I encourage Mrs. [redacted] to continue her research into the circumstances surrounding her voicemail calls as we have neither the technology nor the desire to manipulate cell phone or land line phone systems. Additionally, this case was in fact closed out with our office as identified in Mrs. [redacted]'s compliant and this account is no longer being serviced by our organization.Again we appreciate and thank you for the opportunity to evaluate our staff and processes and hope that this will serve as an acceptable response to your concerns.Regards,

In order for us to properly investigate complaint, we had to reach out to complainant for the last six of her VIN number. We will address complainant's concerns as soon as she returns our call with this information. In no way would we purposely delay a redemption process.

I am rejecting this response because: I was provided zero evidence on why my claim was denied. I requested that information a number of times and yet I still haven't seen it. The investigation that went into the claim is zero. I provide proof to support my claim and the still choose not to take responsibility. I feel the denial of my claims and the poor matter I was treated is from another time the repo company come out to my property, and I was wrongfully placed under citizens arrest. The people I have delt with treated me like a second class cotizen, and was even told I have no rights. Then the chief claim officer never returned my phone calls. I did call a lot but if busneiss was conducted properly; I wouldn't have had a need to call that many times. My name was slandered, and they are hiding behind law enforcement; that was they don't have to take responsibility for what they did and damages caused. I was also told I had to get a lawyer. I feel that since they are making me get one. They shall be responsable for the fees to

We appreciate the opportunity to address these sort of issues and have researched this matter internally. The customer has reached out to our claims department this AM identifying the circumstances outlined and requesting a $75 refund. The local repossession agent has verified that...

they have now refunded in full the $75 requested by the customer. Should there be any further need for us to take further action or have additional conversations with the agent on this matter please reach back out to our claims department personnel and have additional discussion.

I am rejecting this response because: Simply discussing what type of business they conduct does not absolve them of their legal responsibility to provide compensation for the damage caused to my vehicle. They claim that they performed an investigation into the damage, but have failed to provide me with any of the documentation which would disprove my claim that the damage to the gear shift and ignition was caused by the towing 'company.' The vehicle was in their possession when the damage occurs, therefore both legally and logically, the da,age was incurred by the tow 'company' hired by this 'business.' They claim to inspect the facilities once a year, but have provided no proof of inspection, no proof of the legitimacy of the tow 'company' no proof of ever having spoken to the tow 'company', no proof of how my vehicle was towed, and no transparency in their entire dealings with me.  Since there have been other claims filed against this 'business,' it is obvious that the management does not take due diligence in its contracting process in ensuring the safety of both the vehicles and the owners of these vehicles, as threats were made to my safety and the safety of my father, when we picked up my vehicle from this so called 'facility.' My father is a retired veteran of the USMC and USN with over 30 years of service. Neither my father nor myself would have any reason to lie regarding the damage to my vehicle, especially since we found garbage, damage to the ignition and gear shift, and out belongings having been looked through. This in itself is illegal on the part of the tow 'company' and this so called 'business.' Furthermore, the tow 'company' did not have the keys to the vehicle, meaning that the garbage and damage could only have been caused by illegal entry in the vehicle. For all we know, this tow 'company' could still have illegal copies of the 'key' made to enter my car, which they could use at any time to steal or otherwise cause further damage to my vehicle.  Therefore, I am still requesting compensation for the $1086 in da,age made to my vehicle.  I could have made additional claims regarding lost wages due to time taken off due to the lack of access to my vehicle. I am also requesting that the business never make use of the tow 'company' in question. (Having read previous complaints made against this 'business,' the management obviously uses their copy and pasted response above as a standard reply to any consumer filing a complaint against them.)

Hello,Thank you for your perspective, however per Revdex.com compliant management advisement all responses provided to the Revdex.com are subject to public disclosure and therefore must be considered as possible breaches of FDCPA and GLBA federal guidelines as enforced by the CFPB. That having been said, we have enjoyed a long history of protecting the financial confidentiality of our client's customers and take these directives very seriously. I have of course researched this matter specifically and upon advisement from legal counsel am authorize to represent that all claims investigations are thoroughly reviewed and complainants are properly notified of the outcome. Should any complainant have need to reach back out to our office for direct discussion regarding the final disposition of their claim they are welcome to do so, however I would encourage them to ensure that a final disposition of the claim has in fact been rendered prior to reaching any individual conclusions. Should Mrs. [redacted] desire to reach out to me directly, I can be contacted at [redacted] and will be happy upon verification of personal identify in accordance with federal regulation, to have a civil discussion. Thank you,[redacted]

We have reached out to complaintant and provided her with the necessary information to regain personal property from vehicle.

Review: [redacted] contracted American Recovery services that then hired a local company to have my car towed and reposed I was able to recover my vehicle paying all the fees owed to VW and towing cost when I picked up my vehicle they made me sign all the paperwork without letting me inspect the vehicle or nothing otherwise they were not going to bring the car out to me less than a block away I notices multiple lights on my dashboard such as check engine light EPC light other exclamation point lights that I dont know about and my vehicle woult not drive pass 40 the gas pedal goes all the way to the bottom and makes a sound like its on neutral very concerning I contacted VW who gave the number to ARS claims department I have been trying to get a hold of someone there leaving multiple voice mails with no answer I want to have my vehicle inspected and repair because some serious damaged was caused I did everything on my end to recover my vehicle now I want it in the same condition as when it was towed I have been waiting several days with no call back so I can make the claim and take my vehicle inspected.Desired Settlement: I want ARS to contact me and get this issue resolved as soon as possible I cannot go to work with a vehicle in that condition is costing me money and time to all I want is them to fix my vehicle.

Thank you for your correspondence. We have notified our claims department of your concerns and our records show that contact from our claims representatives was made on 5/10/2016 and the review process is underway. Please continue to work with our claims associates on this matter and thank you again for allowing us to evaluate our operations.Regards,

Review: There was damage done to my car when they had it towed. They claim they have pictures but will not show them to me. On May 31, 2016, they contracted a tow company to pick up my car. The tow truck driver damaged my car and claims it was already damaged. This is the contracting company and I hold them as one of the responsible parties. They claim they have pictures proving the damage was already there but they refuse to show them to me. I just want my car fixed. If pictures were actually taken I don't see the big deal in showing them to me. If they are right (I don't think they are) I'll shut up. If they are wrong, someone needs to fix my car. Simple. I want to see the pictures to be sure they were actually taken before he had my car. I was actually there when the car was picked up and I never saw the driver take one picture. If the pictures were taken at the tow shop then they can't prove that the damage was pre-existing.Desired Settlement: I want the repairs and car rental paid for.

Review: American Recovery Service played a role in the illegal repossession of my vehicle. During this process items came up missing from the car, and damage happen to my driveway and driveway gate. The driver used foul language, and took the car from a locked place against my will. I attempt to file a claim, but when I did this I was told I was threating the person who was handling it. Then communication was stopped by the American Recovery Service. I was given legal advise and hung up on many times. I was forced to sign a form to get my car. The conduct business in a very unlawful and unethical manner.Desired Settlement: This matter will be resolved when they repair and replace the things that were damage; along with compensate for lost income.

The customer submitted his claim June 28th. An investigation was completed July 8th, within the 5-10 business days quoted. The result of the investigation was that the claim was not approved due to a lack of supporting evidence. The customer was provided with the details that went into the decision not to approve the claim. The customer questioned the decision, and the decision was reiterated in writing on three separate occasions. The customer still continued to question the decision, and the customer was advised that absent any further information, the decision would not be revisited. This was also confirmed in three separate communications to the customer. The customer chose to place dozens of calls to many different company personnel with the intent to annoy and harass them because of his continued disagreement with the decision that was made. The customer was advised that nobody would communicate with him further due to his behavior, and a formal complaint was filed with local law enforcement. The customer has been provided with the information necessary to file a regulatory complaint or pursue this matter further. I would like to also note that a separate claim investigation into the same areas of concern, which was conducted by the local recovery company; also determined that the claim was not valid.

He stated that he had issued out a check and it was being delivered via ground mail and I never received the check. Review: My vehicle was repossessed and upon making payment to [redacted] I was advised to contact American Recovery Srv at ###-###-#### and provide them with the last 6 digits of my vin number in order to get with the tow company that came out and did the repossession. Upon calling the above number and punching the correct number(4)in order to give the information needed, I then sat on the phone holding for 2 hours and 36 minutes with no live personal contact. I then contacted [redacted] Motors Finance to see if I could get assistance with finding out who actually had possession of my vehicle and they were able to get in touch with a representative on their end in less than 15 minutes and I was told who had my vehicle: East Texas Auto Recovery and given a telephone number to reach them ###-###-####. Upon making that payment and calling [redacted] back with the Money Gram reference number, the rep at [redacted] told me to call American Recovery Srv back in an hour to give them time to receive and process it. I waited 2 hrs and called American Recovery Service this time punching (0) to get to a live rep and this rep was beyond run and immediately transferred me to the same line that I had only held on for 2+ hrs earlier. Called [redacted] Motors Finance yet again and they have resent for a 2nd time that my vehicle needs to be released to me. East Texas Auto Recovery closes at 4 p.m. CST and I am getting the impression that American Recovery Service and the tow companies that it utilized try to hold the vehicle as long as possible in order to run the bill up on storage of vehicles that it told to repossess. This should be against some sort of state law and a crime. The default has been cured with the lender ([redacted] Motors Finance), so legal they should have no right to withhold my vehicle from me, they should be charge with THEFT OF A VEHICLE!Desired Settlement: If my vehicle has to stay at East Texas Auto Recovery another day past 01/15/2015, because American Recovery Service failed to send needed paperwork to release my car to me, any storage fees, misc. fees, fee fees, etc. should be the sole responsibility of American Recovery Service to pay or reimburse me for having to pay and if this company was in the state of Texas I would be filing charges of theft on them. This is a tacky and low down way of scamming more money out of an individual!

Review: On Thursday 12/22/2015, at 1:30am my vehicle 2010 [redacted] Navigator [redacted] was towed from the address [redacted]. said vehicle was parked in reverse up against a tree. Feeling obliged to pick up the vehicle form the front, they could not pick up the vehicle as it was rear wheel drive. They found themselves obligated to pick it up from the rear causing damages I will mention hereafter: damages on the rear bumper, right rear lateral panel, which panel closed causing rear hatch door to be knocked out of place. Right taillight, air suspension, causing damages to the level sensor of the suspension and tearing the air bags from said suspension. Damages to the suspension compressor (to be able to lift such vehicle, the suspension must be turned off which was not done). The right side view mirror was manually closed which should not be done as it is electric… which also caused damage. When the vehicle is driven it feels unstable and the entrance of air from the rear end of the vehicle. The vehicle was dropped from the tow truck causing structural damage. On 12/24/2016 at 11:30am I went to the the tow yard (of the company that towed my vehicle) to retrieve my vehicle. They made me feel obligated to sign a document that stated the vehicle was in perfect condition without me seeing it first. The vehicle was opened without this business having the keys, subtracting all my belongings without my authorization. Returning separately some of my property. I was missing an embroidery machine, which was not my property, and a pair of lenses.Desired Settlement: To said business I have sent photos/videos… they argue that they are not responsible for nothing. I sent them estimates of repair and invoices of stolen objects refusing to pay. I contracted law firm and they don’t attend or return the calls from the law firm. Additionally [redacted] of who I make my car payments to also denied responsibility. I ask for the repair of my vehicle and the stolen items in it. Claim number [redacted]
