Review: I have tried several time to set up a payment which is late, but they refuse to set it up saying that they need the money now because my account is in review. I never pay more than one month late. They don't have a grace period, of which I was never told until just today after the sale of the car and several calls to them. The keep holding me hostage and threatening me with Your account is in review. I would like to know what is going on. They won't tell me anything and won't let me speak to a manager. They are very rude and condescending. I just want to know why they can't take my payment. Its not like I am saying that I dont know when I will be able to pay, very poor company to work with.Desired Settlement: I want them to take my payment over the phone.

C&F Finance Management has completed an investigation and found the following:In regards to complainant stating, "I never pay more than one month late." The complainant has been over 30 days late 3 times with only 10 installment payments made since the inception of the contract on 06/17/2014, and has accrued 9 late charges. As for the grace period, the complainant signed a contract for a Simple Interest Loan which does not have a grace period policy. The installment is due on the due date set in the contract and is considered delinquent one day past the due date. Late fees will be assessed when the payment is 10 days past the installment date, as stated in the TILA portion of the contract. Complainant should read the back of the contract to see how payments are applied and how late payments effect the account in Section 1. Section 3 on the back of the contract discusses what may occur if the promise is broken, and should be reviewed by the complainant.In regards to the complainant's statement regarding being held hostage and threats, C&F Finance Company follows the guidelines of the FDCPA and does not threaten nor harrass customers. The complainant was granted an extension in February of 2015 in order to assist in bringing the account out of delinquency. The policy of the company is to not allow extensions until the customer has made at least 12 installments. The complainant was granted a special exemption to this policy as only 7 installments were made at the time of extension. C&F Finance Company has gone above policy limits to try and assist customer. The complainant is requesting to make an installment on July 10th which would put him back into severe delinquency at 24 days past due and only leaving 7 days until the next installment is due, which is deemed unacceptable coming off of an extension. The extension on the account was to assist the customer to stay out of delinquency. The account is being reviewed by management to determine the next course of action if the account is not brought current. This is not a threat as C&F Finance Company intends to pursue all allowable collection efforts stated in the contract and by state law. The complainant may call the office any time and ask to speak to Doug, Melissa, or Stacy, Collection Department Management. They can further assist with any questions regarding his account.

They are just a terrible company, and they are not willing to help, and on several occassions I have asked for a manager, and I was told, NO, they will just tell you the same thing. When I did leave a message with the manager that I was transferred to on a different occassion, I never heard back. It does me no good to call them, because they don't return your calls. I defies logic as to why they won't accept payment on the 10th. It doesn't make any logical sense.

The late charges and the interest are included in the balance that is still owed and for which you are still responsible. Review: I fell behind on payments due to illness and coming out of work which resulted in the repossession of a car I purchased through C&F Finance. I did have a payment agreement to catch up on the car before the repossession but for some reason the car was repossessed and when I went to the bank the money was still in my account, but that's neither here nor there. I received a deficiency/surplus explanation letter stating that there was a deficiency amount of almost 13k and then a call from a C&F Finance rep stating that I needed to create a payment plan with them to pay the deficiency or they would have to seek a judgment against me. I told her I was still unemployed and I did not think I could do the payment of 100 dollars a month. Shortly after with some luck I was able to confirm that I could make the 100 dollar a month payment and called C&F Finance back within 30 minutes and set up my payment plan of 100 dollars a month due at the end of each month starting Dec of this year. I set this payment plan up with a rep named [redacted] on 28 Nov 2014 and she said I would be receiving a letter in the mail stating our pay agreement. Weds afternoon I spoke to another C&F Finance rep after not receiving the letter in the mail and she put me hold and then came back and told me that I should receive the pay arrangement letter by the end of the week and if I did not to give them a call back. I still have not received the letter and now when I call from both numbers that C&F Finance associates with me I cannot get a hold of anyone. I set this pay arrangement up because I owe this debt and I need to pay and because it was made quite clear to me that a judgment would be placed against me if I was unable to work with getting my debt paid. I feel now that C&F finance will not send me my letter because they are trying to purposefully get a judgment against me even though I have set up a agreement to pay my debt. I am not confrontational and willing to do my best to make sure I pay what is owed so I don't understand why this company is being shady for a lack of a better word. My account # is [redacted]. Also the company repossessed the car and I had items in there. I have still yet to receive my belongings back. I've never been through a repo before so I really know nothing about how things work. When I inquired about my belongings the company gave me phone number to call. When I called the lady was nice but she said she could not tell me where my belongings where and that I needed to speak to C&F. I assumed that C&F would send me my belongings since they had the car. My belongings consist of minor things like body spray, lotions and some football items but also some important things like my license, license plates and iPod(its not the newest one, it's a 4th gen but its mine).Desired Settlement: I would like the pay arrangement that C&F Finance rep Ashley and I set up on 28 Nov 2014 of 100 dollars a month due at the end of each month in writing mailed to me like was told would be and I would like my belongings.

[redacted] set up payment arrangements of $100 monthly beginning 12/31. [redacted] called on 12/3 to inquire about the payment arrangement letter sent, she was advised to give it until the end of the week to arrive and if she had not received the letter to call back. [redacted] has not been in contact with our office since 12/3. A new letter will be sent out 12/09 with a review of her payment arrangements. A judgment will be sought to secure our interest in the debt. This is a normal business practice for C&F Finance Company with all Charged Off Accounts. Once the judgment has been paid in full, we will then notify the courts that the judgment has been satisfied. [redacted] vehicle was repossessed on 10/18 and she did not contact our office until 10/30. On 10/30, she was given the repossession agents phone number for contact as they would be in possession of any belongings in the collateral. C&F Finance Company does not have nor never had physical custody of the collateral. The repossession agency takes possession of the collateral until it is deemed available for sale at auction.

I didn't find out until after signing with C&F that they did not have grace periods. I found this out after my first payment was mailed in 11 days before the due date. I'm in the midwest and they are in Virginia, so it took a while. The day after the due date I began receiving SEVERAL calls per day x 3 days from the company. They left VM's stating someone's name and their call back #; never stating what they wanted. So, I called them back a few days after my due date and asked what the calls were about, I was rudely met with a rep stating I was late on my first payment, this looks horrible as a new customer and I needed to make my payment that day. I explained I mailed my payment off (a check) nearly 2 weeks ago, you should receive it shortly. Instead of the rep saying, "Ok, thank you, I'll note that in the system..." I was told, ok, well you still have to make a payment today and pay the late fees or you'll have your vehicle repossessed. I was shocked and said again, it's in the mail, it should show up soon. That's when I was told they don't have ANY grace periods. I thought that was a joke.. cable, utilities even your cell companies have grace periods. They were rude and told me to borrow some money to make the payment. I hung up. They continued to call me every day SEVERAL times (at lease 5-6 times) for another 2 days. After that, I didn't get any calls. I called them back to ask when the check made it and was told the day after I called them the first time. I was told I could have auto pay set up, pay via phone or money gram. I decided to do money gram. The next month, I didn't pay on the due, but a few days after, so of course the phone calls started again. After explaining every month that I don't get paid on my due date, I asked to have my due date changed - but was told I had to pay $25, upfront! Plus my next month's payment in order to so! I had never heard of being charged to change my date - but I went ahead and did it. Then last year I called to tell them I get paid on a specific day (after my due day) and would like to pay on the day I get paid - yes I was late (less than 30 days) but I needed the extra time. I was told ok that's fine, just make sure I call in on that day and make the payment. THE DAY BEFORE I WAS TO CALL IN AND MAKE MY PAYMENT, THEY REPOSSESSED MY VEHICLE!! This had never happened me me before. Long story short, I called got my vehicle back 3 days later.. they made me pay the past due amt, plus $400 for the repo and the next month that was 2 weeks away!! I made the payment and made sure I paid early each month. Recently I feel back again - paying 1-2 weeks late. I just called last week to give my debit card to have them take their payment in full - showing I want to make my payment and was met with a rep.. ONCE AGAIN... yelling at me, telling me to borrow money and make the payment TODAY, or I'll be repossessed. Telling me they have me being 60 days late and the credit bureaus show this - I informed the rep she was rude, and I had recently bought another vehicle and it only showed I was late 1 time!! Last year when I was repo'd - IN OTHER WORDS... they suck! They are rude and if I wasn't upside down with such a high interest rate (b/c my credit was horrible when I got the vehicle) I would refinance with anther company. I would not recommend them and have told the car lot I bought it from - they no longer use them b/c of my complaints. It's like they train their reps to be mean, disrespectful and unwilling to work with customers.

Review: I was told if I pay my outstanding debt. I will be able to receive my car title to my 2007 Chrysler Sebring. Now that I've paid my debt through Imperial credit system, inc. Now I am told that I have to wait til next month to get my title. I felt lied too. IF they would had told me that from the beginning, then I wouldn't have a problem. I am needing my title a.s.ap.

The C&F Finance Company Compliance Manager has reviewed the complaint and performed an investigation. The following was found:- On 09/25/2015 around 2:55 p.m., Mr. [redacted] contacted our office to advise of payment made of $519.39 to collection agency in regards to balance left on account. Mr. [redacted] wanted to know when he would receive his title. The representative he spoke to explained that the pay-off amount, as of 09/25/2015, was $638.69 and that he would follow-up with collection agency in regards to payment and call Mr. [redacted] back.- On 09/25/2015 around 3:06 p.m., representative called Mr. [redacted] and explained that the title will be released 30 days after money is drafted from account by the collection agency. Maker advised funds were drafted today.- On 09/25/2015 around 3:36 p.m., Mr. [redacted] spoke to representative stating that he was at DMV and was advised, by DMV representative, if Lienholder can send documentation on company letterhead that the loan is satisfied, DMV would give him his title. The representative advised Mr. [redacted] this is called a Lien Release Letter and that we would need to receive the funds from collection agency before we could send Lien Release Letter.- On 09/29/2015, Mr. [redacted] spoke to a representative and stated the collection agency sent him a letter stating the account was paid off. The representative advised that we have still not received the funds in our office and we cannot release title until funds are received.No further contact has been made between Mr. [redacted] and C&F Finance Company. As of 10/01/2015, the funds have not been received in office. Once the funds have been received and the account is satisfied, C&F Finance Company will send Mr. [redacted] the title. If Mr. [redacted] has any further questions, please call Tanya or Melissa at [redacted] in the Recovery Department. Thanks.

I have again spoken to C & F Finance today 10/6/15. They have not received my payment. They told me to call ICS ([redacted]). Which I did. I spoke with a [redacted], and she said that I could send them a copy of my Letter of receipt to them from her stating that my balance is $0.00. Their shouldn't be no problem with C&F Finance sending me my title or a letter of release of my title. I shouldn't have to wait knowing that I am paid in full. I have also enclosed the letter of receipt from ICS.

Review: My payment is due with them on the first. My paperwork states I have until the 10th and then it is considered late.

I mail my payments and if they do not get it on the first the call my home and cell 4-5 times per day. They continue to call and have told me they will call until the receive payment even when arrangements are made. On 2 occasion they have told me they never got payment via mail and demanded I pay via phone or money gram then 2 days later they cash or "find" the original check. This has made my account over drawn and most recently caused be to be stuck out of state with a negative account and no access to money. The most recent occasion they did cut and mail me a check for the original amount of my payment but would not cover the over draft fees. They admitted to getting the check 2 days prior to me making a payment via phone after they informed me they never got it. I am convinced that they hold checks/ payments and harass customers in to making alternative payments( for an addition fee) and then cash checks later. I now have had to dispute this with the bank for the second time in order to be compensated for my overdraft fees. C& F would only refund the amount of my payment by mailing a paper check only after I sent them my bank statement showing 2 payments and reviewing recorded calls looking to see if I requested them to reject the payment they "never got".

Your payment is due on the 1st of the month and is considered delinquent any time after the 1st of each month. A late fee will be assessed when you are 10 days past your due date, as mandated by state law. In regards to phone calls, during my investigation, I found records where one call is placed to your home number and one call is placed to your cell number when you become delinquent. If you have records showing 4-5 calls per day to your phone numbers, please provide to the Compliance Manager at C&F Finance Company so I may further investigate.In regards to the payment issue, C&F Finance Company does not hold checks nor harass customers in order to obtain fees. C&F Finance offers plenty of free options to make payments. I have listened to all calls placed and received from your account phone numbers and have not found any harassment nor violations on behalf of C&F Finance Company. You stated on 06/12/2015 that you mailed a payment on 06/05/2015, the collector informed you that it had not been received yet, and you stated you would check with your bank and then call back, nofurther contact was made on 06/12/2015. On 06/13/2015, you went to C&F Finance’s online bill payment system and made a payment and did not contact us to inform us. On 06/15/2015, your check was delivered to the office and was processed. You called the office on 06/18/2015 to report that two payments had posted. The phone recordings were pulled and at no time did you state to not process the check and therefore no notations were made on your account and the check was processed. C&F Finance’s Customer Service departmentrefunded one payment but was unable to reimburse any additional fees incurred as it was not our mistake.For your desired settlement statement, we cannot reimburse your overdraft fees if the mistake was not ours. If it had been our mistake, we would have done whatever it took to get your money and fees returned. C&F Finance Company follows the FDCPA anddoes not harass customers. Your payment is due on the 1st day of each month. If payments are not received by the due date, our Collections Department will start calling to bring your account current or offer other services, if applicable. Customers are never requiredto pay using a payment option that contains a fee and we offer several free payment options.

I will supply C & F with records of their harrassing calls as I have counted 10 on my cell phone alone starting 6/1/15 - 6/10/15. I also have record of them calling my husbands cell phone and home number several time. I will also supply them with a copy of my contact as well. This dispute with the back is still pending and I do not plan to cancel this or dismiss the matter.

My general purpose for the compliant it to make other consumers aware of the practices of C& F Finance.My I do not foresee this matter being resolved to I have decided to only pay my future payments via money order and pay a fee to have them tracked via the united states postal service. I am also in planning to have my vehicle refinanced with a more reputable company by August.

Review: I purchased a new vehicle on May 5, 2013 and the financing was done through C & F Finance Company. I was involved in a car accident on February 28, 2014 in which I was rear ended and my car was consequently totalled due to the impact of the other vehicle. The other drivers insurance company paid $17,000 to C & F Finance Company for my vehicle. Since I was unaware that I needed [redacted] insurance at the time I purchased my vehicle there was a balance of over $2,300.00 left that I had to pay out of pocket. I made payments towards the $2,300.00 as well as making payments on another vehicle I had to purchase since I did not have the means to get around.

I randomly check my credit report periodically and I found that C & F Finance Company had Wrote Off my vehicle on my credit report due to non-payment. I had never stopped making payments to them despite the fact that my vehicle was totalled. When I contacted them about this they said I had not made the required payments and that after a certain amount of days they Write it off but I still have to make payments. I was upset that they would Write Off the vehicle despite the fact that I had been paying on it.

They are now threatening to garnish my paychecks for the balance due on the vehicle. I am not sure what else I can do in this situation.Desired Settlement: I would like the Write Off taken off my credit report and the account to be in good standings considering I was making payments to them each month.

The account was charged off due to the customer breaking the arrangements made between customer and C&F Finance Company. The original arrangement made between the parties was that the customer was to make partial payments of $250 until the obligation was paid in full. However, the payment that was set up to run on 07/02/2014 was declined by the customers financial institution. C&F Finance Company tried on several occasions to contact the customer regarding the account and no contact was made nor were calls returned from the customer. C&F Finance does not accept partial payments and went beyond our normal business practice to assist the customer so that she could properly pay her obligation. Since the payment was declined and no further contact was made, C&F Finance Company followed our policies and procedures to charge-off the account and pursue collection. The account was charged-off on 07/10/2014. On 07/14/2014, customer called to the office and was advised of the account status and again agreed to make partial payments of $250 on the 30th of each month. A payment was set-up for 07/30/2014 and was the last payment received to date. Customer failed to make the 08/30/2014 payment and has not answered calls or messages left. Customer called the office on 09/30/2014, a new arrangement was made so the customer could pay $150 per month and an automatic deduction form was sent to customer. As of 10/20/2014, the automatic deduction form has not been returned and calls made to the customer have not been returned.

Review: I purchased a vehicle with this company in July of 2012. My payment is due on the 14th of every month. I have been making my car payments online between the 14-24 day of every month. I have never made a payment AFTER the 24 of the month. Today September 24 I made my payment online. I called to confirm my payment today only because I believe that I included the wrong billing address while making my online payment. I spoke with a customer service rep that stated I would be charged a late fee because my payment was made today 09/24/2010. To my understanding it is illegal for the company to charge a late fee with in a 10 day period of when the payment was due. I was informed by the customer service rep that I have several late chargers that I was not aware of. During the life of my loan with this company I have not received any itemized billing statements from this company. I also have not been inform of any interest changes on my account. C & F Finance has very poor customer service and treat there customers very unfairly. I am very displease with their business tactics.Desired Settlement: In order for my issue to be resolved I would like an itemized DETAILED billing statement emailed to me monthly. I would also like to be reimbursed for the late fees that were charged to my account in error. I would also like to be notified of ANY changes made to my account including taxes interest etc. I would also like for this company to improved their customer service department.

Our Customer Service [redacted], spoke to complainant on 9/25/13. [redacted] had a very good conversation with complainant and explained how a Simple Interest Loan works (same information as stated on the [redacted]). [redacted] also explained that we process payments at 3pm EST Monday-Friday. Since the complainant scheduled on the 24th and after that cut-off, [redacted] removed the late charge, as is customary for all accounts. The other late charge assessed for this account occurred when the complainant failed to include a payment amount when setting up her payment online and once we contacted and resolved, we waived the late charge. [redacted] also informed the complainant of our many payment options (included in the loan origination pack sent to all customers at the beginning of the loan) and discussed specifically setting up automated deductions to mitigate future problems. As for the itemized detail statement, we do not send them out monthly to each customer, however, customers may call to request a detailed payment ledger. We sent the complainant a detailed ledger on 9/24/13 as requested. The complainant was satisfied with the conversation and was encouraged to call [redacted] anytime with further questions.

Please be advised that as of today September 30, 2013. I have received my billing statement from C & F Finance. According to the conversation that I had with [redacted], there should not be any late charges processed on my account. This is the first billing statement I have received since opening my account in 07/31/2012. The billing statement states that I have accumulated multiple late charges which I were not aware of. The first late charge was posted on 11/23/2012. It states that it was entered into the system on 11/23/2013 but I was charged an 18.00 late charge. There was also a late fee applied for the payment made on 06/24/2013. Another late charge is listed for payment made on 07/24/2013. I was told by [redacted] that I had not been charged any late fee on my account throughout the life of my loan. The billing statement clearly states that several late charges were applied to my account without my knowledge. Regarding the payment made on 08/24/2013, it was stated in the phone conversation that I would not be charged a late fee. The only resolution for this issue is for the company to remove all late fees applied to my account. As, these late fees were applied with out my knowledge. I would also like the company to notify me when any excessive fees including interest charges are applied to my account.

The detailed ledger that was sent will show the late charges that were applied but it will also show were they were removed. As for your resolution request of notifying you when an excessive fee, including interest charges, are applied to my account. C&F Finance does not charge excessive fees and interest is charged on your account daily. The only fees we charge to an account are for Late Charges, Insufficient Funds, Recovery Fees etc. All of these fees are stated in your contract. Review: I have two complaints about this company. A few months ago I filed a Ch. 13 and before my first payment was new on April 18 my car was reprossessed by C & F Finance 3 weeks after they received my paperwork. but they decided to repo it any way. Then on October 19, 2014 on a Sunday evening while I was in the hospital two representatives from their company came by my home where they spoke with my minor daughter and left her an envelope with just my name hand written on the front of it. With a letter on the inside it with an Oct. 16th, 14 date stating an amount due by 9/20/14. This information could have been certified mailed to me. They are very unprofessional. I want to file an complaint on this company.Desired Settlement: I have consulted an attorney in reference of this matter. They have violated several laws by repro of the vehicle. I need some results.

For the first complaint, the consumer filed Chapter 13 bankruptcy on 12/5/13, case # [redacted], which was later dismissed 3/20/14 for failure to make planned payments. Ten days after dismissal, the account was placed for repossession for non-payment. The consumer then again filed another Chapter 13 bankruptcy on 4/18/14, case # [redacted], however the order extending the automatic stay was not signed until 5/13/14. When the debtors attorney contacted us on 5/12/14 to advise the motion to extend the automatic stay was granted we immediately arranged to have the car returned that day. We stayed in constant communication with the attorney and expedited the return of the collateral.

For the second complaint, representatives of C&F Finance Company delivered a blank envelope with only the customer’s name on the outside and a ‘Please Contact Us’ letter inside. C&F Finance Company has exhausted all avenues in order to reach the customer and have been unsuccessful. As per FDCPA guidelines, C&F Finance Company properly placed a letter in a blank envelope with no company identifying marks on the outside of the envelope, as to not disclose the possible affiliation with customer. Review: I am being called everyday over payments which were made, about 2 mths ago I sufferd a massive stroke, by the grace of God I am walking talking however I was behind for 1month I have paid my back payments how ever they con tinue to call an aggravate me I also suffer with chonic ptsd from combat they know this. I have also told them it is not worth the harassment if they fill they not getting paid pick up the truck I have other options, they never got back to me but still keep calling for 45.00 im willing to take a loss for my health an sanityDesired Settlement: if this continues they can make arrangement to pick the truck up my mind an body can not handle it

Review: I have an issue with c&f finance customer service everyone is so rude and they harass you a lot. They have an automated system and one of the options is to make a payment arrangement but when I try to make one I get a lot of personal questions and attitude them they want all types of documentation. So I just don't make one if it's am issue. Today I received phone calls from them at 2:58, 3:02, and 3:05 back to back for being one day behind is there a grace period or notDesired Settlement: I want a letter or something to know what's acceptable what's not if there's a grace period or can they lower my payments.

There is no Grace Period for the Retail Installment Sales Contract (contract) that you signed at the dealership. Please review the contract for better understanding. Once loans are one day passed due, collection efforts will commence on the account. Depending on which state you reside, C&F Finance Company cannot assess a late fee to your account until the state requirements are meant. This is also stated on your contract under the Truth in Lending portion of your contract. As for your Desired Settlement, there is not a Grace Period and C&F Finance Company does not offer refinancing. If you have any further questions, please feel free to contact us.

C&F is the worst finance company in a long line of bad ones. We have been with them almost 5 years and just found out today they are charging us 22 months of unpaid late fees!!! Our payment has NOT been late 22 times...maybe twice if even that many times. In all this time we have never received a statement saying we had late fees or have even ever been able to access the account online as they do not provide account access. This is 2014...bills are paid online. customer service is a complete joke with this company [redacted] are rude and condescending at every available opportunity. NEVER BANK WITH THIS COMPANY!

On May 8th [redacted] repossessed my [redacted] because I was 2.5 months behind. I was waiting for my tax refund to come in to catch up payments. Prior to this lapse in payments, I was NEVER ONCE late with any payment. I completely complied with the guy who was repossessing my vehicle. To the point that he had the keys and I was able to get all of my belongings out of my truck, including my 9mm hand gun to which I have a c oncealed weapon permit to carry. Somewhere along the way the[redacted] of [redacted]- made a false accusation to the police stating that I had shot at the repo guy. The police came and saw that there was no real threat, that the repo guy was actually in our home making copies of the paperwork needed to get our vehicle back. No report was filed, nothing was out of sorts. The repo guy said that he would make sure that everyone knew that we were cooperative and he personally would do everything he can to make sure we got our truck back. My tax refund came in Monday and when I called to make the past due payments plus the repo fee, I was told by this finance company that I would not be able to get my truck back because I pulled a gun on the repo guy and they would not release the truck to me. There was not a police report filed, simply because nothing happened. I have copies of the documents that the repo guy actually came into my home and allowed me to copy so that I knew what was going on and had all the proper information regarding the repossession. If at any time the repo guy felt as if I was a threat, I seriously doubt that he would be in my home allowing me to make copies of the repossession paperwork. The repossession guy actually had his female neighbor, the mother of the guy he had working with him, drive the truck away because we cooperated completely and he had the keys. It was at one time hooked up to the tow truck, but since we cooperated they were able to unhook it and drive it off, not risking any damage to the vehicle. Now C&F Funding is refusing to give me back my vehicle even after I have all the money and had the money within four days of the repossession stating that I shot at the guy that repossess the truck.
