On 9/02/13, *** signed a RISC, Retail Installment Sales Contract, at *** *** *** ***. The RISC is assigned to C&F Finance Company with phone ***
On 09/10/13, *** *** completed a telephone interview with C&F
Finance Company’s loan processing department and verified that the address on the RISC was the accurate mailing address and that her first payment was due on 10/02/
On 09/17/13, C&F Finance Company sent a Welcome Letter and Coupons to *** *** at the address on the RISC that *** *** verified during the telephone interview.
On 10/04/13, collection efforts began when the first installment was days past due. The notes indicate that the collector verified with *** *** that we had the correct address on her account
On 10/07/and again on 10/21/13, C&F Finance Company sent replacement coupons to *** *** at the same address
From 10/07/to 10/23/in each collection contact, *** *** stated each time that we did have her correct mailing address and that she would not make a payment until she received a coupon book and she had not received anything from us in the mail
On 11/05/13, C&F Finance Company received another application from *** *** *** *** for credit in *** ***’s name and another party. The application received listed the collateral (*** *** ***) securing *** *** open RISC as one of the trade in vehicles. C&F Finance Company declined this application and mailed *** *** an Adverse Action letter on 11/21/13. The
dealership confirmed with *** *** that C&F Finance Company was the finance company that financed her loan and where payments needed to be made.
On 12/27/13, C&F Finance Company sent *** *** a required Notice of Our Plan to Sell Property and on 02/11/C&F Finance Company sent *** *** a required Deficiency Explanation notice both to the same address.
C&F Finance made every effort to communicate with the customer and always mailed documents to *** ***’s address of record*** *** did not make any installment payments on her RISC

There is no Grace Period for the Retail Installment Sales Contract (contract) that you signed at the dealership. Please review the contract for better understanding. Once loans are one day passed due, collection efforts will commence on the account. Depending on
which state you reside, C&F Finance Company cannot assess a late fee to your account until the state requirements are meant. This is also stated on your contract under the Truth in Lending portion of your contract. As for your Desired Settlement, there is not a Grace Period and C&F Finance Company does not offer refinancing. If you have any further questions, please feel free to contact us.

MY FIRST COMPLAINT IS..IF I TOLD YOU FOR MONTHS I DID NOT REC anything FROM YOU IN THE MAIL WHY NOT EMAIL? THE COMAPNY NEVER AGREED WITH YOU AS TO WHERE I MAKE PAYMENTS, I HAD NO ACCT NUMBER!!! Management has reviewed the complaint and found that Mr*** is currently past due for $537.12, which is comprised of your monthly installment and late fees. Your installment is due on the 12th of each month. Please review your contract. Due to your account status and
payment history, you will continued to be called until your account is brought current. If you would like a copy of your payment ledger or would like someone to explain your payment history, please call Customer Service and ask for Sandra or Will. Management has pulled the recorded calls, Mr*** cannot continue to use racial slurs and expletives towards our representatives if he would like assistance over the phone

C&F Finance Company's management has investigated and reviewed the complaint. *** Dowe, Collections Manager, has made several attempts to contact Ms*** to discuss the complaint and her account. Ms*** has not answered any calls from C&F Finance Company and the
voicemail associated with the phone number we have on file is full and no longer accepting any new messages. C&F Finance Company has removed the NSF Fees on Ms***'s account and would like to discuss what occurred. Please contact *** if you have any further questions or comments at *** ***

This company was asked multiple times to not call my place of employment for purposes other than employment verification purposesCalled my wife and told her to borrow money from her family after being two days late at the first contact madeWith the exception of Unique, were extremely rude and unprofessionalTo harass customers after being two days late on your payment is a sure fire way to lose a lot of businessWill definitely be looking at other finance options in the future

The Compliance Manager has reviewed the account and found the following:
The customer contacted our office on 10/20/and stated that she made the final payment on the 16th. The representative confirmed receipt of that payment, for $391.21, and informed customer that she did
not pay the full amount that was quoted to her on 10/09/in the amount of $431.89.Customer signed a month contract and had deferments on the loan which occurred in August of and September of 2012. A deferment is used to assist customers caton payments if they fall behind. The two installments deferred are due at the end of the contract period and additional interest is accrued as stated on the contract. Customer also had late charges assessed on the account and NSF fees, all of which are allowable and detailed on the contract. Customer has a remaining balance of $40.12. Customer's title will be sent days after payment of $40.12 is received and clears processing. If the customer has any further questions or comments, please contact Stacy, Collections Supervisor

C&F Finance Company management has investigated the complaint and found that the delay is coming from the dealership. The Recovery Manager, ***, was able to get exact information regarding the funds from the dealership and contacted complainant to discuss and ensure she was
satisfied with the outcome

Thank you for recently taking the time to express your concerns regarding your account with C&F Finance Company. We have completed a detailed review of your account and appreciate the opportunity to respond to
your complaint filed with the Revdex.com on 5/12/14.
You state in your complaint that, ”The terms and conditions did not disclose any of the charges that are revealed on the total price of the vehicle in purchase. I am being charged a daily fee to have the car outside of the contract.” I reviewed your account and see that you have made payments of which incurred late charges. The late charges are disclosed on the contract you signed in the amount of $per late event. The late charge occurs days after your payment has not been received on your installment due date. The “daily fee” you refer to is called a per diem. This is the amount of interest that accrues on your account each day as this loan is a Simple Interest Loan. If you have any questions regarding what a Simple Interest Loan is please contact our Customer Service Department at ***. Someone will be glad to explain this to you. You can also reference the back of your Contract as it states, We will figure the Finance Charge on a daily basis at the APR on the unpaid part of the Amount Financed.” When you fail to pay on time, that daily per diem
increases the Amount Financed causing the overall total to be increased. This is why it is very important to pay your installment on time as you agreed to in the contract.
You also state, “The total price of the vehicle in contract does not go down each time I make a payment.” We apply payments to your account as stated in the contract. We apply a portion of your payment to principal and a portion to interest. Please review the back of your contract regarding how payments are applied. If you pay on time as agreed upon in the contract, then your principal will go down faster than if you pay late and accrue additional interest and late fees
Regarding statements, here at C&F Finance Company, we are not required and therefore do not send monthly statements to customersWe are in the process of putting into place an automated phone system
that customers may utilize to obtain account information

The Compliance Manager received the complaint, performed an investigation, and found the following:- *** was not "taken over" by C&F Finance Company. The principal of *** sold the company. C&F Finance Company won the bid to purchase the portfolio.- The $fee is
a express payment option. Funds will be applied to the account that day. Payment options have been sent to all former *** customers. The free options are to mail a check, pay in a C&F branch, or have Automatic Deduction of payments. Other payment options that C&F Finance does not charge an express payment option are WesternUnion and MoneyGram. WesternUnion and MoneyGram do charge a fee to use their service. The express payment option fee that C&F Finance charges is allowable by state law.Any further questions regarding the complaint, please contact the Compliance Manager at C&F Finance Company ***

C&F Finance Management has reviewed all notes and materials relating to this complaint and have found the following:On 02/11/2015, an Audit Letter was mailed stating the balance remaining after proceeds from the Insurance Company and the GAP Company had been applied.  The amount was...

$802.12 with a interest per diem of $.07. On 02/20/2015, Mr. [redacted] spoke with a collection representative and an agreeable plan was made to pay the remaining balance.  5 agreed upon payments were received as follows: 03/02/2015 $150, 03/11/2015 $100, 03/12/2015 $50, 03/19/2015 $50, 04/02/2015 $100On 04/01/2015, customer spoke to a representative and stated that a billpay check was sent out for $100 on 03/30/2015 and that another payment will be made on 04/13/2015.  On 04/13/2015, 04/14/2015, 04/15/2015, 04/16/2015, and 04/18/2015 a collections representative phoned the home number and left a message in regards to the next payment.  A call was never returned.  A e-mail was sent on 04/16/2015 to tim[redacted]@gmail.com to call C&F Finance.After numberous attempts to contact customer and due to the broken agreement to pay the remaing balance, Sr. Management followed procedures to Charge-off the account.  A Deficiency Letter was sent stating the obligation that is curently due of $124.51.  This amount does not include the interest that remains on the account, which was included in the $802.12.  A Collections Manager has made several attempts on to speak with customers to settle this matter but has not received a returned call.  At this time, C&F Finance will continue with normal business practices to resolve the remaining obligations on the account.

The account was charged off due to the customer breaking the arrangements made between customer and C&F Finance Company.  The original arrangement made between the parties was that the customer was to make partial payments of $250 until the obligation was paid in...

full.  However, the payment that was set up to run on 07/02/2014 was declined by the customers financial institution.  C&F Finance Company tried on several occasions to contact the customer regarding the account and no contact was made nor were calls returned from the customer.  C&F Finance does not accept partial payments and went beyond our normal business practice to assist the customer so that she could properly pay her obligation.  Since the payment was declined and no further contact was made, C&F Finance Company followed our policies and procedures to charge-off the account and pursue collection.  The account was charged-off on 07/10/2014.  On 07/14/2014, customer called to the office and was advised of the account status and again agreed to make partial payments of $250 on the 30th of each month.  A payment was set-up for 07/30/2014 and was the last payment received to date.  Customer failed to make the 08/30/2014 payment and has not answered calls or messages left.  Customer called the office on 09/30/2014, a new arrangement was made so the customer could pay $150 per month and an automatic deduction form was sent to customer.  As of 10/20/2014, the automatic deduction form has not been returned and calls made to the customer have not been returned.
