that would be able to detail the damages and repairs neededUpon receipt of the device the repair facility stated the device received was not the unit insured by the policy purchased by the insuredAs a courtesy to the insured an exception was made and evaluation was began by the repair facilityThe repair facility fully tested the unit at hand and was unable to replicate the issues expressedThe device was returned to the insured as a result

The Sales Executive did speak with the school contact, [redacted] ***y, to inform them that the customers situation [redacted] stated she had not spoken to the customer, as well, she stated the school would handle this on their endAt this time, Worth Ave Group has asked [redacted] to call the parent directly to further assist with the stated concernsUnfortunately Worth Ave Group is not aware of any issues with the GPO link on the last day for enrolmentWe have requested our IT team look into the information the customer relayed but have not found any errors On 10/7/2016, [redacted] , Call Center Manager, attempted to reach the customer but got her voicemailA message was left providing his direct contact information

Complaint: [redacted] I am rejecting this response because: When I first purchased the insurance I was told it was "full coverage" and that it would cover everythingThough the policy itself says it covers "Mechanical Breakdown", I recognize only after the fact that the fine print actually says that it doesn't actually cover "Mechanical Breakdown"What I was told, and what I was sold was misleading and misinformationYes if I had read ALL the paperwork I would have realized that what was told to me was a lieThat is on meThis does not change the fact that I was TOLD, and the list of coverage specifically mentions "Mechanical Breakdown." Worth Ave Group reviews and qualifies claims based on the Sworn statement provided by the insuredThis signed acknowledgement verifies that the information provided is true and correctAs we have only been provided a statement of events reflecting deterioration over a period of time, we are unable to overturn the decision reachedIf the insured would like our offices to consider additional information, please submit this statement of events for review

At this time the insured has filed claimsClaim WIKI- [redacted] -WEB- reflected a theft situation of an iPadThe adjuster has reviewed the claim and requested Proof of ownership, the stated Police Report, and a form of IdentificationThe insured followed up, providing a statement of purchase that did not reflect a serial number for the purchase described This claim was placed in a "Closed" status on 12/28/due to for weeks of inactivity/ no communication from the insuredClaim C-2018- [redacted] , was a resubmission of Claim WIKI- [redacted] -WEBStill a reported theft of an iPadAs prior the Adjuster requested Proof of Ownership, the Police Report, and ID for the insuredAs with the initial claim written communication was sent to notify the insured of weeks of inactivity the dismissal status nearing on March 1.The third claim C-2018- [redacted] , reported a cracked screen on a phoneThis claim was reviewed and details regarding the incident leading to the incident description was requestedAs with both other claims the insured was notified of the inactivity and the week dismissal nearing on March As of the current date we are awaiting the documentation from the policyholder before we can proceed

WIDI-**- [redacted] -01/ WIDI- [redacted] -WEBClaim initially filed 4/27/20**The insured provided the following statement “INCIDENT: The phones screen suddenly went out on meDAMAGE: LCD crystals including screen due to moisture."As a result, the Adjuster requested for further details regarding the actual incident on 4/27/20**In response the insured detailed, “Mechanical breakdown with no specific incident causing devices screen malfunction”Unfortunately due the the exclusion of coverage for Mechanical Breakdown Worth Ave Group is unable to extend coverage to the lossThis was detailed to the insured on 4/29/20**On 5/1/20**, the insured provided the following statement to our offices, “When I put mechanical breakdown with no specific cause, I meant I didn’t drop or break the phoneThe screen went out due to sweat from my ear leaking under the sceen over time." Following details of the coverage provided by the policy purchased the insured again detailed another scenario of damageThe insured further explained, "My phone has been dropped multiple times, has paint peeling off, and I wondering if I should have the company fixing my phone write you a detailed description of my phones problemsIt seems your doing everything you can, to not cover my paid insurance plan ” To conclude the claim, the Adjuster explained that due to the multiple conflicting statements of events for the claim at hand, Worth Ave Group is unable to overturn the original decision reached due to the discrepant information provided to our officesAs accidental damage is sustained from a one known actual physical incident that has occurred to knowingly cause damage to your deviceYou have provided statements for wear and tear, mechanical breakdown which both are not covered perils on your policy

Claim WIDI- [redacted] -WEB and WIDI- [redacted] -WEB were filed electronically 12/25/The insured provided the requested Police Report and proof of purchase as the coverage was assumed for inaccurate serial numbers of "forthcoming"Upon review of the documentation the claims were approved and reimbursement was issued for the replacement of the two items subject the coverage limit and deductible selected by the insuredAs a result, a check in the amount of $was issued and mailed to the insured on 1/17/to the address provided by the insured

Complaint: [redacted] I am rejecting this response because:It is clear that you are acting in bad faith as the contracted insurer on this item I have spoken with legal council and in matters of contract it is a matter of Common Law which states that in matters of contract interpretation interpretations are constrained in favor of the nondrafter That means that by not having explicit terms in your contract, you will be held liable in a court of law There is nothing in my actions that should preempt you from your responsibility to deal with the damage that was done under the terms that you have sold this insurance If your contracted repair facilities do not have the ability to run diagnostics because of some other issue, it is of no consequence to the insured And in fact, the laptop was and I imagine still is The keyboard was still able to be utilized and the laptop functioned as long as it was plugged in So you are not getting off the hook here But if you wish to persist and do not wish to act in good faith I would askthat you provide me with your Resident Agent who will accept service and process of the court I also ask that you provide me with the Name and Address of the Company with whom I shall conduct my litigation Sincerely, [redacted]

[redacted] currently has policies with Worth Ave Group, [redacted] and [redacted] Policy [redacted] insures IMEI [redacted] and Policy [redacted] insures SN [redacted] Both policies were purchased electronically online, [redacted] as of 8/9/and [redacted] 8/15/On 8/10/2016, the effective date of coverage, the insured submitted a claim on Policy [redacted] The sworn statement reads ," 8/10/2016, INCIDENT: I dropped my iPhone on a mountain while taking a picture and it cracked DAMAGE: Dents top side and right side, cracked screen" Following review of the claim we requested an Apple Out of Warranty Exchange be completedFollowing this claim, Mr [redacted] has submitted additional over both policies claims reflecting new dates of loss and statements of eventFor all claims submitted Mr [redacted] has provided the same receipt of exchange and requested reimbursement Unfortunately Worth Ave Group will not be able to extend coverage due to the fraudulent acts described

On Worth Ave Groups Online claims submission page, we provide all covered and excluded perils for the insureds reviewWe request both details of the damage and the incident leading to the loss claimedAs the insured originally stated the device was overheating and upon further clarification detailed the cause due to being pulled in, Worth Ave Group is unable to qualify the loss for coverage under the accidental insurance purchase

On 6/13/2016, *** *** submitted a claim online stating that, "INCIDENT: Unknown- unit has bent over time. DAMAGE: Bent over time, touch screen intermittent"The Adjuster, *** ***, informed Mr*** on 6/13/that Wear & Tear are not covered by the
policy purchased. Coverage purchased defines WEAR & TEAR: We will not cover loss or damage caused by or resulting from wear and tear, gradual deterioration, insect or verminWear and Tear means the reduction in value to the Insured Product stemming from routine use and exposureAs a result of the defined exclusion and the statement provided by the insured we are unable to classify the loss as accidental damage and will not be able to provide funding for the damages claimed

At this time, the stated document has not been receivedThe insured originally provided a document in which does not meet Apples standard format or details. The original documentation has additional text boxes, does not detail the customer information, problem description/diagnosis, nor a total for the proposed resolution. In order to proceed the insured will need to provide Apple's Genius Bar Work Authorization Form detailing the needed Out of Warranty Exchange and its cost for the damaged unitIf this document can not be provided, we will be happy to proceed with the evaluation of repair/replacement through our claims repair process
