Thank you for the opportunity to provide a response to Mr
***’s recent concern regarding his Trip Cancellation claim (***)
At this time, we still do not
have the required documentation needed to continue to further process the
insured’s claim. We understand that the insured’s have appealed their
originally denied claim based on the illness of a family member. In order
for us to consider this reason on the appeal, we require medical documentation
regarding the family member’s illness, diagnosis, and dates of treatment for
the illness. Our office has been in contact with Mr*** to obtain this
information, and the reasons why this specific information is needed.
On 6/14/16, a representative
from our company sent the insured the required documentation needed to continue
processing the claim, and on 6/17/16, the same representative explained to the
insured “why” this specific information is required
The wording under the Trip Cancellation and Interruption
portion of the policy, Section II states the following:
Section II Benefits
TRIP CANCELLATION AND
INTERRUPTION
The Company will reimburse the Insured a
benefit, up to the Maximum Limit shown in the Schedule if an Insured cancels his/her
Trip or is unable to continue on his/her Trip due to any of the following Unforeseen
events:
The policy defines “Unforeseen” as
follows: means not anticipated or expected and occurring after the effective
date of coverage
The reason that the dates are treatment are required for
further processing is for us to determine if the illness/sickness of the family
is actually “Unforeseen” per the policy language
Additionally, the reason we need to know the diagnosis of the
family member is because there are some exclusions under the policy for medical
conditions. These General Exclusions can
be found under Section IV of the policy, entitled Exclusions and Limitations

Thank you
for the opportunity to provide a response to Ms***a’s recent concern
regarding her Trip Cancellation claim (UC8***)
Our
records indicate that the insured purchased insurance on 09/15/2016, which
became
effective on 09/16/2016, to cover travel between 12/12/through
12/21/2016. The trip was cancelled on 11/28/
as a result of Ms*** ***a’s pregnancy and the physician advising
against travel due to the risk of being infected with the Zika virus. Unfortunately, we were not able to extend
benefits as Pregnancy is excluded from coverage and the risk of
obtaining a Sickness is not a covered peril under the Trip Cancellation
benefit.
We
received an additional letter from Ms***a about the events surrounding the
cancellation of the claim on appeal.
While we understand that the physician advised against travel, we were
not able to overturn the outcome of the claim as the loss is not covered under
the policy

Our

effective on 11/05/2016, to cover travel between 03/07/through
03/14/2017. The trip was cancelled on
03/02/as a result of Mrs***’s pregnancy and the physician advising
against travel due to the risk of being infected with the Zika virus. Unfortunately, we were not able to extend
benefits as Pregnancy is excluded from coverage and the risk of
obtaining a Sickness is not a covered peril under the Trip Cancellation
benefit.
Additional
medical documentation was submitted from the Physician in regards to a medical
condition confirming the need to cancel the trip on appeal. The medical condition noted on the submitted
appeal is excluded from coverage as it does not meet the policy definition, Complications
of Pregnancy; therefore, we were unable to extend benefits.

Thank
you for the opportunity to provide a response to Mr***’ recent concern
regarding his Trip Interruption claim (UC81890457)
Per
our records a Trip Interruption claim (UC81890457) had been filed on 10/18/
due to the
untimely passing of a family member.
We recognize the passing to have occurred on 10/12/2016. Your original scheduled travel dates were
from 10/13/through 10/16/2016. This
was for a round trip flight from Atlanta to Houston. Due to the passing you had purchased
additional airfare on 10/13/to fly from Houston to Cincinnati on
10/15/to attend the funeral.
Unfortunately, as the loss occurred on 10/12/the only benefit in
effect at this time is the Trip Cancellation benefit. The Trip Cancellation benefit provides
coverage for cancellation fees associated with the original booked travel. It does not provide coverage for additional
airfare expenses.

I've reviewed the policy again and nowhere in the policy it states that the day rule specifically counts the date of policy purchase It states that within days from the trip purchase, if the policy is purchased pre-existing condition is waived If you count the days from 5/to 6/3, it is exactly days If you believe the policy specifically states the date of trip purchase is counted as day, please point it out to me on the actual policy so I can fully understand

This
is in response to the concerns raised by Ms*** regarding her Trip Cancellation
claim.
The initial
claim correspondence received indicated that the trip was cancelled due to Ms
***’s traveling companion cancelling the trip. Unfortunately, we were unable to extend
coverage for the loss as cancelling the trip due to a Traveling Companion
choosing not to take the trip is not a covered reason under the Trip
Cancellation benefit.
On
appeal we received a medical certificate filled out by Dr*** indicating
the medical condition being treated has a restriction that necessitates being
accompanied by someone when traveling.
This information does not provide the dates Ms*** was treated for
this condition that prevented travel.
The policy purchased excludes pre-existing condition as defined
below.
Please
refer to the policy wording, which states in pertinent part:

EXCLUSIONS AND LIMITATIONS GENERAL EXCLUSIONS

the claim documentation submitted, it is indicated that Mrs*** cancelled her
trip due to her husband’s military leave dates being changed. As
a result, Mrs*** exchanged the original
travel arrangements incurring an increase in airfare in the amount of $
for new travel datesUnfortunately, this is not recognized as a covered loss
under the Trip Cancellation benefit
In
pertinent part, Mrs***’s policy states:

It has been verified that
the value of the original airfare was not forfeited and the additional airfare increase
is not covered since it was not part of the original insured trip costs. Mrs*** has been reimbursed for the
$cancel fees imposed on the original airfare that was insured under the
policy purchased. Based on our review, we find that the claim has been properly
adjudicated under the terms and conditions of the policy purchased
While we wish the
outcome of our review could have been more favorable, we must adjudicate each
claim in accordance with the terms and conditions of the policy purchased by
our Insured.

This is in response to Mr***’s concerns
regarding his Trip Cancellation claim
The pre-existing medical conditions exclusion includes
any condition for which there were symptoms that would have prompted a person
to seek diagnosis, care or treatment.
The mass being present prompted Mrs*** to seek diagnosis, care
and treatment which then led to a biopsy and the diagnosis which prevented
travel. While we understand she was not
diagnosed until a later date, the mass being present is what prompted her to
seek the treatment and what led to the diagnosis. According to the exclusion, it would be
considered pre-existing and excluded from coverage.

policy wording, which states in pertinent part:

I do not agree with their responseI did not intend nor did my husband intend for him to get arrested that nightWe tried very hard to fight with the courts to allow him to go because this was not an expense we wanted to lose The insurance company states they would cover it if it was a subpoena...in which if you doinn't show up to court you would be arrested If he went against the court order and went on this trip my husband would have been arrested It is the same thing I am sorry their perils do not state that a court order to stay in a state is not something that they would not cover It is up to the adjuster...which means they can make exceptions but are choosing not to help us out This arrest was a huge mistake and my family paid for it dearly why is this company being so discriminatory against my husband's arrest? We cannot afford to lose out on this money and I know they can help us out
