Ms. [redacted], I will reach out to the credit reporting agency and see if they will remove the inquiry. There is no guarantee they will but I will make an effort in an attempt to make you happy. The OpenRoad Lending Team

Please enter your reason(s) for rejecting the business response below.I reject Open Road Lendings response and wish no further communication with Open Road Lending, as I will be forwarding a complaint to Texas attorney general and consumer affairs.

Did you ever consider mailing the copy of the requested application it me? You had no qualms releasing info on me to a lot of car loan companies.

Typical deceiving company who hides behind their contrary clauses. There customer service representatives tell you the opposite of what their policy says. Garbage company, garbage service and garbage management. I will express my dislike of this fraud company by word of mouth and social networking.

I apologize for the poor experience you had with our company. Unfortunately, what you were told by your Loan Care Agent is accurate. You approval is base on your credit profile only. There are still other factors that must qualify in order for us to complete your loan. In your case, you owe more on...

your vehicle than it is actually worth. Your Kia has a wholesale value including all of the options of $10,037 based on NADA. We are allowed to finance up to 125% of that value. Unfortunately in your case, you owe 183% of the value ($18,203) and therefore we are not able to extend you a loan at this time. Regards,The OpenRoad Lending Team

Mr. [redacted] - thank you for voicing your concerns about our company and processes. I have reviewed your application. It appears the reason for the decline is due to Capital One reporting to the credit bureau that you are now past due on a credit card payment which is a change in the credit file we...

obtained when we made the offer to refinance your vehicle. The back of the letter you received from us states that if there are any changes in your credit profile then your offer is no longer valid. Once that account is brought current and Capital One reports it that way to the credit reporting agencies, we can reconsider the pre-approved offer for you refinancing your vehicle.I do apologize this was a poor experience with our company and hope we can earn your business in the future.Regards,The OpenRoad Lending Team

I am rejecting this response because:Why would you send a letter promising lower interest rate and payment if you have yet to have all information needed? Seems like a gimmick and a catch in order for consumers to call you and you lure them into doing business.Maybe, instead of making empty promises, you should wait until you have ALL information needed to make promises of a better loan.
Regards,
[redacted]

I am sorry for your experience

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID 11491487, and find that this resolution is satisfactory to me. Although, there is not an option to opt out when applying. Had I note received the information in the business's response, I would have never known there was a way to opt out. I did read the terms and did not see anywhere in the terms that it was being sent anywhere else.

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my dispute.

I have an updated report and as stated before the Experian rep and myself do not see what you see and the rep has also brought to my attention that I have NO accounts in collections. The accounts that you speak of are listed on my report under accounts and not collections and have been there for over a year. But I can see I am getting no where. I give up, poor customer service at its finest. Oh and thank you for broadcasting details of my credit report on a public website.

Again I am sorry about the poor experience.  The links are just above the submit button on the application so I'm not sure how we are hiding anything.  Also people are pre-approved for lots of types of credit (auto, mortgage, credit cards) but often times you have to prove your income or have insurance or have a drivers license (etc) in order to complete the loan.

Mr. [redacted] - it looks like you have been in contact with one of our representatives already. When we get credit information from the credit reporting agencies, we don't have some crucial pieces of information we need to make the final credit decision. Income and collateral information being the...

two largest deciding factors. In your case, your debt load exceeds your income. It looks like you offered to add your wife to the application and that would have solved this problem. However, FL will not allow us to add someone to an existing title/registration which is what would have to be done if we add her to the loan. Your existing vehicle we are trying to refinance is in your name only. Our hands are tied by the state in this case.  I am sorry for any inconvenience this may have caused you. I hope we can earn your business sometime in the future.

I am sorry we weren't able to give you the exacted rate on the mailer but we were able to lower your current rate over 2.5% and save you over $1,000 over the life of the loan.  As far as multiple inquiries you gave us permission in the terms and conditions directly above the apply button on the...

application.  #4 is quite clear that multiple inquiries could occur.  By providing the information in this application and clicking on the "Click to Complete and Start Saving!" button and the “I Agree to these Terms and Conditions” box, the applicant and any co-applicant ("I," "me," and "my") each agree that: (1) I received and read the State Disclosures and the OpenRoad Lending Privacy Policy; (2) I received, read, and agree to the Consent for Electronic Disclosures and all other Terms and Conditions for this application shown above; (3) I am able to print or keep copies of these materials and this application; and (4) I understand that I could have multiple inquiries on my credit report through this process and I am granting OpenRoad Lending and its partners permission to access my credit report to determine if I qualify for refinancing my existing auto loan, and (5) I provide express consent to receive autodialed/prerecorded calls/texts regarding financial services or other credit related offers from OpenRoad Lending or one if its third party lenders or affiliates at any number I have provided (consent to be contacted is not a condition to purchase services). Finally, multiple inquiries do not lower your credit score as you can see from this article from Experian.  http://www.experian.com/blogs/ask-experian/impact-on-credit-scores-of-inquirie...  You can search for yourself and find there are many other articles stating the same information from the other credit bureaus.Again I am sorry we cannot meet your expectations but we did lower your rate by over 2.5% and can save you a sizeable amount of money over the life of the loan.  I would be willing to include GAP in your loan for only $1 as a show of good faith since your LTV is almost 120%.  Please let us know if you would like to proceed.

They had all of the information the are claiming that they did not have at the time of the Quote I received over the phone. They recorded the phone conversation. They are lying about not having the Buy-out amount, The year of the  vehicle and all the other information. They had all of this Information when they Quoted me the $679 A Month, I just received another solicitation from them in the mail for $602. This is false advertising and they have to honor the 679 Quote they gave me on the phone after receiving the information they claim they did not have, or I will be left no other choice then to take this matter to a higher authority as this is clearly a Violation of the LawWhen consumers see or hear an advertisement, whether it’s on the Internet, radio or television, or anywhere else, federal law says that ad must be truthful, not misleading, and, when appropriate, backed by scientific evidence. The Federal Trade Commission enforces these truth-in-advertising laws, and it applies the same standards no matter where an ad appears – in newspapers and magazines, online, in the mail, or on billboards or buses.

Complaint: [redacted]
I am rejecting this response because:
Regards, If anything that creditor just changed names, I have had 0 new collections since buying the car. Same rules apply remove the hard credit check and do not send me anything further.

I am sorry that you don't remember completing an application for you and your co-applicant ([redacted]) on 10/22/2015 to refinance your 2009 Pontiac Vibe with 116,000 miles from an IP address of 71.77.194.181. You applied on our site at www.openroadlending.com/applyone/ where you agreed to the...

following terms and conditions.  You got to our site from Credit KarmaBy clicking on the “Click to Complete and Start Saving” button, the applicant and any co-applicant (each individually referred to as “I”, “me”, or “my”) agree to the following:I certify that everything stated in my application is true, correct and complete.I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I expressly grant OpenRoad Lending and its third parties, affiliates, agents, service providers or assignees the authority to call and/or email me with questions related to this application and share information about other products and services available.I have read and agree to the State Disclosures and OpenRoad Lending Privacy Policy.I have read and agree to the Consent for Electronic Disclosures, agreeing to the receipt of these and future disclosures and communications electronically, including, without limitation, providing the Privacy Notice on OpenRoad Lending’s web site.If I have applied with a co-applicant, I and the co-applicant both acknowledge it is our intent to apply for a joint account.I authorize OpenRoad Lending and its lending partners, automobile dealers,  third parties, affiliates, agents, service providers or assignees to obtain such additional information as may be required, including credit reports, in order to complete the processing of my applicationAgain I am sorry we were unable to help you at that time.

Thank you for voicing a concern about our company. When you clicked through from the CreditKarma site, you actually completed a full credit application on the OpenRoad Lending site and then agreed to the terms and conditions stated on the application before submitting the application (those are...

listed below for your convenience ). Those terms and conditions give us permission to share your information with other lending institutions in an effort to find you the best terms possible. Regarding your approval... we did approve you at a lower rate than you are currently paying (10.45% vs 13.50%) but since your loan is "paid ahead" and you are so far into your loan, the savings are not significant. Again, we do apologize that this was a poor experience for you. I hope you give us another change to earn your business in the future. The OpenRoad Lending TeamBy clicking on the “Submit Application” button, the applicant and any co-applicant (each individually referred to as “I”, “me”, or “my”) agree to the following:I agree that OpenRoad Lending may forward this application and my financial information to one or more third party lenders, dealers, affiliates or others that may be able to offer me, or assist me in finding, financing or other products that meets my needs. Some of these affiliates may offer or arrange dealer financing rather than a direct loan from a lender.I authorize those third party lenders, dealers, affiliates or others which are forwarded the application to share information in the application and any other credit information they obtain with other third parties who may be able to offer or arrange for a loan or financing through a dealer or other products and services.

The company replied saying, I didn't get the loan because I only worked for 4 months at my current employer and did not have any employment before. Well that's not true. I've been working consistently for over 36months. I don't recall their application allowing me to put further employment information except the one I'm at currently at. Yes, I only worked 4 months at my current job but I've worked consistently for over 36 months.

I am sorry for the bad experience but we received your application from [redacted] on 5/20/16 when you applied to refinance a 2006 kia or hyundai with VIN of [redacted].  Unfortunately there was a bad character in the VIN and we were unable to decode the VIN.  On their site...

you agreed to their terms and service which allowed them to forward to us because they are not a lender.  Also multiple inquiries in a 14 day period have no effect on your credit score.  You can search yourself but here is an article from Experian talking about multiple inquiries in a 14 day period (http://www.experian.com/blogs/ask-experian/impact-on-credit-scores-of-inquiries...  We are only an auto lender so any inquiries for auto credit will not have subsequent effect on your score in a short period.  Finally we have not rejected any request from you as the email you sent this morning to our feedback email, has an address that is over 1 year old so I assume the USPS refused to forward the letter.  Our current address is [redacted].  Since we received your application from [redacted] and it was for a valid request of credit we cannot remove the inquiry.  Again I am sorry for your inconvenience.

Again I am sorry but Mr [redacted] can send me the proof that they asked for it but it doesn't change the contract that they signed and the Final Truth in Lending. The customer has responsibility to know what they signed and also what is on the Final Truth in Lending. Mr. [redacted] should have seen that neither document had GAP in the contract and at that point asked questions why his payment was not higher.
Its not a question of if anyone wins against us, its whether we can legally do something after the customer signed a contract that did not include GAP and after the car has been totalled. When they received their final Truth in Lending and did not see that GAP insurance was included Mr. [redacted] should have contacted us at that time (which was almost 3 years ago) to ask about GAP being included in their loan.
Again I am sorry but for the situation.
