On 5/21/2016, 11:am, *** *** submitted an online claim reflected a water damage to the insured iPhoneOn 5/23/2016, 9:am, Adjuster, Ashlee Munjoy, emailed the insured at ***@gmail.comThis email requested the insured provide an estimate or receipt for a repair by AppleAs a
courtesy to the insured, Worth Ave Group sent a reminder email, 6/10/2016, detailing the previously requested documentation for the repair completed by Apple. Once the requested information is received we will be able to provide the claims reimbursement

I am rejecting this response because: As stated in the initial complaint, e-mail request for cancellation was sent to Worth AveGroup on January 3, 2018. Beginning January 10, my account has been charged eight (8) times @ $each for a total of $52.00. To date (including the three (3) refunds processed last Friday the 23rd.) I have only been refunded five (5) times @ $6.50eafor a total of $32.50. Therefore Worth Avegroup still owes me an additional $

On 10/27/2016, Mr*** submitted Claim WIDI-***-WEB stating, "INCIDENT: The laptop was sat upon. There was also a problem with the battery swelling leading up to this event. The battery casued swelling of the keyboard and so many keys were useless. DAMAGE:
battery, keyboard/case, screen/ case"Upon review, the adjuster sent an emailed request asking for the incident that led to the damage claimedThe insured responded stating, "The swelling occurred from wear. I contacted Apple and it is an issue with an old battery." Resultantly the claim was denied for Mechanical Breakdown and Wear& Tear." As the initial event leading to the damage was not a result of an accident, the coverage purchased is not able to extend to the damage claimed

I am rejecting this response because: I reiterate that the issue was covered for a claim in The wind incident in was no different from my claim that year The company stated that the adjuster who processed and concurred with my claim was no longer with the company That is not a valid reason If the type of claim was covered one year and went through proper procedures for it being granted (and without the now required weather report), then ipso facto, it should be covered the following year I had received no amendments, modifications, or changes from the company on my policy

Unfortunately as our office is not able to differentiate the damages from the first event and the second, we are unable to cover the loss in question. As the insured did not have the device inspected after the failure of the battery and keyboard Worth Ave Group does not have the ability to determine which damages are a result of which event

Unfortunately at this time, Worth Ave Group has only received submission of identificationAs stated prior we are unable to accept an expired form of identificationIn reference to the second image provided, we are noble to determine the name, signature, or picture of on the documentOnce we are able to verify the signature of the the claimed statement to a valid form of identification we will be able to proceed with the claims process

Claim *** was filed with the statement that, "iPhone battery caught exploded and caught fireDamage: Battery, Main board of phone." Unfortunately upon request for the incident that led to the damage claimed the insured explained "Was replacing the battery when the battery
exploded and battery/phone caught on fire". Coverage Purchased: Accidental Damage- Drops, Spills, Cracked Screens, and Liquid Submersion. Theft, Burglary, and Robbery Coverage, Standard Perils - Fire, Flood, Natural Disasters, Power Surge due to Lightening and VandalismThe Policy defines under Your Duties in the Event of a Loss: 2) You must contact us or our agent prior to any repair or replacement of covered propertyAll repair/replacement facilities must be approved by us prior to providing any servicesWe will not accept estimates from unapproved vendors." At this time Worth Ave Group is unable to provide coverage for incident claimed due to the fact that the damage is a direct result from an improper attempt to repair or replace portions of the insured property and are not a result of an accident

On 7/26/2016, Insured *** *** requested a cancelation of the coverage purchasedOn 7/27/2016, a refund of all premiums paid was mailed via U.SPostal Service to the address provided on the policy of *** E *** St., Kansas City, MO ***On 8/24/at 3:24pm, Mr*** called and
informed our offices that payment was not receivedOn 8/25/at 8:am, *** *** emailed an Affidavit of Lost Check to the insured at ***@gmail.comOnce this document is completed and returned to our offices, Worth Ave Group will reissue payment

I filed each and every one of these claims, thereof or after the fact that my first claim was denied when it should have been acceptedI have done nothing wrong and would truly like to not be blamed for something that I blantanly have not done, so either send me the $that it cost me to replace my iPhone since your business so graciously failed meI will not give this up, this is wrong and scondolous of your business

On 10/4/the insured detailed different statement of eventsOriginally, Mr*** stated nothing occurred to the phone to cause the issuesThis statement resulted in a denial of coverage for the claimed damageFollowing this communication the insured called and while speaking with the Assistant Manager stated, "the phone was dropped from his cycling jersey"At this time the Assistant Manager requested picture documentation of the external damage resulting from the dropFollowing this call the insured electronically submitted a 2nd claim, ***, stating, "I had the phone on my window sillOne of our pets jumped up on the window and knocked the phone out of the windowIt landed on the deck a full story below the windowDAMAGE: Phone casing dislodged, will not take adapter." Unfortunately as the insured provided the statement of accidents following the denial of coverage, Worth Ave Group will not be able to proceed with coverage until we have the picture documentation of the "drop" detailed on the call with the Assistant Manager. We have documented with the insured that until the original situation is addressed we will not be able to proceed with future claimsAt this time we have not received the requested documentation regarding the drop originally claimed

Claim WIDI-***-WEB was filed on Sunday, June 11th electronically. The Adjuster reviewed and sent a request for proof of repair for previously denied claims on Monday, 6/12/17. The insured has a previous denial of coverage for damage occurring outside the policy
period. Upon request the insured stated that the insured device was no longer in his possession. The insured did not report that replacement to customer service or update the policy to reflect the device that was being claimed. As a result the Adjuster asked the insured to provide proof of replacement, in an attempt to work under good faith and proceed with this claim on the new device. On 6/19/2017, the insured stated he would attempt to get documentation from Assurion and since has not contacted our company since

As the insured has stated that multiple events have led to the damage at hand, Worth Ave Group is unable to provide an form of exception to the coverage purchased

On 03/19/2017, the insured filed a claim stating the Motorola Nexus stating "got really hot and froze"As a result, Adjuster *** ***, contacted the insured requesting the details of the events that led to the device overheatingThe insured provided the following information, "plugged
phone up and it overheated"Consequentally we explained that the coverage purchased is an accidental policyWe cover accidental damage, theft, fire, flood, and natural disastersUnfortunately, what you are describing falls under electrical or mechanical breakdown which is not covered under the policyThe issues described would more likely fall under a warranty type of policy as opposed to insurance

I am rejecting this response because:This device was housed inside a case, therefore I was unable to pinpoint the date of the accidental damageWhen I stated that the device had bent over time I meant that due to the device case, I was unable to determine the actual date of damage until I removed it from the case to determine the cause of the touchscreen issueIt is only logical that the damage occurred at one given time in the indeterminate past because of the rigid structure of the case
