I am sorry to hear that Ms*** is unhappy with our policies at Best Fitness. All of our memberships are 2-year agreements and we are sure to make certain that everyone understands that when signing up for their membership. This is why, as Ms***
stated in her complaint, we email a copy of the original agreement and stay in contact with all of our members to make sure they don't have any questions and to keep them motivated throughout their fitness journey here with us. We do have Ms***'s signature agreeing to the 2-year commitment. We also offer a window of time where one may cancel their newly-obtained membership because of questions about the agreement; Ms*** signed her agreement in February so she is now past that window. To cancel before your 2-year agreement is expired, it costs $100, unless you are moving or if it's because of a medical condition. These policies are spelled out in our membership agreements that Ms*** signed and received a copy of. Ms*** stated that she was not able to use our facility because of a medical issue but we were never shown proof of this. If Ms*** has a recommendation in writing from her doctor stating that she cannot use our facility any longer, we will gladly cancel her membership and we wish her the best with her health- we just need to see a copy of the doctor's order to stop using the facility permanently. We must stick to our company policies when it comes to cancellations

I just filed a complaint about spending four months trying to cancel my membership with this companyThe company agreed to refund me for charges to my checking account I did not authorizeThey also agreed to waive the last feeI have been corresponding with Sean *** over the last four months, and have told him numerous times that I have no money and have made numerous requests that his company not attempt to take money out of my personal checking account because it will cause overdraft feesSean has ignored my requestsNot only did I not receive my refund,I have $in overdraft fees from Best FitnessI called my bank and they told me that the company has made three attempts to take money out of my account, even AFTER the company agreed to refund my money and waive the last fee.I need to be refunded the $and the $in overdraft feesThe company also needs to stop attempting to take money out of my account

Our annual club enhancement fee is set to be withdrawn days from the original sign date and is withdrawn the same date every year as stated in the agreement the member signs and it is part of their membership duesThis is all clearly explained to all new members during the time they
are joining and the member actually signs for this after it is explained to them. Our cancellation policy does require a day notice and any dues that are owed within those days will still be withdrawn

This letter is in response to a complaint submitted to the Revdex.com about Best Fitness of Albany, Complaint ID: ***On October 16, 2012, member entered into a month agreement with Best FitnessBeginning in July 2013, member’s account went delinquent for several monthsAccording to documentation on the member’s account, three attempts were made to resolve this issue at the club through our Membership DepartmentOn November 22, 2013, the account was turned over to *** *** collections agency for the amount of $Member has the ability to settle their debt directly with Best Fitness for half of the total amount owed: $On February 5, 2016, I personally reached out to the member regarding this issue with instructions to call the club directlyOn February 8, the member returned my call and left a message with our front desk staffThe following morning, I returned the member's call, however was not able to leave a message due to the member's voicemail being fullThe purpose of the call was again to reiterate that the member has the ability to settle their account for half of what is owedI understand this situation is unfortunate, however Best Fitness attempted to collect the member’s debt numerous times before the account was sent to collectionsIn addition to trying to settle the issue in club, multiple letters were drafted and more than a dozen phone calls were made to the phone number that the member put on file for their accountIf you have any other questions regarding this matter, please feel free to contact Best Fitness at the phone number listed below Sincerely, Scott M. Revdex.com spoke to Scott at business and the following was relayed: We did make several attempts to contact the consumer and have not received a replyAs a courtesy, we are going to cancel his membership effective immediately and we have waived the $cancellation fee

Mr*** membership went into default and subsequently was sent to collections back in November of due to non-payment over the course of months, starting in August of During these months of non-payment, our billing department tried over a dozen times to contact Mr*** both via
phone and by drafting letters to his home (See attached abstract of attempted contacts)Under the terms and condition of the membership that Mr*** agreed to, it does indeed state that we (Best Fitness) has the right to declare the entire remaining balance due and payable and if we are not able to do so, the balance will be sent to collections (See attached Membership Agreement)Sadly, Mr***' lack of due diligence in staying current on his monthly payments caused him to be sent to collectionsWe have tried to add resolve to Mr***' situation by giving him alternate avenues to drop his balance significantly but has yet to respond to our offer.Thank you.Sean ***General Manager*** *** *** **

I am sorry to hear that Ms*** is having an unpleasant experience with our billing and collections processOur representatives at the club in Erie always try to make things as easy as possible for everyone and make sure everyone understand our

I believe Ms*** spoke to a manager at our club shortly after filing this complaint and has plans to come into the club on July 7th to settle everythingIf this is not the case, I will be happy to get her any information that she needs

the month of December will absolutely be refunded to her as well as January and we will get this fixed for her right away

Ms*** came in to cancel her membership because she was moving and we notified her that we need proof of relocationShe was unable to provide proper proof, which comes in the form of a lease or mortgage agreement of the new residence, a utility bill from the property (gas, water, electric),
or an updated drivers license issued within daysSince she was unable to provide the proper proof at that time, we suggested that she put a freeze on her membership until she could obtain proper proofAt that time, Ms*** said she would be cancelling her billing informationWe then explained to her that if she does that, she could risk being sent to collections after a period of mthsTwo months had passed and Ms*** sent in the proper proof of relocation however her acct was overdue, therefore we could not process any cancel request until the acct was up to dateShe refused to pay the over due amount towards her membership and was eventually sent to collectionsWe tried several times to explain the process clearly and have the matter resolved to avoid Ms*** being sent to collectionsThe cancellation policy is clearly stated in the agreement as well

To Whom it May Concern: I was able to review Ms***'s account with usBased on our referral terms, save up to $a year, Ms*** would have received her rate lowered to $for monthsAfter her months was up, her rate would have been raised back to the original $In order to

This is just another example of the timing of the month and a loosely worded contract (see attachment) being used so a Corporation can weasel more money out of the consumerIt states that you are responsible for "MONTHLY" dues unless days notice is givenI gave my days which happened to be a week shy of being able to avoid paying Aprils duesNothing in this contract mentions you still being obligated to pay the Enhancement Fee in the event of cancellation I realize this and have no problem paying the monthly amount of "$despite the fact that I will not even be able to use the facility the month of AprilBut I will not pay a $so called "enhancement" fee for this establishment to make "enhancements" to there club for the upcoming year when I wont even be a member anymore and will not be able to have use of any of these "enhancements"This fee is a lie anyways and should not even be allowedIn the time I was a member there I never saw anything "enhanced" or upgradedSo what are the members of this club even really paying for? I will be filing a unauthorized withdrawal of the $fee with my bank when it goes through and I will also be filing a complaint with the Attorney Generals office of the State of Pennsylvania

As you can see we have full addressed Miss [redacted] concerns. Attached is the receipt for her training package which clearly states 30 minute sessions as well. Craig (our Fitness Director) offered her free sessions. Member continued to Train receiving 4 free 60 minute sessions with trainer Rob....

yesterday she was upset that she had 30 min sessions she thought they were hour
sessions. I showed her a copy of contract and the price difference between the
two. I asked why it took so long for her to bring this up she had used over 16
sessions. I tried helping as much as possible she said she would pay the buyout
fee. I told her I would offer her a month of hour sessions and rob agreed. she
still was not happy..**.  [redacted] 12/02/2015 10:16 AM Member was upset about PT felt she
was mislead about the time she had for each session. Spoke with Craig about PT.
Afterward, wanted to cancel her membership and PT explain to member about the 30
day policy said she didn't care about the money because she was going to get it
all back. Member stated she was going to Revdex.com and that she always wins in court
so it did not matter. Paid the buy out for her membership (100) but not her
PT.**

Best Fitness froze Mr. [redacted] personal training as requested back in March for 3 months, per our company policy. Mr. [redacted] did not reach out to us after this until September 30th, when he finally came in to officially cancel his personal training agreement. Best Fitness followed all of our policies regarding this entire process. In good faith, Best Fitness will refund Mr. [redacted]’s membership dues for November, December, and January, totaling $59.97, which would be in line of when he came in to cancel his personal training.
