I have reviewed the response made by the business in reference to complaint ID [redacted], and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
They just gave me a completely generic response which makes me think this never even went to the corporate office which could explain why there is no name listed on the response. If this was from Corporate and that was their "resolution" that just shows how little they care about their locations & members. They did not offer to do anything at all or even look into the list of complaints about this location or try at all. I would like confirmation my complaint did go to corporate and not just branch which as I have stated are of no help whatsoever. I would like a phone # so I can contact the corporate HQ & speak with someone there. If they're unwilling to simply reduce my fee from $19.99 a month to $9.99 a month without the need to sign up a friend which I do not have I will leave when my contract is up next June & find myself a new gym. It is very stressful that I have to go to this gym in these conditions and I am not even allowed to leave without paying a $100 fee.

Attached is [redacted] Contract. In the first box on the left hand side printed in bold letters it states "program type- PT 30 MIN * EFT. Prior attachment of her paid receipt aslo states PT 30 minutes 8 sessions. attached is also her usage of her sessions. Ms. [redacted] continues to take her sessions with Trainer Rob. Ms. [redacted] information was clearly explained, written and adhered to as stated in contract. Our facility has meet the needs of this contract and continue to work with Ms. [redacted] to fulfill her contract.

[redacted]Jason, who was the person that signed me up adamantly told me that all I’d need was my license to show that I was a permanent resident of nyc. He placed the contract in front while saying so and instructed me to sign in the required spots. Upon coming to cancel he was not available and another salesman now introduced a new policy that wouldn’t allow me to use my license if it wasn’t issued at a more recent date. This makes no sense as my permanence address would not be changed as it is my permanent address and it was my final months being in albany as a student. I think I was wrongly tricked into signing a contract and I didn’t listen to the many complaints that others had told me about the gym because Jason assured me that it would be simple to end my contract. Which I did in the 30 day time frame and even if I hadn’t I would have had no problem paying one more month to end my contract.

Member has been notified of the last payment since 5-26-15 when she was canceling due to the 30 day notice with in her contract. Unfortunately that last payment was not made and there fore we can not cancel her membership until this payment is satisfied. Member has been notified of this by phone,...

e-mail and in person. Member has become abusive to staff as they try to explain and assist member. Once final payment of 296 is paid, membership can be terminated. Any left over sessions Ms. [redacted] has will be good for 1 year. Craig the Fitness Director has reached out to try to assist as well and schedule apt for use of any unused sessions to no avail. Therefore due to documentation and signed contract Ms. [redacted] needs to resolve this payment.

I have reviewed your complaint and have discussed it with my team here at Best fitness. We are going to refund you the amount owed to you as quickly as possible. I am sorry that this situation occured.

The $75 check is not a point of contention. Your company sent that refund. I was never refunded $49.99. The invoice sent states I had a -$49.99 balance. I never had a -$49.99 balance because the money was taken out of my checking account, and I provided a copy of my bank statement showing the money was taken out. There was no "reversal". There is no refund from Best fitness in my checking account. I would like to be refunded the $49.99. I would like documentation showing my membership has been cancelled and that I have a zero balance in my account - as proof that the account has been closed. Legally, the invoice that was sent that is "not an invoice" could be used against me. I need written verification from your company that my account has been closed and I have a zero balance. Don't forget the $49.99 refund I am owed. Again, I never received any refund from Best fitness in my checking account, I spoke to my bank and double checked my bank statement.

The idea that I was abusive to staff is ridiculous. I exhausted myself in explaining that I do not owe this money. When I decided to end my personal training sessions I was told that I had sessions left that were paid for and when I used one, I ended up injuring myself which can be verified by the personal trainer.  I didn't end up going back after that.  I never used any other sessions which I already paid for so, as far as I am concerned they owe me a refund. I'm want my membership cancelled.

There has been no offer and it does not appear that the author of the response read the complaint.  My complaint was that they did not document my cancellation and kept withdrawing money. Their response is that since they did not document my cancellation, they could keep withdrawing money.  To recap, they kept taking money out for six years using a collection company of a different name while providing me no service.  Their representative acknowledged to me on the phone that their computer records verified that they had provided me no services for six years.  When I explained that their failure to document my cancellation was not a defense to failing to cancel my account and continuing to withdraw fees, he indicated he understood and stated he would call me back.  He did not call me back.  Now it appears they have replied to my complaint without reading it.  It is very disappointing.
