In response
to the Customer’s complaint regarding the capped pricing plan, an early
termination fee will apply if the contract is cancelled.? The customer is receiving the lowest price
based on the company’s
prevailing priceThe “ market" is the average of full service,
COD and new customer first fill pricingThe customer will not receive
the COD pricing as this is a full service company

Revdex.com:
I have reviewed the response made by the business in reference to complaint ID#? ***, and have determined that my complaint has NOT been resolved because:The business continues to bemoan the fact that a complaint has been filed against it rather actually attempt to fix the problem? The business prepared a contract that fails to comply with New York law and Elgot cannot grasp that it must perform its obligations under contracts in just the same way that consumers must perform theirs? Elgot is even suing us for defamation for writing reviews and complaints with the Revdex.com.My opinion is that Elgot is not an honest company and that consumers in New York should be educated so that they do not do business Elgot, now or ever.-***?

I am rejecting this response because: at no time were we issues a credit to our account.  I was told when I called to find out why the amount per gallon I was being charged that it was an introductory rate.  At no time was I offered a credit to my account.  Also when I called and 200.00, I spoke with a representative who when I told her all of my issues throughout the year transferred me to another associate.  The woman I spoke after holding apologized and said that because of all of the issues she was going to waive the fee and I would be all set.  I thanked her for all of her help and the call was disconnected.  A few minutes later I got a call saying that we had been disconnected and he wanted to get me in touch with a representative to help me.  I told him that I had no idea what he was talking because the person who I was on the phone with helped me and no one hung up on the other person.  He said oh ok and the call was disconnected again.  I have no idea where they are getting the answer I hung up on them!
Sincerely,
Tammy Sabados

I am rejecting this response because: I feel this is very unfair because the salesman told me don't worry Joe if the oil market drops you are protected and it will go down.  I do not know where [redacted] gets their market price from.  I have contacted 4 other companies and their word "cap"  is a true cap price. if it goes down with the daily market price then the customer gets the lower price.  I want out of this contract with NO cancellation fee.   I am going to conytimue this process further.   This is no way to treat a customer.
Sincerely,
[redacted]

A refund check in the amount of  $269.98 will be issued to the customer.  They should receive this check in the mail by the end of the month (February).  Thank you.

After reviewing the account it has been determined that a refund in the amount of $211.64 will be issued to customer.

Good morning, after reviewing the account and speaking with the customer, all charges have been reversed.

Complaint: [redacted]I am rejecting this response because:
My contract with the business had expired and I notified them I no longer wanted a delivery from them. They acknowledged my request and never told me they wanted the request in writing.Sincerely,[redacted]

Complaint: [redacted]
I am rejecting this response because: There was no contract therefore no termination fee!  This is the company's second mistake. The first delivery without permission they apologized and we settled for $2/per gal. I am being generous to offer payment, since I did not authorized this delivery. I will pay only $1/per gal!If I did not contact Revdex.com they would still be delivering without my permission, despite multiple calls to them requesting to stop delivery.
Sincerely,
[redacted]

Mr. [redacted], I have read your complaint and I do see a lot of confusion and misunderstanding during that period and I will apologize for any shortcomings you feel were our fault. I will not get into all the ins and outs of what took place there but rather in an effort to resolve this situation...

quickly I will credit your service contract for that year. You were billed $439.95 for that year and Mrs. [redacted] called in unhappy about the cost and spoke to Natalie who issued you a $199.00 credit on it. I will be glad to reimburse you the difference which you paid in the amount of $240.95. I see that during the whole situation you had canceled your account and moved so I am not sure where to send your refund. Please send me your new address and I will see that it is sent to you. I appreciate your past business and hope we can work again in the future.     Len S[redacted] G.M.

I am rejecting this response because: I am not sure what this contract would entail.  I would like the 1.99 price and whats in the contract.  Thank you

Complaint: [redacted]
I am rejecting this response because:The service contract should NOT be terminated.  That is a 12 month contract that I paid for in full back in August 2015 and is not set to expire until August 2016.   If terminated then I should be credited for the remaining months not used.  I paid $291.40 for this service contract.  The service contract and the oil delivery contract are 2 separate items.
Sincerely,
[redacted]

Revdex.com Complaint #[redacted]
Customer #[redacted]
In response
to the Customer’s complaint regarding the capped pricing plan and cancellation
of her account without a fee, her account has been closed with no outstanding
balance.

Mr. [redacted], I am not sure if you are aware of this or not but Kaufman Fuel is a branch of HOP energy and in that we are we have certain rules and regulations that we have to follow that are put in place by our corporate office but there are also requirements that are put in place by the state of...

Connecticut in the form of laws. I will also say that in this branch I instruct all of our employees to treat our customers the way they would want to be treated, in other words put yourself in their shoes. The problem with this practice is that there is an expectation that there will be an understanding between both parties, if you will, that this is a two way street and unfortunately that is not always the case.  In response to your problems let me resolve them in the following manner. I can assure you that your account has been terminated. I will see that there will be no further marketing to you as I am sure you would never want to do business with a company that displays a pattern of deception and finally I will have your delivery rebilled at $1.899 your COD price for that day and send you a new invoice.                                Len S[redacted]

[redacted] let me explain your oil delivery to you as I believe, [redacted] has already answered the other questions you had  by email yesterday as you never gave us a chance to look into this as we tried contacting you for other reasons to no avail over the previous month or...

so. I am not sure how you would expect to use no oil at your home for heat and hot water as we had a very cold spring and after the April 20th delivery there were another 285 degree days. If we take your adjusted K-Factor for the spring and divide that into the degree days we calculate that  you would of used 71 gallons for heat, (285 / 4) by the end of May. The difference of 138 galloons was for hot water for the summer. I find it even more curious in that you were a customer of ours the previous year and you had a delivery in April of2016 and when you resigned with us in November you took 449.2 gallons so although that delivery was made about a month later you took a lot more than this delivery. I don't know how you think you could have hot water for six months and not use any oil? I am not sure if the gauge on your tank stuck in August or if there was a problem with your vent alarm but I can guarantee you from your history as well as from the numbers used to calculate your usage you received that oil. Also just for the record we have a delivery manager, [redacted]z as well as a Customer Service manager, [redacted] who would of been more than happy to look into any of your concerns by simply placing a phone call as I see nothing in our logs nor did anyone speak to you about this prior to your complaints sent to us via email as well as here at the Revdex.com. Although I am 100% sure of your delivery there could of been a mistake made and we would of made it right by you with a phone call as we are here to take care of our customers and not to try to put something over on them. If you have any further questions please feel free to call me directly at 203-368-4273. Sincerely [redacted] General Manager Hop Energy / Kaufman Fuel...
