Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and find that this resolution is satisfactory to me.
Although it is just a declarative statement. I will go ahead with my review to caution other individuals not to waste their time if they might find themselves in a similar situation.
Regards,

When you applied you agreed to this language on the application which is right above the submit button (#3 specifically).  We work with multiple banks to offer the best possible choices.By providing the information in this application and clicking on the "Click to Complete and Start Saving!" button and the “I Agree to these Terms and Conditions” box, the applicant and any co-applicant ("I," "me," and "my") each agree that: (1) I received and read the State Disclosures and the OpenRoad Lending Privacy Policy; (2) I received, read, and agree to the Consent for Electronic Disclosures and all other Terms and Conditions for this application shown above; and (3) I understand that I could have multiple inquiries on my credit report through this process and I am granting OpenRoad Lending and its partners permission to access my credit report to determine if I qualify for refinancing my existing auto loan, and (4) I provide express consent to receive autodialed/prerecorded calls/texts regarding financial services or other credit related offers from OpenRoad Lending or one if its third party lenders or affiliates at any number I have provided (consent to be contacted is not a condition to purchase services). As far as multiple inquiries, they have no impact on your credit score as evidenced by this article from Experian but you can find many articles that confirm this same information. (http://www.experian.com/blogs/ask-experian/impact-on-credit-scores-of-inquiries... I am sorry that we were unable to help you at this time.

First I want to say I am sorry you had a poor experience with our company. The link to the terms and conditions you are questioning are on the application you competed directly above the "Click to Complete" button. For your convenience, those terms and conditions are listed below.  When you...

applied, you gave us permission to access your credit report so we could provide a loan decision. You also gave permission for us to pass your application to other lenders if we were unable to assist you. Should you have any additional questions, please let us know. Terms and ConditionsBy clicking on the “Click to Complete and Start Saving” button, the applicant and any co-applicant (each individually referred to as “I”, “me”, or “my”) agree to the following:I certify that everything stated in my application is true, correct and complete.I expressly grant OpenRoad Lending and its third parties, affiliates, agents, service providers or assignees the authority to call and/or email me with questions related to this application and share information about other products and services available.I have read and agree to the State Disclosures and OpenRoad Lending Privacy Policy.I have read and agree to the Consent for Electronic Disclosures, agreeing to the receipt of these and future disclosures and communications electronically, including, without limitation, providing the Privacy Notice on OpenRoad Lending’s web site.If I have applied with a co-applicant, I and the co-applicant both acknowledge it is our intent to apply for a joint account.I authorize OpenRoad Lending and its lending partners, automobile dealers,  third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my application.I understand that if I am approved, the approval is only valid for 30 days. If my loan is not completed in that time, I authorize OpenRoad Lending to obtain a new credit report before finalizing the loan. I understand that if something on that credit file changes from the time when I applied, OpenRoad Lending is not obligated to continue through with the loan approval or at the original terms provided to me.I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I authorize those third party lenders, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services.I agree that OpenRoad Lending and any of it’s  third parties, affiliates, agents, service providers or assignees may call me, leave me a voice message, a prerecorded message, an artificial voice message, or send me a text, e-mail, or other electronic message for any purpose related to the servicing and collection of my accounts with you, for surveys or research or for any other informational purpose related to this credit application, the servicing and collection of the resulting loan account (each a “Communication”).  I agree that you and any of your affiliates, agents, service providers or assignees (and any of your assignee’s affiliates, agents or service providers) may call or text me at any telephone number associated with my accounts, including cellular telephone numbers, and may send an e-mail to any email address associated with my accounts.  I also agree that you and any of your affiliates, agents, service providers or assignees (and any of your assignee’s affiliates, agents or service providers) may include my personal information in a Communication and may conduct a Communication using an automatic telephone dialing system.  You will not charge me for a Communication, but my service provider may.  In addition, I understand and agree that you and any of your affiliates, agents, service providers or assignees (and any of your assignee’s affiliates, agents or service providers) may always communicate with me in any manner permissible by law that does not require my prior consent.IMPORTANT INFORMATION ABOUT PROCEDURES FOR APPLYING FOR CREDIT. To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify and record information that identifies each person who applies for credit. What this means to you: When you apply for credit, we will ask for your name, address, date of birth and other information that will allow us to identify you.

A tax return and 1099 that are filed with the State and Government that are signed by myself and my accountant are not made up. I can understand if it was just a generic 1099 but we are talking a 1099, tax return and I even offered to get a letter from my accountant on his letterhead to verify this. You are not a mortgage company so to compare the two is irrelevant. Like I stated before, I have dealt with 6 different car finance companies in the past and all 6 were fine with a 1099 and tax return so to say that is the norm is incorrect. Also, to say you are protecting yourself is going a bit far. You have verified my employment,  my references and where I live. You have seen on my credit report that I have made 16 payments on my current car loan all on time. If I was to lie, which I would never do,  all you have to do is repossess the car. The bottom line on this is that you approved me, I sent you all the required information including proof of income and its not good enough. If its not good enough, than why approve me.  Also, I showed proof that nowhere in your e-mail did you outline the terms and conditions nor did you provide a link or tell me where these can be found. Look at it from my side. I was approved and now all of a sudden you are making things up to not approve me. Phishing for information is a scam so to say you don't know how this can be a scam, well, there you go. You have all my information now and from reading other reviews, it is my understanding that you sell this information to other companies.  You know what your company did. Be honest and just admit that your advertising is deception or at the very least, just remove the inquiry from my credit report and return my paperwork. I do not think that is too much to ask.

Ms. [redacted],Thank you for your comments. When you completed the application process, you agreed to the terms and conditions on the application which state you application would be shared in an effort to find you the best possible terms for refinancing (see below). Unfortunately, none of our lending...

partners were able to assist you either in refinancing. I have removed your information from future mailings. Again, we do apologize for the poor experience and hope we can earn your business someday in the future. The OpenRoad Lending Team I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I authorize OpenRoad Lending’s lending partners, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services.

Complaint: [redacted]
I am rejecting this response because: i checked the the mail today and my title is not there. Why would I want to do business with you?  You don't keep your word. And your offer is Not generous. My gap insurance is with my car insurance. So it is with the vehicle. Your company just wants to do the mess around and Not be responsible for your short comings. Don't promise what you can't do and we wouldn't have this issue. I had walked away. And your email clearly stated there was a special exception for the 378. It didn't say anything or disclaim ltv. So that is on you. And I want my title by cob Friday. Or I want a check for $20+ dollars to get another one from the MvA. You should've sent it already.
Regards,

First let me apologize about your experience with our company. I am sorry your was a poor one. The agent that spoke to you about the effects of multiple inquiries on your credit was accurate. You can see be clicking on this link what Experian, one of the major credit reporting agencies, says about...

multiple inquiries within a certain amount of time. Those are all viewed as one inquiry as you credit score goes. You can view their opinion here (http://www.experian.com/blogs/ask-experian/2009/03/01/impact-on-credit-scores-o... Regarding why we passed your application to third parties to begin with. You agreed to allow us to do so when you submitted your application. This is a completely automated process so when we reviewed and declined your application, it was sent to others right away. When you called the next day, we stopped your application from going anywhere else per your request. I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I authorize OpenRoad Lending and its lending partners, automobile dealers,  third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my application.Again, I am very sorry your experience was a poor one and I hope we can earn your business sometime in the future.Regards,The OpenRoad Lending TeamRevdex.comI'm responding to Open Road Lending. Don't respond to me with a lie. I said on your recorded line that I didn't want other companies running my credit. Your CSR should have said at that time that you all send information to multiple sources and not send my app through. When a customer voice a concern then you supposed to adhere to it and not ignore it. You all were negligent with my personal information. I received a letter from a company I've never heard of stating that they ran my credit and couldn't approve me and one of the things that affected my credit score was too many inquiries. So, don't tell me that it didn't affect my credit, when my credit was ran by several companies. You all have the recorded conversation where I said don't send my information to other companies. Don't respond back to me insulting my intelligence. This has put unnecessary stress on me b/c there are people who have my vital information and they have given it to other sources like Myautoloan.com has given it to Rate Genius and BlueHarbor and who knows what other companies. Now I'm having to watch and see what else comes through the mail from some unknown company that has my personal information and ran my credit or done something else with it. I'm going to have to watch my credit. Going back and forth with you and these other companies made me lose money b/c this is time consuming. I'm going lose even more money b/c I have to reach out to the credit bureaus and let them know those inquiries wasn't authorized b/c you all refuse to contact them and the other companies you negligently gave my information to, so that the credit bureaus can know I didn't authorize this and you all made a big mistake. This was egregious what you all did. You all have the nerve to send me another promotional letter in the mail again. I would never do business with you all. The apathetic way you all and your comrades go about doing business. This is wrong and bad business practices.

Your solicitation says nothing of your "ASSUMPTION" of a lower rate. Open Road Lending is knowingly, grossly misrepresenting rates.I will be posting my entire negative experience with Open Road Lending on all online review sites available.

Complaint: [redacted]
I am rejecting this response because:
None if that was ever mentioned, nor was the lack of responses to emails or voicemails asking for explanations.Which equals a comets lack of professionalism. Again not once was any ov the ltv, mentioned .all messages from herf indicated it was a done deal and I just needed to ok it.Or maybe not returning calls, emails, messagesrom potential clients just how you guys do business and that's your definitio n of service and professionalism.
Regards,

I was solicited for a loan at an advertised rate by Open Road Lending. I didn't seek out  Open Road Lending for any type of "help" as I have a loan with a major bank (SunTrust) at a competitive rate 6%.Open Road Lendings marketing practices are deceptive and a scam. Open Road Lendings response are laughable as they act as they are in the business to help consumers. This company should be investigated by the Texas Attorney Generals office. Again, for the record, I didn't seek out Open Road Lending for any type of "help", I was solicited for a loan at an advertised rate by Open Road Lending. The only help consumers need is protection from predators such as Open Road Lending. I was not shopping for a new rate, I was solicited by Open Road Lending. Open Road Lending should honor my original request to remove all inquiries from my credit bureau.

I am sorry you feel this is unfair but this is the Chief Financial Officer responding and we have done this practice for 20 years.  I am sorry [redacted] cant remember all of his time here but our policy hasnt really changed.  Again we are not a dealer so nothing we would do would be like a dealer.  Again I am putting it in writing that any overage goes back to the customer.  99.99% of the time your lienholder (Coastal Credit) automatically releases the funds back to their customer for any overage without me being involved.  We have refinanced almost $2 billion worth of auto loans and have never kept a single penny from an over pay.  It would be illegal as we are identifying on the note and security agreement how much is being paid to the former lienholder.  Your loan funded with us on 4/27 so any overage you should be receiving from Coastal Credit by the end of May (I cannot control how fast they release overages, just that I can guarantee you get every penny of it).  I dont know what else to do since you loan has funded with us.

I am sorry we were unable to meet your expectations but we a few of our facts are different.  We did lower your rate from 15.1% to 11.95%.  That is over 3% savings.  Also you currently have 63 payments left with Capital one and we approved you for only 60 months.  3 months less...

than your remaining term.  At the 3 less payments (which is almost a savings of over $1,400) our payment is almost $30 per month less than your current.  Which is another $1,800 savings.  So the total savings is over $3,000 over the life of the loan. The reason your interest rate is not lower is because your loan to value (the amount you owe as compared to the value of the vehicle) is over 170%.  Since it is so high it creates risk for the lender, so your rate goes up.  If that value was lower, then we could give you a better rate.  This is really a good deal considering your LTV is over 170% and over the life of the loan you are saving over $3,000.  It may not be as high as the expectations but it averages to be about $50 per month.  Please let us know if you would like to proceed.

Complaint: [redacted]
I am rejecting this response because: I have several credit inquires on my credit report from various banks because of your misleading company, lowering my credit score significantly. I was mislead to believe that there would only be one credit inquiry from your company. Please take the neccesary steps to remove those inquires from my credit report, Most recently receiving a letter from Well Fargo, whom I would never do business with. Next efforts would be to contact the Attorney General's Office and Consumer Protection agency if this is not resolved.
Regards,
[redacted]

We have confirmed with our partners that no additional inquiries have been made and just for information, multiple inquiries in a 14 day period have no affect on your credit score.  You can google your self or see this article by Experian.  http://www.experian.com/blogs/ask-experian/impact-on-credit-scores-of-inquirie... I sorry that we were unable to help you at this time.

I am sorry but we should have never mailed you.  Experian is supposed to knock out limited tradeline individuals.  If you will send a letter to [redacted], requesting the removal of the inquiry, we will have it removed.  Again I am sorry for the confusion.

They have in fact gotten me another loan with a better rate after rejecting my initial application.  I have no further complaints with this company.

Complaint: [redacted]
I am rejecting this response because:  my problem was the Fossett for Maisch and that was provided to me but not knowing about you checking different businesses to get me alone you have this hidden in your page with multiple.  And how could I have received a preapproval for $21,000 if you were checking other places for a loan for me I feel that this is wrong and that you guys should not be doing this without my acknowledgment I am a brain cancer survivor and I am disabled your paper/  Application should be cleared  and in the open so that Consumer can see that you were going to be Checkr in multiple places for a loan.  People that use your website for Loan already have credit problems you just add to make their credit worse and you are advertising on [redacted] and [redacted] states that a consumer can check to see if they can get along without damaging their credit score .  So I would like to see you advertise in bold letters that you will be checking multiple creditors for Carlisle also I have called your company three times and no one has called me back .  I'm so disappointed with all the expense I had when I was sick . my credit ruined.  If I thought I could get along with another company with a lower interest rate I would have done that first .  I think that the federal trade commission should do something to restrict online lending companies from taking advantage of the consumer .  No I'm not happy I still would like my interest rate to be lowered .  It should not matter how much I owe on my car the point was you preapproved me for certain amount of money .  I will be waiting patiently  to see if you did the right thing floor my interest rate and help me finish completing the application process I will chalk this up as I made a mistake .  As a company I would think you would want to try to make the customer happy

Complaint: [redacted]
I am rejecting this response because: they are lying about saving me money. My payment increased despite the APR lowering. And the “over communication” are automated messages your employees don’t even know they are sending out. [redacted] wasn’t excited to save me money, there were no savings to be bad, she wanted to try and bully me into a bad loan agreement, as did [redacted], her supervisor. You don’t deserve your rating. And no email response you make can rectify that.

Complaint: [redacted]
I am rejecting this response because:The company which I'm complaining against remains steadfast in their assertion that I'd applied for credit with them. There's NO logical reason that I would have done this as I've been very satisfied with my current finance arrangement and was engaged in the process of obtaining a NEW mortgage. My attorney has stated that I should file a police report in regards to the issue (as an identity theft matter). It's my contention this organization has NO interest in resolving the matter amicably, has no conscience, and further has no business being in business. Pursuant to this issue affecting me, I've reviewed other similar complaints from others online.

I am sorry for your poor experience with our company. The application does have language that you agree to that allows us to pass your application on to others if we are unable to assist you (that information is listed below). I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I expressly grant OpenRoad Lending and its third parties, affiliates, agents, service providers or assignees the authority to call and/or email me with questions related to this application and share information about other products and services available. Also as stated in the previous post, once you agree the terms above (which you did when you submitted the application), the application is routed instantaneously to various lenders.  Even if you did call within minutes it is too late to stop the multiple inquires.  But multiple inquiries have no effect on your credit score.  You can research for yourself or check out this article form Experian. http://www.experian.com/blogs/ask-experian/multiple-inquiries-when-shopping-for-...
