This has just been brought to my attentionI am looking it this and contacting individuals involved to see where this stands

I have reviewed your complaint and have discussed it with my team here at Best fitnessWe are going to refund you the amount owed to you as quickly as possibleI am sorry that this situation occured

Attached is a copy of the agreement for [redacted] with Mr***'s signature as the buyer and the terms are outlined as Mr [redacted] being the responsible partyThe account will need to be settled either in the club or through the collections agency and then it can be taken out of collections

Ms [redacted] was explained the terms and conditions of our policiesShe agreed that starting a membership with our club would be beneficial and cost-effectiveShe was explained the cancellation process and agreed with the policiesShe was also given a copy of her original agreement which also outlines our cancellation policyWe will be more than happy to help her cancel her account without charge once she provides one of the proper forms outlined in our membership policy

*** *** 05/04/07:PM explained what he needs for proper proof of move, day notice prior to cancellation.RM Above is the only interaction we have had with Mr***This was back in May of where Mr*** was explained the proper credentials that would be
needed for cancel and the time frame of payments once we received those credentialsIt is also stated in the contract that Mr***, did fill out himself, the cancellation policy Mr*** was sent an email copy of this contract

We will be refunding Ms*** both the $and the $as well as making sure the cancellation has been completed immediately

For further clarification, member *** is to be cancelled with no further chargesThis would include final payment of $member made reference to previouslyIn addition, member will also receive refund for $Verification of cancellation may be obtained in person at the club

I have tried on TWO separate occasions to pay them the feeAnd yes I am well aware of what I sent because I sent itOn Sunday, October 4th I attempted to try and pay the $but Dylan made it even more difficult for meHe even called Glenn Swho told Dylan that my fees that they are continually charging me WOULD NOT BE REFUNDED even though he said so in the email sent to me and on the Revdex.com website in a responseI also told Dylan that I could not return on another day to resolve this issue and they still would not make this any easierIn addition, I was told there was a fee to pay in a cash even though I had paid in cash before with no additional feesMoreover, I was never given any hard copy of what the policies were and they seemed to keep changing every time I wentBottom line is this, Best Fitness is a male chauvinistic bunch that is trying to force an option that doesn't existI can't pay anything without my money being returned to meOr better yet, take the that you already took from me illegally and put that towards my cancellation fee and then I will pay the $that I owe via certified mailAnd don't tell me that you can't do that because you can, you just don't want tooAnd if that doesn't work for Best Fitness then be prepared to go to courtCompromise is very big part of negotiations but Best Fitness is not trying to do that at all which doesn't work for meI will not pay you $especially since I have a recording for Dylan telling me that you won't give me money back....it won't happenI can't believe that Best Fitness is that desperate that they are harassing me over a $that I ALREADY TRIED TO PAY!!!! Even better, how about you just cancel my contract as a one time courtesy since I have already tried to pay this billIt is Best Fitness that is holding up this process not meI only wanted to be done with this business which I why I came on Sunday, October 4th to get it doneI will not be returning

For your reference, details of the offer I reviewed appear below.Business stated that "Miss *** came into Best Fitness on 11/26/in response to a text stating that she could reconcile her membership balance if she rejoined during a black Friday promotion"This is incorrectI came in specifically to resolve personal training balance and had no idea that my primary membership had not been cancelledI never received a delinquent letter nor a call that informed me that I was delinquent on my membership or that it had been sent to collectionsI ask that the business show documentation of both sets of communicationAs for the text message, I have the exact messages in which I ask Paul, "You mean the personal training balance? to his text stating""Hey ***, Best Fitness wants you back as a memberThis weekend you can rejoin for nothing out of pocket and past due balance is forgivenAre you interested- Dan from Best fitness."Following my question ""You mean the personal training balance?" he wrote: "Yes, the promo goes between friday and monday.-Dan from Best Fitness"Dan's message, in even saying BF wants you back, gave me no indication that I had an active membership, and furthermore, he affirmed my specific question about personal training being covered in the promotionAs my mentioned in my initial complaint, this inclusion of personal training was also affirmed by RashaanThe sequence and facts of the events presented by Best Fitness are incorrect and unsupported by the written documentation that I have on my phone and no doubt exists in their systemWhats even more upsetting to me is that this is indicative of a pattern on acting in bad faith if not outright lying to cheat customersBest Fitness should have apologized that their staff, agents acting on behalf of the company misled me or were mistaken and also upon looking in their records and finding my cancellation request offered to backdate my cancellationI would have had no problems paying the final that seems legitimate given the 30-day cancellation policy.Also, ABC advised that I could cancel membership by phoneThe company should honor that.Also I have no idea what an enhancement fee and this was not discussedIs this the down payment? The content of the company's response really makes me wonder if the employees or management are being deceptiveI am astonished by the boldness of this deception given that much of the initial dialogue occurred over text and contradicts this official response to the BBC.I again would also like to request the arbitration process outlined in the contract for resolving issues related to membershipsThis company or the agents of this company are acting in bad faith if not downright lying and failing to honor conditions they themselves propose

Another statementI’m sorry but for one as a student moving back home how would be possible for me to provide any of those things? This in itself is an unrealistic requirementMy drivers license for my home address would not change, why would my name be on my parents lease or bills? And I did not have a new job until August, and I wasn’t given a “formal job offer” for itThese requirements laid out “after the fact” because as I said I was rushed to quickly sign because it would be easy to cancel, are all made to keep someone from being able to leave the gym and not in good faithI’ve been paying each month since last year so the notion that I have not tried to get this dealt with until March this year is a complete lieI have paid almost $to the gym as of today for a $a month membership that you guys have me as “delinquent” onIm asking to please allow me to finally move on from this gym and I can provide a recent pay stub to show my living in nycMy license still hasn’t changed and I am not on a single bill in the household which according to the rules of the gym would have me still locked into a gym miles from my home to this very day

I will not accept responsibility for ANY of this debtI feel like this response, shows the horrific business practices of Best Fitness, to read in detail what happened and then "settle" on a lesser amount for hopes someone would be so desperate to accept this settlement No one has ever reached out from corporate to speak to me or hear my account of the situation I again feel that the club was notified regardless of it being certified mail and I will not pay anything towards the balanceIt is pathetic for a corporation to use this small loop hole to black mail customers.

I apologize that Mr*** is having an unpleasant experience with our companyWe do our best to make sure every member understands their agreement before signingAfter looking into the agreement number that Mr*** provided in his complaint, I see that
this account is for a *** ***Mr*** does, indeed, only have one account with us, but he was the initial "buyer" for Mr***'s account; this was the account that was sent to collectionsNot knowing the agreement that Mr*** set up with Mr***, I'm not able to speak as to who is at faultMr*** was contacted several times by the financial institution that handles our billing, and by our staff here in Erie to let him know his account was behind on payments and in jeopardy of being turned over to a collections agencyWe can provide Mr*** with a copy of Mr***'s agreement if he wishesMr*** signed the "buyer" portion, making him financially responsible for the account

attached are the notes from both Abc and Best fitness with exact dates and times regarding notification and explanation of process for both cancellation and on the delinquency of her contractAlso included are the conversations with the membership manager clearly explaining that her PT was not included in Black Friday Promotion and MS*** decision to not proceed

As shown in the attachment provided by Mr***, it clearly states that an Annual Club Enhancement Fee of $will be billed on April 1st of every year and right next to that it states there is a notice to stop monthly billingWithin the time Mr*** came in to cancel, his CEF was due within that daysThe enhancement fee has been waived for Mr*** for his displeasure and the cancel is being processed

Dear Mr***, First of all let me thank you for being part of the Best Fitness Family for several yearsI have read your concerns and what you would like as a resolution. We do offer several promotional programs throughout the year to lower your duesOur constant promotion is to
refer a friend and when they become a member, your dues will be lowered . I would like to offer you passes that you may give to your friends for a free membership. Again Thank you for your membership to Best Fitness and we look forward to helping you to reduce your fee's thru our referral program

Mr*** did not cancelHe did inquire regarding canceling in May and at that point was told proper proof of moveincluding drivers licence issued with in the days, utility bill with his name, a lease with his name, or job offer with his name and dates of hire.when Jason explained cancel process at signing he would have stated day LicenceAs for Mr*** signing the contract that was placed in front of him , had he read the cancellation portion he would have seen the exact requirement (which was explained on that day and in May when he called in ) The same cancellation process has been our policy for many years no policy has changed. Best Fitness provided physical confirmation on cancel process and on occasions verbal instructions on requirements to cancelMr*** did not go to collections until several months later (October) during which time the billing company reached out on several occasions starting in April with calls, texts and letters of delinquency which were all not responded tooNot until 3/12/has Mr*** tried to correct his billing delinquency issues

UPON LOOKING IN OUR SYSTEM WE CAN NOT LOCATE INFORMATION ON A MS*** ***SHE IS NOT IN OUR SYSTEM BY PHONE NUMBER, ADDRESS OR BY NAMETHIS SHOULD END ALL FUTURE CONTACT FROM BEST FITNESS
